REGARDING THE ANNOUNCEMENT OF THE OFFSHORE CRUDE OIL EXPORT PORT AT THE BLACK TIGER FIELD TO BE OPEN FOR SHIPS FROM VIETNAM AND FOREIGN COUNTRIES TO LOAD AND DISCHARGE CARGO

THE MINISTER OF TRANSPORTATION

Pursuant to Article 57 of the Vietnam Maritime Code dated June 30, 1990;

Pursuant to Decree No. 34/CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 13/CP dated February 25, 1994 of the Government promulgating the Regulations on the Management of Marine Activities at Seaports and Marine Areas in Vietnam; and Decree No. 24/NĐ-CP dated May 30, 2001 of the Government amending and supplementing certain articles of the aforementioned Regulations promulgated by Decree No. 13/CP dated February 25, 1994 of the Government;

Considering the Report No. 1044/DEV-03 dated December 31, 2003 of the Cuu Long Joint Venture Management Company regarding the formal announcement of the opening of the port and safety zone at the offshore crude oil export port at the Black Tiger Field, accompanied by the application for port announcement;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

DECISION:

Article 1.

Now hereby permits the offshore crude oil export port at the Black Tiger Field in Ba Ria-Vung Tau Province to be open for ships from Vietnam and foreign countries to load and discharge cargo.

The pilot station area of the offshore crude oil export port at the Black Tiger Field lies within a circle with a radius of two nautical miles, centered at the coordinates as follows:

Latitude: j = 10° 21' 24" N; Longitude: l = 108° 23' 38" E.

Article 2.

1. The Vung Tau Port Office shall be responsible for specialized maritime administration in the area of the offshore crude oil export port at the Black Tiger Field, and based on actual weather, wave, wind conditions, and water depth of the port, shall permit ships with appropriate technical specifications to enter and exit the port safely, ensuring fire prevention and environmental sanitation;

2. The Vung Tau Port Office may collect fees as prescribed by law.

Article 3.

1. The Cuu Long Joint Venture Management Company shall be responsible for organizing the safe operation of the offshore crude oil export port at the Black Tiger Field according to its intended purpose, ensuring fire prevention and environmental sanitation;

2. The Cuu Long Joint Venture Management Company may collect service charges as prescribed by law.

Article 4.

Relevant specialized state management agencies shall perform their duties and exercise their powers in the area of the offshore crude oil export port at the Black Tiger Field in accordance with the law.

Article 5.

This Decision takes effect from January 19, 2004.

Article 6.

The Heads of the Ministry's Office, Department Heads under the Ministry, Director of the Vietnam Maritime Administration, Director of the Ba Ria-Vung Tau Provincial Department of Transport, Director of the Vung Tau Port Office, Director of the Cuu Long Joint Venture Management Company, Heads of related agencies, organizations, and individuals are responsible for implementing this Decision.
