CIRCULAR
REGARDING AMENDMENTS AND SUPPLEMENTS TO CIRCULAR NO. 09/2003/TT-BLDTBXH DATED APRIL 15, 2003 OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS GUIDING THE IMPLEMENTATION OF DECREE NO. 187/2002/QD-TTg DATED DECEMBER 30, 2002 OF THE PRIME MINISTER ON SALARY REGIMES AND ALLOWANCES FOR STAFF OF THE SOCIAL POLICY BANK
On April 15, 2003, the Ministry of Labor, Invalids and Social Affairs issued Circular No. 09/2003/TT-BLDTBXH guiding the implementation of Decree No. 187/2002/QD-TTg dated December 30, 2003 of the Prime Minister on salary regimes and allowances for staff of the Social Policy Bank. Based on the current situation of the Social Policy Bank, following the opinions expressed in Document No. 205 TC/TCNH dated January 7, 2004 from the Ministry of Finance and Document No. 1455/NHNN-TCCB dated December 19, 2003 from the State Bank of Vietnam, the Ministry of Labor, Invalids and Social Affairs guides the amendments and supplements to the above-mentioned Circular No. 09/2003/TT-BLDTBXH as follows:
1. Regarding salary adjustment:
- Amend the last paragraph of item a, point 4, section II as follows: While awaiting the issuance of standards for ranking branches, the Social Policy Bank shall promptly report its production and business tasks and scale of operations of branches to the Joint Ministries for temporary agreement on ranking until the end of 2005.
- Amend item d, point 5, section II as follows: The heads of departments, deputy heads of departments, and equivalent positions at branch offices of the Social Policy Bank shall be entitled to position allowances according to their assigned rank, including the period of temporary ranking until the end of 2005.
- Supplement point 7, section II as follows: For employees transferred from other sectors to work at the Social Policy Bank after January 1, 2004, the transfer and adjustment of salary shall be carried out in accordance with the provisions of Circular No. 19/2000/TT-BLDTBXH dated August 7, 2000 of the Ministry of Labor, Invalids and Social Affairs guiding the adjustment of salary for workers transferred from other sectors to state-owned enterprises.
2. Regarding unit price of salary:
- Amend point 1, section III as follows: The Social Policy Bank may apply the adjustment coefficient to increase the minimum wage level to calculate the unit price of salary as stipulated in sub-item b.2 and b.6, point 2, section III of Circular No. 05/2001/TT-BLDTBXH dated January 29, 2001 of the Ministry of Labor, Invalids and Social Affairs guiding the establishment of unit price of salary and management of salary and income in state-owned enterprises.
- Amend point 2, section III as follows: In the first three years from 2003 to 2005, the salary fund of the Social Policy Bank shall be determined at a minimum equal to the actual average salary implemented in 2002 of staff of the Vietnam Agricultural and Rural Development Bank multiplied by the actual number of employees used on average during the year and reported to the Joint Ministries, based on which the distribution of the salary fund among units and payment of salaries to staff shall be linked to productivity, quality, and efficiency. The determination of the actual average number of employees used annually by the Social Policy Bank shall be carried out in accordance with Circular No. 08/1998/TT-BLDTBXH dated May 7, 1998 of the Ministry of Labor, Invalids and Social Affairs guiding the calculation of the average number of employees per year as prescribed in Decree No. 07/1998/NĐ-CP dated January 15, 1998 of the Government.
Annually, based on the actual situation, the Joint Ministries will announce the average salary level to serve as the basis for determining the salary fund of the Social Policy Bank.
3. This circular takes effect fifteen days after its publication in the Official Gazette.
During the implementation process, if there are any difficulties, the Social Policy Bank is requested to reflect them to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution.
- Amend Point 2, Section III as follows: From 2003 to 2005 within the first three years, the salary fund of the Vietnam Social Policy Bank shall be determined at a minimum equal to the actual average salary implemented in 2002 of officers and employees of the Vietnam Agricultural and Rural Development Bank multiplied by the average number of workers actually employed in the year, and reported to the Joint Ministry, based on which to distribute the salary fund to member units and pay salaries to officers and employees linked to productivity, quality, and effectiveness. The determination of the average annual number of workers actually employed by the Social Policy Bank shall be carried out in accordance with Circular No. 08/1998/TT-BLDTBXH dated May 7, 1998 of the Ministry of Labor, Invalids, and Social Affairs guiding the method of calculating the average number of workers annually as stipulated in Decree No. 07/1998/NĐ-CP dated January 15, 1998 of the Government.
Annually, based on actual conditions, the Joint Ministry will announce the average salary level to serve as the basis for determining the salary fund of the Vietnam Social Policy Bank.
This Circular takes effect fifteen days after its publication in the Official Gazette.
During implementation, if there are any difficulties, the Vietnam Social Policy Bank is requested to report to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution.
