JOINT RESOLUTION
PROVISIONS AND GUIDANCE ON THE CONTENT OF ACTIVITIES, CLASSIFICATION, AND EVALUATION OF WORK TO BUILD HEALTHY COMMUNITIES WITHOUT DRUG ABUSE AND PROSTITUTION
Implementing the Law on Prevention and Control of Drug Abuse No. 23/2000/QH10, the Ordinance on Prevention and Control of Prostitution No. 10/2003/PL-UBTVQH11, and the Ordinance on Administrative Violation Handling No. 44/2002/PL-UBTVQH10; based on the results of evaluating the implementation of the Joint Resolution No. 546/2003/NQLT-BLDTBXH-BVHTT-UBTƯMTTQVN dated February 27, 2003, issued by the Ministry of Labor - Invalids and Social Affairs, the Ministry of Culture - Information, and the Central Committee of the Vietnam Fatherland Front regarding Provisions and guidance on criteria for classification and evaluation of healthy communities without drug abuse and prostitution, The Ministry of Labor - Invalids and Social Affairs, the Ministry of Public Security, the Ministry of Culture - Information, and the Central Committee of the Vietnam Fatherland Front jointly issue this Joint Resolution (amended and supplemented) to provide provisions and guidance on the content of activities, classification, and evaluation of work to build healthy communities without drug abuse and prostitution as follows:
1- Purpose:
To guide the content of activities and unify the methods of classification and evaluation of work to build healthy communities without drug abuse and prostitution, contributing effectively to controlling the actual situation of drug abuse and prostitution in each locality. This also links the work of preventing and combating social evils at the commune, ward, and town level with the mass movement "All People United to Build a Civilized Life." At the same time, it serves as a basis for summarizing experiences, commending, and rewarding localities and organizations that effectively implement the program to prevent and control drug abuse and prostitution.
2- Content of work to build healthy communities without drug abuse and prostitution.
Unify in writing specific guidance on developing and implementing plans to prevent and control drug abuse and prostitution by the People's Councils and People's Committees according to the directives of grassroots Party committees within the framework of the law and in accordance with the actual situation in each locality.
- Propaganda and education on prevention and control of drug abuse and prostitution must be carried out regularly to every household and individual with the goal of pushing back and preventing the emergence and development of social evils.
- Effectively manage the locality through strict monitoring of the situation of drug users and prostitutes, managing household registration, temporary residence registration, and compliance with regulations for businesses and services that may be exploited for prostitution and drug use in accordance with Directive No. 17/2005/CT-TTg dated May 25, 2005 of the Prime Minister on rectifying negative activities in karaoke bars, restaurants, and dance clubs.
- Timely detect and handle violations related to drug abuse and prostitution in accordance with the law.
- Integrate treatment, management, and education of drug users and prostitutes into social work through other socio-economic programs to support these individuals in reintegrating into society, thereby reducing relapse rates.
3- Criteria for classifying communes, wards, and towns
Annually, the Department of Labor - Invalids and Social Affairs, the Public Security Department, the Department of Culture - Information, and the Vietnam Fatherland Front Committee will coordinate to guide all levels in classifying the actual situation of drug abuse and prostitution based on grouping localities (Appendix 1) and the criteria already established, including:
a- Classification of communes, wards, and towns concerning drug abuse: (Appendix 2)
- Commune, ward, town with a focus on drug abuse.
- Commune, ward, town with drug abuse.
- Commune, ward, town without drug abuse.
b- Classification of communes, wards, and towns concerning prostitution: (Appendix 3)
- Commune, ward, town with a focus on prostitution.
- Commune, ward, town with prostitution.
- Commune, ward, town without prostitution.
4- Criteria for evaluating the transformation of communes, wards, and towns
Based on the content of work to build healthy communities without drug abuse and prostitution, the Departments of Labor - Invalids and Social Affairs, Public Security, Culture - Information, and the Vietnam Fatherland Front Committee will collaborate to advise the same-level government and guide lower-level governments in evaluating the transformation of work to build healthy communities without drug abuse and prostitution through scoring according to the following criteria (Appendices 4 and 5):
Level 1- Commune, ward, town without drug abuse and prostitution: Achieving from 90 points including:
Level 1.a- Commune, ward, town maintaining no drug abuse and prostitution: from the previous period to the current period, there are no drug dens, prostitutes, or drug users.
Level 1.b- Commune, ward, town transforming to eliminate drug abuse and prostitution: had drug abuse and prostitution in the previous period, but none in the current period.
Level 2- Commune, ward, town strongly transformed: achieving from 80 points or more.
Level 3- Commune, ward, town transformed: achieving from 50 to 79 points.
Level 4- Commune, ward, town not yet transformed: achieving from 49 points or less.
5- Rewards
Annually, based on the classification and evaluation results of the government and mass organizations at all levels, the Departments of Labor - Invalids and Social Affairs, Public Security, Culture - Information, and the Vietnam Fatherland Front Committee will cooperate to inspect and review as a basis for implementing regular rewards in accordance with the guiding documents of the Law on Competition and Rewards.
5.1- Forms of reward
- At the district level: annually, the Chairman of the District People's Committee presents certificates of merit to communes, wards, and towns that meet the standards of "healthy community without drug abuse and prostitution" or "strongly transformed" after rechecking their self-classification and scoring evaluation results.
- At the provincial level: annually, the Chairman of the Provincial People's Committee presents commendations to communes, wards, and towns that have continuously met the standards of "healthy community without drug abuse and prostitution" or "strongly transformed" for three consecutive years after rechecking their self-classification and scoring evaluation results.
- At the central level: The Minister of Labor, Invalids, and Social Affairs, Deputy Chairman of the National Committee for HIV/AIDS Prevention and Control and Drug Abuse, Prostitution Prevention shall present commendation certificates to communes, wards, towns that have been awarded at least one commendation certificate by the provincial level and four certificates of merit by the district level over five consecutive years.
5.2- Procedures for presenting commendation certificates and awards:
- Reports on achievements and minutes recording the results of self-classification and scoring of communes, wards, towns;
- Proposing documents from the People's Committees with competent authority (if the district presents certificates of merit, then the proposal letter from the commune People's Committee; if the province presents commendation certificates, then the proposal letter from the district People's Committee; if the central government presents commendation certificates, then the proposal letter from the provincial People's Committee);
- Minutes of joint review by the Inter-ministerial Working Group on Labor, Invalids, and Social Affairs, Public Security, Culture, Information, and the Central Front Committee;
- Letters of agreement for commendation in accordance with the provisions of the law.
6 - Implementation Organization
6.1. At the Central Level:
- Ministries and sectors that are members of the Inter-ministerial Working Group shall uniformly assign responsibilities in directing, guiding, and organizing the implementation of activities and applying criteria for classifying and evaluating healthy communes, wards, towns free from drug abuse and prostitution as follows:
a- The Ministry of Labor, Invalids, and Social Affairs shall be responsible for:
- Leading and coordinating with the Ministry of Culture, Sports and Tourism, the Ministry of Public Security, and the Vietnam Fatherland Front Central Committee to direct, guide, urge, inspect localities on the implementation of work to build healthy communes, wards, towns free from drug abuse and prostitution; summarize experiences, promote and widely disseminate exemplary models; annually compile the situation report to the Government;
- Directing the Labor, Invalids, and Social Affairs sector in localities to coordinate with relevant agencies at the same level to implement work to build healthy communes, wards, towns free from drug abuse and prostitution, linked with the "All-Voluntary Movement for Building a Civilized Life"; guiding regular summary evaluation and reporting on the implementation results;
- Coordinating with relevant agencies at the same level to compile professional materials guiding the construction and evaluation of healthy communes, wards, towns free from drug abuse and prostitution.
b- The Ministry of Public Security shall be responsible for:
Directing public security forces at all levels to coordinate with labor, invalids, and social affairs agencies, culture, information agencies, and the Vietnam Fatherland Front at the same level to organize inspections nationwide in key areas, serving as the backbone in combating and eliminating drug abuse and prostitution, especially in bars, nightclubs, hotels, guesthouses, karaoke restaurants; managing and helping drug users and prostitutes to reform; mobilizing the people to actively participate in anti-crime movements linked with the work of building healthy communes, wards, towns free from drug abuse and prostitution.
c- The Ministry of Culture, Sports and Tourism shall be responsible for:
Directing the cultural and information sector at all levels to coordinate with labor, invalids, and social affairs agencies, public security agencies, and the Vietnam Fatherland Front at the same level to promote and mobilize the people to actively participate in the "All-Voluntary Movement for Building a Civilized Life" linked with the work of preventing and curbing drug abuse and prostitution in communes, wards, towns.
d- The Central Committee of the Vietnam Fatherland Front shall be responsible for:
Directing the Vietnam Fatherland Front at all levels to coordinate with labor, invalids, and social affairs agencies, public security agencies, and the cultural and information sector at the same level to develop activity contents for preventing and controlling drug abuse and prostitution within the movement "All-Voluntary Movement for Building a Civilized Life in Residential Areas."
6.2- At the Local Level:
The Anti-AIDS and Anti-Drug Abuse, Prostitution Prevention Steering Committee at all levels shall direct departments, sectors, mass organizations, and social organizations, and guide the Commune Volunteer Activity Teams to implement the Joint Resolution with the advice and assistance of the labor, invalids, and social affairs agency, public security agency, cultural and information agency, and the Vietnam Fatherland Front at the same level. Provincial Departments of Labor, Invalids, and Social Affairs, public security agencies, cultural and information departments, and the Vietnam Fatherland Front
at centrally-administered cities and provinces shall develop plans to coordinate and effectively implement the Joint Resolution and propose to the provincial People's Council and People's Committee about rewarding communes, wards, towns recognized by the provincial or district People's Committee as meeting the standards set out in Clause 5 of this Joint Resolution: In addition to rewards stipulated by the Law on Encouragement and Reward, each locality may determine additional reward amounts accompanying commendation certificates and certificates of merit based on actual conditions to encourage the movement to build healthy communes, wards, towns free from drug abuse and prostitution. 7- Reporting and Meeting System
To ensure the effective implementation of the Joint Resolution, ministries and sectors that are members of the Inter-ministerial Working Group and the Anti-AIDS and Anti-Drug Abuse, Prostitution Prevention Steering Committee at centrally-administered cities and provinces shall direct departments, sectors, mass organizations, and social organizations to actively implement the work of building healthy communes, wards, towns free from drug abuse and prostitution, and organize meetings at least every six months; regularly report quarterly and semi-annually on the implementation of the Joint Resolution in the general report on social evil prevention work; annually classify and evaluate communes, wards, towns, and report to the Ministry of Labor, Invalids, and Social Affairs and other member agencies of the Inter-ministerial Working Group along with classification results, scoring, and statistical forms (issued together with the Joint Resolution).
This Joint Resolution takes effect from January 1, 2006, and replaces Joint Resolution No. 546/2003/NQLT-BLDTBXH-BVHTT-UBTƯMTTQVN dated February 27, 2003, issued by the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Culture, Sports and Tourism, and the Vietnam Fatherland Front Central Committee.
