JOINT CIRCULAR
GUIDELINES FOR IMPLEMENTING THE ADJUSTMENT OF MONTHLY SUBSIDIES FROM OCTOBER 1, 2006 FOR RETIRED RURAL OFFICIALS IN ACCORDANCE WITH DECISION NO. 130-CP OF THE COUNCIL OF MINISTERS ON JUNE 20, 1975 AND DECISION NO. 111-HĐBT OF THE COUNCIL OF MINISTER-CHIEFS ON OCTOBER 13, 1981
Pursuant to Decree No. 93/2006/NĐ-CP dated September 7, 2006 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies for retired rural officials (hereinafter referred to as Decree No. 93/2006/NĐ-CP);
Pursuant to Decree No. 94/2006/NĐ-CP dated September 7, 2006 of the Government adjusting the national minimum wage (hereinafter referred to as Decree No. 94/2006/NĐ-CP);
The Ministry of Home Affairs and the Ministry of Finance issue guidelines for implementing the adjustment of monthly subsidies from October 1, 2006 for retired rural officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Minister-Chiefs on October 13, 1981 as follows:
I. APPLICABLE OBJECTS
The applicable objects of this Circular are retired rural officials who have been receiving monthly subsidies in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Minister-Chiefs on October 13, 1981 (hereinafter referred to as retired elderly rural officials).
II. ADJUSTMENT OF MONTHLY SUBSIDIES
From October 1, 2006, implement the adjustment of monthly subsidies for retired elderly rural officials according to Article 6 of Decree No. 93/2006/NĐ-CP (increasing the monthly subsidy by 10% over the amount received in September 2006) and Clause 1 of Article 2 of Decree No. 94/2006/NĐ-CP (increasing the monthly subsidy by an additional 28.6% after the initial increase of 10% based on the amount received in September 2006) as follows:

In which: The monthly subsidy received as of September 2006 is the subsidy stipulated in Clause 2, Section II of Joint Circular No. 115/2005/TTLT-BNV-BTC dated November 2, 2005 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of Decree No. 119/2005/NĐ-CP dated September 27, 2005 of the Government regarding the adjustment of subsidies for retired rural officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Minister-Chiefs on October 13, 1981.
2. The monthly subsidy received from October 1, 2006 for retired elderly rural officials (rounded off according to the formula specified above) is as follows:
a) For former Secretaries of the Party Committee and Chairmen of the People's Committee of the commune: 562,100 VND/month (an increase of 164,800 VND/month compared to the subsidy received as of September 2006);
b) For former Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Commune Militia Commanders, Chiefs of Public Security Stations: 541,000 VND/month (an increase of 158,600 VND/month compared to the subsidy received as of September 2006);
c) For other positions: 499,500 VND/month (an increase of 146,400 VND/month compared to the subsidy received as of September 2006).
III. IMPLEMENTATION
1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly subsidies from October 1, 2006 according to the provisions of this Circular for the objects within their jurisdiction.
2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.
3. Retired elderly rural officials who move to a new legal residence within the same district must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs - Labor, Invalids and Social Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs; the transfer certificate must be accompanied by the file and decision at the time of retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The department at the place of transfer will continue to pay the subsidy to the transferred official. Retired elderly rural officials who moved to a new legal residence before the effective date of Decree No. 93/2006/NĐ-CP and Decree No. 94/2006/NĐ-CP will continue to be paid by the current paying entity.
This Circular takes effect 15 days after its publication in the Official Gazette. It abolishes Joint Circular No. 115/2005/TTLT-BNV-BTC dated November 2, 2005 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of Decree No. 119/2005/NĐ-CP dated September 27, 2005 of the Government regarding the adjustment of subsidies for retired rural officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Minister-Chiefs on October 13, 1981.
The provisions of this Circular shall be implemented from October 1, 2006.
Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs and the Ministry of Finance for study and resolution./.
