Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister on the establishment, organization, and operation of inter-ministerial coordination bodies;

Pursuant to Decision No. 1525/QĐ-TTg dated November 13, 2007 of the Prime Minister on the adjustment of the heads of inter-ministerial coordination bodies established by the Prime Minister;

Considering the proposal of the Minister of Home Affairs,

DECISION:

Article 1. Position and function

1. The Steering Committee for Enterprise Reform and Development, headed by the Deputy Prime Minister, is reorganized based on the Steering Committee for Enterprise Reform and Development established pursuant to Decision No. 98/2000/QĐ-TTg dated August 17, 2000 of the Prime Minister.

2. The Steering Committee for Enterprise Reform and Development (hereinafter referred to as the Steering Committee) has the function of assisting the Prime Minister in directing, guiding, implementing, inspecting, and supervising the implementation of state-owned enterprise reform work and the development of enterprises registered under the Law on Enterprises.

3. The Chairman of the Steering Committee may use the seal of the Prime Minister, and the Vice-Chairman in charge of the Steering Committee may use the seal of the Government Office.

4. The Chairman of the Steering Committee shall submit to the Prime Minister for approval the Regulations on the Operation of the Steering Committee.

Article 2. Tasks of the Steering Committee

1. Submitting to the Government and the Prime Minister programs and plans for the reform of state-owned enterprises and the development of enterprises registered under the Law on Enterprises nationwide. Directing, guiding, and monitoring the implementation of these programs and plans after they have been approved.

2. Cooperating with functional agencies and research organizations to study models, mechanisms, and policies serving the reform of state-owned enterprises and the development of enterprises registered under the Law on Enterprises.

3. Summarizing, concluding, and reporting periodically and urgently to the Prime Minister on the situation of state-owned enterprise reform and the development of enterprises registered under the Law on Enterprises.

4. Monitoring the pilot conversion of public service units into enterprises operating under the Law on Enterprises.

Article 3. Powers of the Steering Committee

1. Being invited to attend meetings chaired by the Prime Minister or Deputy Prime Minister, and meetings of ministries, sectors, and local authorities related to the tasks of the Steering Committee.

2. Inviting leaders of ministries, sectors, local authorities, and representatives of other relevant agencies and organizations to attend meetings and working sessions of the Steering Committee related to the restructuring and reform of state-owned enterprises and the development of enterprises registered under the Law on Enterprises.

3. Requesting ministries, sectors, local authorities, state agencies, organizations, and individuals to provide information and materials necessary for the implementation of the tasks of the Steering Committee.

Article 4. Members of the Steering Committee

1. Chairman: Deputy Prime Minister.

2. Vice-Chairman in charge: Deputy Director of the Government Office.

3. Members:

- Representatives of the leadership of the Ministries of Planning and Investment, Finance, Labor - Invalids and Social Affairs, Home Affairs;

- Inviting representatives of the leadership of the Central Party Office and the Vietnam General Confederation of Labor to be members.

The Vice-Chairman in charge and members of the Steering Committee shall be appointed by the Prime Minister upon the proposal of the Ministers of the relevant ministries and heads of the relevant agencies as stipulated in this Decision. Members of the Steering Committee shall serve concurrently.

Article 5. Permanent agency and operational funding of the Steering Committee

1. The Government Office is the permanent agency of the Steering Committee, responsible for ensuring the conditions for the operation of the Steering Committee, using its own staff to organize the implementation of the tasks of the Steering Committee as prescribed in Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of

2. The operational funding of the Steering Committee shall be guaranteed from the State budget and allocated within the regular operational funding of the Government Office.

Article 6. The support staff of the Steering Committee is the Department of Enterprise Reform under the Government Office.

Article 7. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette. Decisions No. 121/2000/QĐ-TTg dated November 1, 2000 of the Prime Minister on the functions, tasks, powers, and organizational structure of the Steering Committee for Enterprise Reform and Development, Decision No. 1050/QĐ-TTg dated October 23, 2000 of the Prime Minister on the appointment of members of the Steering Committee for Enterprise Reform and Development, and previous regulations inconsistent with this Decision are hereby repealed.The Chairman of the Steering Committee for Enterprise Reform and Development, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities, and Councils of Management of Economic Groups and Corporation 91 are responsible for implementing this Decision./.

Article 8. Responsibility for Implementation

The Chairman of the Steering Committee for Enterprise Reform and Development, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, Boards of Directors of State Corporations and Corporation 91 are responsible for implementing this Decision./.
