Article 1. Other types of artistic performances

Based on Decree No. 11/2006/NĐ-CP dated January 18, 2006 of the Government promulgating the Regulations on Cultural Activities and Public Cultural Service Business Operations,

The Ministry of Culture, Sports and Tourism guides the organization of cultural and artistic exhibitions in Vietnam and the export of Vietnamese cultural and artistic exhibitions abroad as follows:

This Circular provides detailed guidance on the following contents:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

 1. Scope of application

a) Organizing cultural and artistic exhibitions in Vietnam as stipulated in Articles 18; point a, Clause 1, Article 19; Clause 2, Article 19; Article 20 and point 1, Clause 1, Article 21 of the Regulations on Cultural Activities and Public Cultural Service Business Operations promulgated together with Decree No. 11/2006/NĐ-CP dated January 18, 2006 of the Government (hereinafter referred to as the Regulations promulgated together with Decree No. 11/2006/NĐ-CP);

b) Exporting Vietnamese cultural and artistic exhibitions abroad as stipulated in point i, Clause 1, Article 2; point c, Clause 1, Article 6 of Decree No. 72/2000/NĐ-CP dated December 5, 2000 of the Government (hereinafter referred to as Decree No. 72/2000/NĐ-CP).

Organizations and individuals wishing to organize cultural and artistic exhibitions as stipulated in Clause 2, Article 19 of Decree No. 11/2006/NĐ-CP (hereinafter referred to as the exhibition organizer) must have legal personality if they are Vietnamese organizations; if they are Vietnamese individuals, they must have a national identity card or a confirmation from the local authority where they reside; if they are foreign organizations, they must be legally operating organizations in Vietnam; if they are foreign individuals, they must have a valid passport and entry visa to Vietnam.

2. The State encourages the following exhibitions:

3. a) Exhibitions aimed at introducing to domestic and international audiences the cultural characteristics of ethnic groups in Vietnam, the finest cultural achievements of humanity; progress and achievements in the construction and defense of the Socialist Republic of Vietnam; economic, social, and scientific and technological progress worldwide.

b) Vietnamese exhibitions abroad; foreign exhibitions displayed in Vietnam must comply with the regulations of the host country, respect each country's culture, and enhance friendly cooperative relations between Vietnam and other countries.

Vietnamese organizations or individuals or foreign organizations or individuals displaying exhibitions about Vietnam abroad under the name of representing Vietnam must obtain the consent of the Ministry of Culture, Sports and Tourism.

4. Explanation of certain terms

II. SPECIFIC PROVISIONS

 1. a) Visual works as stipulated in point i, Clause 1, Article 2 of Decree No. 72/2000/NĐ-CP include paintings, graphic works, and sculptures.

b) Fine arts exhibitions as stipulated in Article 18 of the Regulations promulgated together with Decree No. 11/2006/NĐ-CP include painting, graphic, sculpture, applied art, and installation art exhibitions.

c) Exhibition objects and materials as stipulated in Clause 1, Article 21 of the Regulations promulgated together with Decree No. 11/2006/NĐ-CP include works, products, items, tools, documents, video discs, and catalogues that reflect the theme and content of the exhibition.

Authority issuing exhibition permits and registration certificates

2. a) The Department of Fine Arts, Photography and Exhibitions under the Ministry of Culture, Sports and Tourism issues exhibition permits according to point c, Clause 1, Article 6 of Decree No. 72/2000/NĐ-CP and point a, Clause 1, Article 19 of the Regulations promulgated together with Decree No. 11/2006/NĐ-CP (except for book and newspaper exhibitions).

b) Provincial Departments of Culture, Sports and Tourism issue exhibition permits according to point b, Clause 1, Article 19 and accept exhibition registration applications according to Article 20 of the Regulations promulgated together with Decree No. 11/2006/NĐ-CP.

Application documents for exhibition permits and validity period of exhibition permits

3. a) Application documents for exhibition permits (as stipulated in point a, Clause 2, Article 19 of the Regulations promulgated together with Decree No. 11/2006/NĐ-CP) are specified as follows:

- An application form for an exhibition permit according to Form I attached to this Circular;

- For fine arts exhibitions, a list of works indicating the material, size of each work, photographs of the works sized 9 x 12 cm or larger pasted on A4 paper, below each photograph, clearly stating the title, material, size of the work, and signed by the applicant. If it is a video disc, it must ensure high quality, clear images, and detailed information as required for photographs of the works;

- For installation art exhibitions, a document or video disc presenting the concept and content of the work, photographs of the work from three different angles (front view, right side view, left side view), and a list of people involved in forming the work (if applicable);

- For foreign exhibitions displayed in Vietnam, a letter of invitation from a Vietnamese partner or a document signed with a Vietnamese partner regarding the foreign exhibition displayed in Vietnam;

- For exhibitions brought from abroad by organizations or individuals and combined with Vietnamese content according to agreements or contracts between Vietnamese and foreign organizations or individuals, the Vietnamese party must apply for an exhibition permit;

- For exhibitions organized by foreign organizations or individuals currently operating in Vietnam, the organizing entity must apply for an exhibition permit.

b) Exhibition permits are valid for a period of 12 months, and for exhibitions requiring longer preparation time, the period may not exceed 18 months. Beyond these periods without conducting the exhibition, the permit becomes invalid. The exhibition organizer wishing to continue the exhibition must reapply for a permit.

b) The exhibition permit is valid for a period of twelve months; for exhibitions requiring a longer preparation time, the term shall not exceed eighteen months. If the exhibition is not held within these periods, the permit becomes invalid. The organizer wishing to continue with the exhibition must reapply for the permit.

3. Procedures for issuing the registration certificate for exhibitions (as stipulated in Article 20 of the Regulation promulgated together with Decree No. 11/2006/NĐ-CP)

Vietnamese organizations and individuals wishing to organize cultural and artistic exhibitions not falling under the cases stipulated in Clause 1, Article 19 of the Regulation issued together with Decree No. 11/2006/NĐ-CP must submit the exhibition registration dossier to the Department of Culture, Sports and Tourism at the location where the exhibition will be held.

a) The registration dossier includes:

- An exhibition registration form according to the model set out in Appendix III issued together with this Circular;

- Invitation letter sample, catalogues introducing the exhibition content in Vietnamese - Outline of content, list of works, exhibits, and documents for the exhibition,

b) Upon receiving the exhibition registration dossier, the Department of Culture, Sports and Tourism shall have the responsibility to issue an exhibition registration certificate (according to the model set out in Appendix IV).

c) After seven working days from the date the Department of Culture, Sports and Tourism receives the exhibition registration, if the Department does not provide comments in writing, the person registering the exhibition may implement the registered content in accordance with Article 20 of the Regulation issued together with Decree No. 11/2006/NĐ-CP. In case of changes to the registered content, the exhibition organizer must re-register.

III. IMPLEMENTATION PROVISIONS

1. This Circular takes effect forty-five days from the date of issuance.

2. This Circular also promulgates Appendices I to IV including: the application form for exhibition permit (Appendix I), the exhibition permit form (Appendix II), the exhibition registration form (Appendix III), and the exhibition registration certificate form (Appendix IV).

3. During implementation, organizations and individuals encountering difficulties should promptly report to the Ministry of Culture, Sports and Tourism for study and adjustment./.
