CIRCULAR
Guidelines on the functions, tasks, powers, organization, and staffing of the Commendation and Reward Board under the Provincial Department of Home Affairs under the People's Committees of provinces and centrally governed cities

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 13/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decision No. 59/2009/QĐ-TTg dated April 16, 2009 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Central Commendation and Reward Board under the Ministry of Home Affairs;
The Ministry of Home Affairs hereby provides guidelines on the functions, tasks, powers, organization, and staffing of the Commendation and Reward Board under the Provincial Department of Home Affairs under the People's Committees of provinces and centrally governed cities (hereinafter referred to as provincial level) as follows:
Article 1. Position and Functions
1. The Provincial Commendation and Reward Board is an affiliated body of the Provincial Department of Home Affairs, assisting the Director of the Provincial Department of Home Affairs in advising the Provincial People's Committee on managing state administration in the field of commendation and reward.
2. The Commendation and Reward Board is subject to the direction and management of the Provincial Department of Home Affairs regarding organization, staffing, and activities; at the same time, it is subject to professional guidance from the Central Commendation and Reward Board under the Ministry of Home Affairs.
3. The Commendation and Reward Board (equivalent to a branch office) has legal personality, its own seal and bank account, a headquarters, staffing, and operational funding provided by the state budget according to the provisions of the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. It serves as the permanent body of the Provincial Commendation and Reward Council.
2. Assist the Director of the Provincial Department of Home Affairs in performing the following tasks:
a) Drafting programs, plans, and long-term plans for the fields of commendation and reward for submission to the competent authority for issuance.
b) Drafting legal normative documents for the fields of commendation and reward for submission to the competent authority for issuance; guiding and organizing the implementation of legal normative documents, programs, plans, and projects on commendation and reward within the province after approval by the competent authority.
c) Advising the Chairman of the Provincial People's Committee and the Provincial Commendation and Reward Council on organizing commendation campaigns; guiding, urging, inspecting departments, localities, the United Front, political organizations, political-social organizations, and economic organizations in implementing commendation campaigns and reward policies of the Party and State within the province.
d) Taking the lead and coordinating with the United Front, political organizations, political-social organizations, social organizations at the local level, and mass media to identify, publicize, and promote exemplary models.
đ) Organizing the implementation of training and professional guidance plans for staff working in the field of commendation and reward in departments, localities, and enterprises within the province; applying science and technology in the field of commendation and reward.
c) Conducting inspections and investigations related to the work of commendation and reward, and handling complaints and denunciations in this field according to the provisions of the law.
3. Reviewing commendation proposal files submitted by departments, localities, the United Front, political organizations, political-social organizations, social organizations, and economic organizations at the grassroots level, and submitting them to the Provincial People's Committee for decision on commendation or recommending the competent authority for decision on commendation.
4. Managing and archiving commendation files according to the provisions of the law; building and managing a database on commendation and reward; compiling and reporting regularly on commendation and reward according to the provisions.
5. Building, managing, and using the Commendation and Reward Fund according to the provisions of the law; managing, issuing, recovering, and replacing tangible rewards according to the delegated authority; advising on the implementation of award ceremonies according to the provisions of the law.
6. Managing organization, personnel, staffing, finance, and assets assigned; implementing regulations and policies for cadres and civil servants of the Board according to the delegation of the Director of the Provincial Department of Home Affairs and the provisions of the law.
7. Performing other tasks assigned by the Director of the Provincial Department of Home Affairs or authorized agencies according to the provisions of the law.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Leadership of the Board:
a) The Commendation and Reward Board has a Director and not more than three Deputy Directors;
b) The Director of the Commendation and Reward Board is a Deputy Director of the Provincial Department of Home Affairs and a Vice-Chairman of the Provincial Commendation and Reward Council, responsible before the Director of the Provincial Department of Home Affairs and the law for all activities of the Board;
c) Deputy Directors assist the Director, responsible before the Director and the law for the tasks assigned; when the Director is absent, a Deputy Director appointed by the Director shall manage the activities of the Board;
d) The appointment of Directors and Deputy Directors based on professional standards issued by the Provincial People's Committee, implemented according to the law and the delegation of cadre management by the Provincial People's Committee.
2. Organizational Structure:
a) Based on the workload of state management in the field of commendation and reward in the locality, the Director of the Provincial Department of Home Affairs submits to the Provincial People's Committee for a specific decision on the number and names of organizational units of the Board suitable and effective but not exceeding three rooms established according to the areas of work, including: General Coordination - Administrative: Commendation and reward for departments and agencies; Commendation and reward for districts, counties, towns, cities, bases, and enterprises within the province;
b) Each room has a Head and one Deputy Head. The Head is responsible before the Director and the law for the area of work assigned. The Deputy Head is responsible before the Head and the law for the area of work assigned.
3. Staffing:
The establishment quota of the Commendation Board is part of the total administrative establishment of the Department of Home Affairs assigned by the provincial People's Committee. The Head of the Commendation Board determines the positions for the Board to be submitted by the Director of the Department of Home Affairs to the provincial People's Committee for decision to ensure sufficient establishment to effectively perform the functions, tasks, and commendation work of the locality.
Article 4. Organization of Implementation
1. The People's Committees of provinces and centrally governed cities decide on the establishment of the Commendation Board and specify its specific tasks, powers, organization, and establishment according to the guidelines set out in this Circular.
2. The Chairpersons of the People's Committees of provinces and centrally governed cities are responsible for organizing and implementing this Circular.
Article 5. Effective Date
1\. This Circular takes effect forty-five days from the date of issuance.
2. This Circular replaces the provisions at Clause 13, Section II and Point d (regarding the structure of the Commendation Board) of Clause 2, Section III, Part I of Circular No. 04/2008/TT-BNV dated June 4, 2008, issued by the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of the Department of Home Affairs, Provincial and District Internal Affairs Offices; and Point e, 2.1 of Clause 2, Section I of Circular No. 06/2008/TT-BNV dated August 21, 2008, issued by the Ministry of Home Affairs amending and supplementing Clause 2 of Section III, Part I of Circular No. 04/2008/TT-BNV dated June 4, 2008.
During the implementation of this Circular, if there are difficulties or obstacles, the provincial People's Committee is requested to report to the Ministry of Home Affairs for study and resolution./.
