Regulations on the Conditions for Operating Entertainment Dance Activities

“1. Position
Article 1. Other types of artistic performances
Pursuant to Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environmental activities;
The Ministry of Culture, Sports and Tourism stipulates the professional conditions for sports establishments organizing entertainment dance activities as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular details the conditions regarding infrastructure, equipment, and professional staff for sports establishments organizing entertainment dance activities. Entertainment dance activities involve movement to music, including complex actions such as bending, twisting, sliding, somersaulting, and relaxing the body, serving both entertainment and health improvement purposes.
Article 2. Applicability
This Circular applies to organizations and individuals organizing entertainment dance activities in Vietnam.
Article 3. Issuance of Certificate of Compliance with Operating Conditions
A sports establishment organizing entertainment dance activities must obtain a certificate of qualification for operation according to the procedures specified in Article 55 of the Law on Physical Education and Sports when conducting such activities. When organizing high-performance sports training and competition in entertainment dance activities, the sports establishment must ensure the conditions stipulated in Article 43 of the Law on Physical Education and Sports and the competition regulations.
Chapter II
SPECIFIC PROVISIONS
Article 4. Conditions Regarding Infrastructure
1. The location for organizing entertainment dance activities must meet the following conditions:
a) The training venue for entertainment dance activities must have a roof and an area of at least 30 square meters;
b) The floor must be flat, non-slippery, and not deformable;
c) There must be a soundproofing system ensuring that the sound emitted outside the activity location does not exceed the national standard for maximum noise levels allowed;
d) There must be a lighting system providing illumination of at least 150 lux.
2. There must be a restroom and a first aid cabinet available for those participating in training.
3. Ensure operational hours, public order, hygiene, environmental protection, labor safety, and fire prevention according to regulations.
3. There must be equipment serving the arbitration team of the competition including: walkie-talkies, flags, whistles, clocks, time boards, loudspeakers, starting tapes, finishing tapes, safety testing equipment, measuring tools for the size and weight of competition vehicles.
Equipment for participants must be provided, including knee pads, elbow pads, and headgear. A notice board must display operating hours for training sessions, prohibit gambling in any form, smoking, and drinking alcohol or beer.
Article 6. Conditions Regarding Specialized Staff
Sports establishments organizing entertainment dance activities must have professional instructors meeting the standards set out in Point 1 of Section I of Circular No. 05/2007/TT-UBTDTT dated July 20, 2007 of the Sports Committee guiding the implementation of certain provisions of Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding the implementation of certain articles of the Law on Physical Education and Sports.
Chapter III
IMPLEMENTATION
Article 7. Responsibilities of management agencies
The General Department of Sports is responsible for guiding and inspecting the implementation of this Circular. Provincial Departments of Culture, Sports and Tourism under the central government are responsible for implementing this Circular, inspecting, and handling organizations and individuals who violate the professional conditions for operating entertainment dance activities within their jurisdiction.
Article 8. Effective Date
This Circular takes effect 45 days from the date of signature.
During implementation, if any issues arise, organizations and individuals are advised to promptly report them to the Ministry of Culture, Sports and Tourism for timely resolution./.
