Guidelines for determining the level of costs for planning, reviewing, and announcing

Pursuant to Decree No. 116/2008/NĐ-CP dated November 14, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approval, and management of overall socio-economic development plans;
Pursuant to Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approval, and management of overall socio-economic development plans;

The Ministry of Planning and Investment issues guidelines for determining the level of costs for planning (including new planning and adjustment), reviewing, and announcing overall socio-economic development plans; industry, sector, and key product development plans as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides the determination of the level of costs for planning (including new planning and adjustment), reviewing, and announcing overall socio-economic development plans; industry, sector, and key product development plans as prescribed in Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approval, and management of overall socio-economic development plans and Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approval, and management of overall socio-economic development plans (hereinafter referred to as planning projects), including:
1. Overall socio-economic development plan for socio-economic regions, key economic zones, economic corridors, and economic belts (hereinafter referred to as regional-level planning project).
2. Overall socio-economic development plan for provinces and centrally-administered cities (hereinafter referred to as provincial-level planning project).
3. Overall socio-economic development plan for districts, towns, and centrally-administered cities under provinces (hereinafter referred to as district-level planning project).
4. Industry, sector, and key product development plan for the entire country.
5. Industry, sector, and key product development plan for provinces and centrally-administered cities.
Article 2. Applicability
1. This Circular applies to agencies, organizations, and individuals related to planning, reviewing, managing, and announcing planning projects funded by state budget.
2. It is encouraged that organizations and individuals using non-state budget funds to establish, review, and announce planning projects according to the provisions of this Circular.
Article 3. Principles for determining costs
1. The cost standards stipulated in this Circular are the maximum necessary costs to implement all contents of planning, reviewing, approving, and announcing planning projects.
2. The cost standards stipulated in this Circular do not include value-added tax; costs for organizing tender selection according to regulations; costs for conducting survey exploration and mapping (or purchasing) maps (topographic, geological, administrative, and other types of maps) of the planning area; costs for preparing strategic environmental assessment reports.
Based on the approved planning task requirements, if it is necessary to have the above costs, the unit assigned to prepare the detailed budget must supplement the detailed budget based on applying relevant cost standards issued by competent state authorities and submit to the competent authority for decision-making according to the guidance in Appendix X.
3. In cases where the cost of hiring foreign consultants to prepare planning projects funded by the state budget exceeds the cost standards stipulated in this Circular, it must be agreed upon by the competent authority for decision-making according to current regulations.
Article 4. Basis for determining cost levels:
The cost standards prescribed in this Circular are established based on the minimum wage level stipulated in Government Decree No. 22/2011/NĐ-CP dated April 4, 2011, which is 830,000 VND/month, and the prevailing consumer price index at the time of issuing this Circular. In cases where there are changes in the general minimum wage and the prevailing consumer price index, the budget estimate for the planning project at a specific time will be adjusted according to Clause K.
K is the adjustment coefficient for the minimum wage and the prevailing consumer price index, determined in accordance with the guidelines set out in Appendix XI of this Circular.
Chapter II
SPECIFIC PROVISIONS
Article 5. Cost Standards for Comprehensive Economic-Social Development Planning Projects at the Regional and Provincial Levels
1. Calculation Formula: The cost standard for regional and provincial planning projects is calculated using the following formula:

Where:
ofQHVT is the total cost for the comprehensive economic-social development planning project at the regional or provincial level (in million VND).
ofchuẩn = 850 (million VND), which is the cost for the standard comprehensive economic-social development planning project (a hypothetical area of 1,000 km² with a population density of approximately 50-100 people/km² and optimal conditions for planning).
H1 - the area level coefficient, determined in Appendix I.
H2 - the working condition and socio-economic development level coefficient of the planning area, determined in Appendix II.
H3 - the natural area size coefficient of the planning area, determined in Appendix III.
K - the adjustment coefficient for the minimum wage and the prevailing consumer price index. At the time of issuing this Circular, K=1. In cases where there are adjustments to the national minimum wage and the prevailing consumer price index announced by the competent authority, the K coefficient is determined in Article 4 of this Circular.
2. Cost standards for various cost items of regional planning projects are specified in Appendix IV.
3. Cost standards for various cost items of provincial planning projects are specified in Appendix V.
Article 6. Cost Standards for Comprehensive Economic-Social Development Planning Projects at the District Level
The cost for district-level planning projects is calculated as a percentage (%) of the maximum cost of the provincial planning project that includes that district.
1. The cost for district planning projects shall not exceed 40% of the maximum cost of the provincial planning project that includes that district. For island districts, the cost for island district planning projects shall not exceed 50% of the maximum cost of the provincial planning project that includes that island district.
2. The cost for planning projects of towns and cities within provinces shall not exceed 50% of the maximum cost of the provincial planning project that includes those towns and cities.
3. Cost standards for various cost items of district planning projects are specified in Appendix VI.
Article 7. Cost Standards for Planning Projects for the Development of Industries, Sectors, and Key Products
1. Calculation Formula: The cost standard for planning projects for the development of industries, sectors, and key products is calculated using the following formula:

Where: GQHN is the total cost for the planning project for the development of industries, sectors, and key products (in million VND).
Gchuẩn and coefficients H1, H2, H3 are determined as provided in Clause 1, Article 5 of this Circular. Qn - the difference coefficient between the development planning of industries, sectors, and key products, determined in Appendix VII.
K - the adjustment coefficient for the minimum wage and the prevailing consumer price index. At the time of issuing this Circular, K=1. In cases where there are adjustments to the national minimum wage and the prevailing consumer price index announced by the competent authority, the K coefficient is determined in Article 4 of this Circular.
2. Cost standards for various cost items of national planning projects for the development of industries, sectors, and key products are specified in Appendix VIII.
3. Cost standards for various cost items of provincial planning projects for the development of industries, sectors, and key products are specified in Appendix IX.
4. The cost standard for planning projects for the development of a single industry or sector as part of a key industry or sector shall not exceed 50% of the standard cost prescribed for that key industry or sector.
Article 8. Cost Standards for Planning Adjustment Projects
The cost level for planning adjustment projects shall be determined based on the budget estimate according to the content that needs to be adjusted in the approved planning.
1. For planning that has been implemented for five years or more, the cost level shall not exceed 65% of the maximum total cost of the new planning project at the time of preparing the budget estimate.
2. For planning projects that need to be adjusted according to Clause 2, Article 7 of Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approving and managing overall socio-economic development planning, the cost level shall not exceed 10% of the maximum total cost of the new planning project at the time of preparing the budget estimate.
3. The standards for cost items of planning adjustment projects (calculated as a percentage of the total cost level) shall apply the standards for cost items of new planning projects.
Chapter III
IMPLEMENTATION
Article 9. Effective Date
This Circular takes effect from April 1, 2012 and replaces Decision No. 281/2007/QĐ-BKH issued on March 26, 2007 by the Minister of Planning and Investment on issuing cost standards for planning preparation, review, and planning adjustment for overall socio-economic development, industry planning, and major product planning; it also replaces Section 3 of Circular No. 03/2008/TT-BKH dated July 1, 2008 of the Ministry of Planning and Investment guiding the implementation of certain provisions of Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing some articles of Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on planning, approval, and management of overall socio-economic development planning.
Article 10. Transitional Provisions
1. For planning projects which have been approved by competent authorities for outline, tasks, and budget estimate for planning preparation before this Circular takes effect and have signed contracts for hiring consultants, they shall be implemented according to the approved Decision.
2. In cases where the outline, tasks, and budget estimate for planning preparation have been approved by competent authorities before this Circular takes effect but no contract for hiring consultants for planning preparation has yet been signed, the authority approving the budget estimate has the right to adjust the budget estimate according to the provisions of this Circular.
Funding for planning projects shall be allocated within the assigned budget estimates of ministries, sectors, and localities. During the implementation process, if there are any difficulties, organizations and individuals are requested to report to the Ministry of Planning and Investment for research and resolution.
