Regulations on the model and management, use of Inspection Cards

Based on the Inspection Law dated November 15, 2010;
Decree No. 92/2014/NĐ-CP dated October 8, 2014 of the Government amending Clause 1, Article 16 of Decree No. 97/2011/NĐ-CP dated October 21, 2011 of the Government stipulating inspectors and inspection collaborators;
The Government Inspectorate shall stipulate the model of the Inspection Card and the management, use of the Inspection Card as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the model of the Inspection Card; the issuance, management, and use of the Inspection Card for state inspection agencies and Inspectors.
Article 2. Applicability
This Circular applies to state management agencies, state inspection agencies, and Inspectors.
Article 3. General Principles
Article 1. The Inspection Card is issued by the Chief Inspector General of the Government to Inspectors for use when performing inspection tasks.
Article 2. The recipients of the Inspection Card are Inspectors belonging to state inspection agencies.
Article 3. When Inspectors retire, die, go missing, are relieved of their Inspector position, or the Inspection Card has expired, its usage value must be revoked.
Article 4. The issuance and revocation of the Inspection Card shall be carried out in March, June, September, and December each year.
Article 5. Heads of state inspection agencies and Inspectors have the responsibility to manage and use the Inspection Card in accordance with the provisions of the Inspection Law 2010, Decree No. 97/2011/NĐ-CP dated October 21, 2011 of the Government on Inspectors and Inspection Collaborators, and this Circular.
Chapter II
INSPECTION CARD AND MANAGEMENT, USE OF INSPECTION CARD
Article 4. Inspection Card
Clause 1. The Inspection Card identifies the legal status for Inspectors to use when performing inspection duties and powers as prescribed by law.
Clause 2. The Inspection Card is rectangular, measuring 61 mm wide and 87 mm long, consisting of the Inspection Card base and protective film. The content on the Inspection Card is presented in the Vietnamese Unicode font according to Vietnam Standard TCVN 6909:2001.
Clause 3. The Inspection Card base consists of two sides:
a) Front side (Figure 1) with a red background, yellow capital letters, including two lines:
The top line reads "SOCIALIST REPUBLIC OF VIET NAM", bold typeface, size 09;
Between the two lines is the National Emblem, diameter 45 mm, gold color. "INSPECTION CARD", bold typeface, size 16;
Between the two lines is the National Emblem, diameter 24 mm.

b) Back side (Figure 2): Background is pink floral patterns forming rays emanating from the center; in the middle is the emblem of the Inspection sector, printed faintly, diameter 20 mm; in the upper left corner is the emblem of the Inspection sector, diameter 14 mm; from the upper left corner (10 mm away) to the lower right corner is a red diagonal line, width 06 mm.
+ National Emblem: "SOCIALIST REPUBLIC OF VIETNAM", in capitalized letters, size 8;
- National Emblem: top line in capital letters, bold, bottom line in regular letters, bold, size 8, underlined second line;
- Inspection Card: Bold red letters, size 12;
- Number (Inspection Card Code);
- Name: Record the name of the Inspector who is issued the Inspection Card, regular letters, size 10;
- Rank: Record the newly appointed Inspector rank, regular letters, size 10;
- Agency: Record the name of the state inspection agency where the Inspector works, size 10;
- Date of issuance of the Inspection Card, slanted letters, size 10;
- Government Inspector General, capital letters, size 8;
- Signature and name of the Government Inspector General;
- Seal of the Government Inspectorate (diameter 18mm);
- Portrait photograph of the person issued the Inspection Card, size 23mm x 30mm, embossed stamp at the lower right corner of the photo;
- Expiry date, regular letters, size 10.

Clause 4. The protective film of the Inspection Card is a plastic film protecting the outside of the Inspection Card base, printed with a quarter-circle red seal containing the abbreviated text "State Inspection" (STI) repeated continuously at the lower left corner of the back side of the Inspection Card base.
Article 5. Inspector Identification Card Number
1. Each civil servant, People's Army officer, People's Public Security officer who is appointed to the inspector rank shall be issued an Inspector Identification Card number (referred to as card number). The Inspector Identification Card number consists of two parts:
a) The first part includes one uppercase letter and two digits to distinguish the agency using the inspector belonging to a province or centrally governed city (hereinafter referred to collectively as province) or belonging to a ministry or equivalent agency (hereinafter referred to collectively as ministry). The list of identification numbers for state agencies is specified in Decision No. 93/2005/QĐ-BNV dated August 30, 2005 and Document No. 910/BNV-CCVC dated April 3, 2009 of the Ministry of Home Affairs. (Annex attached to this Circular).
b) The second part consists of four digits starting from 0001, which is the serial number of inspectors of state agencies under the province or the serial number of inspectors of the state inspection agency under the ministry.
Example: If the card number is A29 - 0026, then A29 is the code number of the Government Inspectorate agency; 0026 is the number of the 26th inspector under the Government Inspectorate agency.
2. The Inspector Identification Card number will not change in the following cases:
a) When the inspector is transferred or rotated within the same state inspection agency or moved to another state inspection agency within the same province or the same ministry without being relieved of their inspection position according to the law;
b) The inspector is transferred or rotated to another agency and has been relieved of their inspection position, but later is transferred and reappointed to the inspector position at a state inspection agency within the same province or ministry.
3. The Inspector Identification Card number will change (a new number will be issued) in the following cases:
a) The inspector transfers to work at a state inspection agency under a different province or ministry;
b) The inspector is transferred or rotated to another agency and has been relieved of their inspection position, but later is transferred and reappointed to the inspector position at a state inspection agency in a different province or ministry.
Article 6. Raised Seal on Inspector Identification Card
1. The raised seal on the Inspector Identification Card is similar to the model seal of the Government Inspectorate agency, with a diameter of 18 mm.
2. The raised seal is used to stamp in the lower right corner of the photograph of the person receiving the Inspector Identification Card.
3. The Cadre and Civil Servant Department of the Government Inspectorate is responsible for managing and using the raised seal in accordance with the law.
Article 7. Authority, Conditions, and Forms of Issuing Inspector Identification Cards
1. The Chief Inspector General of the Government Inspectorate has the authority to issue Inspector Identification Cards to inspectors of state inspection agencies nationwide.
2. Inspectors who have been appointed to the inspector position may be considered and proposed for issuance of an Inspector Identification Card after receiving a decision appointing them to the inspector position; they shall not be considered or proposed for issuance of an Inspector Identification Card if they have received a retirement notice, death notice, missing person notice, during detention period, disciplinary action period, or a notice regarding investigation of corruption or public service ethics violations by the competent authority.
3. The forms of issuing Inspector Identification Cards include:
a) Issuance of a new Inspector Identification Card;
b) Replacement of Inspector Identification Card;
c) Reissuance of Inspector Identification Card.
Article 8. Issuance of New Inspector Identification Cards and Replacement of Inspector Identification Cards
1. Issuance of a new Inspector Identification Card in the case where a civil servant, People's Army officer, People's Public Security officer of state inspection agencies is appointed to the inspector position for the first time.
2. Replacement of Inspector Identification Card in the following cases:
a) The inspector is promoted to a higher inspector rank;
b) The Inspector Identification Card has expired;
c) The currently used Inspector Identification Card is damaged;
d) Due to changes in the card number, name, workplace, or other reasons leading to the need to change the information of the inspector recorded on the Inspector Identification Card according to the law;
e) When the competent authority issues a new Inspector Identification Card model to replace the old model.
3. Procedures and formalities for issuing new Inspector Identification Cards and replacing Inspector Identification Cards
a) According to the management hierarchy, the Heads of Provincial Inspectorates, Heads of District Inspectorates, Heads of City Inspectorates, and Heads of directly managed units submit a request for issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards to the Head of the Provincial Inspectorate (collectively referred to as Head of Provincial Inspectorate) or the Head of the Ministry Inspectorate (collectively referred to as Head of Ministry Inspectorate);
For inspectors under the Government Inspectorate, the Head of the directly managed unit submits a request for issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards to the Cadre and Civil Servant Department.
b) According to the management authority, the Head of the Provincial Inspectorate, the Head of the Ministry Inspectorate reviews and compiles a list, and submits a request for issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards to the Chief Inspector General of the Government Inspectorate;
The Cadre and Civil Servant Department compiles the demand for issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards for inspectors under the Government Inspectorate.
c) Based on the application file submitted by the Head of the Provincial Inspectorate, the Head of the Ministry Inspectorate, and the Heads of units directly under the Government Inspectorate, the Chief Inspector General of the Government Inspectorate reviews and issues a decision for issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards and directs the implementation of printing and issuance of new Inspector Identification Cards or replacement of Inspector Identification Cards.
4. Documents for Issuance of New Inspector Identification Cards and Replacement of Inspector Identification Cards Include:
a) A letter requesting issuance of a new Inspector Identification Card or replacement of Inspector Identification Card from the Head of the Provincial Inspectorate, the Head of the Ministry Inspectorate, or the Head of directly managed units under the Government Inspectorate;
b) A list of civil servants with brief descriptions and reasons for requesting issuance of a new Inspector Identification Card or replacement of Inspector Identification Card (Form No. 1, Form No. 2);
c) Appointment decision or a copy of the appointment decision to the inspector position;
d) Two color photographs of the individual, taken in ID format, size 30 mm x 40 mm, clearly marked with full name and unit behind the photo and on the envelope containing the photos (each inspector needs two photos);
e) The old Inspector Identification Card cut at the corner for the case of replacing Inspector Identification Card.
Article 9. Reissuing the Inspection Card
1. Inspectors may be considered for reissuance of the Inspection Card if it was lost due to objective reasons; however, the Inspection Card will not be reissued if it was lost due to violations listed in Clause 3, Article 10 of this Circular or if it has been lost more than once during the validity period of the Inspection Card.
2. Procedures and formalities for reissuing the Inspection Card
a) Inspectors must submit a report detailing the reasons for losing the Inspection Card and requesting its reissuance.
b) Depending on the management hierarchy, the Heads of Provincial Inspectorates, District Inspectorates, City Inspectorates under provinces, and Heads of units directly managing inspectors shall examine and confirm the reasons for losing the Inspection Card and propose to the Heads of Provincial Inspectorates and Heads of Ministries regarding the reissuance of the Inspection Card.
For inspectors under the Government Inspectorate, the Heads of units directly managing them shall examine and confirm the reasons for losing the Inspection Card and issue a document proposing the reissuance of the Inspection Card to the Department of Organization and Cadres.
c) Within their management authority, the Heads of Provincial Inspectorates and Heads of Ministries shall examine and compile lists, sending documents requesting the issuance, reissuance, or replacement of the Inspection Card to the Chief Inspector of the Government Inspectorate.
The Department of Organization and Cadres shall compile the demand for reissuing the Inspection Card for inspectors under the Government Inspectorate.
d) Based on the application file submitted by the Heads of Provincial Inspectorates, Heads of Ministries, and Heads of units under the Government Inspectorate, the Chief Inspector of the Government Inspectorate shall examine and issue a decision on the reissuance of the Inspection Card, and direct the printing and reissuance of the Inspection Card.
3. Documents required for reissuing the Inspection Card include:
a) An application for reissuing the Inspection Card.
b) A letter from the Head of the Provincial Inspectorate, Head of the Ministry, or Head of units under the Government Inspectorate requesting the reissuance of the Inspection Card.
c) A list of civil servants with reasons for requesting the reissuance of the Inspection Card (Form No. 3).
d) Two color photographs of the individual, taken in ID format, size 30 mm x 40 mm, clearly marked with full name and unit behind the photo and on the envelope containing the photos (each inspector needs two photos);
Article 10. Using the Inspection Card
1. Inspectors shall use their own Inspection Cards when performing inspection duties and powers as prescribed by law, and only when carrying out inspection tasks.
During inspections, when conducting independent inspections, Inspectors must present the Inspection Card, except in cases where there is confirmation from the direct supervising agency that the Inspector is in the process of obtaining or replacing the Inspection Card.
2. The maximum validity period of the Inspection Card is five years from the date of issuance.
3. It is strictly prohibited for Inspectors to misuse the Inspection Card for personal purposes; using another person's Inspection Card or lending their Inspection Card to others for use. If an Inspector uses the Inspection Card to commit illegal acts, they will face disciplinary action or criminal prosecution depending on the severity of the violation.
Article 11. Retrieving the Inspection Card
1. The Inspection Card must be retrieved in the following situations:
a) When Inspectors retire, die, or go missing while working.
b) When Inspectors are relieved of their positions according to Article 15 of Decree No. 97/2011/NĐ-CP dated October 21, 2011 of the Government on Inspectors and Inspection Collaborators.
c) In cases of replacing the Inspection Card as stipulated in Clause 2, Article 8 of this Circular.
2. Based on decisions made by competent authorities concerning the situations specified in Clause 1 of this Article, the Heads of State Inspectorates, Heads of units under the Government Inspectorate directly managing Inspectors shall proceed to retrieve the Inspection Card, cut the corner of the Inspection Card before handing it over, and report to higher-level State Inspectorates.
3. Inspectors have the responsibility to voluntarily return the Inspection Card to the Heads of State Inspectorates or Heads of units directly managing them as provided for in Clauses 1 and 2 of this Article.
Article 12. Management of Inspection Cards
1. The Government Inspector General shall uniformly manage Inspection Cards within the state inspection organization system in accordance with the provisions of the law.
2. Heads of Provinces' Inspectors, Heads of Ministries' Inspectors
a) Review, compile lists, and submit written requests to the Government Inspector General for issuing new, reissuing, or exchanging Inspection Cards for inspectors within their respective provinces or ministries.
b) Organize the issuance of Inspection Cards, the recovery of Inspection Cards, and maintain records of the issuance of new, reissued, or exchanged Inspection Cards; recover Inspection Cards within their respective provinces or ministries.
c) Monitor and inspect the use of Inspection Cards by inspectors under the provincial or ministry inspection agencies; when discovering inspectors misusing Inspection Cards, they have the authority to temporarily recover the cards, clarify the extent of the violation, recommend appropriate measures to competent authorities, and report to the Government Inspector General.
3. Heads of Departments, Counties, Districts, Municipalities, and Cities under Provinces
a) Review, compile lists, and submit written requests to the Head of the Provincial Inspector for issuing new, reissuing, or exchanging Inspection Cards; recover Inspection Cards for inspectors under their own units.
b) Monitor and inspect the use of Inspection Cards by inspectors under their management.
4. Heads of Units under the Government Inspectorate
a) Review, compile lists, and submit written requests to the Government Inspector General for issuing new, reissuing, or exchanging Inspection Cards; recover Inspection Cards for inspectors under their own units.
b) Monitor and inspect the use of Inspection Cards by inspectors under their management.
5. Inspectors are responsible for safeguarding Inspection Cards. In cases where Inspection Cards are damaged or lost, Inspectors must report to the head of the directly managing inspection agency and apply for replacement or reissue of Inspection Cards.
Article 13. Budget for Issuing Inspection Cards
1. The budget for issuing Inspection Cards shall be provided from the State budget.
2. The Government Inspectorate shall be responsible for managing and using the budget for issuing Inspection Cards in accordance with the provisions of the law.
Chapter
IMPLEMENTING PROVISIONS
Article 14. Effective Date
1. This Circular shall take effect from June 1, 2012.
2. Abolish Circular No. 2313/2007/TT-TTCP dated October 26, 2007 of the Government Inspectorate on guidelines for the format of Inspection Cards and their management and use; previous regulations regarding the format of Inspection Cards, management, and use that conflict with this Circular.
Article 15. Responsibility for Implementation
1. Heads of state inspection agencies, Heads of units under the Government Inspectorate, and related organizations and individuals are responsible for implementing this Circular.
2. During implementation, if there are any difficulties, the Heads of units under the Government Inspectorate, Heads of Provinces' Inspectors, Heads of Inspectors of centrally governed cities, and Heads of Ministries' Inspectors should promptly report to the Government Inspectorate for review and resolution./.
