CIRCULAR
Issuing and guiding the use of forms for administrative procedures
in the field of belief and religion
Pursuant to Decree No. 92/2012/NĐ-CP dated November 8, 2012 of the Government detailing and providing implementation measures for the Ordinance on Belief and Religion dated June 18, 2004;
Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Ministry of Home Affairs issues and guides the use of forms for administrative procedures in the field of belief and religion according to the Decree detailing and providing implementation measures for the Ordinance on Belief and Religion.
Article 1. Scope of Regulation and Applicability
This Circular issues forms for administrative procedures in the field of belief and religion when implementing Decree No. 92/2012/NĐ-CP dated November 8, 2012 of the Government detailing and providing implementation measures for the Ordinance on Belief and Religion; guiding relevant agencies, organizations, and individuals in managing and using forms for administrative procedures in the field of belief and religion. 2. Issuing forms for administrative procedures in the field of belief and religion
Article 1. Issuing 45 forms for administrative procedures in the field of belief and religion attached to this Circular, including:
a) 10 forms of agencies and heads of competent state agencies marked from A1 to A10 (with appendices attached).
b) 35 forms of related organizations and individuals marked from B1 to B35 (with appendices attached).
2. Forms for administrative procedures in the field of belief and religion shall have a unified name, number, code, and size, using A4 paper (210mm x 297mm).
3. Principles of use
Article 1. In the process of conducting belief and religious activities, relevant agencies, organizations, and individuals shall uniformly use the forms for administrative procedures issued under this Circular.
2. Entries in the forms must be in Vietnamese, except for the international trade names of religious organizations (if any), without abbreviations or symbols.
3. Forms for administrative procedures of competent state agencies shall be stored in accordance with current laws on archives.
1. The Governmental Committee for Religious Affairs advises and assists the Minister of the Ministry of Home Affairs in uniformly managing and guiding the use of forms for administrative procedures in the field of belief and religion nationwide and directly performs the following tasks:
Article 4. Implementation organization
a) Building and guiding related agencies, organizations, and individuals to correctly implement forms for administrative procedures in the field of belief and religion;
b) Implementing state management tasks related to belief and religious activities concerning administrative procedures as prescribed by law and this Circular;
c) Monitoring, inspecting, urging, compiling, and reporting to the Minister of the Ministry of Home Affairs on the implementation of forms for administrative procedures in the field of belief and religion.
2. Provincial Departments of Home Affairs advise and assist provincial People's Committees in managing, guiding, and inspecting the use of forms for administrative procedures in the field of belief and religion locally. They directly organize, implement, monitor, inspect, urge, compile, and report results of the implementation of forms for administrative procedures in the field of belief and religion to the Ministry of Home Affairs (through the Governmental Committee for Religious Affairs) and provincial People's Committees.
5. Effectiveness
Article 1. This Circular takes effect from May 15, 2013.
2. During the implementation period, if there are any difficulties, the Governmental Committee for Religious Affairs, Provincial Departments of Home Affairs, and People's Committees of centrally governed cities shall report to the Ministry of Home Affairs for consideration and resolution./.
