On the basis of Decree No. 15/2008/NĐ-CP dated February 4, 2008 of the Government stipulating functions, tasks, powers and organizational structureu|||of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsu t, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP functions of the Ministry of Foreign Affairs;

On the basis of Decree No. 61/2012/NĐ-CP dated August 10, 2012 of the"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Theo đề nghị của Vụ trưởng Vụ Tín dụngof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsd) Agencies, organizations, units, and individuals related to the establishment and operation of Management Boards in public service units;

Collection into the State budget of dividends distributed in 2013 and 2014 for the portion of State capital in joint-stock companies with State capital represented by ministries, sectors, and localitiesof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs4. The list, format, and explanation of methods for preparing mandatory accounting vouchers are specified in Appendix 01 "Mandatory Accounting Voucher System" attached to this Circular. The Minister of Foreign Affairs, the Minister of Interior, the Minister of Finance and the Minister of Labor - Invalids and Social Affairs issue this Joint Circular guiding the implementation of Clause 3 Article 1 of Decree No."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."48/2012/NĐ-CP as follows:iArticle 1. Living allowance regime for spouses accompanying officials and civil servants serving terms at agencies in Vietnam abroad.No. Spouses accompanying officials and civil servants serving terms at agencies in Vietnam abroad shall enjoy the living allowance level prescribed in Clause 3 Article 1 of Decree No. 48/2012/NĐ-CP, specifically as follows:

1. Spouses of Ambassadors shall enjoy a living allowance index of 125%.

2. Spouses of Chargés d'Affaires, Deputy Chiefs of Mission, Consuls, Deputy Military Attaches, Deputy Chiefs of Mission, Consuls General, Deputy Consuls General, and Heads of Vietnamese agencies abroad not holding diplomatic positions shall enjoy a living allowance index of 110%.

3. Spouses of First Secretaries, Second Secretaries, Third Secretaries, Attachés, Consular Officers, Deputy Consular Officers, and spouses of technical staff, non-diplomatic or consular officials but enjoying a living allowance index equivalent to 80%.

4. Spouses of clerical, administrative, technical, driver, catering, cleaning, and security staff shall enjoy a living allowance index of 60%.

Article 2. Living allowance regime for spouses unable to accompany officials and civil servants serving terms at agencies in Vietnam abroad due to difficult family circumstances or difficult and dangerous areas.

1. Spouses unable to accompany officials and civil servants serving terms at agencies in Vietnam abroad due to difficult family circumstances or difficult and dangerous areas shall enjoy 50% of the living allowance level prescribed in this Joint Circular.

2. Factors for assessing difficult family circumstances or difficult and dangerous areas as mentioned in Clause 1 of this Article include:

a) Difficult family circumstances are determined based on one of the following factors:

The spouse or child is ill or suffering from a disease.

The spouse has a parent or in-law over 70 years old who is ill, suffering from a disease, or needs care.

The spouse is working at an agency or unit under the armed forces or undertaking work related to state secrets and cannot accompany officials and civil servants serving terms at agencies in Vietnam abroad.

Unable to arrange schooling for children under 18 years old.

b) Difficult and dangerous areas are determined based on one of the following factors:

War, armed conflict, or violent unrest occurs.

Political instability, insecurity. Harsh environmental conditions affecting health or serious epidemics, natural disasters threatening lives occur.

The Minister of Foreign Affairs decides the list of difficult and dangerous areas.

3. Time of enjoyment:

a) For spouses unable to accompany due to difficult family circumstances or difficult and dangerous areas: The time of enjoying the living allowance is calculated from the date when the competent ministry or sector issues a decision after the spouse has completed the required documentation as stipulated in Clause 4 of this Article.

b) For spouses currently accompanying officials and civil servants serving terms at agencies in Vietnam abroad and must return home due to difficult family circumstances: The time of enjoying the living allowance is calculated from the date when the competent ministry or sector issues a decision after the spouse has completed the required documentation as stipulated in Clause 4 of this Article.

c) For spouses currently accompanying officials and civil servants serving terms at agencies in Vietnam abroad and must return home due to difficult and dangerous areas: The time of enjoying the living allowance is calculated from the date of entry into Vietnam.

4. Application documents:

a) For cases where it is impossible to accompany due to difficult family circumstances include:

Request form for non-accompanying allowance (attached model).

Certified copy of marriage registration certificate.

In cases where parents over 70 years old need care: Must have confirmation from the agency or unit where the official or civil servant works or from the local authority.

In cases of illness or disease: Must have confirmation from a medical facility or a certified copy of the medical records from a district-level or higher medical facility.

In cases of working at an agency or unit under the armed forces or undertaking work related to state secrets: Must have confirmation from the agency or unit where the official or civil servant works.

In cases where schooling cannot be arranged for children: Must have confirmation from the school where the child is studying.

b) For cases where it is impossible to accompany due to difficult and dangerous areas include:

Request form for non-accompanying allowance.

a) Officials and civil servants serving terms at agencies in Vietnam abroad with spouses unable to accompany shall submit the application documents as prescribed in Clause 4 of this Article to the Personnel Department of the competent ministry or sector before going on duty.

b) The Personnel Department of each competent ministry or sector shall be responsible for receiving and reviewing the application documents.

In cases of illness or disease: Must have confirmation from a medical facility or a certified copy of the medical records from a district-level or higher medical facility.

5. Procedure for handling:

a) Officials and civil servants serving a term at Vietnamese agencies abroad whose spouses cannot accompany them shall submit the dossier prescribed in Clause 4 of this Article to the Personnel Department of the respective Ministry or sector主管机关之前。

b) The Personnel Departments of the respective Ministries or sectors主管机关负责接收并审查这些文件。

For spouses of officials and civil servants serving terms at Vietnamese representative agencies abroad, the Ministry of Foreign Affairs issues a decision based on the file reviewed by the competent ministry or sector.

For spouses of officials and civil servants serving terms at other Vietnamese agencies abroad, the head of the competent ministry or sector issues a decision based on the appraisal file of the Personnel Department (Division).

c) Within ten working days from the date of receiving the complete file as stipulated in Clause 4 of this Article, the competent ministry or sector of Vietnamese agencies abroad shall be responsible for issuing a decision to grant living allowances to spouses who cannot accompany according to Clause 1 of this Article. In cases where it is determined that the conditions for granting living allowances as stipulated in Clause 1 of this Article are not met, the competent ministry or sector of Vietnamese agencies abroad shall be responsible for responding to the spouses in writing.

Article 3. Source of funds.

The source of funds for implementing the living allowance system, various supplementary allowances, subsidies, spouse systems, and certain other systems for officials and civil servants serving terms at Vietnamese agencies abroad shall be allocated within the annual state budget estimate of the competent agency to be distributed to Vietnamese agencies abroad in accordance with the State Budget Law and guiding documents for the implementation of the State Budget Law.

Article 4. Implementation.

1. This Circular takes effect from June 22, 2013.

2. The systems prescribed in this Circular shall be applied from August 1, 2012.

3. Repeal the following documents:

a) Joint Circular No. 02/2007/TTLT-BNG-BNV-BTC-BLDTBXH dated October 30, 2007 of the Ministry of Foreign Affairs, the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of Decree No. 131/2007/NĐ-CP dated August 6, 2007 of the Government amending and supplementing Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government on certain systems for officials and civil servants serving terms at Vietnamese agencies abroad.

b) Table V - Appendix II of Joint Circular No. 29/2006/TTLT-BNG-BNV-BTC-BLDTBXH dated November 8, 2006 of the Ministry of Foreign Affairs, the Ministry of Home Affairs, the Ministry of Finance, and the Ministry of Labor, Invalids, and Social Affairs (guiding the content of living allowances for spouses as stipulated in Clause 2, Article 9 of Decree No. 157/2005/NĐ-CP).

4. Competent ministries and sectors managing Vietnamese agencies abroad shall be responsible for guiding and directing units under their management to implement this Joint Circular.

5. During the implementation process, if there are any difficulties, please reflect them to the relevant ministries for consideration and resolution.
