Chapter I

GENERAL PROVISIONS

Article 1. Scope and Objects Regulated

||| This Circular stipulates the principles, recipients, criteria, procedures, and formalities for awarding Commemorative Medals to individuals who have made significant contributions to the sectors and fields under the management authority of the Ministry of Home Affairs.

Article 2. Types of Commemorative Plaques in fields under the management authority of the Ministry of Home Affairs

1. ||| Commemorative Medal "For the Cause of State Organization";

2. ||| Commemorative Medal "For the Cause of Competition and Rewards";

3. ||| Commemorative Medal "For the Cause of State Management of Religion";

||| Commemorative Medal "For the Cause of Archival Work".

Article 3. Principles for awarding the Commemorative Medal

1. ||| A Commemorative Medal shall be awarded only once to an individual, with no posthumous awards.

2. ||| Each individual may only be awarded one type of Commemorative Medal according to their field of work.

3. ||| Special cases shall be decided by the Competition and Rewards Council of the sector or field upon submission to the Minister of Home Affairs.

4. ||| The awarding of Commemorative Medals shall be carried out strictly in accordance with the recipients, criteria, procedures, and formalities for awarding and presenting Commemorative Medals as prescribed in this Circular, ensuring fairness, democracy, transparency, and timeliness.

5. ||| Annually, the Ministry of Home Affairs will consider awarding Commemorative Medals to honor individuals on the occasion of traditional days of the sectors and to award them exceptionally in special cases.development |||

||| Article 4. Funding for rewarding Commemorative Medals

1. ||| The funding for rewarding the Commemorative Medal "For the Cause of State Organization" shall be allocated from the Competition and Rewards Fund of the Ministry of Home Affairs.

2. ||| The funding for rewarding the Commemorative Medal "For the Cause of Competition and Rewards" shall be allocated from the Competition and Rewards Fund of the Central Competition and Rewards Board.

3. ||| The funding for rewarding the Commemorative Medal "For the Cause of State Management of Religion" shall be allocated from the Competition and Rewards Fund of the Government Religious Board.

4. ||| The funding for rewarding the Commemorative Medal "For the Cause of Archival Work" shall be allocated from the Competition and Rewards Fund of the National Archives and Records Administration.

||| Article 5. Rights and responsibilities of individuals receiving Commemorative Medals

1. ||| Individuals awarded Commemorative Medals by the Ministry of Home Affairs shall receive Certificates, Commemorative Medals corresponding to their field of work, and monetary rewards as stipulated.

2. ||| Individuals receiving Commemorative Medals shall have the responsibility to continue preserving and promoting the traditions of the Ministry of Home Affairs, setting a good example in implementing the policies and laws of the Party and the State.

Chapter II

||| RECIPIENTS, CRITERIA AND CONDITIONS FOR AWARDING COMMENDATION MEDALS

Article 6. Recipients of Commendation Medal

1. ||| Individuals working in the fields of State Organization, Competition and Rewards, State Management of Religion, and Archival Work:

a) ||| Commemorative Medal "For the Cause of State Organization":

||| Civil servants, public officials, employees, and workers employed in agencies, units, and organizations under the Ministry of Home Affairs including functional departments, the Office of the Ministry, the Inspectorate, and direct service units supporting state management activities of the Ministry.

||| Civil servants in Personnel Departments of central ministries, agencies, and mass organizations.

||| Public officials, civil servants, and employees working in the field of State Organization at Provincial Home Affairs Departments.

||| Public officials, civil servants, and employees working in the field of State Organization at District Home Affairs Departments.

b) ||| Commemorative Medal "For the Cause of Competition and Rewards":

||| Leaders of the Order Institute, the Central Competition Board, the National Institute of Competition and Rewards, the Central Competition and Rewards Board; members of the National Movement for Competition and Rewards and the Central Competition and Rewards Council.

||| Civil servants, public officials, employees, officers, and reserve personnel engaged in competition and rewards work under the Central Competition and Rewards Board; Competition and Rewards Departments (Bureaus, Offices) under central ministries, agencies, and mass organizations; political organizations, political-social organizations; state-owned corporations and economic groups established by the Prime Minister's decision; Competition and Rewards Boards at provincial level administrative bodies and district-level People's Committees; and commune-level People's Committees.

c) ||| Commemorative Medal "For the Cause of State Management of Religion":

||| Individuals engaged in religious work at Party and State agencies, ministries, departments, and political-social organizations from central to local levels..

d) ||| Commemorative Medal "For the Cause of Archival Work":

||| Public officials, civil servants, and employees working in units under the National Archives and Records Administration; individuals engaged in archival work in state agencies, political organizations, political-social organizations, social organizations, occupational social organizations, economic organizations, and people's armed forces units.

2. ||| Leaders of the Party and State; leaders of central ministries, departments, and mass organizations; leaders of provinces and centrally-administered cities; leaders of state-owned corporations and economic groups established by the Prime Minister's decision; leaders of districts and towns within provinces who have made significant contributions to the common cause of the Ministry of Home Affairs or in one of the following fields: State Organization; Competition and Rewards; State Management of Religion; Archival Work. development |||

3. ||| Foreign individuals or overseas Vietnamese who have contributed to building and consolidating comprehensive friendly relations with the Ministry of Home Affairs or in one of the following fields: State Organization; Competition and Rewards; State Management of Religion; Archival Work.

Article 7. Criteria and Conditions for Awarding Commendation Medals

1. For individuals falling under the subject defined in Clause 1, Article 6 who have worked for at least 15 years up to the time of review (for the field of Commendation and Reward, full-time staff must have worked for at least 15 years and part-time staff for at least 20 years), and have satisfactorily completed their annual tasks. In cases where they were sent to study their major or perform military service, and then reassigned to continue working, the time spent studying and performing military service shall be counted as working time within the sector. This period will be accumulated even if the work was not continuous.

2. For individuals falling under the subjects defined in Clause 2 and Clause 3, Article 6, one of the following conditions must be met:

a) Achievements in leadership and direction contributing to the construction and development of sectors or fields under the Ministry of Home Affairs' jurisdiction.

b) Proposing useful initiatives, solutions, scientific research projects, or applications of technological advancements that contribute to promoting and developing sectors or fields under the Ministry of Home Affairs' jurisdiction.

c) Outstanding achievements in consolidating international cooperation, actively contributing to the construction and development of sectors or fields under the Ministry of Home Affairs' jurisdiction.nationalIndividuals currently under disciplinary review or those involved in criminal cases without a conclusion from competent state agencies.

Article 8. Subjects Not Eligible for Consideration for Commendation Medals

1. Individuals undergoing one of the disciplinary measures (excluding dismissal from employment). The time served under disciplinary measures will not be counted towards working time for the purpose of awarding the Commemorative Medal.

2. Individuals who have been dismissed from employment; those being pursued for criminal responsibility or sentenced to imprisonment.

Article 9. Subjects Not Eligible for Awarding Commendation Medals

Individuals falling under Clause 1, Article 6 are prioritized for the awarding of the Commemorative Medal as follows:

Article 10. Cases Eligible for Priority Consideration for Commendation Medals

Individuals awarded the title "Heroic Forces", "Labor Hero", Gold Star Order, Ho Chi Minh Order, Independence Order (all levels) are proposed for the award immediately upon receiving the commendation decision.

1. Individuals awarded the Ho Chi Minh Prize, State Prize; National Model Worker title; Orders (except those mentioned in Clause 1 of this Article) are proposed for the award five years earlier than the time specified in Clause 1, Article 7.

2. Individuals awarded a Prime Minister's Merit Award or the Model Worker title at the central ministry, agency, or provincial level are proposed for the award three years earlier than the time specified in Clause 1, Article 7.

3. PROCEDURES AND DOCUMENTS FOR AWARDS AND PRESENTATION OF THE COMMEMORATIVE MEDALỹ Article 11. Procedures for awarding the Commemorative Medal

Chapter III

Commemorative Medal "For the Cause of Civil Service Organization"

The Cadre and Civil Servant Department of the Ministry of Home Affairs prepares files for individuals meeting the criteria from functional departments, the Ministry's Office, the Inspectorate, and direct service units serving state management functions of the Ministry of Home Affairs, reports to the Ministry of Home Affairs' Commendation and Reward Council for review, and sends it to the Standing Committee of the Ministry of Home Affairs' Commendation and Reward Council before June 30 each year.

1. The Cadre and Civil Servant Departments of ministries, agencies equivalent to ministries, government agencies, Provincial Home Affairs Departments of centrally governed cities and provinces are responsible for receiving nomination requests for the awarding of the Commemorative Medal from individuals under their management; civil servants working in the Civil Service Organization field at Provincial Home Affairs Departments of centrally governed cities and provinces; Civil Service Departments of districts, counties, and centrally governed cities within provinces; and individuals under Clause 2 and Clause 3, Article 6 of this Circular; checking against the criteria, compiling lists, reporting to the Commendation and Reward Council and the same-level leadership for review, and sending them to the Ministry of Home Affairs before June 30 each year.

a) Commemorative Medal "For the Cause of Commendation and Reward"

b) For individuals defined in Point b, Clause 1, Clause 2, Clause 3, Article 6: Commendation and Reward Departments of central ministries, agencies, and organizations; State-owned Economic Groups and Corporations established by the Prime Minister's Decision; Provincial Home Affairs Departments (Commendation and Reward Boards) of centrally governed cities and provinces receive files from units, compare with the criteria, compile lists, report to the Commendation and Reward Council and the same-level leadership for review, and send them to the Central Commendation and Reward Board before April 10 each year.policiesThe Central Commendation and Reward Board compiles and reviews the nomination files for the awarding of the Commemorative Medal, and sends them to the Ministry of Home Affairs before May 10 each year.

2. Commemorative Medal "For the Cause of Religious Administration"

a) For individuals defined in Point c, Clause 1, Clause 2, Clause 3, Article 6: Commendation and Reward Departments of central ministries, agencies, and organizations; the Cadre and Civil Servant Department, the Governmental Religious Affairs Bureau; Provincial Home Affairs Departments (Religious Affairs Boards) of centrally governed cities and provinces receive files from individuals and units, compare with the criteria, compile lists, submit to the Commendation and Reward Council and the same-level leadership for review, and send nomination files for the awarding of the Commemorative Medal to the Governmental Religious Affairs Bureau before May 30 each year.

b) The Governmental Religious Affairs Bureau compiles and reviews the nomination files for the awarding of the Commemorative Medal, and sends them to the Ministry of Home Affairs before June 30 each year.

3. Commemorative Medal "For the Cause of Archiving and Record Management"

a) For individuals defined in Point d, Clause 1, Clause 2, Clause 3, Article 6:onOffices of central ministries, agencies, and organizations; Provincial Home Affairs Departments (Archiving and Record Management Agencies) of centrally governed cities and provinces receive nomination requests for the awarding of the Commemorative Medal from individuals under their management, check against the criteria, prepare files for individuals meeting the criteria, report to the Commendation and Reward Council and the same-level leadership for review, and send them to the National Archives and Records Management Agency before July 1 each year.

b) The National Archives and Records Management Agency compiles and reviews the nomination files for the awarding of the Commemorative Medal, and sends them to the Ministry of Home Affairs before August 1 each year.

4. Medal "For the Archives and Records Cause"

a) For individuals specified in Point d Clause 1, Clause 2, Clause 3 Article 6:

The offices of ministries, sectors, central agencies of organizations and mass associations, and Provincial Departments of Home Affairs (Archives and Records Management Agencies) shall receive applications for the awarding of the Medal from individuals under their jurisdiction, verify against the prescribed criteria, prepare files for eligible individuals, report to the Awards Council for review by the same-level leadership, and submit to the National Archives and Records Administration before July 1 annually.đượThe National Archives and Records Administration shall compile and review the application files for the awarding of the Medal, and submit them to the Ministry of Home Affairs before August 1 annually.

b) During implementation, if there are any difficulties, the relevant agencies, units, and individuals are requested to promptly reflect these issues to the Ministry of Home Affairs for study and appropriate amendments.

5. The Department of Competition and Awards, Office of the Ministry of Home Affairs receives and examines the proposal dossier submitted by the Department of Cadre and Civil Servant Organization, Ministry of Home Affairs; the Central Steering Committee for Competition and Awards; the Government Religious Affairs Board; the State Archives and Records Management Agency; the Departments (Boards) of Cadre and Civil Servant Organization of ministries, ministerial-level agencies, and government agencies; the Provincial Home Affairs Departments under central cities and provinces, and reports to the Standing Committee of the Competition and Awards Council of the Ministry of Home Affairs for consideration and submission to the Minister of Home Affairs for decision.

Article 12. Documents for Proposing to Award Commemorative Medals

1. The dossier for proposing the awarding of Commendation Medals consists of one set as follows:

a) A proposal letter from the unit (in accordance with Form I in the Appendix);

b) A list of proposed recipients of Commendation Medals (in accordance with Forms II, III, and IV in the Appendix).

c) A summary report on achievements during the working period for individuals in the sector (in accordance with Form V in the Appendix).

d) In cases eligible for priority consideration for awarding as specified in Article 10 of this Circular, copies of the Award Decisions and Certificates of Recognition must be attached.

2. The summary report on achievements (Appendix V) is retained at the proposing unit: the Department of Cadre and Civil Servant Organization (for dossiers of units under the Ministry of Home Affairs), Vthe Office of the Ministry (for dossiers of central ministries, sectors, mass organizations, and provinces and centrally-administered cities);No. the Central Steering Committee for Competition and Awards; the Government Religious Affairs Board; the State Archives and Records Management Agency.

Article 13. Organization of Commemorative Medal Presentation

1. The presentation ceremony for Commendation Medals shall be organized on the occasion of the traditional anniversary days of the sectors: State Administration (August 28); Patriotic Competition (June 11); State Management of Religion (August 2); and Archival Affairs (January 3).

2. The agency or organization proposing the awarding of Commendation Medals is responsible for organizing the presentation ceremony for the individuals in accordance with current regulations.

Chapter IV

IMPLEMENTATION

This Circular takes effect 45 days from the date of issuance; it abolishes Decision No. 32/2002/QĐ-BTCCBCP dated July 1, 2002, issued by the Head of the Government Cadre and Civil Servant Organization Board (now the Ministry of Home Affairs) regarding the issuance of Commendation Medals and Regulations on the awarding of Commendation Medals "For the Cause of the Cadre and Civil Servant Sector", Circular No. 06/2009/TT-BNV dated May 27, 2009, issued by the Minister of Home Affairs guiding the awarding of Commendation Medals "For the Cause of the Competition and Awards Sector", Circular No. 07/2011/TT-BNV dated April 1, 2011, issued by the Minister of Home Affairs guiding the awarding of Commendation Medals "For the Cause of the State Management of Religion Sector", and Decision No. 04/2007/QĐ-BNV dated April 4, 2007, issued by the Minister of Home Affairs issuing Commendation Medals and Regulations on the awarding of Commendation Medals "For the Cause of Archival and Records Management". 3. During the implementation process, if there are any difficulties, they are requested to promptly reflect them to the Ministry of Home Affairs for research and appropriate amendments.
