CIRCULAR

Guidelines on business operations to perform functions, tasks, and authorities

of legal institutions

Pursuant to the Ordinance on Consolidation of Legal Normative Documents in 2012;

Pursuant to Decree No. 55/2011/NĐ-CP dated July 4, 2011 of the Government stipulating the functions, tasks, powers, and organizational structure of legal affairs bodies;

Pursuant to Decree No. 48/2013/NĐ-CP dated May 14, 2013 of the Government amending and supplementing certain articles related to administrative procedure controlto amend and supplement some articles of the N |||Decision related to administrative procedure control;

Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Justice;

At the proposal of the Department Director of General Issues on Law Building,

The Minister of Justice issues this Circular guiding business operations to perform functions, tasks, and authorities of legal institutions.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides business operations to perform functions, tasks, and authorities of legal institutions.

Article 2. Applicability

1. Legal institutions at Ministries and agencies equivalent to Ministries;

2. Legal institutions at agencies under the Government;

3. Legal institutions at General Departments and equivalents, Bureaus under Ministries and agencies equivalent to Ministries;

4. Legal institutions at specialized agencies under Provincial People's Committees and Municipal People's Committees directly under the Central Government (hereinafter referred to collectively as Provincial People's Committees).

Chapter II

BUSINESS OPERATIONS IN LEGISLATIVE WORK

Article 3. Legal institutions at Ministries and agencies equivalent to Ministries

1. Proposing, planning, and organizing the implementation of legislative programs for laws and ordinances of the National Assembly; legislative programs for decrees of the Government

a) Proposing and guiding, urging relevant units to prepare proposals for building laws, ordinances, and decrees within the scope of management of Ministries and agencies equivalent to Ministries;

b) Taking the lead and coordinating with relevant units to establish proposals for building laws and ordinances; proposals for building decrees within the scope of management of Ministries and agencies equivalent to Ministries. During the process of establishing proposals for building laws and ordinances; proposals for building decrees, if there are differing opinions, the legal institution may seek the opinion of the Minister or the Head of the agency equivalent to a Ministry, or propose that the Minister or the Head of the agency equivalent to a Ministry convene a meeting with relevant agencies and units with the participation of representatives from the Ministry of Justice, the Government Office, the Ministry of Finance, and the Ministry of Home Affairs to reach a consensus on proposals for building laws, ordinances, and decrees;

c) Taking the lead and coordinating with relevant units to prepare files for proposals for building laws and ordinances to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Ministry of Finance and the Ministry of Home Affairs for comments on the rationality of the proposed financial and human resources (if applicable);

d) Taking the lead and coordinating with relevant units to revise and perfect files for proposals for building laws and ordinances to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Ministry of Justice to draft plans for building laws and ordinances; files for proposals for building decrees to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Government Office and the Ministry of Justice to draft plans for building Government decrees;

đ) Taking the lead in drafting plans for implementing legislative programs for laws and ordinances, legislative programs for Government decrees, and organizing the implementation of these plans after approval;

e) Taking the lead and coordinating with relevant units to draft proposals for adjusting and supplementing legislative programs for laws and ordinances to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Ministry of Justice; drafting proposals for adjusting and supplementing legislative programs for Government decrees to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Government Office and the Ministry of Justice;

g) Taking the lead in drafting reports on the implementation of legislative programs for laws and ordinances, legislative programs for Government decrees to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry, then submitted to the Ministry of Justice and the Government Office.

2. Drafting plans and organizing the implementation of legislative programs for normative legal documents within the authority to issue of Ministries and agencies equivalent to Ministries

a) Guiding and urging relevant units to draft plans for building normative legal documents within the authority to issue of Ministries and agencies equivalent to Ministries;

b) Taking the lead and coordinating with relevant units to draft long-term and annual plans for building normative legal documents of Ministries and agencies equivalent to Ministries to be reviewed and approved by the Minister or the Head of the agency equivalent to a Ministry, then organizing the implementation of these plans after approval;

c) Taking the lead and coordinating with relevant units to draft proposals for adjusting and supplementing long-term and annual plans for building normative legal documents of Ministries and agencies equivalent to Ministries to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry;

d) Guiding, monitoring, urging, and inspecting the implementation of legislative programs and plans of Ministries and agencies equivalent to Ministries, and periodically reporting to the Minister or the Head of the agency equivalent to a Ministry.

3. Building and drafting normative legal documents

a) Drafting plans and organizing the drafting of projects and drafts of normative legal documents assigned to be primarily drafted. In cases where normative legal documents contain provisions on administrative procedures or gender equality issues, impact assessments on administrative procedures and gender equality issues must be organized;

b) Participating in the drafting of projects and drafts of normative legal documents according to the assignment of the Minister or the Head of the agency equivalent to a Ministry or at the request of the primary drafting agency;

c) Guiding, monitoring, urging, and inspecting the implementation of plans for drafting projects and drafts of normative legal documents by units under Ministries and agencies equivalent to Ministries that are primarily responsible for drafting.

4. Preparing files and reviewing projects and drafts of normative legal documents

a) Leading or coordinating with the primary drafting unit to prepare files for projects and drafts of normative legal documents to be reviewed and decided by the Minister or the Head of the agency equivalent to a Ministry regarding the organization of soliciting opinions from agencies, organizations, and individuals; organizing reviews within the authority or sending to the Ministry of Justice for review.

b) Guide, monitor, urge, and inspect agencies and units responsible for drafting in the preparation of project files and draft regulatory legal documents, including an Administrative Procedure Assessment Report and a Gender Equality Issue Report if the project or draft regulatory legal document contains provisions on administrative procedures and gender equality issues;

c) Review projects and draft regulatory legal documents prepared by units under the Ministry, equivalent ministries, or government agencies operating within the scope of the Ministry's or equivalent ministry's management, which have been assigned by the Minister or head of an equivalent ministry to be primarily responsible for drafting;

d) Lead or coordinate with units under the Ministry, equivalent ministries, and government agencies to revise, supplement, and perfect project files and draft regulatory legal documents to be submitted to the Minister or head of an equivalent ministry for consideration and decision before submission to the Ministry of Justice for review;

đ) Lead or coordinate with units under the Ministry, equivalent ministries, and government agencies to submit project files and draft regulatory legal documents to the Minister or head of an equivalent ministry for consideration and decision prior to submission to the Government;

5. Provide comments on projects and draft regulatory legal documents;

a) Lead or coordinate with relevant units to assist the Minister or head of an equivalent ministry in providing comments on projects and draft regulatory legal documents sent by other agencies or organizations for their opinions, including opinions on administrative procedures and gender equality issues if the project or draft regulatory legal document contains provisions on administrative procedures and gender equality issues;

b) Provide comments on projects and draft regulatory legal documents prepared by units under the Ministry, equivalent ministries, or government agencies operating within the scope of the Ministry's or equivalent ministry's management, which have been assigned by the Minister or head of an equivalent ministry to be primarily responsible for drafting, including comments on administrative procedures and gender equality issues if the project or draft regulatory legal document contains provisions on administrative procedures and gender equality issues;

6. Negotiate, sign, accede to, and implement international treaties and agreements within the scope of the Ministry's or equivalent ministry's management;

a) Lead or coordinate with relevant units to develop and implement long-term and annual plans on negotiating, signing, acceding to, and implementing international treaties and agreements to be submitted to the Ministry of Foreign Affairs for consolidation;

b) Lead or coordinate with relevant units to participate in drafting, negotiating, and providing comments on draft international treaties and agreements;

c) Lead or coordinate with relevant units to prepare files for submission, report negotiations, and sign international treaties and agreements;

d) Lead or coordinate with relevant units to develop implementation timelines and specific measures for international treaties and agreements;

đ) Lead or coordinate with relevant units to conduct reviews and inspections of regulatory legal documents and propose recommendations to competent authorities to amend, supplement, abolish, or promulgate regulatory legal documents to implement international treaties and agreements in accordance with the law;

e) Lead or coordinate with relevant units to propose to the Minister or head of an equivalent ministry for consideration and recommend necessary measures to competent authorities to protect the rights and interests of the State in cases where international treaties or agreements proposed for signature or accession by the Ministry or equivalent ministry are violated;

g) Lead or coordinate with relevant units to develop reports on the situation of negotiating, signing, acceding to, and implementing international treaties and agreements to be submitted to the Minister or head of an equivalent ministry for consideration and decision before submission to the Ministry of Foreign Affairs for consolidation.

Article 4. Legal Affairs Organization at Government Agencies

Shall take the lead or coordinate with relevant units to assist the head of the Government agency in performing the tasks prescribed in Article 3 of this Circular, except for the tasks prescribed in points b and c, Clause 4, Article 3.

Article 5. Legal Affairs Organization at General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies

1. Propose, draft, and organize the implementation of programs and plans for drafting normative legal documents

a) Propose and guide, urge relevant units to prepare proposals for drafting normative legal documents within the scope of specialized state management of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies;

b) Take the lead, coordinate with relevant units to draft proposals for drafting normative legal documents within the scope of specialized state management to be submitted to the General Department Director, Bureau Chief for consideration and decision to send to the Legal Affairs Department of the Ministry, Equivalent Agency for examination and consolidation;

c) Coordinate with the Legal Affairs Department of the Ministry, Equivalent Agency in drafting proposals for annual programs, adjustments, and supplements to plans for drafting normative legal documents of the Ministry, Equivalent Agency;

d) Guide, monitor, urge, and inspect relevant units of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies in implementing plans and programs for drafting normative legal documents;

đ) Take the lead, coordinate with relevant units of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies to build reports on the situation and progress of implementing annual programs and plans for drafting normative legal documents within the scope of specialized state management of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies to be submitted to the General Department Director, Bureau Chief for consideration and decision to send to the Legal Affairs Department of the Ministry, Equivalent Agency for consolidation.

2. Drafting normative legal documents

a) Take the lead, coordinate with relevant units to draft normative legal documents within the scope of specialized state management according to the assignment of the General Department Director, Bureau Chief. In cases where the draft normative legal document includes provisions on administrative procedures and gender equality issues, impact assessments on administrative procedures and gender equality issues must be organized;

b) Participate in the process of drafting normative legal documents by units of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies or other agencies and units according to the assignment of the General Department Director, Bureau Chief;

c) Guide, monitor, urge, and inspect the situation of drafting normative legal documents by units of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies according to the assignment of the General Department Director, Bureau Chief.

3. Prepare files and review draft normative legal documents

a) Take the lead or coordinate with the main drafting unit to prepare files for draft normative legal documents to be submitted to the General Department Director, Bureau Chief for consideration and decision on organizing opinions from agencies, organizations, individuals, and proposing the Legal Affairs Department of the Ministry, Equivalent Agency to organize reviews or propose the Legal Affairs Department of the Ministry, Equivalent Agency to send to the Ministry of Justice for review;

b) Take the lead or coordinate with the main drafting unit to revise, supplement, and complete review files for draft normative legal documents according to the recommendations of the reviewing agency.

4. Provide comments on draft normative legal documents

a) Take the lead or coordinate with relevant units of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies to participate in providing comments on draft normative legal documents sent by other agencies and units for comments according to the assignment of the General Department Director, Bureau Chief, including comments on administrative procedures and gender equality issues if the draft normative legal document includes provisions on administrative procedures and gender equality issues;

b) Provide comments on draft normative legal documents sent by units under General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies for comments, including comments on administrative procedures and gender equality issues if the draft normative legal document includes provisions on administrative procedures and gender equality issues.

Article 6. Legal Affairs Organization at Specialized Agencies under the People's Committee at the Provincial Level

1. Proposing, planning, and organizing the implementation of programs and plans to draft regulatory legal documents

a) Proposing and guiding, urging relevant units to propose the drafting of regulatory legal documents of the Provincial People's Council and the Provincial People's Committee within their respective fields of state management at the local level;

b) Taking the lead and coordinating with relevant units to assist the head of the agency in proposing the drafting of regulatory legal documents of the Provincial People's Council and the Provincial People's Committee within their respective fields of state management at the local level;

c) Taking the lead and coordinating with relevant units to assist the head of the agency in soliciting opinions on the proposal to draft regulatory legal documents of the Provincial People's Council and the Provincial People's Committee;

d) Taking the lead and coordinating with relevant units to revise and perfect the dossier for proposing the drafting of regulatory legal documents to be submitted to the head of the agency for review and decision, then sent to the Office of the Provincial People's Committee for consolidation and planning of the program to draft regulatory legal documents of the Provincial People's Council and the Provincial People's Committee;

đ) Taking the lead and coordinating with relevant units to assist the head of the agency in coordinating with the Office of the Provincial People's Committee and the Department of Justice in planning and implementing the program to draft regulatory legal documents of the Provincial People's Council and the Provincial People's Committee;

e) Guiding, monitoring, urging, and inspecting subordinate units within specialized agencies in implementing the program and plan to draft regulatory legal documents of the Provincial People's Council and the Provincial People's Committee, ensuring progress and quality of draft regulatory legal documents;

g) Taking the lead and coordinating with relevant units to propose adjustments and supplements to the program for drafting regulatory legal documents of the Provincial People's Council and the Provincial People's Committee to be submitted to the head of the agency for review and decision, then sent to the Office of the Provincial People's Committee for consolidation;

h) Taking the lead and coordinating with relevant units to prepare reports on the situation and progress of implementing the program to draft regulatory legal documents of the Provincial People's Council and the Provincial People's Committee, and issues arising during the drafting of regulatory legal documents to be submitted to the head of the agency for review and decision, then sent to the Standing Body of the Provincial People's Council, the Office of the Provincial People's Committee, and the Department of Justice;

2. Drafting Regulatory Legal Documents

a) Preparing plans and organizing research and drafting of draft regulatory legal documents according to the division of labor by the head of the agency. In cases where draft regulatory legal documents contain provisions on administrative procedures and gender equality issues, impact assessments on administrative procedures and gender equality issues must be organized;

b) Participating in the drafting process of regulatory legal documents according to the division of labor by the head of the agency based on proposals from the main drafting agencies;

c) Guiding, monitoring, inspecting, and urging the drafting of regulatory legal documents by subordinate units within specialized agencies of the Provincial People's Committee;

3. Preparing Dossiers for Draft Regulatory Legal Documents

a) Leading or coordinating with relevant units to prepare dossiers for draft regulatory legal documents to be submitted to the head of the agency for review and decision regarding requests for opinions from agencies, organizations, individuals, or requests for the Department of Justice to review;

b) Leading or coordinating with relevant units to revise, supplement, and complete dossiers for reviewing draft regulatory legal documents according to the Department of Justice's request;

4. Providing Comments on Draft Regulatory Legal Documents

a) Leading or coordinating with relevant units, as assigned, to assist the head of the agency in providing comments on draft regulatory legal documents prepared by other agencies and units for solicitation of opinions, including comments on administrative procedures and gender equality issues if the draft regulatory legal documents contain provisions on administrative procedures and gender equality issues;

b) Providing comments on draft regulatory legal documents prepared by units within specialized agencies under the Provincial People's Committee, including comments on administrative procedures and gender equality issues if the draft regulatory legal documents contain provisions on administrative procedures and gender equality issues;

5. Negotiating and Implementing International Agreements at the Local Level Within the Scope of State Management Fields at the Local Level According to the Division of Labor by the Head of the Agency

a) Participating in negotiations and drafting comments on international agreement drafts within the scope of state management fields at the local level according to the division of labor by the head of the agency;

b) Coordinating to participate in organizing the implementation of international agreements within the assigned tasks and authority;

c) Carrying out other international agreement-related work according to the division of labor by the head of the agency and as stipulated by law;

Chapter III

ADMINISTRATIVE PROCEDURE CONTROL TASKS

Article 7. Legal Affairs Organization at Ministries and Equivalent Agencies

1. Take the lead and coordinate with relevant units to develop and submit to the Minister, Head of Equivalent Agency for approval the annual plan on administrative procedure control of the Ministry, Equivalent Agency, and organize its implementation after approval.

2. Advise and assist the Minister, Head of Equivalent Agency in guiding, training, monitoring, urging, and inspecting the implementation of administrative procedure control tasks within the scope of the Ministry's, Equivalent Agency's management sector.

3. Control regulations on administrative procedures and the implementation of administrative procedures

a) Participate in providing opinions and reviewing regulations on administrative procedures for draft normative legal documents under the authority of the Minister, Head of Equivalent Agency to issue;

b) Lead in guiding the assessment of impact and calculation of compliance costs for administrative procedures according to the provisions of the law; inspect units under the Ministry, Equivalent Agency assigned to lead in drafting normative legal documents to implement the assessment of impact and calculation of compliance costs for administrative procedures;

c) Conduct independent impact assessments of administrative procedures for draft normative legal documents;

d) Urge units under the Ministry, Equivalent Agency to implement statistics on newly issued administrative procedures, amended, supplemented, or replaced administrative procedures, and abolished administrative procedures within the scope of the Ministry's, Equivalent Agency's management sector, and submit to the Minister, Head of Equivalent Agency for announcement;

đ) Urge and guide units under the Ministry, Equivalent Agency to implement public posting and handling of administrative procedures for individuals and organizations;

e) Control the quality and enter data on administrative procedures and related documents that have been announced into the national database on administrative procedures.

4. Review and evaluate administrative procedures

a) Take the lead and coordinate with relevant units to develop and submit to the Minister, Head of Equivalent Agency for issuance and organization of implementation plans for reviewing and evaluating administrative procedures within the scope of the Ministry's, Equivalent Agency's management sector; examine, evaluate, and propose solutions for amending, supplementing, replacing, abolishing, or revoking administrative procedures and related regulations within the scope of the Ministry's, Equivalent Agency's management sector;

b) Monitor, urge, and inspect units under the Ministry, Equivalent Agency to implement decisions of the Minister, Head of Equivalent Agency approving solutions, amendments, supplements, replacements, abolitions, or revocations of administrative procedures and related regulations within the scope of the Ministry's, Equivalent Agency's management sector.

5. Take the lead and coordinate with relevant units to periodically build reports every six months or as required about the situation and results of administrative procedure control activities and handling of reflections and suggestions on administrative regulations of the Ministry, Equivalent Agency, and submit to the Minister, Head of Equivalent Agency for consideration and decision to send to the Ministry of Justice for consolidation.

6. Receive and process reflections and suggestions from individuals and organizations regarding administrative regulations

a) Assist the Minister, Head of Equivalent Agency in receiving, studying, and proposing assignments to handle reflections and suggestions from individuals and organizations regarding administrative regulations within the scope of the Ministry's, Equivalent Agency's management sector;

b) Assist the Minister, Head of Equivalent Agency in urging the handling of reflections and suggestions from individuals and organizations regarding administrative regulations within the scope of the Ministry's, Equivalent Agency's management sector;

c) Take the lead and coordinate with relevant units to maintain the operation of the electronic database system for receiving and processing reflections and suggestions from individuals and organizations regarding administrative regulations and the situation and results of handling administrative procedures within the scope of the Ministry's, Equivalent Agency's management sector.

Article 8. Legal Affairs Organization at Government Agencies

Shall take the lead and coordinate with relevant units to assist the Heads of Government Agencies in coordinating with the Legal Affairs Department under the Ministry or equivalent agency managing the sector to implement tasks related to administrative procedure control within the scope of management of Government Agencies as stipulated in Article 7 of this Circular.

Article 9. Legal Affairs Organization at General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies

1. Advise the General Department Director, Department Director on directing and managing activities related to administrative procedure control within the specialized field of state management of General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies; at the same time, coordinate with units under General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies to organize and implement administrative procedure control tasks.

2. Shall take the lead and coordinate with the Legal Affairs Department of the Ministry or Equivalent Agency to organize training and disseminate documents and materials related to administrative procedure control within the specialized field of state management of General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies.

3. Shall take the lead and coordinate with the Legal Affairs Department of the Ministry or Equivalent Agency to guide units under General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies in implementing administrative procedure control and receiving, processing complaints and suggestions from individuals and organizations regarding administrative regulations within the specialized field of state management of General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies.

4. Coordinate with units under General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies to organize implementation of administrative procedure control tasks according to the division of labor by the General Department Director, Department Director.

5. Monitor and urge units and civil servants under General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies to fulfill administrative procedure control tasks and receive, process complaints and suggestions from individuals and organizations to ensure timely and quality completion.

6. Shall take the lead and coordinate with relevant units to build a six-month report or as required about the situation and results of administrative procedure control activities and the receipt and processing of complaints and suggestions regarding administrative regulations within the specialized field of state management of General Departments and Equivalent Agencies, Departments under Ministries and Equivalent Agencies for review and decision by the General Department Director, Department Director, then submit to the Minister, Head of Equivalent Agency.

Article 10. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in building annual programs and plans on administrative procedure control work within the scope of state management in the locality and organizing their implementation after approval.

2. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice to implement administrative procedure control within the scope of state management in the locality.

3. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in handling complaints and suggestions from individuals and organizations regarding administrative regulations within the scope of state management in the locality.

4. Shall take the lead and coordinate with relevant units to coordinate with the Department of Justice to monitor the quality and entry of administrative procedures and related documents that have been published into the national database on administrative procedures.

5. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in building a six-month report or as required about the situation and results of administrative procedure control and the receipt and processing of complaints and suggestions regarding administrative regulations within the scope of state management in the locality for submission to the Department of Justice for consolidation and reporting to the Provincial People's Committee.

Chapter IV

DUTIES IN THE WORK OF REVIEWING, SYSTEMATIZING, CONSOLIDATING LEGAL REGULATIONS AND LEGISLATIVE SYSTEMS OF LEGAL REGULATIONS

Article 11. Legal System Organization at Ministries and Ministries-equivalent Agencies

1. Reviewing and Systematizing Regulatory Legal Documents

a) Take the lead and coordinate with relevant units to develop plans for reviewing and systematizing regulatory legal documents within the scope of management of the Ministry or Ministries-equivalent Agency, and implement such plans after approval;

b) Take the lead or coordinate with relevant units to organize the implementation of reviewing and systematizing regulatory legal documents within the scope of management of the Ministry or Ministries-equivalent Agency;

c) Take the lead and coordinate with functional units under the Ministry of Justice to organize training on skills and expertise for staff involved in reviewing and systematizing regulatory legal documents;

d) Take the lead and coordinate with relevant units annually to prepare a comprehensive report on the results of reviewing and systematizing regulatory legal documents within the scope of management of the Ministry or Ministries-equivalent Agency, to be submitted to the Minister or Head of the Ministries-equivalent Agency for consideration and decision, then sent to the Ministry of Justice for consolidation and reporting to the Government;

e) Perform other tasks assigned by the Minister or Head of the Ministries-equivalent Agency or as stipulated by laws on reviewing and systematizing regulatory legal documents.

2. Consolidating Regulatory Legal Documents

a) Take the lead and coordinate with relevant units to develop plans for consolidating regulatory legal documents within the scope of management of the Ministry or Ministries-equivalent Agency, and implement such plans after approval;

b) Take the lead or coordinate with relevant units, as assigned by the Minister or Head of the Ministries-equivalent Agency, to consolidate regulatory legal documents issued by the Ministry or Ministries-equivalent Agency and joint documents drafted by the Ministry or Ministries-equivalent Agency as the main drafter, in accordance with laws on consolidating regulatory legal documents;

c) Take the lead and coordinate with functional units under the Ministry of Justice to provide guidance and training on skills and expertise for consolidating regulatory legal documents;

d) Perform other tasks assigned by the Minister or Head of the Ministries-equivalent Agency or as stipulated by laws on consolidating regulatory legal documents.

3. Codifying Systems of Legal Norms

a) Take the lead and coordinate with relevant agencies to develop plans for codifying systems of legal norms within the scope of management of the Ministry or Ministries-equivalent Agency, and implement such plans after approval;

b) Take the lead and coordinate with relevant units to advise the Minister or Head of the Ministries-equivalent Agency on assigning units to take the lead in codification according to chapters;

c) Take the lead and coordinate with relevant units to propose chapter outlines for submission to the Minister or Head of the Ministries-equivalent Agency for consideration and decision, then sent to the Ministry of Justice for consolidation;

d) Take the lead or coordinate with relevant units to carry out codification of legal norms according to chapters; prepare documentation of codification results according to chapters for submission to the Minister or Head of the Ministries-equivalent Agency for consideration and decision, then sent to the Ministry of Justice for review; incorporate and revise codification results based on conclusions from the Review Committee and comments from the Ministry of Justice;

e) Take the lead or coordinate with relevant units to propose updating new legal norms within the scope of management of the Ministry or Ministries-equivalent Agency for submission to the Minister or Head of the Ministries-equivalent Agency for consideration and decision, then sent to the Ministry of Justice for incorporation into the Code;

f) Take the lead and coordinate with functional units under the Ministry of Justice to provide guidance and training on skills and expertise for codification within the scope of management of the Ministry or Ministries-equivalent Agency;

g) Organize monitoring, urging, and inspecting codification carried out by units under the Ministry or Ministries-equivalent Agency;

h) Take the lead and coordinate with relevant units to compile annual reports on the results of codifying systems of legal norms within the scope of management of the Ministry or Ministries-equivalent Agency for submission to the Minister or Head of the Ministries-equivalent Agency for consideration and decision, then sent to the Ministry of Justice for consolidation and reporting to the Government;

i) Perform other tasks assigned by the Minister or Head of the Ministries-equivalent Agency or as stipulated by laws on codifying systems of legal norms.

Article 12. Legal Affairs Organization at Government Agencies

Shall take the lead and coordinate with relevant units to assist the Heads of Government Agencies in coordinating with the Legal Affairs Department under the Ministry or equivalent agency to manage the industry or sector to carry out the review, systematization, consolidation of regulatory legal documents and codification of the regulatory legal system as prescribed in Article 11 of this Circular within the scope of management of Government Agencies.

Article 13. Legal Affairs Organization at General Departments and Equivalent Departments, Bureaus under Ministries or Equivalent Agencies

Shall take the lead and coordinate with relevant units to assist the Directors of General Departments and Equivalent Departments, Bureaus under Ministries or Equivalent Agencies in coordinating with the Legal Affairs Department under the Ministry or Equivalent Agency to implement the review, systematization, consolidation of regulatory legal documents and codification of the regulatory legal system as prescribed in Article 11 of this Circular within the scope of specialized state management of General Departments and Equivalent Departments, Bureaus under Ministries or Equivalent Agencies.

Article 14. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Shall take the lead and coordinate with relevant units to develop plans for reviewing and systematizing regulatory legal documents within the scope of specialized state management in the locality and organize the implementation of such plans after approval.

2. Shall take the lead and coordinate with relevant units to assist the Heads of Specialized Agencies in leading and coordinating with the Legal Affairs Board of the Provincial People's Council and related agencies to implement the review and systematization of regulatory legal documents of the Provincial People's Council and Provincial People's Committee that regulate issues within the scope of specialized state management in the locality.

3. Shall take the lead and coordinate with relevant units to implement the review and systematization of regulatory legal documents, and propose measures to handle the results of the review of regulatory legal documents within the responsibility of the specialized agency.

4. Shall take the lead and coordinate with relevant units to annually compile the results of the review and systematization of regulatory legal documents, prepare a comprehensive report of the specialized agency, submit it to the Head of the agency for consideration and decision, and send it to the Department of Justice for consolidation and reporting to the Provincial People's Committee on the results of the review and systematization of regulatory legal documents.

5. Shall take the lead and coordinate with functional units under the Department of Justice to guide and train skills and expertise in reviewing and systematizing regulatory legal documents.

6. Shall perform other tasks assigned by the Head of the agency or as stipulated by laws on reviewing and systematizing regulatory legal documents.

Chapter V

DUTIES IN THE WORK OF INSPECTION AND HANDLING OF REGULATORY LEGAL DOCUMENTS

Article 15. Legal Affairs Organization at Ministries or Equivalent Agencies

1. Shall take the lead and coordinate with relevant units to develop plans for inspecting regulatory legal documents within the scope of management of Ministries or Equivalent Agencies, submit them to the Minister or Head of Equivalent Agency for approval, and organize their implementation after approval.

2. Shall take the lead and coordinate with relevant units to assist the Minister or Head of Equivalent Agency in implementing the inspection of regulatory legal documents within the scope of management of Ministries or Equivalent Agencies.

3. Shall take the lead and coordinate with relevant units to develop and submit to the Minister or Head of Equivalent Agency plans and organize inter-ministerial inspection teams to conduct inspections of regulatory legal documents by topic, area, or by industry or sector within the scope of management of Ministries or Equivalent Agencies.

4. Shall take the lead and coordinate with relevant units to assist the Minister or Head of Equivalent Agency in handling regulatory legal documents contrary to the law according to the provisions of laws on inspection and handling of regulatory legal documents.

5. Shall take the lead and coordinate with relevant units to establish a network of information, build and manage databases serving the work of inspecting and handling regulatory legal documents within the scope of management of Ministries or Equivalent Agencies.

6. Shall take the lead and coordinate with relevant units to train inspection and handling skills of regulatory legal documents for staff and civil servants engaged in inspecting regulatory legal documents; organize and manage a team of inspectors of regulatory legal documents within the scope of management of Ministries or Equivalent Agencies.

7. Shall regularly coordinate and exchange expertise with the Regulatory Legal Documents Inspection Department under the Ministry of Justice and legal affairs organizations under Ministries or Equivalent Agencies, government agencies.

8. Shall propose to the Minister or Head of Equivalent Agency to implement mid-term and final reviews of the work of inspecting and handling regulatory legal documents, commendation, disciplinary action, and resolution of complaints and denunciations regarding inspection and handling of regulatory legal documents within their authority.

9. Shall take the lead and coordinate with relevant units to develop six-monthly and annual reports on the work of inspecting and handling regulatory legal documents within the scope of management of Ministries or Equivalent Agencies, submit them to the Minister or Head of Equivalent Agency for consideration and decision, and send them to the Ministry of Justice to prepare reports and report to the Prime Minister on the work of inspecting and handling regulatory legal documents nationwide.

10. Shall perform other tasks assigned by the Minister or Head of Equivalent Agency or as stipulated by laws on the work of inspecting and handling regulatory legal documents.

Article 16. Legal Affairs Organization at Government Agencies

Shall take the lead and coordinate with relevant units to assist the Heads of Government Agencies in coordinating with the Legal Department under the Ministry or equivalent Ministry managing the sector or field to implement inspection and handling of regulatory legal documents according to Article 15 of this Circular within the scope of management of Government Agencies.

Article 17. Legal Affairs Organization at General Departments and Equivalent Departments, Bureaus under Ministries or Equivalent Ministries

Shall take the lead and coordinate with relevant units to assist the General Department Directors, Bureau Directors in coordinating with the Legal Department under the Ministry or equivalent Ministry to implement inspection and handling of regulatory legal documents according to Article 15 of this Circular within the scope of specialized state management of General Departments and Equivalent Departments, Bureaus under the Ministry or equivalent Ministry.

Article 18. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in drafting plans for inspecting regulatory legal documents and organizing implementation of the plan after approval.

2. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in implementing inspections of regulatory legal documents.

3. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in drafting plans and organizing inter-sector inspection teams to carry out inspections of regulatory legal documents by topic, area, or sector.

4. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in proposing measures to handle regulatory legal documents that violate the law according to the regulations on inspection and handling of regulatory legal documents.

5. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in organizing information networks, building and managing databases serving the inspection and handling of regulatory legal documents within the authority of the Provincial People's Councils and Provincial People's Committees.

6. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in drafting semi-annual, annual, or ad hoc reports on the inspection and handling of regulatory legal documents.

7. Shall perform other tasks assigned by the Heads of Agencies or as stipulated by laws on inspection and handling of regulatory legal documents.

Chapter VI

BUSINESS IN THE WORK OF SPREADING AND EDUCATING ON LAW

Article 19. Legal Affairs Organization at Ministries or Equivalent Ministries

1. Shall take the lead and coordinate with relevant units in drafting annual and long-term programs and plans for spreading and educating on law within the scope of management of Ministries or Equivalent Ministries and organizing implementation of these programs and plans after approval.

2. Shall take the lead and coordinate with relevant units in organizing spreading and educating on law within the scope of management of Ministries or Equivalent Ministries; determining the content and form of spreading and educating on law suitable for each group of subjects; compiling materials and disseminating specialized legal knowledge; building, training, and enhancing the team of legal lecturers of Ministries or Equivalent Ministries; guiding, monitoring, and urging subordinate units of Ministries or Equivalent Ministries in implementing spreading and educating on law.

3. Shall take the lead and coordinate with relevant units in inspecting, resolving complaints and denunciations, and handling violations in spreading and educating on law within the scope of management of Ministries or Equivalent Ministries.

4. Shall cooperate with related agencies in building and managing national databases on law within the scope of management of Ministries or Equivalent Ministries.

5. Shall take the lead and coordinate with relevant units in international cooperation on spreading and educating on law within the scope of management of Ministries or Equivalent Ministries.

6. Shall take the lead and coordinate with relevant units to assist the Ministers or Heads of Equivalent Ministries in organizing the implementation of National Law Day.

7. Shall take the lead and coordinate with relevant units in summarizing and concluding the situation of implementing spreading and educating on law at Ministries or Equivalent Ministries.

8. Shall take the lead and coordinate with relevant units in annually drafting reports on spreading and educating on law within the scope of management of Ministries or Equivalent Ministries to be submitted to the Ministers or Heads of Equivalent Ministries for consideration and submission to the Ministry of Justice for consolidation and drafting reports to be submitted to the Government.

Article 20. Legal Affairs Organization at Government Agencies

Shall take the lead and coordinate with relevant units to advise and assist the Heads of Government Agencies in implementing legal awareness and education activities as stipulated in Article 19 of this Circular within the scope of management of Government Agencies.

Article 21. Legal Affairs Organization at General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies

Shall take the lead and coordinate with relevant units to assist the Directors of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies in implementing legal awareness and education activities as stipulated in Article 19 of this Circular within the specialized fields of state management of General Departments and Equivalent Departments, Bureaus under Ministries, and Equivalent Agencies.

Article 22. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in developing long-term and annual programs and plans for legal awareness and education activities within the fields of state management at the local level, and organize the implementation of these programs and plans after approval.

2. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in organizing legal awareness and education activities within the fields of state management at the local level.

3. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in coordinating with the Department of Justice in building, organizing training, and enhancing the legal propagandist team of the agency.

4. Shall coordinate with relevant units to assist the Heads of Agencies in inspecting, handling complaints and grievances, and dealing with violations in legal awareness and education activities within the fields of state management at the local level.

5. Shall take the lead and coordinate with relevant units in summarizing and concluding on the implementation of legal awareness and education activities within the fields of state management at the local level.

6. Shall take the lead and coordinate with relevant units to assist the Heads of Agencies in organizing the implementation of National Law Day of the Socialist Republic of Vietnam.

7. Shall take the lead and coordinate with relevant units in compiling and building annual reports on legal awareness and education activities within the fields of state management at the local level, submit them to the Heads of Agencies for review and decision, then send them to the Department of Justice for consolidation and reporting to the Provincial People's Committee, and to the Ministry of Justice for consolidation, statistics, and reporting to the Government.

Chapter VII

BUSINESS IN MONITORING THE IMPLEMENTATION OF LAWS

Article 23. Legal Affairs Organization at Ministries and Equivalent Agencies

1. Shall take the lead and coordinate with relevant units in developing work plans for monitoring the implementation of laws within the scope of management of Ministries and Equivalent Agencies, and organize the implementation of these plans after approval.

2. Shall take the lead and coordinate with relevant units in reviewing and identifying detailed provisions assigned in normative legal documents from higher-level state agencies within the scope of management of Ministries and Equivalent Agencies, compile a list of decrees of the Government, decisions of the Prime Minister, send it to the Office of the Government for consolidation and submission to the Prime Minister for consideration and issuance of the list and allocation of the drafting agency for detailed regulations implementing normative legal documents; compile a list of circulars and joint circulars within the authority to issue of the Ministers and Heads of Equivalent Agencies, send it to the Ministry of Justice for monitoring; develop plans for drafting and issuing detailed regulations implementing normative legal documents from higher-level state agencies within the scope of management of Ministries and Equivalent Agencies. 3. Shall take the lead in guiding, monitoring, urging, and inspecting relevant units in the implementation of work on monitoring the implementation of laws and the development and issuance of detailed regulations implementing normative legal documents from higher-level state agencies within the scope of management of Ministries and Equivalent Agencies.

4. Shall take the lead and coordinate with relevant units in organizing surveys and investigations on the implementation of laws within the scope of management of Ministries and Equivalent Agencies.

5. Shall take the lead and coordinate with relevant units in recommending the Ministers and Heads of Equivalent Agencies to handle according to their authority or propose competent authorities to handle the results of monitoring the implementation of laws, apply measures to enhance the organization of law enforcement and the development and issuance of detailed regulations, ensuring progress and quality.

6. Shall take the lead and coordinate with relevant units in compiling annual reports of Ministries and Equivalent Agencies on law enforcement monitoring; monthly compile reports on the issuance of detailed regulations implementing normative legal documents from higher-level state agencies within the scope of management of Ministries and Equivalent Agencies, and submit them to the Ministry of Justice for consolidation.

6. To take the lead and coordinate with relevant units in building the annual report of the Ministry, agency at the ministerial level on the work of monitoring the implementation of laws; to build monthly reports on the situation of issuing detailed regulatory documents to implement normative legal documents of higher-level state agencies within the scope of management of the Ministry, agency at the ministerial level, and send them to the Ministry of Justice for consolidation.

Article 24. Legal Affairs Organization at Government Agencies

Shall take the lead and coordinate with relevant agencies and units to assist the Heads of Government Agencies in performing the legal supervision work as stipulated in Article 23 of this Circular within the scope of management of Government Agencies, except for Clause 2 of Article 23.

Article 25. Legal Affairs Organization at General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies

1. Shall take the lead and coordinate with related units to develop and implement plans for monitoring the implementation of laws within the specialized administrative management sector of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies.

2. Shall take the lead and coordinate with related units to review and determine the detailed provisions assigned according to the regulations of higher-level state normative legal documents; draft proposed lists of detailed regulatory documents within the authority to issue of the Government, Prime Minister, Ministers, and Heads of Equivalent Agencies, to be submitted to the Legal Department of the Ministry or Equivalent Agency for consolidation. The Government, Prime Minister, Ministers, and Heads of Equivalent Agencies shall submit the proposed list to the Legal Department of the Ministry or Equivalent Agency for consolidation.

3. Shall take the lead in guiding, supervising, urging, and inspecting related units in implementing the monitoring of the implementation of laws, developing, and issuing detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies.

4. Shall take the lead and coordinate with related units to organize investigations and surveys on the implementation of laws within the specialized administrative management sector of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies.

5. Shall take the lead and coordinate with related units to recommend the General Department Director, Department Director to handle within their authority or propose competent authorities to handle the results of monitoring the implementation of laws, apply measures to enhance the organization of law enforcement and the development and issuance of detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies.

6. Shall take the lead and coordinate with related units to develop annual reports of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies on the monitoring of the implementation of laws; monthly reports on the issuance of detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector of General Departments and Equivalent Organizations, Ministries' Departments, and Equivalent Agencies, to be submitted to the General Department Director, Department Director for consideration and decision, then submitted to the Legal Department of the Ministry or Equivalent Agency for consolidation.

Article 26. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Shall take the lead and coordinate with related units to develop work plans for monitoring the implementation of laws within the specialized administrative management sector at the local level and implement these plans after approval.

2. Shall take the lead and coordinate with related units to review and determine the detailed provisions assigned according to the regulations of higher-level state normative legal documents; draft proposed lists of detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector at the local level, to be submitted to the Department of Justice for consolidation.

3. Shall take the lead in guiding, supervising, urging, and inspecting specialized agency units in implementing the monitoring of the implementation of laws, developing detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector at the local level.

4. Shall take the lead or coordinate with related units to organize investigations and surveys on the implementation of laws within the specialized administrative management sector at the local level.

5. Shall take the lead and coordinate with related units to recommend the Head of the Agency to handle within their authority or propose competent authorities to handle the results of monitoring the implementation of laws, apply measures to enhance the organization of law enforcement and the development and issuance of detailed regulatory documents to implement higher-level state normative legal documents, ensuring progress and quality.

6. Shall take the lead and coordinate with related units to develop annual reports of specialized agencies on the monitoring of the implementation of laws; ad hoc reports on the issuance of detailed regulatory documents to implement higher-level state normative legal documents within the specialized administrative management sector at the local level, to be submitted to the Head of the Agency for consideration and decision, then submitted to the Department of Justice.

Chapter VIII

BUSINESS IN THE WORK OF STATE COMPENSATION

Article 27. Legal Affairs Organization at Ministries and Ministerial-Level Agencies

1. Advise and assist the Minister, Head of a ministerial-level agency to coordinate with the Ministry of Justice in managing state administration regarding state compensation work within the scope of the Ministry's or ministerial-level agency's management sector.

2. Take the lead and coordinate with relevant units to advise and assist the Minister, Head of a ministerial-level agency to issue or submit for approval by competent state agencies to amend, supplement, or promulgate new normative legal documents on state responsibility for compensation.

3. Take the lead and coordinate with relevant units to advise and assist the Minister, Head of a ministerial-level agency to organize training and capacity building for skills and expertise in handling compensation for civil servants working in compensation resolution within the scope of the Ministry's or ministerial-level agency's management sector.

4. Take the lead and coordinate with relevant units to advise and assist the Minister, Head of a ministerial-level agency to determine the responsible compensation body when the victim requests or there is no consensus among agencies and units within the scope of the Ministry's or ministerial-level agency's management sector regarding the determination of the responsible compensation body.

5. Take the lead and coordinate with relevant units to advise and assist the Minister, Head of a ministerial-level agency to guide, monitor, inspect, and audit the resolution of compensation within the scope of the Ministry's or ministerial-level agency's management sector.

6. Take the lead and coordinate with relevant units to advise and assist the Minister, Head of a ministerial-level agency to monitor and urge the payment of compensation funds and the fulfillment of repayment responsibilities within the scope of the Ministry's or ministerial-level agency's management sector.

7. Coordinate with related agencies and units to provide information and guide procedures to support victims in exercising their right to claim compensation.

8. Coordinate with related agencies and units to resolve complaints, denunciations, and handle violations of laws on state responsibility for compensation within the scope of the Ministry's or ministerial-level agency's management sector.

9. Take the lead and coordinate with relevant units to periodically (every six months and annually or as required) compile, summarize, and evaluate the implementation of compensation within the scope of the Ministry's or ministerial-level agency's management sector, report to the Minister, Head of a ministerial-level agency for consideration and decision, and send to the Ministry of Justice for consolidation.

10. Perform other tasks assigned by the Minister, Head of a ministerial-level agency or as stipulated by laws on state compensation work.

Article 28. Legal Affairs Organization at Government Agencies

1. Take the lead and coordinate with relevant units to advise and assist the Head of a government agency in resolving compensation, paying compensation funds, and fulfilling repayment responsibilities.

2. Take the lead and coordinate with relevant units to guide, monitor, and urge units under the responsible compensation body to implement compensation resolution.

3. Coordinate with related agencies and units to advise and assist the Head of a government agency to provide information and guide procedures to support victims in exercising their right to claim compensation.

4. Coordinate with related agencies and units to resolve complaints, denunciations, and handle violations of laws on state responsibility for compensation within the scope of the government agency's management.

5. Take the lead and coordinate with relevant units to periodically (every six months and annually or as required) compile, summarize, and evaluate the implementation of state responsibility for compensation within the scope of the government agency's management, report to the agency head for consideration and decision, and send to the Ministry of Justice for consolidation.

Article 29. Legal Affairs Organization at General Departments and Equivalent Agencies, Bureaus under Ministries, and Agencies Equivalent to Ministries

Coordinate with relevant agencies and units to assist the Director-General, Bureau Chief in implementing tasks related to state compensation work as stipulated in Article 27 of this Circular within the scope of specialized state administration sectors managed by General Departments and Equivalent Agencies, Bureaus under Ministries, and Agencies Equivalent to Ministries.

Article 30. Legal Affairs Organization of Specialized Agencies under Provincial People's Committees

1. Take the lead and coordinate with relevant units to advise and assist the Head of the Agency in cooperating with the Department of Justice to perform state management tasks at the local level regarding state compensation work.

2. Take the lead and coordinate with relevant units to advise and assist the Head of the Agency in organizing training on skills and procedures for handling state compensation for officials and civil servants responsible for such work.

3. Take the lead and coordinate with relevant units to advise and assist the Head of the Agency in guiding, urging, and inspecting units under the Agency responsible for compensation to implement state compensation work.

4. Take the lead and coordinate with relevant units to advise and assist the Head of the Agency in advising the Provincial People's Committee to determine the agency responsible for compensation when the person suffering damage requests or there is no agreement on determining the responsible agency according to the law.

5. Coordinate with relevant agencies and units to provide information and guide procedures to support persons suffering damage in exercising their right to claim compensation within the scope of state management sectors at the local level.

6. Coordinate with relevant agencies and units to handle complaints, denunciations, and violations of the law on state compensation responsibilities according to the law.

7. Take the lead and coordinate with relevant units to regularly conduct statistics, summaries, and evaluations of the implementation of state compensation responsibilities every six months, annually, or upon urgent request within the scope of state management sectors at the local level, and submit them to the Head of the Agency for review and decision, then send to the Department of Justice for consolidation and reporting to the Provincial People's Committee.

8. Perform other tasks assigned by the Head of the Specialized Agency under the Provincial People's Committee or as prescribed by the law on state compensation work.

Chapter IX

LEGAL SUPPORT SERVICES FOR ENTERPRISES

Article 31. Legal Affairs Organization at Ministries and Agencies Equivalent to Ministries

1. Take the lead and coordinate with relevant units to develop annual programs and plans for legal support services for enterprises within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries, and organize their implementation after approval.

2. Take the lead and coordinate with relevant units to propose activities for legal support for enterprises operating within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries, and submit them to the Minister or Head of the Agency Equivalent to a Ministry for consideration and decision, then send to the Ministry of Justice for consolidation.

3. Receive and respond to enterprises' inquiries about laws within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries when the responses from specialized agencies under provincial people's committees do not meet enterprise requirements.

4. Receive and compile enterprises' suggestions on the development and improvement of regulatory legal documents within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries to propose to the Minister or Head of the Agency Equivalent to a Ministry for consideration and decision, or to suggest competent authorities to consider and decide on issuing new or amending existing legal documents.

5. Take the lead and coordinate with relevant units to prepare annual reports on receiving and processing enterprises' suggestions for improving laws within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries, and submit them to the Minister or Head of the Agency Equivalent to a Ministry for consideration and decision, then send to the Ministry of Justice for consolidation.

6. Take the lead and coordinate with relevant units to establish, maintain, and update databases on legal regulatory documents related to enterprise operations to be published on the Ministry’s or Agency Equivalent to a Ministry’s electronic information website, except for documents classified as state secrets.

7. Take the lead and coordinate with relevant units to compile materials introducing and disseminating legal regulatory documents and training materials on legal knowledge within the scope of industries and fields managed by Ministries and Agencies Equivalent to Ministries that are relevant to enterprise operations.

8. Take the lead and coordinate with relevant units to prepare annual reports on the implementation of legal support activities for enterprises, summarizing legal support work for enterprises or as required by the Ministry of Justice, and submit them to the Minister or Head of the Agency Equivalent to a Ministry for consideration and decision, then send to the Ministry of Justice.

Article 32. Legal Affairs Organization at Government Agencies

1. Take the lead and coordinate with relevant units to assist the head of the Government agency in coordinating with the Legal Affairs Department under the Ministry or equivalent ministry managing the sector or field to implement legal support activities for businesses within the scope of management of the Government agency according to the legal support program and plan for businesses.

2. Take the lead and coordinate with relevant units to provide legal support for businesses according to the division of labor by the Minister or head of the equivalent ministry, or in accordance with the law on legal support for businesses.

Article 33. Legal Affairs Organization at General Departments and Equivalent Departments under Ministries, Equivalent Ministries

1. Take the lead and coordinate with relevant units to assist the General Department Director or Department Director in coordinating with the Legal Affairs Department under the Ministry or equivalent ministry to implement legal support activities for businesses within the scope of specialized state management in their sector or field according to the legal support program and plan for businesses of the Ministry or equivalent ministry.

2. Take the lead and coordinate with relevant units to provide legal support for businesses within the scope of specialized state management in their sector or field of the General Department and equivalent departments under the Ministry or equivalent ministry according to the division of labor by the Minister or head of the equivalent ministry.

Article 34. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

1. Take the lead and coordinate with relevant units to assist the head of the agency in coordinating with the Department of Justice in drafting the program and plan for legal support work for businesses within the scope of state management in their sector or field at the local level and organizing the implementation of the program and plan after approval.

2. Take the lead and coordinate with relevant units to provide legal support activities for businesses; receive and answer questions about laws for businesses within the scope of state management in their sector or field at the local level.

3. Receive and compile business recommendations regarding amendments, supplements, or issuance of new regulatory legal documents related to business operations and submit them to the head of the agency for review and decision to send to the Department of Justice for consolidation.

4. Assist the head of the agency in coordinating with the Department of Justice to draft annual reports on the receipt and handling of business recommendations for improving legal provisions within the scope of state management in their sector or field at the local level.

5. Assist the head of the agency in coordinating with the Department of Justice to establish, maintain, and update databases of regulatory legal documents related to business operations; compile materials introducing and disseminating regulatory legal documents, training materials on legal knowledge within the scope of state management in their sector or field at the local level related to business operations.

6. Assist the head of the agency in coordinating with the Department of Justice to draft annual reports on legal support activities for businesses, summarizing legal support work for businesses at the local level or as required by the Ministry of Justice.

Chapter X

OPERATIONAL MATTERS IN ADVISING ON LEGAL ISSUES AND PARTICIPATING IN LITIGATION PROCESSES

Article 35. Legal Affairs Organization at Ministries and Ministries-equivalent Agencies

1. Advise on legal issues related to procedures and formalities for participating in litigation, hiring lawyers, or directly participating in litigation as representatives of the agency or unit upon authorization by the Minister or Head of a Ministry-equivalent Agency.

2. Take the lead or coordinate with relevant units in preparing files and necessary documents to serve the process of participating in litigation; monitor the situation, gather relevant information, and promptly advise and propose directions and measures for resolution.

3. Take the lead or coordinate with relevant units in monitoring, urging, and inspecting subordinate units within Ministries and Ministry-equivalent Agencies to comply with internal regulations and rules; implement court judgments and commercial arbitration decisions that have taken effect.

4. Take the lead or coordinate with relevant units in providing legal advice on complex issues or those with differing opinions before presenting them to the Minister or Head of a Ministry-equivalent Agency for consideration and decision.

5. Take the lead or coordinate with relevant units in advising the Minister or Head of a Ministry-equivalent Agency on handling or recommending competent authorities to handle violations of laws within the scope of their administrative management; participate in resolving disputes within the scope of their administrative management.

6. Take the lead or coordinate with relevant units in participating in resolving disputes within the scope of their administrative management.

7. Provide legal advice on other issues as assigned by the Minister or Head of a Ministry-equivalent Agency.

Article 36. Legal Affairs Organization at Government Agencies

Take the lead or coordinate with relevant units in assisting the Head of a Government Agency in performing advisory work on legal issues and participating in litigation as stipulated in Article 35 of this Circular within the scope of their administrative management; perform advisory work on legal issues and participating in litigation as assigned by the Head of a Government Agency.

Article 37. Legal Affairs Organization at General Departments and Equivalent Units, Bureaus under Ministries and Ministries-equivalent Agencies

Take the lead or coordinate with relevant units in assisting the Director of General Departments and Equivalent Units, Bureau Directors in performing advisory work on legal issues and participating in litigation as stipulated in Article 35 of this Circular within the scope of their specialized state administrative management; perform advisory work on legal issues and participating in litigation as assigned by the Director of General Departments and Equivalent Units, Bureau Directors.

Article 38. Legal Affairs Organization at Specialized Agencies under Provincial People's Committees

Take the lead or coordinate with relevant units in assisting the Heads of Specialized Agencies under Provincial People's Committees in performing advisory work on legal issues and participating in litigation as stipulated in Article 35 of this Circular within the scope of their local state administrative management; perform advisory work on legal issues on other matters as assigned by the Heads of Specialized Agencies under Provincial People's Committees.

Chapter XI

EFFECTIVE DATE AND IMPLEMENTATION

Article 39. Effective date

This Circular takes effect from February 28, 2015.

Article 40. Responsibility for Implementation

1. Within the scope of their functions and tasks, Ministries, Ministry-equivalent Agencies, Government Agencies, and People's Committees of provinces and centrally-administered cities are responsible for organizing the implementation of this Circular.

2. In the course of implementation, if there are difficulties or obstacles, agencies and units are requested to promptly reflect these to the Ministry of Justice for guidance, research, and appropriate amendments and supplements./.
