The Minister, Head of the Office of the Government and the Minister of Home Affairs issue this Joint Circular guiding the functions, tasks, powers, and organizational structure of the People's Committee Office at provincial level and the People's Council and People's Committee Office at district level.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSand centrally governed cities within centrally governed citieson1. The People's Committee Office at provincial level (hereinafter referred to as the provincial level) is an agency under the People's Committee at the provincial level, having the function of advising and assisting the People's Committee at the provincial level on: Programs and work plans; organizing, managing, and publishing official information about the activities of the People's Committee, the Chairman of the People's Committee at the provincial level; being the focal point for the Electronic Information Portal, connecting the administrative electronic information system for directing and managing by the People's Committee, the Chairman of the People's Committee at the provincial level; managing the bulletin and serving the activities of the People's Committee at the provincial level; assisting the Chairman of the People's Committee at the provincial level (including Deputy Chairmen of the People's Committee at the provincial level) in performing their duties and powers within their jurisdiction; managing archives and internal administrative affairs of the Office.
Article 1. Position and Functions
2. The People's Committee Office at the provincial level has legal personality, its own seal, and separate accounts.
1. Submit to the People's Committee at the provincial level for issuance:
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
a) Regulations on the operation of the People's Committee at the provincial level;
b) Documents specifying the functions, tasks, powers, and organizational structure of the People's Committee Office at the provincial level;
c) Documents guiding the specific functions, tasks, and powers of the People's Council and People's Committee Office at the district level (hereinafter referred to as the district level);
d) Documents specifying the conditions and standards for the positions of Heads and Deputy Heads of units under the People's Committee Office at the provincial level; Heads and Deputy Heads of the People's Council and People's Committee Office at the district level.
2. Submit to the Chairman of the People's Committee at the provincial level for issuance:
a) Decisions on establishing, merging, splitting, or dissolving units under the People's Committee Office at the provincial level;
b) Other documents as assigned by the Chairman of the People's Committee at the provincial level.
3. Advise, build, and organize the implementation of programs and work plans of the People's Committee at the provincial level:
a) Consolidate proposals from Departments, agencies equivalent to Departments, and agencies under the People's Committee at the provincial level (hereinafter referred to as Departments), People's Committees at the district level, and related agencies and organizations;
b) Recommend to the Chairman of the People's Committee at the provincial level to include in the program and work plan issues that need focused direction and management or to assign relevant agencies to study and develop projects, draft documents;
c) Build and submit to the People's Committee and the Chairman of the People's Committee at the provincial level for issuance or approval of the program and work plan;
d) Monitor and urge Departments, People's Committees at the district level, and related agencies and organizations to implement the program and work plan, ensuring timely progress and quality;
đ) Report periodically or urgently on the results of implementation; recommend solutions to effectively implement the program and work plan;
e) Timely report, adjust the program and work plan to meet the requirements of management, direction, and control by the People's Committee and the Chairman of the People's Committee at the provincial level.
4. Serve the activities of the People's Committee at the provincial level:
a) Take the lead and coordinate with relevant agencies to prepare agendas and contents for meetings of the People's Committee at the provincial level;
b) Implement the system of consolidation and reporting;
c) Monitor, urge, and evaluate the implementation of the Regulations on the operation of the People's Committee at the provincial level;
d) Organize citizen reception work in accordance with the provisions of the law.
5. Advise and assist the Chairman of the People's Committee at the provincial level in performing the following tasks and powers:
a) Summon and chair meetings;
b) Monitor, urge, direct, and inspect the work of Departments; People's Councils and People's Committees at the district level;
c) Perform tasks before the People's Council at the provincial level; interact, report, and respond to citizens' suggestions;
d) Direct and apply necessary measures to resolve matters in urgent or emergency situations;
đ) Improve working methods; maintain discipline and order in the local administrative machinery.
6. Receive, process, and submit to the People's Committee and the Chairman of the People's Committee at the provincial level for resolution of documents and files sent or submitted by agencies, organizations, and individuals (incoming documents):
a) For projects, plans, and draft documents submitted by agencies: Check the file, drafting procedures, format, and presentation techniques of the draft document; summarize the content, clearly state the decision-making authority, the consistency in the direction and management of the People's Committee and the Chairman of the People's Committee at the provincial level regarding the related issue, propose one of the following options: Issuance, approval; submission to the provincial-level People's Committee meeting; sending for opinions from members of the provincial-level People's Committee; notify the opinion of the Chairman of the provincial-level People's Committee requiring the drafting agency to complete the document, seek additional opinions from agencies, organizations, and individuals, or perform other tasks as prescribed and in accordance with the regulations of the provincial-level People's Committee.
During the processing, if there are differing opinions on the project, plan, or draft document, convene a meeting with related agencies to discuss before submitting;
b) For draft reports and speeches: Coordinate with relevant agencies to edit and finalize according to the instructions of the Chairman of the People's Committee at the provincial level;
c) For other documents: Recommend to the Chairman of the People's Committee at the provincial level to assign relevant agencies to implement; organize the necessary conditions for the People's Committee and the Chairman of the People's Committee at the provincial level to handle in accordance with the law and the content of the incoming document.
7. Issue, manage, monitor, urge, and inspect the implementation and results of documents of the People's Committee and the Chairman of the People's Committee at the provincial level:
a) Manage and use seals, issue documents of the People's Committee and the Chairman of the People's Committee at the provincial level;
a) Managing and using seals, issuing documents of the People's Committee, Chairman of the provincial People's Committee;
b) Monitor, urge, inspect the implementation status and results of documents issued by the People's Committee, Chairman of the Provincial People's Committee; periodically review and report to the Chairman of the Provincial People's Committee to ensure consistency and unity in guidance and management;
c) Review to identify issues and new developments regarding authority, files, procedures, processes, and administrative office practices during the guidance and management process of the People's Committee, Chairman of the Provincial People's Committee; promptly report to the Provincial People's Committee for amendments and supplements; annually compile and report to the Government Office;
d) Archive documents, files, and materials of the People's Committee, Chairman of the Provincial People's Committee.
8. Implement information systems:
a) Organize the management and update of information to support the guidance and management of the People's Committee, Chairman of the Provincial People's Committee;
b) Implement reporting on the operation of the Electronic Information Portal and the electronic administrative information system for guidance and management by the People's Committee, Chairman of the Provincial People's Committee;
c) Publish and distribute the Provincial Gazette;
d) Establish, manage, and maintain the computer network of the Provincial People's Committee.
9. Ensure material and technical conditions:
a) Ensure material and technical conditions for the activities of the People's Committee, Chairman of the Provincial People's Committee;
b) Serve work trips, meetings, and receptions for the People's Committee, Chairman of the Provincial People's Committee.
10. Guide administrative office practices:
Take the lead in coordinating with the Office of the Delegation of the National Assembly and the Provincial People's Council to summarize and guide specialized knowledge and administrative office practices for the Offices of Departments, the Office of the People's Council, and the People's Committee at the district level, and civil servants in the Office - Statistics of communes, wards, and towns.
11. Perform internal administrative tasks:
a) Organize the implementation of documents, plans, and programs issued or approved by competent authorities related to the activities of the Office of the Provincial People's Committee;
b) Receive and process documents sent to the Office of the Provincial People's Committee from agencies, organizations, and individuals; issue and manage documents according to regulations;
c) International cooperation in accordance with laws and assignments or delegations from the People's Committee, Chairman of the Provincial People's Committee;
d) Study and apply scientific research results and administrative reforms to serve assigned tasks;
đ) Manage organizational structure, staffing, job classification, position establishment, and personnel composition according to occupational standards and the number of employees in affiliated public service units under the Office of the Provincial People's Committee;
e) Implement salary systems and incentive policies, rewards, disciplinary measures, and professional training for civil servants, officials, and workers under the management of the Office of the Provincial People's Committee;
g) Guide and inspect the implementation of self-management and responsibility mechanisms for directly subordinate public service units; manage and be responsible for financial and asset management according to regulations;
h) Perform other tasks and powers delegated by the People's Committee, Chairman of the Provincial People's Committee or as stipulated by law.
Article 3. Leadership of the People's Committee Office at the provincial level
1. The leadership of the People's Committee Office at the provincial level consists of the Director of the Office and not more than three Deputy Directors of the Office.
Specifically, the People's Committee Office in Hanoi City and Ho Chi Minh City may have up to four Deputy Directors of the Office.
2. The Chairman of the People's Committee at the provincial level appoints the Director and Deputy Directors of the Office in accordance with the provisions of the law.
Article 4. Organizational Structure
1. Administrative units:
a) General Department;
b) Economic Department;
c) Science, Education, Culture and Social Affairs Department;
d) Internal Affairs Department;
đ) Administrative and Organizational Department;
e) Management and Finance Department;
g) Provincial Citizens' Reception Committee;
h) Specialized Department
For localities that do not meet the criteria for establishing a Department of Foreign Affairs, a Foreign Affairs Department under the People's Committee Office at the provincial level shall be established.
For localities where ethnic minority groups reside and do not meet the criteria for establishing an Ethnic Minorities Board, an Ethnic Minorities Department shall be established or a specialized civil servant shall be assigned to handle ethnic minority affairs under the People's Committee Office at the provincial level;
i) In addition to the above Departments, the People's Committee Office at the provincial level may establish up to two additional Departments; specifically, the People's Committee Office in Hanoi City and Ho Chi Minh City may establish up to three additional Departments.
2. Publicly-owned institutions directly subordinate:
a) Guest House;
b) Other publicly-owned institutions established by the Chairman of the People's Committee at the provincial level according to the provisions of the law.
Article 5. Civil Servant Establishment and Number of Staff at Publicly-Owned Institutions
The establishment of civil servants and the number of staff at publicly-owned institutions under the People's Committee Office at the provincial level are allocated based on job positions, linked to functions, tasks, workload, and within the total establishment of civil servants and public service establishments of the province, centrally-administered city by the competent authority.
Article 6. Working System
1. The People's Committee Office at the provincial level and its subordinate units operate under the head system, ensuring the principle of democratic centralism.
2. The Director of the Office is responsible before the Chairman of the People's Committee at the provincial level and before the law for all activities of the People's Committee Office at the provincial level; he/she is the account holder of the People's Committee Office at the provincial level.
3. Deputy Directors assist the Director in performing tasks, are assigned by the Director to oversee specific areas of work, and are responsible before the Director and before the law for the area of work assigned.
When the Director is absent, a Deputy Director appointed by the Director will manage the activities of the People's Committee Office at the provincial level.
4. Heads of units under the People's Committee Office at the provincial level are responsible before the Director and the Deputy Director overseeing their field for all activities of their unit.
5. Civil servants and officials are subject to leadership, direction, management, and assignment of work by the leadership of the People's Committee Office at the provincial level and the leadership of the Departments; they implement reporting systems according to the working regulations of the agency.
Article 7. Responsibility System
1. The People's Committee Office at the provincial level is responsible for issues of advice and proposals within the scope of its duties and powers as prescribed.
2. Specialists, Department leaders, and leadership of the People's Committee Office at the provincial level are responsible for their advisory opinions and proposals.
Article 8. Work Relationships
1. The People's Committee Office at the provincial level is subject to direction and management regarding staffing and personnel matters by the People's Committee at the provincial level; it is also subject to direction, inspection, and guidance on professional matters by the Government Office.
2. The People's Committee Office at the provincial level has the responsibility to periodically review, summarize, and report to the People's Committee at the provincial level and the Government Office on the situation and results of assigned tasks.
3. The People's Committee Office at the provincial level collaborates with the Provincial Party Committee Office, Municipal Party Committee Office, the Office of the Delegation of National Assembly Members and People's Council, departments, sectors, district People's Committees, and related agencies in advising and assisting the People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level in performing their duties and powers within their jurisdiction.
Article 9. Transitional Provisions
1. The People's Committee Office at the provincial level retains the current number of Deputy Directors exceeding the provisions of this Circular (as of the date this Circular takes effect) to ensure stability.
Additional Deputy Directors can only be appointed when the number is less than the provisions of this Circular.
2. Maintain the unit implementing information technology and publishing the official gazette until specific guidelines on the Official Information Portal are issued.
Article 10. Effective Date
This Circular takes effect from December 15, 2015, replacing Circular Jointly Issued No. 02/2011/TTLT-VPCP-BNV dated January 28, 2011, of the Government Office and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of the People's Committee Office at the provincial level and centrally-administered cities, and previous regulations inconsistent with this Circular.
Article 11. Implementation Organization
1. The People's Committee at the provincial level is responsible for reviewing and issuing the documents stipulated in Clause 1, Article 2 of this Circular Jointly Issued.
2. The Chairman of the People's Committee at the provincial level is responsible for directing a review, proposing amendments, supplements, or amending and supplementing within his/her authority the local documents related to the operation organization and working relationship of the People's Committee Office at the provincial level and related agencies, ensuring consistency with this Circular Jointly Issued.
3. The Director of the People's Committee Office at the provincial level is responsible for:
a) Chairing and coordinating with the Director of the Department of Home Affairs to submit to the People's Committee and the Chairman of the People's Committee at the provincial level for issuance of the documents stipulated in Clause 1 and Point a, Clause 2, Article 2 of this Circular Jointly Issued;
b) Reviewing and advising the People's Committee and the Chairman of the People's Committee at the provincial level to amend and supplement relevant regulations to ensure consistency with this Circular Jointly Issued;
c) Issuing documents defining the functions, tasks, powers of units under the People's Committee Office at the provincial level and the working regulations of the People's Committee Office at the provincial level consistent with new functions, tasks, powers, and organizational structures;
d) Arranging, deploying, transferring, appointing, and improving the team of civil servants and officials to effectively perform assigned tasks.
đ) On an annual basis, report to the Government Office on the situation and results of implementing this Joint Circular.
4. During the implementation process, if any issues arise or difficulties occur, agencies and organizations shall reflect them to the Government Office for timely resolution in coordination with the Ministry of Home Affairs./.
