Pursuant to the Law on Handling Administrative Violations 2012;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

5. Having been issued identification signs and certificates for traffic patrol and control police as stipulated by the Ministry of Public Security.

Article 2. Applicability

This Circular applies to:

Article 4. Duties and Powers of Officers Performing Traffic Patrol and Control Duties on Public Roads

Officers conducting traffic patrols and controls on public roads shall perform the following duties:

1. Implement directives from the Ministry of Public Security, the Highway Police Corps, the Provincial Public Security Director (hereinafter referred to as the Provincial Public Security), the Head of the Traffic Guidance and Control Department, the Head of the Expressway Patrol and Control Department under the Highway Police Corps, the Head of the Road and Rail Traffic Police Department, the Head of the Provincial Public Security Traffic Police Department (hereinafter referred to as the Head of the Traffic Police Department), the County, District, City, and Provincial Public Security Chief (hereinafter referred to as the County Public Security Chief); approved patrol and control plans.

2. Ensuring traffic order and safety within the assigned patrol and control areas; promptly and strictly dealing with violations as prescribed by law.

3. Reporting and proposing measures to address deficiencies in state management of security, order, and traffic safety to competent authorities; coordinating with road management agencies to detect and prevent violations of road construction protection regulations and road safety zones.

4. Guiding and promoting compliance with road traffic laws among participants in traffic.

5. Organizing rescue operations for accident victims, protecting accident scenes, and resolving traffic accidents in accordance with laws and regulations of the Ministry of Public Security; participating in search and rescue operations and mitigating consequences caused by natural disasters on roads.

6. Cooperating with specialized units of the People's Public Security to combat crime and other illegal acts on assigned traffic routes, vehicles, and areas as prescribed by law.

5. Has been issued with a badge and Certificate for Traffic Police Patrol and Control on Roadways in accordance with the regulations of the Ministry of Public Security.

Chapter II

SPECIFIC PROVISIONS

Section 1

TASKS AND LIMITATIONS OF STAFF PERFORMING PATROL AND TRAFFIC CONTROL ON ROADWAY DUTIES

Staff performing patrol and traffic control on roadway duties shall carry out the tasks of the People's Police force and the specific tasks listed below:

Article 4. Tasks

1. Implement directives from the Ministry of Public Security, the Highway Police Corps, the Director of Provincial Public Security Organs (hereinafter referred to as Provincial Public Security Organs); the Head of the Traffic Patrol and Control Guidance Department, the Head of the Expressway Traffic Patrol and Control Department under the Highway Police Corps; the Head of the Road Traffic Police Department - Railway Traffic Police Department, the Head of the Road Traffic Police Department of Provincial Public Security Organs (hereinafter referred to as the Head of the Traffic Police Department); the Head of County, District, City, and Town Public Security Organs (hereinafter referred to as the Head of County-level Public Security Organs); and the approved patrol and control plans by the competent authority.

2. Ensure traffic order and safety within the assigned patrol and control routes and areas; promptly and strictly detect and handle violations according to the law.

3. Report and propose measures to the competent authority to address promptly any loopholes and shortcomings in state management of security, public order, and traffic order and safety on roadways; cooperate with highway management agencies to detect and prevent violations of regulations protecting highway facilities and highway safety zones.

4. Guide and promote participants in traffic to strictly comply with laws on traffic on roadways.

5. Organize rescue operations for accident victims, protect accident scenes, and resolve traffic accidents in accordance with the law and regulations of the Ministry of Public Security; coordinate in search and rescue operations, emergency response, and mitigation of consequences caused by natural disasters on roadways.

6. Cooperate with specialized units of the People's Public Security to combat crime and other illegal acts on assigned road traffic routes, road traffic means (hereinafter referred to as means), and areas in accordance with the law.

6. Cooperate with the specialized units of the People's Public Security to combat crimes and other violations of the law on road traffic routes and road traffic vehicles (hereinafter referred to as vehicles) within the assigned areas in accordance with the provisions of the law.

Article 5. Powers and Duties

1. To stop vehicles participating in road traffic; to inspect vehicles and their documents; to inspect persons and the documents of vehicle drivers, personal identification documents of persons on the inspected vehicle, and compliance with regulations governing road transport activities as prescribed by law.

2. To handle administrative violations in the field of road traffic, security, public order, social safety, and other administrative violations in other areas of state management as prescribed by law.

3. To apply measures to prevent and ensure the handling of administrative violations as prescribed by law; temporarily detain driver's licenses, vehicle registration certificates, and other related documents concerning the vehicle, the driver, or other persons on the vehicle when they commit a violation of the law, and documents related to transport activities to ensure the enforcement of administrative penalty decisions as prescribed by law.

4. To request agencies, units, organizations, and individuals to cooperate and support in resolving traffic accidents; traffic congestion, hindrances to traffic, or other situations causing disruption to public order and social safety.

5. To use weapons, auxiliary tools, and means, technical equipment as prescribed by law.

6. To requisition various types of transportation means; communication means; other technical equipment of agencies, organizations, individuals, and to operate and use such means and equipment as prescribed by law.

7. Temporarily prohibiting persons and vehicles from traveling on certain sections of roads, reallocating traffic lanes, routes, and places for parking vehicles when traffic congestion occurs or when there is a need to ensure security, public order, and social safety.

8. To exercise other powers and duties as prescribed by law.

Section 2

EQUIPMENT AND USE OF MEANS, TECHNICAL EQUIPMENT, WEAPONS,

AUXILIARY TOOLS FOR TRAFFIC POLICE PERFORMING PATROL TASKS,

Staff performing patrol and traffic control on roadway duties shall carry out the tasks of the People's Police force and the specific tasks listed below:

Article 6. Equipment of Means, Technical Equipment, Weapons, and Auxiliary Tools

1. Transportation means, including: Cars, motorcycles, and other specialized vehicles equipped with police lights, flags, sirens for priority vehicles as prescribed by law on road traffic.

a) Both sides of the patrol car body shall be painted with reflective blue stripes, with the words "TRAFFIC POLICE" in white (reflective material), with each character measuring 10cm x 10cm, stroke width 03cm, evenly distributed on both sides of the car body. The arrangement of stripes, spacing between characters, and words shall be adjusted according to the type of vehicle for balance and suitability.

b) Both sides of the fuel tank or the rear side panels or both sides of the motorcycle patrol trunk shall have the words "C.S.G.T" in blue (reflective material). The size of the characters and the spacing between them shall be adjusted according to the type of vehicle for balance and suitability.

c) The color of the paint for cars and motorcycles used for patrol and inspection tasks: White.

2. Technical equipment

Technical equipment provided for Traffic Police performing patrol, inspection, and handling of administrative violations in the field of road traffic shall be implemented in accordance with Decree No. 165/2013/ND-CP dated November 12, 2013 of the Government on the management, use, and list of technical equipment used to detect administrative violations related to traffic order and safety and environmental protection (hereinafter referred to as Decree No. 165/2013/ND-CP).

3. Communication means: Walkie-talkies, telephones, fax machines, data transmission computers.

4. Weapons and auxiliary tools provided for Traffic Police.

5. Traffic command batons; whistles; loudspeakers; cone-shaped poles; barriers; signs to block roads, stop vehicles.

6. Lighting lamps.

7. Other technical equipment as prescribed by the Ministry of Public Security.

Article 7. Use of technical equipment, weapons, and support toolsnational

1. The use of technical equipment, weapons, and support tools must be carried out in accordance with the provisions of the Law on Handling Administrative Violations 2012, Decree No. 165/2013/NĐ-CP, Circular No. 40/2015/TT-BCA dated August 24, 2015 of the Minister of Public Security on the use of technical equipment in the People's Public Security to detect administrative violations related to traffic order and safety and environmental protection, and legal documents on the management and use of weapons and support tools.

2. Use sirens for priority signals in accordance with the law.

3. Priority signal lights shall be used continuously in the following cases:

a) Patrol and mobile control;

b) Control at a point on the road or at a Traffic Police Station during daytime under poor weather conditions that limit visibility (rain, fog...);

c) Control at a point on the road or at a Traffic Police Station at night.

Section 3

FORMS OF PATROLLING AND CONTROLLING

Article 8. Open patrol and control

1. Methods of open patrol and control

a) Patrol and mobile control;

b) Control at a Traffic Police Station;

c) Control at a point on the road;

d) Mobile patrol and control combined with control at a point on the road.

Open patrol and control on expressways shall be conducted according to the methods prescribed in Points a, c, and d of this Clause.

2. Open patrol and control must have a plan approved by the Head of the Expressway Traffic Control Department under the Traffic Police Corps, the Head of the Traffic Police Department, or the Head of the Police Department at the county level or higher. The patrol and control plan must clearly state the time, route, and location of the patrol and control.

3. When conducting open patrol and control, the following regulations must be implemented:

a) Wear uniforms in accordance with the regulations of the Ministry of Public Security;

b) Use transportation means or walk to patrol and control within the assigned area;

c) Use technical equipment, weapons, and support tools in accordance with the law and this Circular.

Article 9. Combined open patrol and control with disguise

1. Cases of combined open patrol and control with disguise

a) Disguise using technical equipment to enhance the effectiveness of traffic order and safety assurance work;

b) Combat crime prevention when the security and public order situation or traffic order and safety is complex.

2. Authority to decide on combined open patrol and control with disguise

a) The Director of the Traffic Police Corps, the Director of the Provincial Police Department or higher decides on combined open patrol and control with disguise as prescribed in Clause 1 of this Article;

b) The Head of the Expressway Traffic Control Department under the Traffic Police Corps, the Head of the Traffic Police Department, or the Head of the Police Department at the county level decides on combined open patrol and control with disguise for the case prescribed in Point a of Clause 1 of this Article.

3. Conditions for combined open patrol and control with disguise

a) There must be a patrol and control plan approved by the authority prescribed in Clause 2 of this Article. The content of the plan must clearly state the method of implementation, forces, communication methods, time, patrol and control areas; technical equipment used for patrol and control;

b) The patrol and control team must arrange a part of the staff in the team to disguise (wearing civilian clothes) to monitor traffic order, detect, and combat violations. Upon discovering a violation, they must immediately inform the open patrol and control team to proceed with inspection and handling in accordance with the law;

The disguised part and the open patrol and control part in a patrol and control team must maintain an appropriate distance to ensure timely and lawful handling of violations;

c) Strictly prohibit the abuse of combined open patrol and control with disguise to harass, cause inconvenience, and damage the interests of the State, the rights and legitimate interests of citizens, agencies, and organizations.

Article 10. Supervision through monitoring systems for traffic order and safety violations on roadways

1. The monitoring system for traffic order and safety violations on roadways includes:

a) Terminal devices (speed measurement devices with image recording; surveillance cameras recording images of violating vehicles; control devices; other electrical, electronic, and mechanical equipment...) installed fixedly along the roadway to monitor traffic order and safety conditions in real-time and automatically record images of individuals and vehicles violating traffic laws;

b) Central processing equipment systems, management software, and databases for monitoring and handling traffic order and safety violations;

c) Data transmission systems;

d) Other auxiliary devices.

2. Units tasked with patrol and supervision shall arrange qualified staff to be stationed at the Control Center to coordinate the operation of the monitoring system and report traffic violations committed by individuals and vehicles to the Patrol and Supervision Teams on duty on the route for them to handle and process violations according to regulations.

3. Upon receiving reports of traffic violations from the Control Center of the monitoring system, the Patrol and Supervision Teams shall stop vehicles, conduct inspections, and process violations according to regulations. At the end of their patrol and supervision shift, Team Leaders are responsible for reporting the number of cases they have inspected and processed to the Control Center. Staff stationed at the Control Center are responsible for compiling cases discovered through the monitoring system but not yet inspected or processed, and reporting and proposing in writing to those with authority to handle violations according to the law.

4. Violations recorded and collected by technical equipment of the monitoring and violation handling system for traffic order and safety on roadways must be compiled into lists, printed as image or recording records of the violations, and kept in administrative violation case files according to the Ministry of Public Security's regulations on file work.

Article 11. Mobilizing other police forces and communal police to cooperate in patrols and supervision

In cases where it is necessary to mobilize other police forces and communal police to cooperate with highway traffic police in patrolling and supervising traffic order and safety on roadways, this shall be carried out in accordance with the provisions of Government Decree No. 27/2010/NĐ-CP dated March 24, 2010, regarding the mobilization of other police forces and communal police to cooperate with highway traffic police in patrolling and supervising traffic order and safety on roadways when necessary, and Circular No. 47/2011/TT-BCA dated July 2, 2011, issued by the Minister of Public Security detailing the implementation of certain provisions of Government Decree No. 27/2010/NĐ-CP.

Section 4

CONTENT OF PATROL, SUPERVISION, AND VIOLATION HANDLING

Article 12. Situations where vehicles can be stopped

1. Stopping vehicles must meet the following requirements:

a) Safety and compliance with legal regulations;

b) Not obstructing traffic operations;

c) Once the vehicle has been stopped, inspection must be conducted, and if a violation is found, it must be handled according to the law.

2. Staff performing patrol and supervision duties may stop vehicles for inspection in the following situations:

a) Directly discovering or detecting through technical means and equipment, recording violations of traffic laws;

b) Implementing orders and plans for patrol and supervision issued by the Director of the Highway Traffic Police Corps or the Provincial Public Security Director or higher;

c) Implementing plans for organizing patrols, supervision, and handling violations to ensure traffic order and safety issued by the Head of the Expressway Highway Traffic Patrol and Supervision Department under the Highway Traffic Police Corps, the Head of the Highway Traffic Police, or the County Public Security Director or higher;

d) Written requests from heads or deputy heads of investigative agencies; written requests from relevant agencies regarding stopping vehicles for inspection to serve security, order maintenance, crime prevention, and combating other illegal activities. Requests must specify the time, route, vehicles to be inspected and processed, and the participating forces;

đ) Reports or accusations about violations of the law by individuals and vehicles involved in traffic.

Article 13. Contents of Patrol

1. The contents of patrol must be reflected in the patrol and control plan approved by the competent authority, aiming to strictly and effectively implement the directives of the Government, the Prime Minister, the Ministry of Public Security, the Director of the Traffic Police Department, and the Provincial Police Director.

2. Officers performing patrol and control duties shall use road traffic vehicles or walk within the assigned areas to conduct patrols and controls, applying professional methods combined with the use of technical equipment to monitor, prevent, detect, promptly stop, and strictly handle violations of laws on traffic order and safety and other violations as prescribed by law.

Article 14. Contents of Control

1. Implementing the control of persons and vehicles participating in road traffic; handling violations of road traffic laws against persons and vehicles participating in road traffic, including the following contents:

a) Controlling relevant documents related to persons and vehicles, including:

- Driver's license; Vehicle registration certificate; Certificate of technical inspection and environmental protection for motor vehicles; Certificate of compulsory civil liability insurance for vehicle owners and other relevant documents related to persons, vehicles, and transportation activities;

- When controlling, it is necessary to compare the documents with each other and between the documents and the actual conditions of persons, vehicles, and goods being transported.

b) Controlling the conditions for participating in traffic of vehicles

- Controlling the technical safety and environmental protection conditions of motor vehicles;

- Controlling front and rear license plates, headlights (high beam, low beam), signal lights, wipers, side mirrors, brake lights, number plate lights, reverse lights;

- Controlling and evaluating the technical condition of the steering system, longitudinal and transverse links, joints; braking system, oil or air lines of the braking system; instruments on the dashboard (pay attention to checking the pressure gauge for vehicles using air brakes); monitoring devices, rescue and emergency equipment (if available); horn and light switches; suspension system; tire size, wear, and air pressure of the vehicle;

- Controlling the installation of fire prevention and firefighting equipment, transportation permits according to the law for passenger-carrying vehicles, fuel-carrying vehicles, and dangerous cargo-carrying vehicles.

c) Controlling road transport activities

- Controlling the specifications, dimensions of goods and objects carried (length, width, height), types, weight of goods or number of people on the vehicle compared to the content stipulated in the documents, the legality of goods, and safety measures;

- In cases where there is evidence that in the transport vehicle or object, there are hidden items of administrative violations, and the person participating in traffic has hidden items or means used for administrative violations in their possession, they may inspect the transport vehicle or object and the person according to administrative procedures; when conducting inspections, they must comply with the provisions of the law on handling administrative violations;

- In cases where criminal offenses are discovered, a record of the incident must be made, the person, items, means, documents, and materials related to the case must be temporarily detained, and a report must be submitted to the competent authority for instructions on how to resolve the matter; the temporary detention of the person, items, means, documents, and materials related to the case must comply with the provisions of the law.

2. Controlling through technical equipment

a) When violations of traffic order and safety by persons and vehicles participating in traffic have been recorded through technical equipment, officers implementing the stop command for control must immediately prepare an administrative violation record and handle it according to regulations. If the violator requests to view images or results of recordings of the violation, they must be shown immediately if such images or results are available; if not available immediately, the violator must be guided to view them when the violation is processed at the unit's office;

b) In cases where the vehicle cannot be stopped immediately for control and handling of violations according to regulations, the Patrol and Control Team Leader must report to the Head of the Expressway Traffic Patrol and Control Department under the Traffic Police Department, the Head of the Traffic Police Department, or the County-level Public Security Director or higher to notify the owner of the vehicle and require the violator to go to the Public Security Office where the violation was discovered for resolution. When resolving the case, the violator must be allowed to view images or results of recordings of their violation; an administrative violation record must be prepared and handled according to regulations.

Article 15. Handling Violations

1. When discovering violations, officers assigned patrol and control tasks must promptly prepare an administrative violation record, except in cases of administrative penalties without preparing a record. If immediate action is needed to stop administrative violations or to ensure compliance with administrative penalty decisions, the Patrol and Control Team Leader must decide or report to the authorized person to decide on the application of preventive measures and ensure the handling of administrative violations. The procedures for preparing administrative violation records, penalties without records, and applying preventive measures and ensuring the handling of administrative violations must comply with the provisions of the law on handling administrative violations.

2. After completing the administrative violation record, the patrol and control officer must deliver the record to the violator and inform the persons on the vehicle about the violations to ensure supervision. For vehicles carrying 16 passengers or more, the assigned patrol and control officer must directly enter the passenger compartment to inform them. Even in cases where no violations are found, notification must still be given and the statement "Thank you for your assistance to the Traffic Police force" must be made.

3. In cases of violations that do not require an administrative violation record to be established or fall within their own jurisdiction without the need for investigation, they may issue on-the-spot administrative penalty decisions or during the time of conducting patrol and supervision activities. For other cases, they must consolidate the violation files and transfer them to the competent authority to issue administrative penalty decisions.

Section 5

ASSIGNMENT OF RESPONSIBILITIES AND COOPERATION RELATIONS IN PATROL WORK,

Staff performing patrol and traffic control on roadway duties shall carry out the tasks of the People's Police force and the specific tasks listed below:

Article 16. Traffic Police Corps

1. Take the lead and coordinate with relevant units in drafting normative legal documents, policies, and guidelines concerning traffic safety and order on roads.

2. Direct, guide, and inspect patrol, supervision, and administrative handling of violations related to traffic safety and order on roads; coordinate with the Inspectorate of the Ministry of Public Security to inspect compliance with laws, regulations, procedures, and internal rules of the People's Public Security Forces in the Traffic Police Force when requested.

3. Develop plans for road traffic patrols and supervision nationwide.

4. Deploy forces of the Traffic Police Corps to organize patrols, supervision, and administrative handling of violations related to traffic safety and order on expressways; take the lead and coordinate with provincial public security organs to organize patrols, supervision, and administrative handling of violations related to traffic safety and order on expressways when necessary.

5. Organize forces of the Traffic Police Corps to independently implement or take the lead and coordinate with provincial public security organs and related forces to implement road traffic patrol and supervision plans approved by the competent authority on national road routes.

Article 17. Provincial Public Security Organs

1. Provincial Public Security Director

a) Direct the Traffic Police Force to conduct road traffic patrols and supervision within their management area;

b) Decide on the assignment of responsibilities, classification of patrol and supervision routes and areas, and administrative handling of violations related to traffic safety and order on roads between the Traffic Police Department and the county-level public security organs according to this Circular;

c) Direct the local Traffic Police Force to cooperate with the Traffic Police Corps' patrol and supervision forces to conduct patrols, supervision, and administrative handling of violations related to traffic safety and order on expressways when required.

2. Traffic Police Department

a) Advise the Provincial Public Security Director to decide on the deployment of forces from the Traffic Police Department and county-level public security organs to organize activities for road traffic patrols, supervision, and administrative handling to ensure traffic safety and order on road routes within the administrative boundaries of the locality;

b) Deploy forces and organize activities for road traffic patrols, supervision, and administrative handling of violations related to traffic safety and order on national highways within the administrative boundaries of the locality; provincial roads, urban roads according to the division of labor decided by the Provincial Public Security Director;

Based on the actual situation of ensuring traffic safety and order on sections of national highways passing through the administrative boundaries of districts, towns, cities under provinces, and towns under counties, the Traffic Police Department advises the Provincial Public Security Director to plan the deployment of forces from the Traffic Police Department to lead and coordinate with the county-level Traffic Police Force to conduct patrols, supervision, and administrative handling of violations related to traffic safety and order according to the law;

c) Guide, inspect, and urge the county-level Traffic Police Force to implement patrol, supervision, and administrative handling of violations related to traffic safety and order on roads.

3. County-level Public Security Organs

a) Deploy forces and organize activities for road traffic patrols, supervision, and administrative handling of violations related to traffic safety and order on county roads, village roads, and specialized roads within the administrative boundaries; provincial roads, urban roads according to the division of labor decided by the Provincial Public Security Director;

b) Coordinate with the Traffic Police Department to conduct patrols, supervision, and administrative handling of violations related to traffic safety and order on sections of national highways passing through the administrative boundaries of districts, towns, cities under provinces, and towns under counties according to the plan of the Provincial Public Security Director.

Chapter III

IMPLEMENTATION

Article 18. Effective Date

This Circular takes effect from February 15, 2016, and replaces Circular No. 65/2012/TT-BCA dated October 30, 2012, issued by the Minister of Public Security, stipulating the tasks, powers, forms, and contents of road traffic patrols and supervision by the Traffic Police Corps.

Article 19. Responsibility for Implementation

1. The Director of the Traffic Police Corps shall be responsible for:

a) Direct, monitor, guide, inspect, and urge the implementation of this Circular;

b) Direct the compilation of training materials for patrol, supervision, and administrative handling of violations related to traffic safety and order on roads;

c) Organize training, inspection, and evaluation of the results of training for patrol, supervision, and administrative handling of violations related to traffic safety and order on roads for officers under the Traffic Police Corps and leaders, commanders, and officers of traffic police units nationwide.

2. The Provincial Public Security Director shall be responsible for

a) Organizing training for traffic police officers under their management according to the training materials compiled by the Traffic Police Corps;

b) Directing and organizing the implementation of patrol, supervision, and administrative handling of violations in the field of road traffic according to this Circular.

3. The heads of the General Departments, heads of units directly under the Ministry of Public Security, Provincial Public Security Directors, and Fire Prevention and Control Police Directors of centrally-administered municipalities are responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, public security units and localities shall report to the Ministry of Public Security (through the Traffic Police Corps) for timely guidance./.
