CIRCULAR

REGULATIONS ON THE LENGTH OF SERVICE IN THE CRYPTOGRAPHIC FIELD

On the basis of The Cryptographic Law dated November 26, 2011;

Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Considering the proposal of the Director of the Government Cryptographic Board;

The Minister of National Defense issues this Circular to regulate the length of service in the cryptographic field.

Article 1. Scope of Regulation

This Circular stipulates the method of calculation, cases eligible for and not eligible for inclusion in the length of service in the cryptographic field, and procedures for recognizing the length of service in the cryptographic field.

Article 2. Applicability

1. Personnel engaged in cryptographic work are military personnel and People's Public Security officers.

2. Personnel engaged in cryptographic work who are not military personnel or People's Public Security officers but receive salaries equivalent to those of military personnel.

3. Cryptographic trainees receive living allowances.

4. Agencies, organizations, and individuals related.

Article 3. Length of Service in the Cryptographic Field

1. The length of service in the cryptographic field includes the time spent working in cryptographic organizations and the time spent as cryptographic trainees receiving living allowances.

2. A period of 12 months of working in cryptographic organizations or being a cryptographic trainee receiving living allowances counts as one year of service in the cryptographic field.

3. The length of service in the cryptographic field is calculated from the date when the competent authority decides on the engagement in cryptographic work or training, retraining, or specialized vocational instruction in cryptography until the decision to terminate employment or study in cryptographic organizations or death during such employment or study.

Article 4. Method of Calculating the Length of Service in the Cryptographic Field

1. Personnel recruited into cryptographic organizations shall have their length of service in the cryptographic field calculated as follows:

a) Personnel assigned, detailed, or appointed to perform cryptographic force tasks shall have their length of service in the cryptographic field calculated from the effective date of the competent authority's decision to engage in cryptographic work;

b) Personnel recruited for training, retraining, or specialized vocational instruction in cryptography shall have their length of service in the cryptographic field calculated from the effective date of the competent authority's decision to enroll;

c) Personnel engaged in other work in cryptographic organizations who switch to cryptographic work shall have their length of service in the cryptographic field calculated from the effective date of the competent authority's decision to engage in cryptographic work.

2. Personnel who cease work in cryptographic organizations and then resume cryptographic work shall have their length of service in the cryptographic field calculated from the effective date of the competent authority's decision to engage in cryptographic work and shall include the previous time spent in cryptographic work.

Example 1: Comrade Le Van A, with a salary coefficient of 5.90 at grade 9/10 under the Cryptographic Technical Salary Scale, Group 1, worked in cryptographic work from October 1980 to December 1994, worked in other jobs within cryptographic organizations from January 1995 to October 2004, ceased work in November 2004, received a decision from the competent authority to resume cryptographic work in October 2007, and continued working until retirement in December 2015. Therefore, Comrade A's length of service in the cryptographic field is calculated as follows:

- From October 1980 to December 1994 = 14 years and 3 months;

- From October 2007 to December 2015 = 8 years and 3 months.

Total = 22 years and 6 months.

3. For personnel with multiple periods of cryptographic work, the length of service in the cryptographic field is the sum of the time spent in cryptographic work during each period.

Example 2: Comrade Tran Thi B, with a salary coefficient of 6.60 at grade 6/9 under the Cryptographic Rank Salary Scale, was a Cryptographic Staff member from February 1985 to February 2000, transferred to another job in March 2000, served as a Cryptographic Section Chief from March 2010 to December 2015, and retired in January 2016. Therefore, Comrade B's length of service in the cryptographic field is calculated as follows:

- From February 1985 to February 2000 = 15 years and 1 month;

- From March 2010 to December 2015 = 5 years and 10 months.

Total = 20 years and 11 months.

Article 5. Other cases eligible for counting towards the length of service in confidential work

In addition to the cases stipulated in Article 3 of this Circular, the following cases are still eligible for counting towards the length of service in confidential work:

1. A person engaged in confidential work who is assigned by an authorized authority to be seconded or sent to study at schools outside the confidential organization.

2. A person engaged in confidential work who falls ill, suffers an accident, or is on maternity leave and is authorized by an authority to seek treatment or convalesce at healthcare facilities, recuperation groups inside and outside the confidential organization, or at home.

3. A person engaged in confidential work who was missing for less than six months during anti-French, anti-American wars, or the war to protect the Fatherland, and whose head of the organization using confidential services confirms that there is no evidence of surrendering to the enemy, betraying the Fatherland, or voluntarily quitting the confidential organization.

4. A person engaged in confidential work who was captured by the enemy and later returned to their agency or unit, if there is no evidence of surrendering to the enemy or betraying the Fatherland, the time spent being captured will still be counted towards the length of service in confidential work.

5. A person engaged in confidential work who was wrongfully convicted by a court and subsequently declared innocent by an authorized court, the time off work due to temporary detention, imprisonment, or serving a sentence will still be counted towards the length of service in confidential work; if they were wrongfully disciplined with dismissal or temporary suspension of duties, and the error was corrected by an authorized authority, the time off work due to wrongful discipline will still be counted towards the length of service in confidential work.

6. A person engaged in confidential work who was sentenced to corrective labor without imprisonment or suspended imprisonment and placed under supervision and education by the agency or unit managing confidential work, the time spent serving the sentence will still be counted towards the length of service in confidential work.

7. A person engaged in confidential work who committed a crime and was sentenced to imprisonment, after completing the prison term if not dismissed from the confidential organization, the time worked before imprisonment will be counted towards the length of service in confidential work.

8. A person engaged in confidential work who stopped working or changed jobs for less than twelve months, if authorized by an authorized authority to continue confidential work, the time spent stopping work or changing jobs will be continuously counted towards the length of service in confidential work.

9. A person engaged in confidential work who is dispatched abroad for more than thirty consecutive days for work, study, or training under the spouse/family member dispatch system for civil servants, public officials, and employees on the payroll of agencies and units, and personnel receiving salaries from armed forces units.

Article 6. Cases ineligible for counting towards the length of service in confidential work

1. A person engaged in confidential work who surrenders to the enemy or betrays the Fatherland.

2. A person engaged in confidential work who commits a crime and is sentenced to imprisonment and dismissed from the confidential organization by an authorized authority, the time spent serving the imprisonment sentence will not be counted towards the length of service in confidential work.

3. A person engaged in confidential work who violates laws on state secrets protection and is dismissed from the confidential organization.

4. A person engaged in confidential work who voluntarily leaves their job and does not return to the agency or unit, the time spent working in the confidential organization prior to leaving voluntarily will not be counted towards the length of service in confidential work.

5. A graduate of a confidential school who has not been assigned work within twelve months after graduation, starting from the thirteenth month, will not be counted towards the length of service in confidential work.

Article 7. Competence, Procedure, and Formalities for Recognizing Years of Confidential Service

1. The Director of the Government Confidential Affairs Board has the authority to decide on recognizing years of confidential service.

2. Documents for Recognizing Years of Confidential Service

a) For individuals currently engaged in confidential work, the documents for recognizing years of confidential service include:

- A certified copy of the Curriculum Vitae or Party Member's Record of the individual engaged in confidential work;

- A letter requesting recognition of years of confidential service from the agency or organization utilizing confidential services according to Model No. 04A issued together with this Circular.

b) For individuals engaged in confidential work who have ceased working in confidential organizations (retirement, transfer to another field, resignation), the documents for recognizing years of confidential service include:

- An application form for confirmation and recognition of years of confidential service according to Model No. 01 issued together with this Circular.

- A certified copy of the Curriculum Vitae of the individual engaged in confidential work during their time working in a confidential organization or Party Member's Record. In cases where there is no record, the retirement, transfer, or resignation file may be referenced, which includes information about the period of confidential work.

- For cases where the documents do not reflect the period of confidential work, the individual engaged in confidential work shall prepare a statement detailing their period of confidential work within the confidential organization, confirmed by the agency or organization directly managing the individual before they ceased working in the confidential organization; if the original agency or organization has been divided, merged, or dissolved, then the superior agency or organization shall confirm according to Model No. 02 issued together with this Circular.

- Confirmation of the period of confidential work by the Head of the agency or organization directly managing the individual engaged in confidential work for cases with complex records, unclear situations, or files that do not clearly show the period of work in the confidential organization, during the resistance against France and America, or special assignments; if the agency or organization directly managing the individual engaged in confidential work has been divided, merged, or dissolved, then the superior agency or organization shall confirm according to Model No. 03 issued together with this Circular.

3. Procedure and Formalities for Recognizing Years of Confidential Service

a) For individuals currently engaged in confidential work, the Head of the agency or organization directly utilizing confidential services shall complete the documents according to Point a Clause 2 Article 2 of this Regulation and submit them to the Confidential Affairs Bureau of the relevant Ministries and sectors according to the organizational management system for individuals engaged in confidential work.

b) For individuals engaged in confidential work who have ceased working in confidential organizations (retirement, transfer to another field, resignation), the individual shall complete the documents according to Point b Clause 2 Article 2 of this Regulation and submit them to the Confidential Affairs Bureau of the relevant Ministries and sectors according to the organizational management system for individuals engaged in confidential work before ceasing work in the confidential organization.

c) Within fifteen working days from the date of receiving complete and valid documents as stipulated in Clause 2 Article 2 of this Regulation, the Confidential Affairs Bureau of the relevant Ministries and sectors shall be responsible for checking the validity of the documents and sending a letter to the Government Confidential Affairs Board according to Model No. 04B issued together with this Circular; if the documents are invalid, the Confidential Affairs Bureau of the relevant Ministries and sectors shall issue a notice and guide the organization or individual to complete the documents within five working days from the date of receipt of the documents.

d) Within fifteen working days from the date of receiving complete and valid documents, the Political Department - Organization/Confidential Affairs Board shall be responsible for reviewing, reporting to the Director of the Government Confidential Affairs Board for consideration and decision on recognizing years of confidential service according to Model No. 05 issued together with this Circular.

Article 8. Effective Date

1. This Circular takes effect from January 4, 2016.

2. There will be no retroactive calculation of years of confidential service for those who have already been decided on the recognition of years of confidential service before the effective date of this Circular.

Article 9. Responsibility for implementation

1. The Director of the Government Confidential Affairs Board, the Heads of agencies and organizations utilizing confidential services, and related agencies and units shall organize the implementation of this Circular.

2. During the implementation process, if there are any difficulties, please report to the Government Confidential Affairs Board for consolidation and reporting to the Minister of National Defense for consideration and resolution.
