Pursuant to Decree No. 95/2012/ND-CP dated November 12, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign trade agency activities;
To implement the Vietnam-Eurasian Economic Union Free Trade Agreement, officially signed on May 29, 2015 in the Republic of Kazakhstan and approved by the President of the Socialist Republic of Vietnam under Decision No. 1805/QD-NN dated August 19, 2015;

The Minister of Industry and Trade issues this Circular regulating the application of quota duty import licenses for tobacco leaf and poultry eggs from member countries of the Eurasian Economic Union in 2017, 2018 and 2019.
Article 1. Scope of Regulation
Quota duty import licenses shall be applied to tobacco leaf and poultry eggs originating from member countries of the Eurasian Economic Union according to the Vietnam-Eurasian Economic Union Free Trade Agreement.
Article 2. Applicability
This Circular applies to traders importing tobacco leaf and poultry eggs from member countries of the Eurasian Economic Union under quota duty import licenses and other organizations and individuals related thereto.
Article 3. Goods and Quantity of Quota Duty Import Licenses
The commodity codes and total quantities of quota duty import licenses for 2017, 2018 and 2019 for the goods subject to quota duty import licenses as stipulated in Article 1 of this Circular shall be implemented according to the Appendix attached hereto.
Article 4. Principles for Applying Import Duty Rates within Quota Duty Import Licenses
Imported goods must have a Certificate of Origin issued by the competent authority of the member countries of the Eurasian Economic Union (abbreviated as C/O Form EAV).
For tobacco leaf specifically, Vietnamese traders with import licenses for tobacco leaf under quota duty import licenses issued by the Ministry of Industry and Trade pursuant to Circular No. 04/2014/TT-MININD dated January 27, 2014 of the Ministry of Industry and Trade detailing certain provisions of Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign trade agency activities are permitted to import (directly or through entrusted imports). The quantity imported will be deducted from the quota duty import license quantity specified in the import license issued by the Ministry of Industry and Trade.
Article 5. Import Procedures
Procedures for importing tobacco leaf and poultry eggs shall be handled at the customs office where the import procedures are carried out, following the principle of automatic rollover until the end of the quota duty import license quantity for each item specified in the Appendix attached hereto.
Article 6. Tariff Rate for Import Duties
Import duty rates within quota duty import licenses and outside quota duty import licenses for tobacco leaf and poultry eggs imported from member countries of the Eurasian Economic Union shall be implemented according to the regulations of the Government.
Article 7. Effective Date
This Circular takes effect from March 14, 2017 to December 31, 2019./.
