DETAILING CLAUSE 2 OF ARTICLE 21 OF DECREE NO. 173/2016/NĐ-CP DATED DECEMBER 27, 2016 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF INSPECTION IN THE CULTURE, SPORTS, AND TOURISM SECTOR
Pursuant to Decree No.76/2013/NĐ-CP dated July 16, 2013 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports, and Tourism;Pursuant to Decree No. 173/2016/NĐ-CP dated December 27, 2016 of the Government stipulating the organization and operations of inspection in the culture, sports, and tourism sector;Upon the proposal of the Inspector General of the Ministry of Culture, Sports, and Tourism after consultation with the Chief Inspector of the Government;The Minister of Culture, Sports, and Tourism promulgates this Circular detailing Clause 2 of Article 21 of Decree No. 173/2016/NĐ-CP dated December 27, 2016 of the Government stipulating the organization and operations of inspection in the culture, sports, and tourism sector.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation This Circular regulates uniforms, equipment lists, technical devices, preservation, and use of such equipment for inspection activities in the culture, sports, and tourism sector. Article 2. Applicability This Circular applies to cultural, sports, and tourism inspection agencies, inspectors, civil servants working at these inspection agencies.
Chapter II
UNIFORMS, EQUIPMENT LIST, AND TECHNICAL DEVICES OF INSPECTION IN THE CULTURE, SPORTS, AND TOURISM SECTOR
Article 3. UniformsThe uniforms of inspectors in the culture, sports, and tourism sector shall be implemented according to Circular No. 02/2015/TT-TTCP dated March 16, 2015 of the Government Inspectorate stipulating uniforms for civil servants, inspectors, officials, and staff members at state inspection agencies. The management and issuance of uniforms shall comply with relevant laws.
Article 4. Equipment List
1. The list of equipment and technical devices serving inspection activities includes:
a) Special-purpose transportation means (special-purpose cars, motorcycles, boats, speedboats);
b) Light intensity measurement device;
c) Sound intensity measurement device, noise level meter;
d) pH measuring device, swimming pool water quality standard equipment;
e) Wastewater rapid testing device;
f) Airborne dust and air quality measurement device;
g) Audio recording, video recording, camera devices;
h) Laptop, portable printer, mobile phone;
i) Fax machine, photocopier, scanner;
j) Other office equipment as prescribed by law.
2. In addition to the equipment and technical devices specified in Clause 1 of this Article, when necessary, cultural, sports, and tourism inspection agencies may be equipped with additional devices to serve inspection work, handling complaints, petitions, receiving citizens, and preventing corruption.
d) Rapid wastewater testing equipment;
e) Airborne dust measurement equipment and air quality monitoring equipment;
g) Audio recording devices, video recording devices, cameras;
h) Laptop computers, portable printers, mobile phones;
i) Fax machines, photocopiers, scanners;
k) Other office equipment as prescribed by law.
2. In addition to the technical means and equipment specified in Clause 1 of this Article, when necessary, the Cultural, Sports and Tourism Inspection Authority may be equipped with additional technical means and equipment to serve inspection work, handling complaints, reports, receiving citizens, and preventing and combating corruption.
Article 5. Management and use of technical equipment and devices
The management and use of technical equipment and devices shall be carried out in accordance with the provisions of laws on the management and use of state assets.
Chapter III
IMPLEMENTATION PROVISIONS
Article 6. Effective Date
1. This Circular takes effect from April 10, 2017.
2. This Circular replaces Circular No. 10/2010/TT-BVHTTDL dated September 9, 2010 of the Minister of Culture, Sports and Tourism detailing Article 20 of Decree No. 71/2009/NĐ-CP dated August 28, 2009 of the Government on the organization and operation of Cultural, Sports and Tourism Inspectors.
Article 7. Responsibility for Implementationfor implementation
1. The Director of the Ministry’s Office, the Chief Inspector of the Ministry, the Head of the Department of Planning and Finance, Directors of Departments of Culture, Sports and Tourism, Directors of Departments of Culture and Sports, Directors of Tourism Departments of provinces and centrally-administered cities, relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
2. The Ministry’s Inspectorate is responsible for deploying and monitoring the implementation of this Circular.
3. During the course of implementation, if there are any difficulties, relevant agencies, units, organizations, and individuals should promptly report to the Ministry of Culture, Sports and Tourism (Inspectorate) for study, consideration, and adjustment./.
