REGULATIONS ON THE IMPLEMENTATION OF DAYTIME CHEMOTHERAPY, RADIOTHERAPY, AND COMBINED CHEMORADIOTHERAPY AT HEALTH CARE FACILITIES

Pursuant to the Law on Health Care and Treatment 2009;Decree No. 63/2012/NĐ-CP dated August 31, 2012 of the Government stipulating functions, tasks, powers, and responsibilities;

hereby promulgates this Circular regulating the implementation of daytime chemotherapy, radiotherapy, and combined chemoradiotherapy at health care facilities.Article 1. This Circular regulates the implementation of daytime chemotherapy, daytime radiotherapy, and combined daytime chemoradiotherapy (hereinafter referred to as chemotherapy, radiotherapy, and chemoradiotherapy during the day).Article 2. This Circular applies to patients who have been prescribed daytime radiotherapy, chemotherapy, or combined chemoradiotherapy and healthcare facilities that have been approved by competent authorities to perform chemotherapy, radiotherapy techniques (or treatment with radioactive isotopes).

THE MINISTER OF HEALTH Article 2. Regulations on the Implementation of Daytime Chemotherapy, Radiotherapy, and Combined Chemoradiotherapy at Healthcare FacilitiesClause 1. Daytime chemotherapy, daytime radiotherapy, and combined daytime chemoradiotherapy are forms of inpatient treatment at healthcare facilities during working hours.Clause 2. The procedures for medical examination and treatment, professional technical processes, management of medical records, and medical examination and treatment costs (excluding bed fees) for the form of daytime chemotherapy, radiotherapy, or combined chemoradiotherapy shall be implemented according to regulations applicable to inpatient medical examination and treatment.As for the bed fee for daytime chemotherapy, radiotherapy, or combined chemoradiotherapy, it shall be implemented according to Circular No. 37/2015/TTLT-BYT-BTC dated October 29, 2015 issued jointly by the Ministry of Health and the Ministry of Finance, which stipulates unified prices for medical services under health insurance between hospitals of the same level nationwide.

Article 1. Scope of Regulation and Applicability

Clause 3. The prescription for patients to undergo daytime radiotherapy, chemotherapy, or combined chemoradiotherapy is decided by the treating physician based on the patient's health condition and disease status and is only applicable to patients residing (permanent or temporary residence) within the province or centrally-administered city where the healthcare facility operates. In cases where patients do not reside within the province or centrally-administered city where the healthcare facility operates, daytime treatment can only be applied to voluntary patients and not to poor or near-poor patients.

Clause 4. Monitoring the progression of the patient's disease

Point a. Patients undergoing daytime chemotherapy, radiotherapy, or combined chemoradiotherapy are examined clinically and paraclinically daily or according to the schedule set by the treating physician. Daily examinations during treatment are not charged according to the regulation.

Point b. In cases where the disease progresses severely, the treating physician decides to transfer the patient for 24-hour monitoring and treatment. This examination is counted as one medical examination according to the regulation.

Clause 5. Coordination among specialties

When implementing daytime chemoradiotherapy, depending on the patient's disease status and the conditions of the healthcare facility, the patient may be referred by the chemotherapy or radiotherapy department or the clinical department to undergo daytime chemotherapy, radiotherapy, or combined chemoradiotherapy, with the department being responsible for maintaining the medical record.

Clause 6. Dispensing Medication

Medications used for patients undergoing daytime chemotherapy, radiotherapy, or combined chemoradiotherapy are dispensed daily or per treatment cycle.

This Circular takes effect from May 1, 2017.

Clause 1. The Department of Medical Examination and Treatment, Ministry of Health, serves as the lead agency coordinating with relevant units to implement this Circular.

Clause 2. The Vietnam Social Security directs provincial social security agencies, the Social Security of the Ministry of Defense, and the Social Security of the Ministry of Public Security to coordinate with the Department of Health and healthcare facilities to settle medical examination and treatment costs for patients with health insurance cards undergoing daytime chemotherapy, radiotherapy, or combined chemoradiotherapy.

Clause 3. Heads of agencies and units: Departments of Health, Health Ministries, and sectors serve as the lead agencies coordinating with relevant units to implement this Circular within their respective jurisdictions.

Medicines for patients undergoing daytime chemotherapy, daytime radiotherapy, or daytime chemoradiotherapy shall be issued daily or per treatment course to patients.

Article 3. Effectiveness

This Circular takes effect from May 1, 2017.

Article 4. Organization of Implementation

1. The Department of Medical Examination and Treatment under the Ministry of Health shall act as the lead agency coordinating with relevant units to organize the implementation of this Circular.

2. The Vietnam Social Security shall instruct the Social Security Departments of provinces and centrally governed cities, the Social Security Department of the Ministry of National Defense, and the Social Security Department of the Ministry of Public Security to coordinate with the Health Departments and healthcare facilities to settle medical examination and treatment costs for patients holding health insurance cards undergoing daytime chemotherapy, daytime radiotherapy, or daytime chemoradiotherapy.

3. Heads of agencies and units: Health Departments, Health Departments of Ministries and sectors shall act as the lead agency coordinating with relevant units to organize the implementation of this Circular within their respective management scope.

4. Heads of healthcare facilities that conduct chemotherapy and radiotherapy shall be responsible for organizing the implementation of this Circular, organizing patient flow management, 24/24-hour inpatient beds, and separate day inpatient treatment, ensuring that day inpatients are not mixed with 24/24-hour inpatients.

Article 5. Responsibilities for Implementation

The Director of the Department of Medical Examination and Treatment, the Head of the Ministry's Office, the Inspector General, the Heads of Departments, Directors of Bureaus, and General Directors of the Bureaus and General Departments under the Ministry of Health, the Vietnam Social Security, the Directors of Health Departments, the Heads of Health Sectors, and the Heads of related agencies, organizations, and units shall be responsible for implementing this Circular. In the process of implementation, if there are difficulties or obstacles, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Health (Department of Medical Examination and Treatment) for research and resolution.
