Pursuant to the Law is agencies and organizations registered to participate in the System with one or more roles as follows: ficer Ch"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."ngày 25 tháng 12 năm namend2001;

Article 1

5. Về y tế dự phòng:

a) Xây dựng, ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành các văn bản quy phạm pháp luật, các quy định chuyên môn, các tiêu chuẩn, quy chuẩn kỹ thuật quốc gia về các lĩnh vực: Giám sát, phòng, chống bệnh truyền nhiễm, HIV/AIDS, bệnh không lây nhiễm, bệnh nghề nghiệp, tai nạn thương tích; kiểm dịch y tế biên giới; vệ sinh sức khỏe môi trường, vệ sinh sức khỏe lao động, vệ sinh sức khỏe trường học; vệ sinh chất lượng nước uống, nước sinh hoạt; dinh dưỡng cộng đồng; hóa chất gia dụng và hóa chất, chế phẩm diệt côn trùng, diệt khuẩn dùng trong lĩnh vực gia dụng và y tế;amend17 ||| Ban hành, sửa đổi, bổ sung danh mục bệnh truyền nhiễm thuộc các nhóm, danh mục bệnh truyền nhiễm bắt buộc phải sử dụng vắc xin, sinh phẩm y tế và tổ chức thực hiện việc tiêm chủng vắc xin và sinh phẩm y tế cho các đối tượng bắt buộc theo quy định của pháp luật;

a) Establish and submit to competent authorities for issuance mechanisms and policies to implement the inheritance, conservation, development, modernization of traditional medicine, and the integration of traditional medicine with modern medicine;

b) Develop, issue, or submit to competent authorities for issuance normative legal documents, specialized regulations, standards, and technical norms at the national level concerning the field of traditional medicine;y|||

c) Issue, reissue, adjust, revoke certificates of practice for traditional medicine diagnosis and treatment; issue, reissue, adjust, revoke certificates of recognition for family hereditary prescriptions and permits for operation of medical facilities providing traditional medicine diagnosis and treatment according to the provisions of the law;y |||

d) Review the specialized content of registration files for advertising activities related to traditional medicine diagnosis and treatment according to the provisions of the law;

g) Direct, guide, inspect, and supervise the implementation of mechanisms, policies, normative legal documents, specialized regulations, and technical standards in the field of traditional medicine;No.2. 8. Regarding medical equipment and health care facilities:

a) Develop and submit to competent authorities for publication national technical standards on medical equipment; issue specialized regulations and national technical standards on medical equipment;

b) Issue a list of essential medical equipment for healthcare units;o |||

c) Issue, suspend, revoke certificates of circulation for domestically produced medical equipment, import permits for medical equipment that directly affect human health according to the list of the Ministry of Health; review the specialized content of registration files for advertising medical equipment according to the provisions of the law;in|||policies5. a) Develop and issue or submit to competent authorities for issuance normative legal documents, specialized regulations, national technical standards on pharmaceuticals and cosmetics; national standards on drugs; issue the Vietnamese Pharmacopoeia and National Drug Formulary;

b) Issue, revoke certificates of practice for pharmacists registered to practice foreign-invested pharmacy; certificates of eligibility to operate drug businesses for drug manufacturing facilities, drug storage service facilities, drug testing service facilities; drug circulation permits; drug export and import permits; permits for foreign enterprises supplying drugs to Vietnam to conduct drug business activities in Vietnam; certificates of compliance with Good Manufacturing Practice (GMP), Good Laboratory Practice (GLP), Good Storage Practice (GSP), and Good Clinical Trial Practice (GCP) for drug business entities according to the provisions of the law; issue, cancel certificates of Good Pharmacy Practice (GPP) chain store enterprises;developmentIssue, revoke certificates of compliance with Good Manufacturing Practice (CGMP) for cosmetics; acceptance numbers for cosmetic product declarations; acceptance forms for Good Agricultural Practices (GAP) and Good Harvesting Practices (GHP) declaration and certificates of free circulation for drug and cosmetic business units according to the provisions of the law;rime Minister cManage the quality of drugs and cosmetics; decide on suspending circulation and recalling drugs and cosmetics according to the provisions of the law; coordinate with relevant agencies to prevent and combat the production, circulation of counterfeit and substandard drugs and cosmetics, and smuggling of drugs and cosmetics;amendg) Review the specialized content of registration files for drug advertising;N ||| declaration of customs import procedures. Implement state management over drug prices and use measures to stabilize drug prices on the market according to the provisions of the law;

c) Direct, guide, organize implementation, and inspect, supervise rational, safe, and effective drug use;

d) Direct, guide organization implementation, and inspect, supervise the implementation of laws and regulations in the pharmaceutical and cosmetic fields;rime Minister cOn food safety:

Lead in developing and issuing or submitting to competent authorities for issuance normative legal documents on food safety within the scope of management assigned to the Ministry;

e) Lead in developing and issuing national technical standards or regulations on criteria and safety limits for all food products; issue national technical standards for food additives, processing aids, utensils, and materials in direct contact with food according to the provisions of the law;

g) Issue general regulations ensuring food safety for food production and business establishments; issue specific regulations on conditions ensuring food safety for collective dining kitchens, hotels, resorts, restaurants, catering service establishments, and street food vendors;

h)||| Designate organizations to certify conformity for food products, food additives, processing aids, utensils, and materials in direct contact with food that have issued technical standards based on consultations from relevant ministries and sectors when necessary;rime Minister cm shall be used.

10. g) Lead in organizing food safety awareness campaigns, disseminating knowledge, and educating the public about food safety laws; monitor, prevent, investigate, and coordinate to stop food poisoning and food safety incidents under the Ministry's jurisdiction;

a) Manage food safety throughout the production, processing, preservation, transportation, export, import, and business processes for food additives, processing aids, bottled water, mineral water, functional foods, nutrient-enriched foods, utensils, and materials in direct contact with food according to the provisions of the law;

b) Issue certificates of conformity declaration, certificates of compliance with food safety regulations for processed packaged foods, food additives, processing aids, utensils, and materials in direct contact with food;June 2024;13. Regarding water resources:

c) Issue certificates of content approval for food additive, processing aid, utensil, and material in direct contact with food advertisements and food products under the Ministry's jurisdiction;ondocuments ensuring food safety for collective kitchens, hotels, resorts, restaurants, food service businesses, and street food vendors;

) Take the lead in organizing the implementation of training work;ênform, disseminate knowledge, educate laws on food safety;June 2024;nstruct, prevent, investigate, and coordinate to prevent food poisoning and food safety incidents within the scope of management of the Ministry;June 2024;Manage food safety throughout the production, preliminary processing, processing, storage, transportation, export, import, and business operations involving food additives, food processing aids, bottled water, mineral water, functional foods, nutrient-enriched foods, food processing equipment, containers, packaging materials that come into direct contact with food as prescribed by law;

e) Issue, suspend, revoke certificates of conformity declaration for processed ready-to-eat foods, food additives, food processing aids, food processing equipment, containers, packaging materials;aeclaration of conformity for food additives, food processing aids, food processing equipment, containers, packaging materials, and products mineral water natural, functional foods, nutrient-enriched foods, food processing equipment, containers, packaging materials that come into direct contact with food as prescribed by law;

g) Issue certificates confirming advertising content for food additives, food processing aids, food processing equipment, containers, packaging materials, and products

h)||| under the management of the Ministry;rime Minister cSubmit to competent authorities for approval of planning and training human resources in the health sector and special mechanisms and policies in training human resources in the health sector;

12. Regarding environmental protection in healthcare activities:

a) Leading, coordinating with the Ministry of Natural Resources and Environment, the Ministry of Construction to build and submit to competent authorities for promulgation regulations, standards, technical standards on environmental protection in healthcare activities, environmental protection in funeral and cremation activities and

d) Directing, guiding the organization of implementation of measures to protect human health from the impact of climate change, environmental pollution and adverse environmental factors;

13. d) Leading, guiding the organization of implementation and inspecting, supervising the implementation of normative legal documents, technical standards on the management and destruction of medical waste and environmental protection

d) Guide the registration of activities for sports clubs, grassroots physical education and sports facilities, and cheerleading clubs.nationalManage training institutions for health

16. Institute of Health Strategy and Policy.

a) Develop, submit to competent authorities for issuance consolidated documents, policies, strategies, plans, and national technical standards on scientific research and technological development in the healthcare sector, clinical trials, and bioethics in the medical field.policies;

b) Guide, organize implementation, and supervise and evaluate the dissemination and application of scientific research results, new technologies, and the transfer of new medical technologies.i Implement new medical technologies.

c) Manage national technical standards in the healthcare sector according to the law; guide and monitor the dissemination and application of national technical standards within the healthcare sector.

d) Organize the implementation of agreements on technical barriers to trade (TBT) in the healthcare sector.

17. Regarding information technology:

a) Develop strategies, plans, and organize the implementation of information technology applications and development in the healthcare sector.

b) Develop and issue technical standards on information technology applications and development in the healthcare sector.

c) Develop, issue, and organize the implementation of regulations on medical activities on the internet.

d) Direct, guide, organize the application of information technology throughout the healthcare sector.

18. Carry out international cooperation in areas under the Ministry's jurisdiction according to the law.; Inspect compliance with legal provisions and resolve complaints, petitions, and suggestions related to areas under the Ministry's jurisdiction; implement anti-corruption measures and handle violations of law in areas under the Ministry's jurisdiction according to the law.

Article 4. Effectiveness

This Decree takes effect from October 20, 2012.

This Decree replaces Government Decree No. 188/2007/NĐ-CP dated December 27, 2007 on the functions, tasks, powers, and organizational structure of the Ministry of Health, and Government Decree No. 22/2010/NĐ-CP dated March 9, 2010a i, bi, and supplements Article 3 of Government Decree No. 188/2007/NĐ-CP dated December 27, 2007 on the functions, tasks, powers, and organizational structur, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP based on Decree No. 24/2014/ND-CP dated April 4, 2014 issued by the Governmentpolicies; abolishes previous provisions that conflict with this Decree.

Article 5. Responsibilities

Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen DECREES:h provincial people's committees, cities directly under the Central Government are responsible for implementing this Decree./.h councillor.
