Regulations on the management and use of funds to ensure traffic safety order

Pursuant to Resolution No. 50/2017/QH14 of the National Assembly on the allocation of the central budget for 2018;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law;
Decree No. 87/2017/Decree No. 26 the 7 Article 2. Pursuant to Decision No. 22/2017/QĐ-TTg dated June 22, 2017 of the Prime Minister on the organization and operation of the National Traffic Safety Committee and Provincial Traffic Safety Committees under the Central Government;
Implementing Resolution No. 01/NQ-CP dated January 1, 2018 of the Government on tasks and key solutions to implement the socio-economic development plan and state budget estimate for 2018;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance issues this Circular these regulations stipulate the management and use of funds to ensure traffic safety order as follows:
Article 1. Scope of Regulation and Applicability

a) These Circulars stipulate the management and use of funds to ensure traffic safety order (hereinafter referred to as traffic safety order).
b) These Circulars do not regulate the source of funds ensuring the operation of the Office of the National Traffic Safety Committee and the Office of the Provincial Traffic Safety Committees according to the staffing authorized by the competent authority and the administrative management expenditure allocation standard prescribed in Decision No. 46/2016/QĐ-TTg dated October 19, 2016 of the Prime Minister on the standard for allocating the regular budget expenditure estimate for 2017.
2. Scope of application.
a) The National Traffic Safety Committee;
b) The Ministry of Transport, the Ministry of Public Security, People's Councils and People's Committees of provinces and centrally governed cities;
c) Provincial Traffic Safety Committees and Traffic Safety Committees at the district level;
d) Direct forces participating in ensuring traffic safety order under the Ministry of Public Security, the Ministry of Transport, and the People's Committees of provinces and centrally governed cities;
đ) Other agencies, units, organizations, and individuals related to the management and use of funds to ensure traffic safety order.
Article 2. Sources of funds to ensure traffic safety order
1. State budget allocated from the sources of economic activities' expenses according to the current budget management hierarchy within the regular budget estimates of ministries, central agencies, and localities;
2. Central budget supplemented with specific purposes for local budgets. During the period 2018-2020, the central budget will supplement local budgets with 70% of the revenue from fines for administrative violations in the field of traffic safety that accrue to the central budget on each locality's territory in the previous year immediately preceding the current year (the 2018 estimate will be based on the actual performance of 2016; the 2019 estimate will be based on the actual performance of 2017, and the 2020 estimate will be based on the actual performance of 2018).
3. Support and aid from domestic and foreign organizations and individuals for traffic safety assurance activities;
4. Other income sources as prescribed by law.
Article 3. Contents of expenditures to ensure traffic safety order
1. Common expenditure contents
c) Expenditure on inspection and supervision activities regarding the work of ensuring traffic safety order;
d) Expenditure on training in traffic safety order business;
đ) Expenditure on night shift wages and overtime pay directly serving the work of ensuring traffic safety order according to current laws;
e) Expenditure on purchasing equipment and means of transport serving the work of ensuring traffic safety order according to current standards and regulations;
g) Expenditure on fuel, repair of equipment and means of transport serving the work of ensuring traffic safety order;
h) Expenditure on statistics, data analysis; building, maintaining, and updating databases serving the work of ensuring traffic safety order;
i) Expenditure on rewarding collectives and individuals with outstanding achievements in the work of ensuring traffic safety order according to current laws;
k) Expenditure on international cooperation in traffic safety order;
l) Expenditure on condolences and support for traffic accident victims and their families in particularly serious accidents during Tet holidays and "World Day of Remembrance for Road Traffic Victims";
m) Other expenditures directly serving the work of ensuring traffic safety order.
a) Expenditure on developing programs and plans to implement national strategies, projects, and inter-ministerial coordination measures to ensure traffic safety order, to be submitted to the competent authority for approval so that ministries, sectors, and localities can implement them;
b) Expenditure on directing, managing, coordinating, inspecting, urging ministries, sectors, and localities to address and mitigate the consequences of particularly serious traffic accidents, sudden and complex issues ensuring traffic safety order nationwide;
c) Expenditure on rectifying traffic safety hazards, preventing traffic congestion;
d) Expenditure on promoting exemplary models for ensuring traffic safety order;
đ) Expenditure on implementing other tasks assigned by
3. Special expenditure contents for ensuring traffic safety order at the Ministry of Public Security
a) Expenditure on conducting traffic accident investigations;
b) Expenditure on training for officers and soldiers directly involved in ensuring traffic safety order at night (including other police forces participating directly in the task of ensuring traffic safety order as prescribed in Decree No. 27/2010/NĐ-CP dated March 24, 2010 of the Government on mobilizing other police forces and village police to cooperate with traffic police in patrolling and controlling traffic safety order on roads when necessary and Circular No. 47/2011/TT-BCA dated July 2, 2011 of the Ministry of Public Security detailing the implementation of some provisions of Decree No. 27/2010/NĐ-CP of the Government);
c) Expenditure on repairing, maintaining, improving, upgrading, and expanding command posts, teams, traffic control stations, temporary holding places for vehicles violating traffic safety order;
d) Expenditure on centralized procurement of certain means and equipment needed uniformly to serve the work of ensuring traffic safety order, decided by the Minister of Public Security according to current standards and regulations.
đ) Expenditure on supporting public security in some localities with difficult revenue sources to serve the work of ensuring traffic safety order in their areas. The Minister of Public Security shall issue criteria, principles, and support contents to unify the implementation.
a) Expenditure for planning and implementing measures to coordinate among departments, sectors, and authorities at all levels (including commune level) in ensuring traffic safety and alleviating traffic congestion;
b) Expenditure for special tasks of the provincial police force as stipulated in points a, b, and c, Clause 3, Article of this provision;
c) Expenditure for developing programs and projects on ensuring traffic safety, promoting exemplary models in ensuring traffic safety;
d) Expenditure for directing, inspecting, and urging cooperation activities among sectors, organizations, and mass organizations in the field of ensuring traffic safety, alleviating traffic congestion within the area, rescue operations, and mitigating consequences caused by traffic accidents;
đ) Expenditure for repairing traffic safety incidents and preventing traffic congestion;
e) In cases where localities establish Traffic Safety Committees at district, county, and city levels under provinces according to Clause 1, Article 7 of Decision No. 22/2017/QĐ-TTg dated June 22, 2017 of the Government Chairman: The expenditure for ensuring traffic safety at district, county, and city levels under provinces shall be regulated by the Chairman of the People's Committee of the province or centrally-administered city, ensuring consistency based on the provisions of this Circular;
g) Expenditure for other tasks directly serving the work of ensuring traffic safety as decided by the Chairman of the People's Committee of the province or centrally-administered city;
Article 4. Levels of expenditure
1. The level of expenditure for ensuring traffic safety shall be implemented according to the current financial expenditure standards and regulations prescribed by competent state agencies;
2. For items of expenditure without specified levels set by competent state agencies, the Chairman of the National Traffic Safety Committee, the Minister of Transport, the Minister of Public Security, and the People's Councils of provinces and centrally-administered cities shall decide to apply expenditure levels for similar tasks and contents that have been prescribed by authorized bodies, with valid invoices and supporting documents, within the allocated budget and bear responsibility for their decisions;
3. Some specified expenditure levels are as follows:
a) Expenditure for working expenses, conferences, and training sessions to implement tasks and work related to ensuring traffic safety shall be carried out according to Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance on working expense regulations and conference regulations;
b) Expenditure for vocational training on traffic safety shall be implemented according to the laws on using state budget funds for training and upgrading civil servants, public officials, and employees;
c) Expenditure for awards shall be implemented according to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Commendation and Awards;
d) Expenditure for慰问交通事故受害者及其家庭:
- 在特别严重的交通事故中:对每名死亡人员的救助不超过500万越南盾;对每名重伤人员的救助不超过200万越南盾;
- 在春节和“世界道路交通事故受害者纪念日”期间:对每名重伤人员及其因交通事故而陷入困境的家庭的慰问不超过200万越南盾。
đ) 对直接参与夜间交通安全保障工作的干部、战士(包括根据政府第27/2010/NĐ-CP号决定规定的其他直接参与交通安全保障任务的警察力量)的补贴标准:每人每班最高10万越南盾(每班不少于4小时)。
Article 5. Establishment, allocation, implementation, and settlement of funds for traffic safety assurance
1. The establishment, allocation, implementation, and settlement of funds for traffic safety assurance shall be carried out in accordance with the provisions of the State Budget Law and guiding documents thereof.
2. This Circular provides additional guidance on the establishment and allocation of budget estimates:
Annually, along with the time for establishing the state budget revenue and expenditure plan for the year, agencies and units assigned the task of ensuring traffic safety shall establish the budget estimate for traffic safety assurance funds and consolidate them into the annual state budget revenue and expenditure plan of the Ministry, agency, or unit to submit to the financial authority at the same level for consolidation and reporting to the competent authority for approval in accordance with regulations; including:
a) For the National Traffic Safety Committee, the Ministry of Transport
The Ministry of Transport shall establish the budget estimate for traffic safety assurance funds, consolidating the funds for implementing traffic safety assurance tasks of the National Traffic Safety Committee prepared by the Committee's Office.
b) For the Ministry of Public Security
The Ministry of Public Security shall establish the budget estimate for expenditures on traffic safety assurance from the administrative penalty revenue allocated for traffic safety.
During the period 2018-2020, the Ministry of Public Security shall establish the budget estimate for expenditures on traffic safety assurance corresponding to 30% of the administrative penalty revenue for traffic safety from the central budget received in the previous year immediately preceding the current year, including in detail:
- For the Ministry of Public Security and its subordinate units directly implementing the tasks;
- To support public security forces in some localities with difficult revenue sources to serve traffic safety assurance work in their respective areas.
- Departments of Transport, Provincial Police, Municipal Police under Central Government, and all levels of Traffic Safety Committees shall establish the budget estimate for traffic safety assurance funds according to the assigned tasks and submit them to the financial authorities at the same level for consideration and consolidation into the annual state budget expenditure plan to report to the People's Councils of provinces and centrally governed cities for submission to the People's Assembly of the province in accordance with regulations. Specifically, for Provincial Police and Municipal Police under Central Government, they shall establish the budget estimate including the funds for implementing traffic safety assurance tasks of the police forces at the district, town, city, and commune levels within the province, and police stations and towns, sending it to the local financial authority, and also sending it to the Ministry of Public Security for monitoring and managing the police force.
- The People's Councils of provinces and centrally governed cities shall decide the allocation level of central government supplementary budget funds with specific purposes for local budgets from administrative penalty revenue in the field of traffic safety for provincial and municipal police forces to implement traffic safety assurance tasks in their respective areas in accordance with Point b, Clause 9, Article 9 of the State Budget Law and the allocation level for other local forces participating in traffic safety assurance work in their respective areas in accordance with the regulations of the competent authority.
In 2018 specifically, localities shall use 70% of the central government supplementary budget funds for localities from administrative penalties in the field of traffic safety for provincial and municipal police forces to implement traffic safety assurance tasks in their respective areas, while the remaining 30% shall be allocated to other local forces participating in traffic safety assurance work in their respective areas in accordance with Point 7.2, Clause 7, Section II of Resolution No. 01/NQ-CP dated January 1, 2018 of the Government on major tasks and solutions to implement the socio-economic development plan and state budget estimate for 2018.
- Expenditures for the provincial and municipal police forces shall be implemented through the payment order form prescribed in Article 19 of Circular No. 342/2016/TT-BTC dated December 30, 2016 of the Ministry of Finance detailing and guiding the implementation of certain provisions of Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law.
Organizations and individuals using funds for traffic safety assurance must spend them according to the contents approved by the competent authority and within the state budget expenditure plan already assigned, ensuring compliance with the current state expenditure regulations; they must accept inspection and supervision by the competent authority; and they must settle accounts annually in accordance with current laws.
Article 6. Inspection Work
The National Committee for Traffic Safety, the Ministry of Transport, the Ministry of Public Security, the Department of Transport, and the Traffic Safety Committees shall cooperate with the financial authorities at the same level to conduct regular and spot inspections of agencies and units regarding their implementation of tasks and funds allocated for traffic safety assurance.
Article 7. Implementation Organization
1. This Circular takes effect from March 1, 2018.
2. Circular No. 137/2013/TT-BTC dated October 7, 2013, issued by the Ministry of Finance, guiding the management, use, and settlement of funds allocated for traffic safety assurance from the state budget, shall cease to be effective from the date this Circular takes effect.
3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be applied according to those amended, supplemented, or replacing documents.
4. In the course of implementation, if there are any difficulties, agencies and units are requested to report them to the Ministry of Finance for timely resolution. /./
