CIRCULAR
REGULATIONS ON REPORTING SYSTEM OF THE MILITARY ENFORCEMENT BRANCH
Pursuant to the Civil Enforcement Law 2008 amended and supplemented in 2014;
Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;
Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Director of the Department of Enforcement;
The Minister of National Defense promulgates this Circular on the reporting system of the Military Enforcement Branch.
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates principles, types, procedures, deadlines for reporting; contents, timeframes for implementing the reporting system; forms, methods, amendments, supplements, and outline templates for reports on the work of the Military Enforcement Branch (hereinafter referred to as the reporting system).
2. This Circular applies to the Department of Enforcement under the Ministry of National Defense; the Enforcement Office under the General Staff, military regions, and the Navy Command (hereinafter collectively referred to as the Enforcement Office at the military region level); agencies, units, and individuals related to the reporting system of the Military Enforcement Branch.
Article 2. Principles of implementing the reporting system
Ensuring timeliness, completeness, accuracy, and compliance with civil enforcement laws and regulations set forth in this Circular.
Article 3. Types, procedures, timing, and deadlines for reporting
a) Periodic reports include: Monthly, quarterly, semi-annual, 10-month, and annual;
a) Regular reports include: Monthly, semi-annual, quarterly, and annual;
b) Ad hoc reports, thematic reports;
c) Statistics on civil enforcement.
2. Reporting procedures
a) The Enforcement Office at the military region level shall report to the Commander of the military region and equivalent positions, and to the Department of Enforcement under the Ministry of National Defense;
b) The Department of Enforcement under the Ministry of National Defense shall report to the Minister of National Defense;
c) The Enforcement Office at the military region level and the Department of Enforcement under the Ministry of National Defense shall report to competent authorities or persons authorized by law.
3. Data collection period for reporting:
b) Quarterly report: From the first day of the first month of the quarter to the last day of the last month of the quarter;
b) Semi-annual report: From October 1 of the previous year to March 31 of the following year;
c) Quarterly report: From October 1 of the previous year to June 30 of the following year;
d) Annual report: From October 1 of the previous year to September 30 of the following year.
4. Reporting deadlines
a) The Enforcement Office at the military region level shall submit reports to the Commander of the military region and equivalent positions, and to the Department of Enforcement under the Ministry of National Defense before the third day of the next reporting period;
b) The Department of Enforcement under the Ministry of National Defense shall submit reports to the Ministry of National Defense and competent authorities with jurisdiction before the seventh day of the next reporting period.
5. For ad hoc reports, thematic reports, and statistics on civil enforcement, they shall be implemented according to the tasks assigned by the Enforcement Office at the military region level, the Department of Enforcement under the Ministry of National Defense, or the requirements of competent authorities and persons authorized by law.
Article 4. Contents and timeframes for reporting
1. Periodic reports
a) Content: Report on the performance of state management functions and specialized management of civil enforcement in the military, results of tasks assigned by the Ministry of National Defense;
b) Timeframe: The date of preparation of the report is the day immediately following the end of the reporting period; the date of sending the report is the date stamped on the postal service, military mail, fax, data transmission report, or the date of receipt if the report is submitted directly; In case the date of preparation of the report and the date of sending the report coincide with public holidays or Tet holidays, the date of preparation of the report and the date of sending the report shall be the first working day after the holiday.
2. Ad hoc reports, thematic reports: The content and timeframe for reporting shall be carried out according to the requirements of state management and specialized management of civil enforcement in the military, according to the assigned tasks or the requirements of competent authorities and persons authorized by law.
3. Statistics on civil enforcement: The content and timeframe for reporting shall be carried out in accordance with the laws on statistics and civil enforcement statistics and the regulations of the Ministry of Justice.
Article 5. Form and Method of Reporting
1. Form of Report The report shall be in writing on A4 paper, signed with the name and position of the head of the reporting agency; stamped according to regulations; the format and presentation technique of the document shall comply with the regulations of the Ministry of National Defense and relevant laws.
2. Method of Sending Reports
a) Direct delivery;
b) Sending through military postal service or via postal service;
c) Sending via fax, email, or military data transmission network, followed by sending the written report to the receiving agency.
Article 6. Amendment, Supplement, and Outline Template for Reports
1. Amendment and Supplement of Reports In cases where it is necessary to amend or supplement the content or figures in the report, the reporting agency shall be responsible for submitting the amended and supplemented report along with an explanatory document regarding the amendment and supplement, and must have the signature and stamp of the head of the reporting agency.
2. Outline Template for Reports The uniform outline template for reports applicable within the Military Enforcement Department shall be stipulated by the Director of the Military Enforcement Department under the Ministry of National Defense.
Article 7. Effective Date
This Circular takes effect from February 25, 2019, and replaces Circular No. 121/2015/TT-BQP dated November 3, 2015, issued by the Minister of National Defense, concerning the reporting system for civil enforcement work in the military.
Article 8. Responsibility for Implementation
The Director of the Military Enforcement Department under the Ministry of National Defense, commanders of agencies and units, and related individuals are responsible for implementing this Circular.
