CIRCULAR
Amending and supplementing certain articles of Circular Joint Circular No. 24/2014/TTLT-BKHCN-BNV dated October 1, 2014 issued by the Minister of Science and Technology and the Minister of Home Affairs on code numbers and qualification standards for scientific and technological vocational positions
Pursuant to the Civil Servant Law dated November 15, 2010;
Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, use, and management of civil servants;
Pursuant to Decree No. 161/2018/NĐ-CP dated November 29, 2018 of the Government amending and supplementing certain provisions on recruitment of civil servants and public officials, promotion of civil servants' ranks, upgrading of public officials' levels, and implementation of employment contracts for certain types of work in administrative agencies and public institutions;
At the proposal of the Director of the Personnel Department and the Director of the Legal Department;
The Minister of Science and Technology issues this Circular amending and supplementing certain articles of Joint Circular No. 24/2014/TTLT-BKHCN-BNV dated October 1, 2014 of the Minister of Science and Technology and the Minister of Home Affairs on code numbers and qualification standards for scientific and technological vocational positions (hereinafter referred to as Joint Circular No. 24/2014/TTLT-BKHCN-BNV).
Article 1. Amending and supplementing certain articles of Joint Circular No. 24/2014/TTLT-BKHCN-BNV:
1. Supplementing Clause 1a as follows:
"Clause 1a. Definitions:
1. International reputable journal means journals defined in Clause 3, Article 2 of Circular No. 37/2014/TT-BKHCN dated December 12, 2014 of the Minister of Science and Technology on management of basic research topics funded by the National Research Development Fund.
2. ISI reputable journal means journals defined in Clause 4, Article 2 of Circular No. 37/2014/TT-BKHCN dated December 12, 2014 of the Minister of Science and Technology on management of basic research topics funded by the National Research Development Fund.
3. Domestic reputable scientific journal means domestic scientific journals with international standard serial number (ISSN) included in the annual list of journals for point calculation of the State Council of Professors' Sectoral and Inter-sectoral Council.
4. Scientific article Scientific work
5. means a scientific work published in a scientific journal with an international standard serial number (ISSN), clearly demonstrating the scientific idea, essential content of the research issue, current research situation both domestically and internationally, significant theoretical and practical contributions; research methods, tools, cited sources, and references. Monograph
6. means a scientific work presenting comprehensive and relatively thorough results of specialized research on a specific scientific issue. Textbook
7. means teaching and learning materials with content suitable for training programs approved by the head of higher education institutions or approved by the Minister of Education and Training. Project, work, design in technical field
means projects, works, designs for developing, applying, implementing technology or other tasks within the scope of technical fields managed by technical staff, classified according to types and levels (groups) as stipulated by specialized laws."
“Article 3a. The results of professional activities are converted into points
1. The results of professional activities that are converted into points include:
a) Results from implementing scientific and technological tasks at various levels that have been accepted at the satisfactory level or higher;
b) Intellectual property rights results, including:
- Author of an invention granted an Invention Patent Certificate;
- Author of a Utility Model granted a Utility Model Certificate and applied in practice;
- Author of a Plant Variety granted a Plant Variety Protection Certificate;
c) Scientific articles;
d) Monographs, textbooks;
đ) Results from implementing projects, works, designs within the technical specialty;
2. Each result of professional activities converted under Clause 1 of this Article must be consistent with the scientific and technological specialty in which the officer is currently working, suitable to the position and responsibilities they hold. The method for converting points is specified in the Appendix attached to this Circular.
3. Scientific articles, monographs, textbooks published with overlapping content of 30% or more with other works of the same author can only be counted once for conversion into points.
4. For professional activity results converted involving multiple authors, the main author receives one-third of the points, and the remaining points are distributed according to each participant's contribution. If it is not possible to determine the specific contribution of each person, the remaining points will be equally divided among all participants.
5. Points shall not be converted for monographs and scientific articles formed from the results of scientific and technological tasks already converted into points.
3. Amend Point d and đ, and supplement Point e of Clause 3, Article 4 as follows:
“d) Possess the ability to lead national-level scientific and technological tasks and lead or participate in scientific and technological tasks at various levels.
Has led at least one national-level scientific and technological task (or led at least three ministry-level or provincial-level scientific and technological tasks) that have been accepted at the satisfactory level or higher, and participated in at least two ministry-level or provincial-level scientific and technological tasks that have been accepted at the satisfactory level or higher; or is the main author or editor of at least one monograph and the main author of at least two scientific articles published in reputable international journals, including one article published in a reputable ISI journal.
đ) For officers applying for promotion to Senior Researcher (Class I), during the time holding the title of Principal Researcher (Class II) or equivalent, they must achieve the scientific and technological results stipulated in Point d of Clause 3 of this Article or must accumulate at least five converted points from professional activities, including at least three points converted from ministry-level or provincial-level scientific and technological tasks or publication of articles in reputable international scientific journals, and at least two points achieved in the last two years before the deadline for submitting applications for promotion to Senior Researcher (Class I).
e) Have experience in scientific research and technology development. Officers promoted from the title of Principal Researcher (Class II) to Senior Researcher (Class I) must have held the title of Principal Researcher (Class II) or equivalent for a minimum of six years, including at least two years in the most recent period holding the title of Principal Researcher (Class II).
4. Amend Point d and đ, and supplement Point e of Clause 3, Article 5 as follows:
“d) Possess the ability to lead ministry-level or provincial-level scientific and technological tasks and lead or participate in other scientific and technological tasks.
Has led at least one ministry-level or provincial-level scientific and technological task (or led at least three institutional-level scientific and technological tasks) that have been accepted at the satisfactory level or higher, and participated in at least one ministry-level or provincial-level scientific and technological task that has been accepted at the satisfactory level or higher; or participated in the author group of at least one monograph and is the main author of at least one scientific article published in a reputable international journal.
đ) For officers applying for promotion to Principal Researcher (Class II), during the time holding the title of Researcher (Class III) or equivalent, they must achieve the scientific and technological results stipulated in Point d of Clause 3 of this Article or must accumulate at least three converted points from professional activities, including at least one point converted from institutional-level or higher scientific and technological tasks or publication of articles in reputable international scientific journals, and at least one point achieved in the last two years before the deadline for submitting applications for promotion to Principal Researcher (Class II).
e) Have experience in scientific research and technology development. Officers promoted from the title of Researcher (Class III) to Principal Researcher (Class II) must have held the title of Researcher (Class III) or equivalent for a minimum of nine years, including at least two years in the most recent period holding the title of Researcher (Class III).
5. Amend Point d of Clause 3, Article 6 as follows:
“d) Possess the ability to lead institutional-level scientific and technological tasks and participate in other scientific and technological tasks.
During the time holding the title of Researcher, led at least one institutional-level scientific and technological task that has been accepted at the satisfactory level or higher, and is the author of at least one scientific article published in a reputable domestic scientific journal.
6. Amend Point d and đ, and supplement Point e of Clause 3, Article 8 as follows:
“d) Possess the ability to lead or participate in national-level scientific and technological tasks or Class I projects, works, designs within the technical specialty, and lead and organize the implementation of scientific and technological tasks or projects, works, designs at various levels within the technical specialty.
Has participated in at least one national-level scientific and technological task (or served as the head of at least one ministry-level or provincial-level task accepted at a satisfactory level) and served as the head of at least two basic-level scientific and technological tasks accepted at a satisfactory level; or is the author of at least one exclusive invention patent and one utility solution granted an exclusive certificate and applied in practice; or serves as the director, main organizer, or head of at least one Class I project, work, or design in the technical field and serves as the director, main organizer, or head of at least two Class II projects, works, or designs in the technical field completed, put into use, and demonstrating effectiveness; or serves as the head or main designer of at least one Class I project or work and serves as the head or main designer of at least two Class II projects or works approved by the competent authority.
đ) For staff members participating in the senior engineer (Class I) promotion examination, during the time holding the position of principal engineer (Class II) or equivalent, they must have achieved the professional activity results specified in point d, Clause 3 of this Article or must achieve at least 04 points converted from professional activity results, including at least 02 points converted from the results of leading or participating in implementing scientific and technological tasks at the ministry level or higher or serving as the director, main organizer, or head of projects, works, or designs at Class II or higher in the technical field, or being the author of a scientific article, invention patent granted an exclusive certificate, or a utility solution granted an exclusive certificate and applied in practice, and at least 01 point converted must be achieved within the last two years counted from the deadline for submitting the application for the senior engineer (Class I) promotion examination.
e) Have experience in researching, applying, and developing technology and organizing the implementation of projects, works, or designs in the technical field. Staff members promoted from the position of principal engineer (Class II) to senior engineer (Class I) must have held the position of principal engineer (Class II) or equivalent for a minimum of 06 years, including at least 02 years in the most recent period holding the position of principal engineer (Class II).
7. Amend point d and đ, and supplement point e of Clause 3, Article 9 as follows:
“d) Possess the ability to lead the implementation of scientific and technological tasks at the ministry or provincial level or Class II projects, works, or designs in the technical field, and lead or participate in the implementation of scientific and technological tasks or projects, works, or designs in the technical field at various levels.
Has served as the head of at least one ministry or provincial-level scientific and technological task accepted at a satisfactory level; or has participated in at least two ministry or provincial-level scientific and technological tasks accepted at a satisfactory level; or is the author of at least one utility solution granted an exclusive certificate and applied in practice; or serves as the director, main organizer, or head of at least one Class II project, work, or design in the technical field and serves as the director, main organizer, or head of at least one Class III project, work, or design in the technical field completed, put into use, and demonstrating effectiveness; or serves as the head or main designer of at least one Class II project or work and serves as the head or main designer of at least two Class III projects or works approved by the competent authority.
đ) For staff members participating in the principal engineer (Class II) promotion examination, during the time holding the position of engineer (Class III) or equivalent, they must have achieved the professional activity results specified in point d, Clause 3 of this Article or must achieve at least 02 points converted from professional activity results, including at least 01 point converted from the results of leading or participating in implementing scientific and technological tasks at the basic level or higher or projects, works, or designs at Class III or higher in the technical field; or is the author of a utility solution granted an exclusive certificate and applied in practice, a scientific article published, and at least 01 point must be achieved within the last two years counted from the deadline for submitting the application for the principal engineer (Class II) promotion examination.
e) Have experience in implementing research and application activities and developing technology, organizing the implementation of projects, works, or designs in the technical field. Staff members promoted from the position of engineer (Class III) to principal engineer (Class II) must have held the position of engineer (Class III) or equivalent for a minimum of 09 years, including at least 02 years in the most recent period holding the position of engineer (Class III).
8. Amend point d of Clause 3, Article 10 as follows:
“d) Possess the ability to lead the organization and implementation of scientific and technological tasks at the basic level or Class III projects, works, or designs in the technical field.
During the time holding the position of engineer (Class III), serve as the head of at least one basic-level scientific and technological task accepted at a satisfactory level; or serve as the director, main organizer, or leader of at least one Class III project, work, or design in the technical field, completed, put into use, and demonstrating effectiveness; or serve as the head or main designer of at least one Class III project or work approved by the competent authority.
Article 2. Effectiveness
This Circular takes effect from March 5, 2020.
Article 3. Responsibility for Implementation
1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and related agencies, organizations, and individuals are responsible for implementing this Circular.
2. In the process of implementation, if there are difficulties, please reflect them to the Ministry of Science and Technology for guidance or consideration and resolution./.
