Guidelines for Implementing Housing Support for Poor Households and Near-Poor Households

in Poor Districts under the National Target Program

Decision No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communication;

Pursuant to the Housing Law issued on November 25, 2014;

Pursuant to Resolution No. 24/2021/QH15 dated July 28, 2021 of the National Assembly approving the investment policy for the National Target Program on Sustainable Poverty Reduction for the 2021-2025 period;

Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 07/2021/NĐ-CP dated January 27, 2021 of the Government stipulating the multidimensional poverty standard for the period 2021-2025;

Pursuant to Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating the management mechanism and implementation organization of the National Target Programs;

Pursuant to Decision No. 02/2022/QĐ-TTg dated January 18, 2022 of the Prime Minister stipulating the principles, criteria, allocation quotas, and local budget matching ratios for implementing the National Target Program on Sustainable Poverty Reduction for the period 2021-2025;

At the proposal of the Director of the Department of Housing and Real Estate Market Management;

The Minister of Construction issues this Circular guiding the implementation of housing support for poor households and near-poor households in poor districts under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025 to implement Decision No. 90/QĐ-TTg dated January 18, 2022 of the Prime Minister approving the National Target Program on Sustainable Poverty Reduction for the period 2021-2025.

Article 1. Scope of Regulation and Applicability

This Circular guides the determination of beneficiaries, principles, criteria, quality, and the organization and implementation of housing support for poor households and near-poor households in poor districts approved in Decision No. 353/QĐ-TTg dated March 15, 2022 of the Prime Minister approving the list of poor districts, extremely difficult communes in coastal areas, islands, and mountainous regions for the period 2021-2025.

a) Poor households and near-poor households (according to the multidimensional poverty standard for the period 2021-2025) listed by the People's Committee of the commune, residing in poor districts, and being independent households that have been separated for at least three years before the effective date of the National Target Program on Sustainable Poverty Reduction for the period 2021-2025 (hereinafter referred to as the Program);

b) Beneficiaries of housing support shall not include households that have already received housing support under the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030 and other programs, projects, and policies;

c) Relevant agencies, organizations, and individuals.

Article 2. Implementation Principles

1. Ensuring transparency, democracy, promoting the right to self-management and active participation of the community and people. Prioritizing the use of local materials and employing local labor to implement housing support for poor households and near-poor households in poor districts under the Program.

2. Delegating authority and decentralization to localities in building and organizing implementation in accordance with conditions, characteristics, cultural identity, customs, and traditions of ethnic groups and regions, while reinforcing national defense and security.

3. Providing direct support to each poor household and near-poor household. Prioritizing support for ethnic minority poor households and poor households with members who have rendered meritorious service to the revolution.

4. Mobilizing funds from multiple sources to implement, combining state support with community assistance and household self-organization in constructing houses.

5. Strengthening inspection, supervision, monitoring, and evaluation of the implementation of housing support for poor households and near-poor households in poor districts at all levels and sectors. Taking preventive measures and promptly addressing negative manifestations, and strictly handling acts of corruption, waste, and violations during the implementation process.

Article 3. Criteria for Housing Support

Poor households and near-poor households eligible for housing support fall under one of the following cases:

1. Poor households and near-poor households that do not have housing or whose housing is classified as unstable (among the three main structures: foundation-flooring, frame-wall, roof, at least two structures are made from unstable materials).

2. The average housing area per person of poor households and near-poor households is less than 8 square meters.

3. Not having received housing support from state programs, projects, policies, political-social organizations, or other social organizations.

Article 4. Quality Requirements for Housing After Support

1. After receiving new construction or repair support, housing must ensure a minimum usable area of 30 square meters, meet the "3 hard" criteria (hard foundation-flooring, hard frame-wall, hard roof), and have a lifespan of at least 20 years.

2. The parts of the foundation-flooring, frame-wall, and roof of the house must be made from high-quality materials, not temporary, easily damaged, or flammable materials. Specifically:

a) "Hard foundation-flooring" refers to the foundation-flooring of the house made from materials that increase hardness such as cement-sand mortar, concrete, reinforced concrete, brick/masonry, tile, wood;

b) "Hard frame-wall" includes the frame and column system. Depending on specific conditions, the frame and columns can be made from reinforced concrete, steel, durable wood; walls built with bricks/masonry or made from durable wood;

c) "Hard roof" includes the roof support system and roofing. Depending on specific conditions, the roof support system can be made from reinforced concrete, steel, durable wood. The roof is made of reinforced concrete and tiled. In the case of a metal roof imitating tiles, cold-rolled metal, insulated metal, corrugated metal, and having a sturdy support structure (steel frame, wood...) firmly connected to the masonry wall and reinforced concrete column, this metal roof is considered a durable material;

Depending on actual conditions, the parts of the house may be made from locally available materials of equivalent quality meeting technical standards and ensuring durability. The People's Committee of provinces (or authorized to the Department of Construction) shall specify local material types (if any), report to the Ministry of Construction for consideration and decision.

Article 5. Priority Order for Housing Support

1. Prioritize support for the following groups in the following order:

a) Ethnic minority poor households;

b) Poor households with members who are war veterans;

c) Poor and near-poor households with members belonging to social assistance beneficiaries;

d) Poor and near-poor households with particularly difficult circumstances (elderly, single, disabled);

đ) Poor and near-poor households in areas frequently affected by natural disasters;

e) Remaining poor and near-poor households.

2. For poor and near-poor households with the same level of priority, support will be implemented in the following order:

a) Poor and near-poor households with damaged, leaky housing (made from quickly deteriorating, low-quality materials) at risk of collapse and unsafe;

b) Poor and near-poor households without housing (households without their own housing, currently living with parents but have separated households, staying with others, renting houses - except those renting state-owned housing);

c) Poor and near-poor households with large families.

Article 6. Procedures for Developing the Housing Support Proposal

1. At the village level and equivalent (referred to as the village level)

a) The civil servant assigned to poverty reduction work at the commune level shall coordinate with the Village Head to convene a meeting to disseminate the main contents of the housing support policy for poor households and near-poor households as stipulated in Decision No. 90/QĐ-TTg dated January 18, 2022 of the Prime Minister approving the National Target Program on Sustainable Poverty Reduction for the period of 2021-2025 and this Circular to the households; compile a list of poor and near-poor households requiring new construction or repair of their houses;

b) Based on the list of poor and near-poor households requiring new construction or repair of their houses, organize a review and propose a list of poor and near-poor households to be supported with housing (in accordance with the model attached as Appendix I to this Circular) to be submitted to the People's Committee at the commune level for consideration and review. The meeting includes the Poverty Review Steering Board at the commune level, the civil servant assigned to poverty reduction work at the commune level, the Village Head (chairing the meeting), the Secretary of the Village Party Branch, Women's Union, Farmers' Association, Veterans' Association, Communist Youth Union, and representatives of poor and near-poor households in the village; invite a representative from the Vietnam Fatherland Front at the commune level to supervise;

c) Households included in the proposed support list must be agreed upon by more than 50% of the participants at the meeting (through a show of hands or secret ballot voting).

2. At the commune level

a) The People's Committee at the commune level shall publicly post the list of poor and near-poor households proposed for support in new construction or repair of their houses at the communal cultural house or community center and the office of the People's Committee at the commune level; announce through the commune-level radio station (if available) for a period of three days;

b) Upon completion of the public posting period, the People's Committee at the commune level shall review, verify, consolidate, and submit to the People's Committee at the district level the list of poor and near-poor households eligible for support in new construction or repair of their houses.

3. Within three working days from the date of receipt of the report from the People's Committee at the commune level, the People's Committee at the district level shall consolidate and approve the list and report it to the People's Committee at the provincial level. In case the list needs to be adjusted, it must be re-approved and immediately reported to the People's Committee at the provincial level.

4. The People's Committee at the provincial level shall organize the development and approval of the Housing Support Proposal for poor and near-poor households within its jurisdiction (in accordance with the model attached as Appendix VII to this Circular); send the Proposal to the Ministry of Construction, the Ministry of Labor, Invalids and Social Affairs, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation and reporting to the Prime Minister.

5. In cases where complaints or denunciations arise during the approval process of the list of poor and near-poor households to be supported with housing, such complaints or denunciations and their resolution shall be carried out in accordance with the Law on Complaints and the Law on Denunciations.

Article 7. Implementation of Housing Support

1. Design of Model Houses

a) The People's Committee at the provincial level shall direct relevant agencies to research and design a minimum of three typical models of houses suitable for the customs and traditions of each locality (accompanied by cost estimates and projected primary materials);

b) Localities shall organize the introduction of these design models for people to refer to and choose from. Respect the wishes of the people, do not compel poor and near-poor households to build houses according to the model designs;

c) Depending on specific conditions, people may construct based on experience and tradition, in line with their family's economic and living conditions, but must ensure the minimum criteria regarding area and quality as prescribed.

2. Organization of New Construction or Repair of Houses

a) Poor and near-poor households listed for support in new construction or repair of houses shall sign a commitment to construct or repair their houses and register with the People's Committee at the commune level to request supply of materials for new construction or repair of houses (if needed), and propose selection of house models and methods of new construction or repair of houses (in accordance with the model attached as Appendix II to this Circular);

b) For poor and near-poor households with members who are social welfare beneficiaries and have particularly difficult circumstances (elderly, single, disabled) and lack the ability to construct or repair their houses themselves, the People's Committee at the commune level shall coordinate with the Vietnam Fatherland Front at the commune level and its affiliated organizations to assign community groups, agencies, and units located in the area to organize new construction or repair of houses for these individuals;

c) Poor and near-poor households receiving support for new construction or repair of houses must report to the People's Committee at the commune level when completing stages of work (completion of the foundation for those building new houses, completion of 30% or more of the workload for those repairing existing houses) or completion of the entire project for acceptance inspection as the basis for disbursing the support funds;

d) The People's Committee at the commune level shall be responsible for monitoring, guiding, supervising, and assisting poor and near-poor households during the process of new construction or repair of houses to ensure progress and quality; prepare minutes confirming completion by stage and minutes confirming completion of the project for use (in accordance with the models attached as Appendices III and IV to this Circular).

3. Support Standards and Disbursement of Support Funds

a) New construction: 40 million VND per household; repair: 20 million VND per household from the central budget;

b) Management, utilization, settlement, and auditing of central budget funds shall be implemented in accordance with the guidelines of the Ministry of Finance.

Article 8. Implementation organization

1. Responsibilities of the Ministry of Construction

a) Consolidate the results of implementation by localities and submit to the Ministry of Labor, Invalids and Social Affairs for consolidation and reporting to the Government and the Prime Minister as prescribed;

b) Propose sources of funding and allocation plans for central budget funds for the period 2021-2025 and annually within the scope of management and submit to the Ministry of Labor, Invalids and Social Affairs for consolidation into the overall plan as prescribed;

c) Develop plans for central budget funds for the period 2021-2025 and annually to implement activities serving the guidance and implementation of the Program and submit to the Ministry of Labor, Invalids and Social Affairs for consolidation as prescribed.

d) Chair and coordinate with ministries, sectors, and central agencies to guide provinces with poor districts, which have been approved by the competent authority, to establish and implement housing support programs for poor and near-poor households in poor districts under the National Target Program on Sustainable Poverty Reduction for the period of 2021-2025 at local levels;

đ) Chair and coordinate with ministries, sectors, and central agencies to inspect, supervise, and urge provinces with poor districts, which have been approved by the competent authority, to implement housing support policies for poor and near-poor households in accordance with the set goals and requirements;

2. Responsibilities of the People's Committees of provinces with poor districts that have been approved by the competent authority;

a) Implement housing support policies for poor and near-poor households within their jurisdiction in compliance with regulations, adapting to the actual conditions of the locality, ensuring that support reaches the correct beneficiaries, serves the intended purpose, and is effective. Depending on the actual conditions and the budget balance capacity of the locality, decide on additional support from the local budget to improve the quality of housing for poor and near-poor households beyond the central government's support funds;

b) Assign the Construction Department to chair and coordinate with the Department of Labor, Invalids, and Social Affairs and related departments and sectors to implement housing support policies for poor and near-poor households within their jurisdiction; guide communes and townships to determine the current status and quality of housing after receiving support;

c) Organize and approve housing support programs for poor and near-poor households within their jurisdiction in accordance with Clause 4, Article 6 of this Circular;

d) Direct specialized agencies to research and design at least three typical house models;

đ) Direct relevant agencies and local authorities at all levels to cooperate with organizations and mass organizations within their jurisdiction to mobilize community support and assistance for poor and near-poor households to build new or repair houses;

e) Inspect, supervise, evaluate, and submit quarterly reports (in the format attached as Appendix V of this Circular) before the 15th day of the last month of each quarter and annual reports (in the format attached as Appendix VI of this Circular) before December 10th each year on the implementation results to the Ministry of Construction for consolidation and submission to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Government;

g) Prepare plans for implementing policy funds (including all sources of funds), report on progress and results of fund disbursement annually to the Ministry of Construction, the Ministry of Labor, Invalids, and Social Affairs, and other relevant agencies as prescribed;

h) Direct the dissemination and popularization of housing support policies for poor and near-poor households to the public through appropriate forms. Publicly announce criteria and beneficiary groups of the policy;

3. Responsibilities of the People's Committees of districts;

a) Aggregate and approve, within their authority, lists of poor and near-poor households eligible for new construction or repair of houses in accordance with Clause 3, Article 6 of this Circular;

b) Regularly inspect and supervise implementation to ensure that the policy reaches every poor and near-poor household with housing difficulties within the target group; prevent waste and corruption; ensure that poor and near-poor households have housing meeting the required quality standards after receiving support;

4. Responsibilities of Commune People's Committees

a) Review, assess, aggregate lists of poor and near-poor households eligible for new construction or repair of houses and submit them to the district-level People's Committee for approval in accordance with Clause 2, Article 6 of this Circular;

b) Acceptance and confirmation of completed construction volumes in stages (completion of foundation work for newly constructed houses by poor and near-poor households or completion of at least 30% of construction work for existing houses being repaired by poor and near-poor households) and confirmation of project completion and put into use as the basis for disbursing support funds in accordance with regulations;

c) The People's Committee of communes directs and supervises poor and near-poor households to use support funds for new construction or repair of houses for their intended purposes, ensuring that houses are fully constructed and ready for use; mobilize organizations and mass organizations such as the Fatherland Front, Women's Union, Farmers' Association, Veterans' Association, Ho Chi Minh Communist Youth Union to assist poor and near-poor households in building new or repairing houses; maximize the mobilization of resources from the community, material suppliers, and households; utilize and exploit local materials like sand, gravel, pebbles, wood in accordance with the law to ensure reduced construction costs for houses;

5. The Real Estate Management Agency has the responsibility to assist the Minister of Construction in guiding, urging, and inspecting the implementation of housing support for poor and near-poor households in poor districts; consolidate and report on implementation regularly and propose amendments and supplements for consideration and issuance by the Minister of Construction within his/her authority or submit to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Government and the Prime Minister for consideration and decision;

Article 9. Implementation Provisions

1. This Circular takes effect from August 15, 2022;

2. Ministries, ministerial-level agencies, People's Committees at all levels, and related organizations and individuals are responsible for implementing this Circular. In the course of implementation, if any issues arise, they should promptly reflect them to the Ministry of Construction for amendment and supplementation or submit them to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Government and the Prime Minister for consideration and decision./.
