Pursuant to the Law organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.approved by the Government on 19 the 6 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;15;

Pursuant to Decree No.123/2016/NĐ-CP dated 01 the 9 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).6/ The Government shall prescribe the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies. bMinistry;

 

At the proposal of the Minister of Construction;

The Government shall issue a Decree prescribing the functions, tasks, powers, and organizational structure of the Ministry of Construction..

 

Article 1. Position and and Individuals in Handling Errors, Losses, Misplacements, or Damage to Files and Results, and in Delayed Result Deliveryfunction

The Ministry of Construction is an agency of the Government, performing the following state management functions: urban planning, architecture; construction investment activities; urban development; technical infrastructure; housing; office buildings; real estate market; building materials; state management of public services in the fields under the Ministry's jurisdiction as prescribed by law.

Article 2. Tasks and power

The Ministry of Construction shall perform the tasks and powers as stipulated in Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government prescribing the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies, and the following specific tasks and powers:

1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees, and draft resolutions of the Government according to the annual legislative program of the Ministry that has been approved, and other projects, programs, and resolutions assigned by the Government and the Prime Minister; submit to the Government and the Prime Minister strategies, plans, long-term, medium-term, and annual development plans, and important national projects and works within the scope of the Ministry of Construction’s management.

3. Issue circulars and other documents within the scope of the Ministry's state management; develop and issue, or submit to competent authorities for issuance, technical standards, national standards, economic-technical norms, typical designs, and model designs in the fields under the Ministry's management; guide and inspect the implementation of such documents.

4. Direct and organize the dissemination, popularization, and education on laws within the scope of the Ministry's state management; organize the enforcement and monitoring of the enforcement of laws related to the sectors and fields entrusted by the Ministry throughout the country; organize the implementation and monitoring of strategies, plans, and programs within the fields under the Ministry's management.

5. On urban planning and architecture:

a) Develop and submit to competent authorities for issuance, or issue directly within their authority, regulations on the preparation, review, and approval of various types of urban planning, including: regional urban planning, city planning, special-purpose functional area planning, rural area planning; guide and inspect the implementation thereof.

b) Organize the preparation and submit to the Prime Minister for approval regional urban planning involving multiple provinces, special-purpose functional areas with national significance, along expressway corridors, and provincial economic corridors; general urban planning for new cities with planning areas spanning administrative boundaries of two or more centrally-administered municipalities or provinces, and general urban planning for new cities with forecasted populations equivalent to or larger than those of third-tier cities, and other planning as assigned by the Prime Minister; guide the implementation of such planning after approval.

c) Review master plans for urban development that fall within the Prime Minister's approval authority; provide written comments to provincial People's Committees to approve detailed urban development plans as prescribed by law.

d) Issue urban planning standards, cost estimates, methods for preparing and managing costs in urban planning, architectural design, and urban design regulations.

đ) Establish and manage a nationwide database on urban planning and architecture.

e) Develop guidelines for the development of Vietnamese architecture suitable for each stage, submit to the Prime Minister for approval, and guide and inspect the implementation thereof.

g) Guide and inspect the implementation of legal provisions regarding: urban design; urban space, architectural, and landscape management; urban planning and architectural design regulations; planning permits; architectural design competitions for construction projects.

h) Guide and inspect the implementation of legal provisions regarding the qualifications of organizations and individuals participating in urban planning design; issuance and management of professional practice certificates for urban planning design and the competence certificates of consulting firms for urban planning design.

6. Regarding construction investment activities:

a) Guide and inspect the implementation of legal provisions regarding the preparation, review, approval, and management of construction investment projects; review construction investment projects according to legal provisions; guide the application of building information modeling during construction investment and operation.

b) Guide and inspect the approval of technical design, construction drawing design, and project estimates for construction works; review construction design and project estimates according to legal provisions.

c) Monitor, inspect, and evaluate overall investment in construction investment activities within their authority; guide and inspect the implementation of important construction investment projects and national key works according to legal provisions; perform the tasks and powers of the investor for construction investment projects assigned by the Prime Minister.

d) Issue technical standards for civil and industrial construction works; organize the establishment of a national standard system for surveying, designing, constructing, and inspecting civil and industrial construction works; guide the application of foreign standards in Vietnam's construction activities.

đ) Issue templates for construction permits; guide and organize the issuance, adjustment, extension, revocation of construction permits, and management of construction order according to construction permits; suspend construction or request the provincial People's Committee to direct suspension of construction and handle violations or revoke construction permits when discovering incorrect issuance of construction permits or construction works violating construction order management regulations according to construction permits.

e) Guide the selection of contractors in construction activities in accordance with the provisions of the Construction Law and the Bidding Law; guide the evaluation of the performance of contractors in accordance with the provisions of the law;

g) Guide the implementation of regulations on hiring foreign consultants in construction activities in Vietnam and the issuance and revocation of construction operation licenses for foreign contractors operating in Vietnam; implement the issuance and revocation of construction operation licenses for foreign contractors that are organizations bidding on packages of projects belonging to Group A and other packages in areas involving two or more provinces;

Guide and inspect the implementation of legal provisions regarding contracts in construction activities; guide methods for adjusting construction contract prices; publish model construction contracts;

i) Guide and inspect the implementation of regulations on establishing and managing investment costs for construction projects, including: total investment ceiling, construction project budget estimates, construction norms and construction prices, construction duration, investment cost control, methods for measuring construction volumes, methods for determining machinery and equipment construction prices, methods for determining construction labor unit prices, methods for determining construction price indices; publish construction norms, investment capital rates, construction price indices, project management cost norms and construction investment consulting norms (including foreign consulting fees); provide unified opinions for Ministries, agencies at the level of Ministries, People's Committees of provinces and centrally governed cities to issue specialized construction norms and special construction norms; establish, manage databases and provide information on construction investment cost management;

k) Guide and inspect quality management work in construction projects during the following stages: surveying, design, construction, acceptance, handover, warranty; conduct periodic or spot inspections and recommend measures to address violations related to construction project quality; suspend construction and require the project owner, consultants, and contractors to rectify when construction quality does not meet requirements and poses risks of harm to people and property according to the law; organize inspections of construction project acceptance work in accordance with the law;

l) Guide specialized construction testing activities, quality certification, judicial appraisal, cause determination, and resolution of construction accidents and issues during the operation and use of construction projects; organize the implementation of construction quality certification, judicial construction appraisal, cause determination of construction accidents and issues during the operation and use of construction projects in accordance with the law; inspect, evaluate, and issue certificates confirming the conditions for specialized construction testing activities;

Organize the implementation of the tasks of the National Acceptance Council for construction projects; host the National Quality Award for construction projects; manage the quality of important national construction projects assigned by the Prime Minister;

n) Guide and inspect maintenance work for construction projects, assess the quality, load-bearing safety, and operational safety of construction projects during their operation and use; guide the handling of projects that have exceeded their service life but still need to be used according to the law;

o) Guide and inspect the implementation of legal provisions regarding the qualifications required for individuals and organizations participating in construction activities;

Specify examination procedures for issuing various types of construction practice certificates; issue models of practice certificates, construction activity capability certificates, framework training programs, and vocational training programs for construction activities; guide and inspect the issuance and management of various types of practice certificates and construction activity capability certificates; implement the issuance of construction practice certificates for individuals and construction activity capability certificates for organizations in accordance with the law;

Establish databases, update and publish information about the capabilities of organizations and individuals engaged in construction activities (including foreign organizations operating in Vietnam) in accordance with the law;

7. Regarding urban development:

a) Develop guidelines, strategies, overall plans for the development of the national urban system, important national programs and projects on urban development; indicators for the field of urban development in the national socio-economic development tasks for each stage; guide and inspect the implementation after approval by the Prime Minister;

Develop and submit to competent authorities for promulgation or promulgate within their authority mechanisms and policies for urban development investment management, policies and solutions for urbanization management processes, urban development models, regulations on establishing and managing costs for urban utility services, urban development area planning and assessment costs, urban development programs, urban classification proposals; guide and inspect the organization of implementation;

Review or provide written unified opinions for competent authorities to approve urban development plans, urban development areas, and urban development investment projects in provinces and centrally governed cities in accordance with the law;

 

Develop and submit to competent authorities for regulation the system of criteria and standards for classifying cities at each stage in line with the country's overall development; guide, inspect, and organize the annual evaluation and classification of cities based on the criteria and standards prescribed by competent authorities; review and submit to the Prime Minister for decision the recognition of city categories for special category, Category I, and Category II cities; decide on the recognition of city categories for Category III and Category IV cities;

 

 

d) Guide, inspect urban development investment activities according to planning and plans; guide and inspect the implementation of legal provisions on the management of new urban development, upgrading, renovation, conservation, beautification, refurbishment, expansion, and reconstruction of cities; guide urban construction order management;

 

f) Guiding and inspecting the management and use of land for urban construction according to approved urban development plans;

 

g) Organize promotional, facilitation, and coordination activities for domestic and foreign resources for urban development investment in accordance with the law and the division of work assigned by the Government;

 

h) Organize the establishment and management of information databases on urban development;

 

8. Regarding technical infrastructure, including: Urban and industrial zone water supply, urban and rural concentrated residential area drainage and wastewater treatment; solid waste management in urban areas and rural concentrated residential areas; urban lighting, urban greenery; cemeteries (excluding martyrs' cemeteries) and crematoriums; urban transportation infrastructure structures; underground construction management in urban areas; common use management of urban technical infrastructure works;

a) Regarding urban and industrial zone water supply, urban and rural concentrated residential area drainage and wastewater treatment:

Develop national orientations, strategies, programs, and indicators on water supply, drainage, and wastewater treatment, seek written opinions from the Ministry of Natural Resources and Environment, submit to the Prime Minister for approval, and organize implementation after approval;

Develop and issue, within its authority, or submit to competent authorities for issuance and guidance, inspection of the implementation of technical standards, national standards, economic-technical norms for water supply, drainage, and wastewater treatment construction projects; regulations and procedures for planning, reviewing, and approving water supply, drainage, and wastewater treatment plans; mechanisms and policies for developing water supply, drainage, and wastewater treatment;

Organize the preparation, review, and submission to the Prime Minister for approval or approval under the Prime Minister's delegation of inter-provincial water supply, drainage, and wastewater treatment plans; direct and guide, inspect the implementation of these plans after approval;

Review inter-provincial water supply and drainage plans for centrally-administered municipalities that are special-class cities and submit them to the Prime Minister for approval; provide written unified opinions for provincial People's Committees to approve provincial-level water supply and drainage plans, and water supply and drainage plans for centrally-administered municipalities that are first-class cities;

Organize investment promotion activities, resource mobilization for water supply, drainage, and wastewater treatment development; guide the implementation of urban and inter-provincial water supply, drainage, and wastewater treatment construction projects according to the Prime Minister's assignment;

Guide the application of technological models and management systems for water supply, drainage, and wastewater treatment suitable for urban, industrial, and rural concentrated residential area characteristics and scales; management and operation of water supply, drainage, and wastewater treatment systems;

Guide methods for pricing clean water consumption, frameworks for clean water prices, drainage service fees, and wastewater treatment fees; inspect the implementation;

b) Regarding solid waste management in urban areas and rural concentrated residential areas:

Develop investment programs for solid waste treatment and submit them to the Prime Minister for approval; guide implementation after approval;

Develop and issue, within its authority, or submit to competent authorities for issuance and guide the inspection of the implementation of regulations on planning, reviewing, and approving solid waste management plans; technical standards, national standards for constructing solid waste treatment facilities; economic-technical norms, capital investment rates, cost budgeting methods, and pricing methods for solid waste collection, transportation, and treatment services;

 

Organize the preparation, review, seek written opinions from the Ministry of Natural Resources and Environment, and submit to the Prime Minister for approval or approval under the Prime Minister's delegation of inter-provincial solid waste management plans; guide and inspect the implementation of these plans after approval;

Review solid waste management plans for centrally-administered municipalities that are special-class cities and submit them to the Prime Minister for approval; provide written unified opinions for centrally-administered municipalities that are first-class cities to approve their city's solid waste management plans;

Guide and inspect the establishment and management of solid waste treatment facility construction plans; organize investment promotion activities and direct, guide the implementation of inter-provincial solid waste treatment facility construction projects according to the Prime Minister's assignment;

c) Regarding urban lighting and urban greenery:

Develop urban lighting and greenery development orientations and submit them to the Prime Minister for approval; guide and inspect implementation after approval;

Develop and issue, within its authority, or submit to competent authorities for issuance and guide the inspection of the implementation of technical standards, national standards, economic-technical norms for urban lighting and greenery; regulations on planning, reviewing, and approving urban lighting plans; mechanisms and policies to encourage urban lighting and greenery development;

Review urban lighting plans for centrally-administered municipalities that are special-class cities and submit them to the Prime Minister for approval; provide written unified opinions for centrally-administered municipalities that are first-class cities to approve their city's urban lighting plans;

Guide methods for budgeting and managing costs for maintaining urban lighting systems and urban greenery maintenance costs; guide and inspect compliance with legal provisions on urban lighting management and urban greenery management nationwide;

 

d) Regarding cemetery management (excluding martyrs' cemeteries) and crematoriums:

Guide, inspect the implementation of legal provisions on planning and activities related to construction, renovation, expansion, closure, relocation of cemeteries and crematoriums; issue technical standards for cemetery and crematorium construction; develop for competent authorities to promulgate national standards on cemetery and crematorium construction.

Appraise and submit to the Prime Minister for approval the planning of cemeteries in special-class cities; provide written agreement for People's Committees of central cities classified as first-class cities to approve cemetery planning according to legal provisions.

Guide and inspect the management and use of cemeteries and crematoriums; guide methods for establishing and managing costs, pricing services for cemeteries, and cremation service fees.

d) On urban transportation infrastructure:

Guide the establishment, appraisal, approval of urban traffic planning and contents of traffic planning in urban planning projects; inspect the construction of urban transportation infrastructure according to approved urban and traffic plans.

Appraise traffic planning for central cities classified as special-class cities to submit to the Prime Minister for approval; provide written agreement for People's Committees of central cities classified as first-class cities to approve urban traffic planning.

Develop and promulgate technical standards for urban transportation infrastructure construction; stipulate classification and categorization of urban roads; develop for competent authorities to promulgate national standards on urban road construction.

e) On urban underground construction management:

Develop orientations and strategies for urban underground construction development suitable for each stage of national socio-economic development; guide and inspect implementation after approval by the Prime Minister.

Guide and inspect work on the establishment, appraisal, approval, and management of implementation of urban underground space planning.

Issue technical standards for urban underground construction projects within authority; develop and promulgate national standards, economic-technical norms for public urban underground construction and urban underground technical infrastructure projects within authority or submit to competent authorities for issuance.

Develop and promulgate regulations on urban underground construction and exploitation management, undergrounding of power lines and cables within authority or submit to competent authorities for issuance.

Guide the establishment and management of databases, provision of information on urban underground construction systems.

Develop incentive mechanisms and policies to encourage investment in urban underground construction projects to be submitted for approval by the Government and the Prime Minister.

g) On shared management of urban technical infrastructure:

Guide and inspect work on the establishment, appraisal, approval of urban planning related to determining shared urban technical infrastructure projects.

Develop and promulgate technical standards, national standards, economic-technical norms for shared urban technical infrastructure projects; regulations on shared use of urban technical infrastructure; templates for management operation contracts for shared urban technical infrastructure projects, templates for shared use contracts for urban technical infrastructure projects.

Guide pricing methods for leasing, rental price ranges for shared urban technical infrastructure projects and organize inspections and supervision of implementation.

Guide, monitor, and inspect compliance with legal provisions on shared management and use of urban technical infrastructure.

9. Regarding housing:

a) Develop national housing development strategies for each period, housing development targets and annual housing development plans in the national socio-economic development tasks and according to each phase; direct implementation after approval by the Prime Minister.

b) Guide provincial People's Committees in building local housing development programs, housing development targets, and annual housing development plans in local socio-economic development tasks and according to each phase; provide opinions on housing development programs of provinces and centrally-administered cities.

Develop and submit to competent authorities for issuance or issue within authority mechanisms and policies to mobilize resources for national housing development, programs, projects, and initiatives for specific target groups in key areas and support improvements in housing for social policy beneficiaries; guide and inspect implementation.

Guide and inspect the establishment, appraisal, approval, adjustment, or suspension of housing construction investment projects, capital raising at housing construction investment projects according to legal provisions on housing; appraise to submit to the Prime Minister for decision or approval of investment proposals, project approval for housing construction according to government delegation and Prime Minister's assignment; guide, urge, and inspect implementation of old apartment renovation and reconstruction.

Issue technical standards for various types of housing; develop for competent authorities to promulgate national standards on housing; issue regulations on classification criteria, management and usage rules, warranty and maintenance systems for various types of housing; issue a framework training program for property management operations; recognize training institutions for specialized property management operations training.

e) Establishing and submitting to the Prime Minister for issuance of standards for the area of official housing; reviewing the demand for official housing and establishing and submitting to the Prime Minister for approval the development plan for official housing of central agencies (except the Ministry of National Defense and the Ministry of Public Security); providing unified opinions for the Ministry of National Defense and the Ministry of Public Security to submit to the Prime Minister for approval the development plan for official housing for the subjects specified in point d, Clause 1, Article 32 of the Housing Law.

g) Guiding the method for determining rental prices for official housing, sale prices, rental prices, lease-purchase prices for social housing, resettlement housing; guiding the method for determining management and operation costs for housing; guiding the criteria, conditions, and procedures for selecting buyers, renters, and lease-purchasers of social housing;

h) Organizing the establishment and management of the Government's official housing fund according to the division of labor by the Prime Minister;

i) Proposing programs for surveys and statistics on housing across multiple provinces and centrally-administered cities for submission to the Prime Minister for consideration and decision-making, and organizing implementation after approval;

10. Regarding office premises:

a) Organizing the preparation and review of planning for the development of administrative office systems of state agencies, state-owned workplaces of political-social organizations, and public service units at the central level; directing, guiding, and inspecting the implementation after approval by the Prime Minister;

b) Guiding and inspecting provincial People's Committees in the preparation of planning for the development of administrative office systems of state agencies, state-owned workplaces of political-social organizations, and public service units at the local level;

c) Issuing technical standards for building offices and workplaces; preparing and submitting to competent authorities for publication national standards for building offices and workplaces; issuing regulations on classification criteria and maintenance regimes for state-owned offices and workplaces;

d) Organizing surveys, statistics, and periodic evaluations of state-owned offices and workplaces to serve state management of offices;

11. On the real estate market:

a) Building strategies and policies for the development and management of the real estate market; directing implementation after approval by the Prime Minister;

b) Taking the lead and coordinating with ministries, ministerial-level agencies, and provincial People's Committees in organizing implementation and managing real estate business;

c) Inspecting and supervising the implementation of laws on real estate business; coordinating with provincial People's Committees to organize inspections and reviews of real estate projects to make recommendations to competent state authorities for recovery, suspension, temporary halt, adjustment, transfer, or assignment of real estate projects;

d) Guiding training and capacity building for real estate brokerage and property trading floor management; issuing a framework training program for real estate brokerage and property trading floor management; issuing a model real estate broker certificate; guiding and inspecting the issuance and management of real estate broker certificates;

đ) Guiding and inspecting the implementation of legal provisions on real estate service business; the establishment and organization of activities of property trading floors;

e) Building and managing the national information system on the real estate market; developing and publishing indices to evaluate the real estate market as prescribed by law;

12. On construction materials:

a) Organizing the preparation, review, and submission to the Prime Minister for approval of comprehensive planning for the development of construction materials in Vietnam, cement development planning, and national programs and projects on construction materials; guiding and inspecting implementation after approval by the Prime Minister;

b) Organizing the preparation, review, approval, and guidance of implementation of planning for the development of major construction material products (excluding cement development planning);

c) Guiding and inspecting provincial People's Committees in the preparation, review, approval, and management of implementation of local construction material development planning;

d) Organizing the preparation, review, and submission to the Prime Minister for approval of planning for exploration, exploitation, processing, and utilization of major construction material minerals and cement minerals; guiding and inspecting implementation after approval by the Prime Minister;

e) Guiding and inspecting provincial People's Committees in the preparation, review, approval, and management of implementation of local planning for exploration, exploitation, processing, and utilization of common construction material minerals;

g) Guiding activities related to assessment and evaluation of production technology, product quality, and construction material goods; processing technology and quality of construction material minerals; guiding and inspecting testing, inspection, evaluation, and certification activities for the suitability of construction material product quality;

h) Issuing or submitting to competent authorities for issuance the list, conditions, and technical standards for construction materials subject to import and export, restricted import and export construction materials, and construction materials requiring conditions for business; guiding and inspecting implementation;

i) Guiding the use of construction materials that conserve mineral resources, energy, and are environmentally friendly in construction projects;

13. On technical safety in construction works:

a) Leading the establishment of national standards on occupational safety and health and construction, issuing national technical standards on occupational safety and health within its scope of management after obtaining the opinion of the Ministry of Labor, Invalids and Social Affairs, including: occupational safety and health in formulating technical measures and organizing construction work; occupational safety for machinery, equipment, and materials with strict requirements for occupational safety used in construction works;

b) Implement state management over machines, equipment, materials, and substances with strict requirements for safety and labor hygiene used in construction works; establish detailed lists of types of machines, equipment, materials, and substances with strict requirements for safety and labor hygiene under the Ministry's jurisdiction to submit to the Ministry of Labor, Invalids, and Social Affairs for promulgation; develop and issue inspection procedures and guidelines, inspecting the operation of inspections of machines, equipment, and materials with strict requirements for safety and labor hygiene under the Ministry's jurisdiction after receiving opinions from the Ministry of Labor, Invalids, and Social Affairs;

c) Organize training, upgrading, and examination of inspection skills for machines, equipment, and materials with strict requirements for labor safety and hygiene for inspection objects under its management;

d) Issue, extend, reissue, and revoke Certificates of Qualification for Technical Safety Inspection Activities and issue, reissue inspector certificates within the Ministry's jurisdiction, and publish them on the Ministry of Construction's electronic information website;

đ) Guide the implementation of technical incident reporting, investigation, statistics, and reporting on incidents causing labor safety hazards during construction; guide and inspect labor safety and hygiene matters within the scope, tasks, and authority of state management of the Ministry;

14. On environmental protection:

a) Direct and guide the integration of environmental planning, plans, and programs into strategies, plans, and programs for development in fields under the Ministry's state management;

b) Develop and issue regulatory legal documents on environmental protection in fields under the Ministry's management as prescribed by law;

c) Direct and guide the implementation of strategic environmental impact assessment reports, environmental impact assessment reports; review strategic environmental impact assessment reports, environmental impact assessment reports within the authority, monitor environmental impacts from industry and field activities, prepare environmental protection work reports for the industry;

d) Develop and implement environmental protection activities and climate change response measures within the Ministry's management scope;

đ) Implement energy-efficient and effective use in construction projects, develop green buildings and green growth in fields under the Ministry's state management;

15. Organize the implementation of tasks related to the application of information technology and the construction of an e-Government in the construction sector according to the law; build and manage the operation of online service systems in fields under the Ministry of Construction's state management as assigned by the Government and the Prime Minister;

16. Organize the implementation of statistical work, document storage, and data on fields under the Ministry's state management according to the law;

17. Decide specific policies and measures and direct the implementation of operational mechanisms for public service organizations under the Ministry's management according to the law; manage and direct the operations of subordinate public institutions;

18. On exercising rights and obligations as the owner of state capital in enterprises with state capital under the Ministry's management scope:

a) Develop proposals and overall plans for restructuring, organizational reform, shareholding, ownership conversion, innovation, and development of state-owned enterprises and public service units under the Ministry's management to submit to the Prime Minister for approval and direct the implementation of the proposal after approval;

b) Submit to the Prime Minister for decision or decide within the authority the appointment, dismissal, resignation, commendation, disciplinary action, salary system for positions of Chairman of the Board of Directors, Board Members, General Director, and Professional Inspector at State-owned corporations and companies 100% owned by the state under the Ministry's management;

c) Review and submit to the Prime Minister for approval or approve within the authority the charter organization and operation of State-owned corporations 100% owned by the state under the Ministry's management;

d) Appoint representatives of state capital in state-owned enterprises directly under the Ministry when they become joint-stock companies;

19. Propose the Government to issue mechanisms and policies to encourage, support, and guide the development of enterprises, cooperatives, and other collective and private economic forms under the state's economic components in fields under the Ministry's management; guide and inspect compliance with regulations for business sectors with conditions under the Ministry's management;

20. Develop and implement the Science and Technology Development Strategy for the Construction Industry; guide the implementation of scientific research and technological advancement activities in fields under the Ministry's management; develop and organize the management of product quality standards and measurement systems in the Construction Industry according to the law;

21. Develop and implement the Human Resource Development Plan and the Human Resource Training Strategy for the Construction Industry; coordinate with the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs to develop architectural and engineering training programs and other vocational levels in construction specialties; develop and organize specialized knowledge training and professional skills enhancement for construction officials, civil servants, and employees; develop and organize urban management and development knowledge training and enhancement for leadership and professional urban officials at all levels;

22. Develop and implement international cooperation plans and programs and international integration in fields under the Ministry's management according to the law; organize negotiations and sign international treaties under the Government's authorization; participate in international organizations as assigned by the Government; sign and organize the implementation of international agreements on behalf of the Ministry according to the law;

23. Decide and direct the implementation of the Ministry's administrative reform plan according to the goals and contents of the overall administrative reform program approved by the Prime Minister.

24. Perform tasks and exercise powers over associations and non-governmental organizations within the scope of state management of the Ministry in accordance with the provisions of law.

25. Conduct inspections and audits; handle complaints and reports; prevent and combat corruption and misconduct; and handle violations of laws in areas under the scope of state management of the Ministry.

26. Manage organizational structure, staffing, civil servants, officials, the number of employees under labor contracts; implement salary systems and incentive policies, rewards, and disciplinary measures for civil servants, officials, and employees under the scope of management of the Ministry in accordance with the provisions of law.

27. Prepare the budget estimate of the Ministry; coordinate with the Ministry of Finance and the Ministry of Planning and Investment to establish and consolidate revenue and expenditure budget estimates according to sectors and fields under the scope of management for submission to the Government for presentation to the National Assembly; manage, organize implementation, and settle accounts of the state budget; manage and be responsible for state assets assigned; perform other tasks related to the state budget, finance, and assets in accordance with the provisions of law.

28. Carry out other tasks assigned or delegated by the Government or the Prime Minister.

Units from Clause 1 to Clause 17 of this Article are organizations assisting the Minister in performing state management functions; units from Clause 18 to Clause 25 are public service units directly subordinate to the Ministry.

Departments under the Ministry shall be organized into divisions, including: The Department of Planning - Finance and the Cadre and Civil Servant Organization Department shall be organized into four divisions; the Office shall be organized into eight divisions; the Inspectorate shall be organized into nine divisions.

Bureaus under the Ministry shall be organized into divisions, including: The Construction Economy Bureau shall be organized into three divisions; the Construction Activity Management Bureau, the Southern Operations Bureau, and the Urban Development Bureau shall be organized into four divisions; the Technical Infrastructure Bureau shall be organized into five divisions; the State Quality Control Bureau for Construction Projects shall be organized into six divisions; the Real Estate Management and Market Bureau shall be organized into seven divisions;

The Minister of Construction shall submit to the Prime Minister for decision on the list of other public service units under the Ministry.

The Minister of Construction shall stipulate the functions, tasks, powers, and organizational structures of Departments, Bureaus, Offices, Inspectorates, public service units, and other units under the Ministry in accordance with the provisions of law.

Article 4. Effective date

1. This Decree takes effect from the date of issuance.

2. This Decree replaces Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Construction.

Article 5. Responsibilities for Implementation

The Minister of Construction, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./
