Issuing the Regulation on the Organization and Operation of Vocational Education and Continuing Education Centers

Pursuant to the Education Law dated June 14, 2019;

Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating the responsibilities for state management of education;

At the proposal of the Director of the Department of Continuing Education,

The Minister of Education and Training issues this Circular on the Regulation on the Organization and Operation of Vocational Education and Continuing Education Centers

Article 1. This Circular promulgates the Regulation on the Organization and Operation of Vocational Education and Continuing Education Centers.

Article 2. This Circular takes effect from February 22, 2023. This Circular applies to Vocational Education and Continuing Education Centers as provided for in point b, Clause 2, Article 44 of the Education Law 2019.

Article 3. The Head of the Office, Directors of Departments of Continuing Education, Heads of units under the Ministry of Education and Training related to this matter, Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training, Directors of Departments of Education, Science and Technology of Bac Lieu Province, Directors of Vocational Education and Continuing Education Centers, and relevant organizations and individuals are responsible for implementing this Circular.

REGULATIONS

Organization and operation of Vocational Education and Continuing Education Centers

PART I

GENERAL PROVISIONS 

Article 1. Scope of Regulation and Applicability

1. This Regulation stipulates the organization and operation of Vocational Education and Continuing Education Centers, including: Organizational structure; Educational activities; Teachers and staff; Students; Finance and assets; Relationships between Vocational Education and Continuing Education Centers and other agencies and organizations.

2. This Regulation applies to Vocational Education and Continuing Education Centers (hereinafter referred to as Centers) and relevant organizations and individuals.

Article 2. Legal Status and State Management of Centers

1. Centers are continuing education institutions within the national education system and are public service units with legal personality, their own seals and separate accounts.

2. Centers are subject to state management of continuing education by the Ministry of Education and Training; vocational education activities by the Ministry of Labor, Invalids and Social Affairs; and state management on the local level by the People's Committee of the province or centrally governed city (hereinafter collectively referred to as Provincial People's Committee) where the Center is headquartered.

3. Centers shall implement self-management and accountability in accordance with the provisions of the law.

Article 3. Naming Regulations for Centers

1. The naming of Centers is regulated as follows:

a) Name of the Center: Vocational Education and Continuing Education Center + specific name or place name.

b) The specific name of the Center must be clear and transparent, not causing misunderstanding about the organization and activities of the Center; it should be consistent with the historical traditions, culture, ethics, and customs of the nation.

2. The name of the Center shall be recorded in the decision establishing the Center, the seal of the Center, the signboard, and transaction documents.

3. The signboard of the Center shall include the following information:

a) Top left corner

- First line: People's Committee of the province and the name of the province;

- Second line: The main managing agency of the Center.

b) In the middle, the name of the Center as prescribed in Clause 1 of this Article shall be recorded.

c) At the bottom, the address, telephone number, email, and website (if any) of the Center shall be recorded.

Article 4. Tasks and Authorities of the Center

1. Organizing the implementation of educational and training programs:

a) Literacy program.

b) Educational programs within the national education system's curriculum for awarding certificates, including: Continuing education programs at the lower secondary level and continuing education programs at the upper secondary level for individuals benefiting from social policies, persons with disabilities, those within compulsory schooling age according to the annual plan of the locality, and workers who wish to complete their general education curriculum.

c) Education programs meeting learners' requirements, updating knowledge and skills in areas such as legal education, culture, society, sports, arts, environment, health, economy, finance; skill development programs; technology transfer programs in labor and production aimed at enhancing productivity.

d) Training and upgrading programs to enhance professional qualifications and vocational capabilities, including: Foreign language and computer training, cultural knowledge enhancement; ethnic minority language training for cadres and civil servants working in ethnic and mountainous regions; regular teacher training; pre-school, primary, and lower secondary school teachers' training on organizing experiential activities and career guidance; teacher training programs to improve professional qualifications and expertise; other training programs to enhance professional qualifications and vocational capabilities for the cadre, civil servant, and public service staff team according to the local plan and lifelong learning needs of citizens.

2. Surveying learning demands, professional qualifications, and vocational skills in the locality, determining learning content, and proposing to the Department of Education and Training and local authorities the organization of educational and training programs and suitable learning formats for each type of learner.

3. Cooperating with general education institutions, vocational education institutions, and other continuing education facilities in the locality to implement knowledge and skill enhancement programs, experiential activities, and other supportive educational activities based on learners' and schools' needs.

4. Implementing basic level training or linking with basic, intermediate, and college-level training as prescribed by the Ministry of Labor, Invalids, and Social Affairs; linking with university-level training as prescribed by the Ministry of Education and Training.

5. Exercising autonomy as prescribed by law and the following specific provisions:

a) Determining the mission, vision, strategy, and development plans of the Center;

b) Deciding on the establishment of organizational structures, developing teaching staff and management personnel based on the Center's strategic planning and development plan; defining the functions and tasks of organizations under the Center;

c) Receiving and disbursing financial resources, investing in conditions to ensure the quality of training as prescribed by law; deciding on tuition fees for educational programs that meet learners' needs according to the Center's financial autonomy regulations;

d) Admitting students and managing learners; developing educational programs; organizing the compilation or selection of study materials appropriate to the educational objectives of each program; managing and issuing certificates to learners as prescribed by law;

đ) Organizing the implementation of scientific research and technological cooperation activities, international cooperation according to the Center's development strategy and plan; ensuring the quality of education at the Center; selecting quality assurance organizations to register for accreditation;

6. Mobilizing, managing, and utilizing resources as prescribed by law.

7. Constructing, investing in, managing, and effectively using material infrastructure and educational equipment according to the requirements of educational and training programs.

8. Recruiting, employing, and managing teachers, managers, and public service staff; organizing for teachers to update and enhance their professional skills; organizing for teachers, public service staff, and learners to participate in social activities.

9. Implementing democratic regulations within the Center.

10. Implementing information and reporting systems and being responsible for explaining to competent authorities, learners, and society.

11. Other tasks and authorities as prescribed by law.

Chapter II

ORGANIZATION AND STRUCTURE OF THE CENTER

Article 5. Organizational Structure of the Center

The organizational structure of the Center includes: director, deputy directors; specialized and vocational departments; classrooms; production, business, and service organizations serving educational and training activities (if any); commendation and discipline councils; scientific council and advisory council (when necessary).

Article 6. Director of the Center

1. The Director of the Center is the head of the Center, directly managing and directing the organization and machinery, and is responsible under the law and to the superior management agency for all activities of the Center.

2. Qualifications for the Director of the Center

a) Having sufficient health, good political qualities and morals;

b) Holding a bachelor's degree in teacher education or higher, or a bachelor's degree in a relevant field and a certificate in pedagogical training;

c) Having at least five years of work experience in the education sector;

d) Having undergone training and development in vocational management of vocational education (for centers that have been registered for vocational education activities).

3. The supervising authority decides on recognizing, appointing, reappointing, dismissing, transferring, rotating, rewarding, disciplining, and implementing systems and policies for the Director of the Center according to the provisions of the law.

4. Duties and powers of the Director of the Center

a) Building and approving strategies and development plans for the Center;

b) Establishing regulations regarding: number, structure of labor, job positions, recruitment, management, utilization, development of teaching staff, managerial personnel, and employees according to the provisions of the law;

c) Deciding on the establishment, merger, division, dissolution of organizations within the Center; appointing, dismissing, and removing from office heads and deputies of organizations within the Center;

d) Developing planning and developing the teaching staff and managerial personnel; deciding on salary based on job position linked to performance and quality of work, consistent with levels of autonomy; recruiting employees according to the needs of the Center; managing, utilizing civil servants and terminating contracts according to the law. Annually, organizing evaluations and classifications of teachers, managerial personnel, and employees;

đ) Organizing and directing the construction of a healthy pedagogical environment; ensuring political security and social order within the Center;

e) Implementing democratic regulations within the Center; implementing state policies and systems for managerial personnel, teachers, employees, and students within the Center according to the provisions of the law;

g) Signing contracts with other educational institutions; production, business, and service organizations in educational activities or other production, business, and service organizations according to the provisions of the law;

h) Issuing school records, certificates, and certifications to students who meet the requirements according to the provisions;

i) Deciding on rewards and punishments for managerial personnel, teachers, employees, and students within the scope of management authority delegated;

k) Managing physical facilities, assets, finance, and organizing the exploitation and effective use of mobilized resources to serve the educational and training activities of the Center according to the provisions of the law;

l) Implementing information and reporting systems and being subject to supervision, inspection, and audit according to the provisions of the law;

m) Annually, reporting on the implementation of duties and powers to the direct management agency;

n) Other duties and powers as prescribed by law.

Article 7. Deputy Director of the Center

1. The Deputy Director of the Center assists the Director in managing and operating the Center's activities; is responsible for managing and directing tasks assigned by the Director or authorized.

2. Criteria for Deputy Director of the Center

a) Having sufficient health, good political qualities and morals;

b) Hold a bachelor's degree in teacher training or a relevant field, or must have a bachelor's degree in a suitable major and a certificate in pedagogical training;

c) Have at least three years of work experience in the education sector.

3. The supervising authority decides to recognize, appoint, reappoint, dismiss, transfer, rotate, reward, discipline, and implement systems and policies for the Deputy Director of the Center according to the provisions of the law.

Article 8. Professional and Operational Teams

1. The professional and operational teams have the responsibility to advise and assist the Director of the Center in managing, summarizing, proposing opinions, and organizing the implementation of the main tasks of the Center such as: academic affairs, training, administrative management, asset management; personnel organization; summary, external relations; professional and operational activity management; student management, learner management; financial management, property management, equipment management according to the functions and tasks assigned by the Center Director.

The Director decides to establish professional and operational teams based on the organizational structure of the Center approved in the Center's job position plan.

2. The professional and operational teams have team leaders and deputy team leaders (sub-team leaders). The team leader must hold a bachelor's degree or higher.

3. The deputy team leader assists the team leader in managing and operating the team's activities according to the assigned tasks. The number of deputy team leaders depends on the assigned functions and tasks and the scale of training at the Center, specified in the Center's job position plan. The appointment and dismissal of team leaders and deputy team leaders at the Center are carried out according to the provisions of the law.

Article 9. Production, Business, and Service Teams Serving Educational and Training Activities

1. The production, business, and service teams serving educational and training activities aim to create conditions for learners and teachers at the Center to practice and intern to enhance their knowledge and skills.

2. The production, business, and service teams serving educational and training activities do not have the function of organizing training or joint training.

The Center Director decides to establish, assign functions and tasks, dissolve the production, business, and service teams serving educational and training activities based on the Center's job position plan that has been approved.

Article 10. Councils within the Center

1. The Commendation and Award Council

The Commendation and Award Council is established at the beginning of each academic year to assist the Center Director in organizing commendation movements and recommending award lists for staff, teachers, employees, and students at the Center. The Commendation and Award Council is established by the Center Director and serves as its chairman. Members of the Commendation and Award Council include: secretary, party committee member, deputy director, some team leaders, and class teachers.

2. The Disciplinary Council

a) The Student Disciplinary Council is established to review or remove disciplinary actions against students on a case-by-case basis. The Student Disciplinary Council is established and chaired by the Center Director. Members of the council include: secretary, party committee member, deputy director, some team leaders, class teachers with students who violated rules, some experienced educators, and the head of the parent representative council of the Center (for students in compulsory education age).

b) The Staff, Teacher, and Employee Disciplinary Council is established to review and recommend disciplinary measures for staff, teachers, and employees on a case-by-case basis. The establishment, composition, and operation of the Staff, Teacher, and Employee Disciplinary Council are carried out according to the provisions of the law.

3. Advisory Council

The Advisory Council is established by the Director based on specific work requirements. The tasks, composition, and duration of the Advisory Council are determined by the Center Director. Members of the Advisory Council participate on a case-by-case basis and do not receive salary.

Chapter III

ORGANIZATION OF EDUCATIONAL ACTIVITIES IN THE CENTER

Article 11. Programs, Textbooks, and Learning Materials

1. The Center uses programs, textbooks, and learning materials for educational programs leading to diplomas issued by the Ministry of Education and Training or those that have been reviewed.

2. For training, development, and education programs meeting learners' needs, the Center selects and uses learning materials from higher education institutions, colleges, domestic and international educational organizations that have been published according to regulations, or programs and materials developed by the Center in accordance with learners' needs and the Center's capacity to respond.

The Director of the Center is responsible under the law and before the educational management agency for the content of the programs and teaching materials at the Center; simultaneously, they are responsible for reporting to the Department of Education and Training on the programs and teaching materials used at the Center.

Article 12. Admissions

1. Annually, the Center develops an admissions plan based on the learning needs of the people, the local socio-economic development plan, the scale of operations, and the Center's capacity to respond; publicly announces information about courses including the program, teaching materials, output objectives, study conditions, teachers, assessment methods, confirmation of study results, opening date, tuition fees, other necessary information, and publicly announces this information before the course commencement date.

The Center Director is responsible for the admission information for each course, ensuring the accuracy and truthfulness of the information, and safeguarding the rights of learners.

2. Admission targets for junior high school and high school

a) The target group for enrolling in the regular education program to obtain a junior high school graduation certificate is individuals who have completed the primary education program or the literacy program. The target group for enrolling in the regular education program to obtain a high school graduation certificate is individuals who have graduated from junior high school.

b) Individuals who have a certificate confirming completion of the general education program, if they wish to enroll at the Center (without retesting) to enhance knowledge for the high school graduation examination, the Center Director will arrange classes based on the Center's capacity and allow students to review their knowledge.

c) For admissions into non-first-grade classes, if learners have a record book showing satisfactory academic performance and promotion, the Center will arrange them to join the next class.

3. For other program admissions, the Center will admit learners based on their needs and the Center's capacity to meet teaching and learning conditions.

Article 13. Teaching Activities

1. Learners enrolled in the regular secondary education program and the regular high school education program are organized into classes. Each class has a class teacher, a class president, vice-presidents, and learners. The class president and vice-presidents are elected by learners at the beginning of each academic year or after each semester. Learners actively participate in discussions and contribute to building the activity plans of the group and the class with the support of teachers. The number of learners in each class at the secondary and high school levels does not exceed forty-five learners.

2. The implementation forms of regular education programs at the Center include: work-study; online learning; guided self-study, and other learning forms according to learners' needs. Work-study, online learning, and guided self-study are implemented according to specific regulations of the Ministry of Education and Training.

Article 14. System of Books for Monitoring Educational Activities at the Center

1. For the Center

a) Records of educational programs leading to national education diplomas and literacy programs (if implemented), including:

- Register book;

- The center's educational plan (by academic year);

- Student tracking and evaluation book (including educational records for disabled students);

- Record book of lesson topics;

- Student transcripts;

- Diploma and certificate issuance management book.

b) Records of training programs, educational programs meeting learners' needs, and other training programs

- Plan for organizing educational and training activities of the center (based on assigned tasks, by academic year);

- Records of short-term vocational training courses (in accordance with regulations and guidelines of the Ministry of Labor, Invalids and Social Affairs, if the Center implements them).

c) Records of joint training for university level as prescribed by the Ministry of Education and Training;

d) Records of staff, teacher, and employee evaluations;

e) Management and storage record books for incoming and outgoing documents;

g) Records of educational equipment and library management;

h) Records of asset and financial management;

2. For specialized departments:

a) Specialized department's educational plan (by academic year);

b) Record book of specialized department meetings.

3. For teachers:

a) Teacher's educational plan (by academic year);

b) Lesson planning (lesson plans);

c) Student tracking and evaluation book;

d) Class advisor record book (for teachers responsible for class advising).

4. The records specified in Clause 1, Clause 2, and Clause 3 of this Article may be maintained in electronic form instead of paper records, in accordance with the Center's conditions and teachers' capabilities, ensuring the legality of electronic records. Management of electronic records shall be regulated by the Department of Education and Training according to the connection standards and data standards of the Ministry of Education and Training.

5. Preservation of records managing educational activities at the Center shall be carried out in accordance with the provisions of the law.

Article 15. Examination, Evaluation, Classification of Learning Results, Issuance of Certificates and Diplomas

1. The Center is responsible for conducting examinations and evaluating learning results of students in accordance with the regulations of the Ministry of Education and Training.

2. Students who complete the literacy program and meet the conditions set forth by the Minister of Education and Training shall be recognized as having completed the literacy program.

3. Students who complete the regular secondary school education program and meet the conditions set forth by the Minister of Education and Training shall be awarded a junior high school graduation diploma by the head of the specialized education agency under the provincial People's Committee.

4. Students who complete the regular high school education program and meet the conditions set forth by the Minister of Education and Training shall be eligible to take exams; if they pass, they will be awarded a high school graduation diploma by the head of the specialized education agency under the provincial People's Committee; if they do not take the exam or fail it, they will be issued a certificate of completion of the general education program by the Center director.

5. Students who complete training programs and meet the exit criteria for a given level of training as stipulated in the National Qualifications Framework of Vietnam shall be awarded a corresponding diploma.

6. Students who complete various types of training programs and meet the conditions set forth by the Ministry of Education and Training shall be eligible to take exams; if they pass, they will be awarded a certificate corresponding to the training program.

7. For foreign language and information technology training programs leading to certificates within the national education system, the Center may organize exams and issue certificates when meeting the required conditions.

8. Students who complete short-term training courses at the Center shall be eligible to take assessments; if they meet the program objectives, they will be issued a certificate of course completion by the Center director.

Article 16. Quality Assurance and Education Quality Assessment

The Center shall be responsible for implementing activities related to quality assurance and education quality assessment in accordance with regulations, specifically performing the following activities:

1. Advising the Party Committee and local authorities on planning the construction and development of the Center to strive for achieving educational quality assessment standards at each stage.

2. Organizing self-assessment, registering for external assessment; proposing competent authorities to recognize the Center's achievement of educational quality assessment standards when it meets the specified evaluation criteria.

3. Based on the results of external assessment, supplementing and perfecting the self-assessment report; implementing plans to improve quality in the self-assessment report, recommendations from the external assessment team, and directives from management agencies. Annually, reporting on the implementation of quality improvement to the direct educational management agency for guidance, direction, inspection, and supervision.

4. Preparing complete files and data related to the Center's activities, necessary conditions to serve external assessment work; providing feedback on draft external assessment reports within the deadline.

5. Maintaining and promoting the results of educational quality assessment to continuously improve quality.

Article 17. International Cooperation

The Center implements various forms and programs of international cooperation aimed at enhancing educational quality and training, meeting the lifelong learning needs of all citizens, in accordance with the Center's actual needs and conditions as stipulated by law.

Chapter IV

TEACHERS AND STAFF

Article 18. Teachers

1. Teachers are those who undertake teaching and educational tasks at the Center, participating in teaching programs as prescribed in Clause 1, Article 4 of this Regulation.

2. Center teachers include permanent teachers, contractual teachers, and visiting lecturers.

Article 19. Standards and Required Training Levels for Teachers and Lecturers

1. Teachers instructing regular secondary school education programs and regular high school education programs must meet the required training levels and occupational standards as stipulated for corresponding general education teachers.

2. Teachers participating in teaching programs leading to national education system certificates must ensure the specified conditions regarding professional qualifications.

3. Lecturers involved in training other educational programs of the Center must meet the professional conditions set by the Center Director.

Article 20. Duties and Authorities of Teachers

1. Teachers at the Center have duties and authorities similar to those of general education teachers. In addition, teachers at the Center also have the following additional duties and authorities:

a) Participating in surveys of learning needs in the area, determining learning content, and proposing the organization of appropriate programs and formats for different target groups;

b) Compiling materials and organizing the implementation of regular education programs organized by the Center;

c) Participating in enrollment and literacy campaigns, universal education efforts;

d) Participating in the management of classes and joint training programs of the Center;

đ) Participating in the Center’s educational quality assurance activities;

e) Supporting professional activities at community learning centers;

g) Tutoring and supporting learning for disabled students.

2. Teachers serving as class advisors at the Center, in addition to the duties and authorities stipulated in Clause 1 of this Article, also have additional responsibilities and authorities similar to those of class advisors at general education schools.

3. Working conditions for teachers at the Center are regulated by the Ministry of Education and Training.

Article 21. Conduct, Language, and Dress Code for Teachers

1. The conduct and language of teachers must be exemplary and serve an educational purpose for students.

2. The attire of teachers must be neat, appropriate, and suitable for teaching activities.

Article 22. Standards, Duties, and Authorities of Staff Members

1. The occupational title standards and required qualifications for staff members such as librarians; equipment, laboratory technicians; administrative clerks; information technology; education support for persons with disabilities; school health, accounting; cashiers, secretaries shall be applied according to current regulations for general education institutions.

2. Duties of staff members

a) Tasks assigned according to plans, contracts, and the director's allocation at the Center;

b) Implement professional rules and comply with the Center's internal regulations;

c) Participate in training courses relevant to their assigned tasks;

d) Ensure safety for educational activities at the Center; adhere to labor safety regulations;

đ) Cultivate ethics, maintain personal integrity, honor, and reputation, and that of the Center; foster unity, mutual assistance, and support among colleagues;

e) Enhance physical fitness, study culture, and professional skills to improve the quality of work;

g) Fulfill civic duties and comply with laws, industry regulations, and Center decisions made by the director.

Chapter V

STUDENTS

Article 23. Students

Students at the Center are individuals enrolled in at least one educational program offered by the Center.

Article 24. Duties of Students

1. Respect teachers, management staff, and other employees of the Center; comply with the Center's internal regulations and this Charter's provisions.

2. Fully meet all requirements for studying and practical work as stipulated by the Center.

3. Safeguard and protect the Center's property.

4. Contribute to building, protecting, and promoting the Center's traditions.

5. Pay tuition fees in full and on time (for students required to pay tuition).

Article 25. Rights of Students

Students have the following rights:

1. To be respected and treated equally, and to receive complete information about their studies.

2. To choose programs, forms, and locations of study that suit their abilities and conditions, and to be facilitated in changing programs, forms, and locations if they wish and are accepted by the new location.

3. To participate in Center activities as prescribed.

4. To directly or through authorized representatives protect their legitimate rights, provide feedback on teaching content, methods, and other Center activities.

5. To benefit from part of the results of labor production, technical practice, and other activities they participate in; to be considered for scholarships and social allowances according to the law.

6. Students who complete regular education programs as specified in Article 15 of this Charter shall be awarded diplomas, certificates, or certificates of completion.

Article 26. Conduct, Language, and Dress Code for Students

1. The conduct and language of students must be cultured and appropriate to the ethics and lifestyle in an educational environment.

2. The attire of students must be neat and convenient for studying and living at the Center.

Chapter VI

FINANCE AND ASSETS

Article 27. Finance and Financial Sources of the Center

1. Implement financial income and expenditure in accordance with the State Budget Law and other regulations on state financial management.

2. Financial sources of the Center

a) Budget funds allocated by the state budget;

b) Revenue from the Center's public service activities, including: tuition fees; revenue from cooperative training, scientific, technological, production, business, service activities, and other public service activities;

c) Assistance, sponsorship, support, and gifts from organizations and individuals both within and outside the country in accordance with the law;

d) Other lawful revenues.

Article 28. Physical Facilities, Educational Equipment, and Library of the Center

1. Infrastructure

a) The Center has a location for constructing physical facilities and has sufficient classrooms, desks and chairs, laboratories, libraries, functional rooms, and practical labor production rooms to meet the requirements of teaching and learning educational programs.

b) The Center is responsible for developing specific plans and timelines to submit to the competent authority for approval to enhance investment in physical facilities to achieve higher standards.

c) The Center is responsible for managing and using its physical facilities efficiently, avoiding waste; regularly planning renovations and upgrades of physical facilities in accordance with regulations; absolutely not putting into use physical facilities that have exceeded their service life and are unsafe without renovation and repair.

2. Educational Equipment

a) The Center is equipped with educational equipment, organizes management and effective use of educational equipment in teaching and education in accordance with the Ministry of Education and Training's regulations.

b) Teachers are responsible for effectively using the Center's educational equipment in teaching and educational activities; encouraging teachers and students to make teaching aids according to the content and methods of regular education programs.

3. Library

a) The Center's library is organized and operates in accordance with the school library standards set by the Ministry of Education and Training.

b) The Center's library serves learning, teaching, and scientific research activities for students, teachers, staff, and workers.

c) The Center's library is arranged safely, scientifically, and conveniently. Encouraging Centers to build open libraries, creating reading spaces for students. Developing electronic libraries where conditions permit.

d) Encouraging socialization in library development.

Article 29. Management and Use of Assets and Finance

1. The Center's assets are invested, provided, managed, and used in accordance with the law and current regulations of the Law on Management and Use of Public Assets.

2. Every member of the Center is responsible for maintaining and protecting the Center's assets. Annually, the Center must organize an inventory and revaluation of the value of its assets and implement reporting procedures as prescribed by law.

3. The Center is responsible for publicly disclosing annual income and expenditure and managing finances in accordance with the law.

Chapter VII

RELATIONSHIP BETWEEN THE CENTER AND OTHER AUTHORITIES AND ORGANIZATIONS

Article 30. Relations between the Center and political-social organizations, occupational associations, and social organizations at the local level

1. The Center shall coordinate with political-social organizations, occupational associations, and other social organizations at the local level to implement the contents of cooperative programs aimed at supporting and creating favorable conditions for all people of all age groups to participate in learning.

2. Encourage organizations and individuals to invest in developing the Center, participate in building lifelong learning movements and a learning society.

Article 31. Relations between the Center and enterprises

The Center has the responsibility to proactively cooperate with enterprises in training activities, including:

1. Developing and implementing training plans to meet the direct production technical workforce needs of enterprises and the labor market.

2. Inviting representatives of related enterprises to participate in the development of the Center's training programs and curricula; participating in teaching, guiding vocational internships, and evaluating students' academic performance.

3. Cooperating with enterprises to organize visits and internships for teachers and students at enterprises, linking teaching and learning with practical production and services.

4. Collaborating with enterprises to train and enhance the vocational skills of enterprise employees when needed.

5. Cooperating with enterprises in research, production, application, and technology transfer activities.

Article 32. Relations between the Center and the families of students

1. Annually, the Center is responsible for publicly announcing plans, enrollment quotas, standards, policies, and benefits for students and their families.

2. The Center is responsible for advising and supporting students and their families in selecting appropriate programs, times, and forms of study.

3. Maintaining regular contact with the families of students, exchanging information about students' academic performance and discipline.

Chapter VIII

IMPLEMENTATION

Article 33. Responsibilities of the Ministry of Education and Training, the Ministry of Labor, Invalids, and Social Affairs

1. The Ministry of Education and Training shall perform state management functions in regular education; guide the implementation of this Circular; organize inspections, examinations, and handling of violations concerning the responsibilities of state management, management activities of the Ministry, and provisions of this Regulation.

2. The Ministry of Labor, Invalids, and Social Affairs shall direct and guide vocational education activities; organize inspections, examinations, and handling of violations concerning vocational education activities and related provisions in this Regulation.

Article 34. Responsibilities of the Provincial People's Committee

1. Direct the organization and implementation of this Regulation for Centers within its jurisdiction.

2. Allocate sufficient resources for the Center to implement according to this Regulation.

3. Assign competent agencies directly managing or delegating management authority over Centers within its jurisdiction in accordance with actual provincial conditions to ensure the quality and effectiveness of educational and training programs; resolve difficulties and obstacles in accordance with the law.

4. Inspect and audit the implementation of this Regulation within its authority and according to the current administrative delegation system; handle violations by Centers within its jurisdiction in accordance with the law.

5. Consolidate and develop the network of Centers in conjunction with the construction of a learning society in the locality.

Article 35. Responsibilities of the Department of Education and Training and the Department of Labor, Invalids and Social Affairs

1. Responsibilities of the Department of Education and Training

a) Guide the implementation of this Regulation for Centers.

b) Inspect, audit the organization and operation, and handle violations of Centers according to regulations.

c) Publicize the list of Centers, quality commitments, quality assurance conditions, establishment time, and operating permit locations on the Department of Education and Training's electronic portal so that learners and society can monitor.

d) Annually compile and evaluate the operational situation of Centers within their jurisdiction and report to the Ministry of Education and Training.

2. Responsibilities of the Department of Labor, Invalids and Social Affairs

a) Guide Centers to organize the implementation of vocational training programs according to the regulations of the Ministry of Labor, Invalids and Social Affairs.

b) Lead and coordinate with the managing agency to inspect and audit the implementation of regulations concerning vocational education at Centers, and handle violations according to the authority prescribed.

Article 36. Responsibilities of the Managing Agency

1. Directly manage the Center and bear responsibility for guiding, resolving, and inspecting and supervising issues related to personnel, assets, and infrastructure of the Center within its management scope.

2. Direct the implementation of the organizational and operational regulation of the Center according to this Circular.

3. Prepare sufficient conditions regarding infrastructure, teaching equipment, faculty, staff, and workers for the Center to operate effectively and with quality when implementing regular education programs; primary vocational programs (if granted a registration certificate for vocational education activities); and joint training classes at the Center.

4. Inspect the implementation of this Circular and handle violations of subordinate Centers according to the law.

Article 37. Responsibilities of the Center

1. Strictly implement the provisions of this Regulation and relevant laws.

2. The Director of the Center is responsible for explaining to management agencies at all levels about the implementation of tasks and powers assigned under this Regulation.

3. Annually or at any time, compile the operational situation of the Center and submit reports to the Department of Education and Training./.
