Issuing national technical regulations on
environmental quality

On the basis of Law on Standards and Technical Regulations June 29, 2006;

On the basis of Environmental Protection Law November 17, 2020;

On the basis of Decree No. 127/2007/NĐ-CP dated August 1, 2007, issued by the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

On the basis of Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing some articles of Decree No. 127/2007/NĐ-CP ATTACHED TO THIS CIRCULAR ARE THE NATIONAL TECHNICAL REGULATIONS ON SEARCH AND RESCUE MULTIBAND TRANSMITTERS OPERATING IN THE FREQUENCY BAND FROM 9 200 MHz TO 9 500 MHz (QCVN 60:2023/BTTTT).

On the basis of Decree No. 68/2022/NĐ-CP September 22, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

On the basis of Circular No. 26/2019/TT-BKHCN dated December 25, 2019 of the Minister of Science and Technology detailing the construction, examination, and issuance of technical regulations;

At the proposal of the Director of the Environmental Pollution Control Department, the Head of the Science and Technology Department, and the Head of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular on national technical standards for ambient environmental quality.

Article 1. Attached to this Circular are 05 national technical standards for ambient environmental quality, including:

1. QCVN 03:2023/BTNMT - National Technical Standard on Soil Quality;

2. QCVN 05:2023/BTNMT - National Technical Standard on Air Quality;

3. QCVN 08:2023/BTNMT - National Technical Standard on Surface Water Quality;

4. QCVN 09:2023/BTNMT - National Technical Standard on Groundwater Quality;

5. QCVN 10:2023/BTNMT - National Technical Standard on Marine Water Quality.

Article 2. Implementation clause

This Circular takes effect from September 12 2023.

2. From the date this Circular takes effect, the following Circulars shall cease to be effective, except as provided in Clause 4 of Article 1 of this Circular:

a) Circular No. 16/2009/TT-BTNMT dated October 7, 2009 of the Minister of Natural Resources and Environment on national technical standards for the environment;

b) Circular No. 13/2012/TT-BTNMT dated November 7, 2012 of the Minister of Natural Resources and Environment promulgating "National Technical Standards on Allowable Limits of Dioxins in Certain Types of Soil";

c) Circular No. 43/2013/TT-BTNMT dated December 25, 2013 of the Minister of Natural Resources and Environment on national technical standards for the environment;

d) Circular No. 64/2015/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment promulgating national technical standards for the environment;

đ) Circular No. 65/2015/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment promulgating national technical standards for the environment;

e) Circular No. 66/2015/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment promulgating national technical standards for the environment;

g) Circular No. 67/2015/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment promulgating national technical standards for the environment.

3. From the date this Circular takes effect, the following standards shall cease to be effective:

a) QCVN 15:2008/BTNMT issued together with Decision No. 16/2008/QĐ-BTNMT dated December 31, 2008 of the Minister of Natural Resources and Environment on national technical standards for the environment;

b) QCVN 05:2013/BTNMT issued together with Circular No. 32/2013/TT-BTNMT dated October 25, 2013 of the Minister of Natural Resources and Environment on national technical standards for the environment.

4. Transitional Provisions

a) For tasks and projects assessing wastewater reception capacity and water body load approved before the effective date of this Circular that include the assessment of nitrate (NO₃^- calculated as N) and phosphate (PO₄^3- calculated as P) parameters, the limit values for nitrate and phosphate parameters specified in QCVN 08-MT:2015/BTNMT issued together with Circular No. 65/2015/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment on national technical standards for the environment shall continue to apply, except for tasks and projects adjusted to apply QCVN 08:2023/BTNMT issued together with this Circular;

b) For tasks and projects treating land contaminated by persistent organic pesticide chemicals approved before the effective date of this Circular, QCVN 54:2013/BTNMT issued together with Circular No. 43/2013/TT-BTNMT dated December 21, 2015 of the Minister of Natural Resources and Environment on national technical standards for the environment shall continue to apply, except for tasks and projects adjusted to apply QCVN 03:2023/BTNMT issued together with this Circular.

Article 3. Implementation Organization

1. Ministries, ministerial-level agencies, People's Committees at all levels, Departments of Natural Resources and Environment of provinces and centrally-administered cities, and relevant organizations and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, if difficulties or obstacles are identified, organizations and individuals should promptly report them to the Ministry of Natural Resources and Environment for consideration and resolution./.
