Pursuant to the Law on Local Administration Organization dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration Organization dated November 22, 2019;

Pursuant to the Law on Issuing Normative Legal Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Issuing Normative Legal Documents dated June 18, 2020;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to Decree No. 98/2023/NĐ-CP of the Government dated December 31, 2023 providing details on the implementation of certain provisions of the Law on Competition and Reward;

Pursuant to Circular No. 01/2024/TT-BNV dated February 24, 2024 of the Ministry of Home Affairs stipulating measures for implementing the Law on Competition and Recognition and Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government detailing the implementation of certain provisions of the Law on Competition and Recognition;

Based on the proposal of the Department of Home Affairs at Proposal No. 128/TTr-SNV dated May 7, 2024.

DECISION:

Article 1.

These Regulations on the work of competition and recognition of Bac Ninh Province are hereby promulgated together with this Decision.

Article 2.

This Decision takes effect from June 11, 2024 and replaces Decision No. 16/2020/QD-UBND dated October 2, 2020 of the Bac Ninh Provincial People's Committee on issuing the Regulations on the work of competition and recognition of Bac Ninh Province.

Article 3.

The Provincial Competition and Recognition Council; Heads of provincial departments, agencies, mass organizations; People's Committees of districts, towns, cities; relevant agencies, units, organizations, and individuals are responsible for implementing this Decision.

REGULATIONS

ON THE WORK OF COMPETITION AND RECOGNITION OF BAC NINH PROVINCE
(Issued together with Decision No. 13/2024/QD-UBND dated May 31, 2024 of the Bac Ninh Provincial People's Committee)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. These regulations provide detailed provisions on certain aspects of the work of competition and recognition including Clause 4, Clause 6 Article 24; Clause 3 Article 26; Clause 3 Article 27; Clause 3 Article 28; Clause 2 Article 29; Clause 2 Article 30; Clause 2 Article 31; Clause 6 Article 74; Clause 2 Article 75 of the Law on Competition and Recognition 2022 and certain aspects of the work of competition and recognition on the territory of Bac Ninh Province.

Article 2. Aspects of the work of competition and recognition not provided for in these regulations shall be implemented in accordance with the Law on Competition and Recognition 2022; Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government detailing the implementation of certain provisions of the Law on Competition and Recognition; Circular No. 01/2024/TT-BNV dated February 24, 2024 of the Ministry of Home Affairs stipulating measures for implementing the Law on Competition and Recognition and Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government detailing the implementation of certain provisions of the Law on Competition and Recognition and other guiding documents.

Article 2. Applicability

1. Collectives and individuals in state agencies, political organizations, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations, enterprises, other economic organizations, military units, and households (hereinafter referred to as agencies, units, localities) achieving many achievements in competition movements on the territory of Bac Ninh Province.

2. Individuals and collectives of overseas Vietnamese; individuals and collectives of foreigners; foreign agencies and organizations and international organizations in Vietnam; collectives and individuals belonging to central agencies located in the province who have made contributions to the socio-economic development, national defense security, social welfare activities, and other activities on the territory of Bac Ninh Province.

3. Organizations and individuals at various levels of the provincial government having the authority to grant awards and organizations and individuals with functions and tasks related to the work of competition and recognition on the territory of Bac Ninh Province.

Article 3. Abbreviations and explanations of terms

In this Regulation, some terms are abbreviated and explained as follows:

1. The Law on Encouragement and Reward 2022 is Law No. 06/2022/QH15 adopted by the National Assembly of the Socialist Republic of Vietnam at its 15th session, third meeting on June 15, 2022.

2. Decree No. 98/2023/NĐ-CP is Decree No. 98/2023/NĐ-CP dated December 31, 2023 issued by the Government detailing the implementation of certain provisions of the Law on Encouragement and Reward.

3. Circular No. 01/2024/TT-BNV is Circular No. 01/2024/TT-BNV dated February 24, 2024 issued by the Ministry of Home Affairs stipulating measures to implement the Law on Encouragement and Reward and Decree No. 98/2023/NĐ-CP dated December 31, 2023 issued by the Government detailing the implementation of certain provisions of the Law on Encouragement and Reward.

4. People's Committee is abbreviated as "UBND".

5. Member unit is a unit within a Group, Cluster, or Joint Competition Program.

6. Direct laborer is a worker, farmer, soldier in the armed forces; civil servant, officer, employee, and worker.

Article 4. General Provisions on Rewards

Implemented according to Article 1 of Circular No. 01/2024/TT-BNV.

Article 5. Principles of Encouragement and Reward and Principles for Awarding Merit Titles and Forms of Reward

Implemented according to Article 5 of the Law on Encouragement and Reward 2022 and Article 4 of Decree No. 98/2023/NĐ-CP.

Chapter II

FORMS, SCOPE, CONTENT, RESPONSIBILITIES FOR ORGANIZING ENCOURAGEMENT CAMPAIGNS

Article 6. Forms and Scope of Organizing Encouragement Campaigns

Forms and scope of organizing encouragement campaigns are implemented according to Article 16 of the Law on Encouragement and Reward 2022 and Article 2 of Circular No. 01/2024/TT-BNV.

Article 7. Content of Organizing Encouragement Campaigns

Content of organizing encouragement campaigns is implemented according to Article 17 of the Law on Encouragement and Reward 2022 and Article 3 of Circular No. 01/2024/TT-BNV.

Article 8. Implementation of Organizing Encouragement Campaigns

Implemented according to Article 4 of Circular No. 01/2024/TT-BNV.

Chapter III

CRITERIA FOR MERIT TITLES, FORMS OF REWARD AND SEEKING OPINIONS FOR REWARDS

Article 9. State-Level Rewards

The Chairman of the Provincial People's Committee proposes competent authorities to grant rewards:

1. Title of "National Model Worker"; Gold Star Medal; Ho Chi Minh Medal; Independence Medal and Labor Medal (all categories); Heroic Laborer; Commendation from the Prime Minister: Awarded to collectives and individuals who meet the criteria specified in Articles 21, 34, 35, 36, 37, 38, 42, 43, 44, 63, 73 of the Law on Encouragement and Reward 2022; Articles 8, 9, 10, 11, 12, 16, 17, 18 of Decree No. 98/2023/NĐ-CP.

2. Flag of Government Encouragement: Implemented according to Article 25 of the Law on Encouragement and Reward 2022; Article 5 of Decree No. 98/2023/NĐ-CP; Clause 2 of Article 5 of Circular No. 01/2024/TT-BNV.

3. Rewards for Long-Term Contributions: Implemented according to Articles 36, 37, 38, 42, 43, 44 of the Law on Encouragement and Reward 2022; Articles 6, 7, 10, 11, 12, 16, 17, 18 of Decree No. 98/2023/NĐ-CP and guiding documents.

4. National Honorary Titles, Ho Chi Minh Prize, State Prizes:

a) Title of "Heroic Province": Implemented according to Article 60 of the Law on Encouragement and Reward 2022;

b) Title of "Mother of Vietnam's Heroes": Implemented according to Article 61 of the Law on Encouragement and Reward 2022 and guiding documents;

c) Title of "People's Armed Forces Hero", "Labor Hero": Implemented according to Articles 62, 63 of the Law on Encouragement and Reward 2022;

d) Title of "People's Teacher", "Outstanding Teacher"; "People's Doctor", "Outstanding Doctor"; "People's Artist", "Outstanding Artist"; "People's Artisan", "Outstanding Artisan": Implemented according to Articles 64, 65, 66, 67 of the Law on Encouragement and Reward 2022 and guiding documents;

đ) Ho Chi Minh Prize, State Prize: Implemented according to Articles 68, 69, 70 of the Law on Encouragement and Reward 2022 and guiding documents.

Article 10. Provincial Awards

The Chairman of the People's Committee of the province decides on awards:

1. Title "Flag of Excellence of the People's Committee of the Province":

a) Criteria:

Meeting the criteria stipulated in Article 26 of the Law on Encouragement and Reward 2022; Clause 2, Article 5 of Circular No. 01/2024/TT-BNV.

b) Recipients:

- Units belonging to the Clusters and Groups of Encouragement organized by the province;

- Units belonging to the Clusters and Groups of Encouragement organized by departments, agencies, mass organizations, district people's committees, and units under the province.

2. Title "Outstanding Labor Collective":

a) Criteria:

Meeting the criteria stipulated in Article 27 of the Law on Encouragement and Reward 2022.

b) Recipients:

- Agencies, units, and localities under the province;

- Production and business units including Limited Liability Companies, Joint Stock Companies, Joint Ventures,... (excluding Economic Groups and State Corporations) and subordinate units such as factories, departments, workshops;

- Departments and equivalent units under provincial departments, agencies, mass organizations, and equivalents;

- Departments and equivalent units under district people's committees; commune people's committees;

- Units under the subordinate units of provincial departments, agencies, mass organizations, and equivalents.

3. Title "Provincial Model Worker" awarded annually to individuals meeting the criteria stipulated in Article 22 of the Law on Encouragement and Reward 2022.

4. Certificate of Merit from the Chairman of the People's Committee of the province given to collectives and individuals meeting the criteria stipulated in Article 74 of the Law on Encouragement and Reward 2022; Clause 4, Article 1, Clause 3, Article 5 of Circular No. 01/2024/TT-BNV.

5. Commemorative Medal: Implemented according to the provisions of Clause 2, Article 71 of the Law on Encouragement and Reward 2022.

Article 11. Awards at the grassroots level

1. Titles "Grassroots Model Worker"; "Advanced Worker": Implemented according to the provisions of Articles 23; Clause 1 and Clause 3, Article 24 of the Law on Encouragement and Reward 2022.

The evaluation of the title "Advanced Worker" in certain specific cases is implemented according to the provisions of Clause 5, Article 1 of Circular No. 01/2024/TT-BNV.

2. Title "Advanced Labor Collective":

a) Criteria:

Meeting the criteria stipulated in Article 28 of the Law on Encouragement and Reward 2022.

b) Recipients:

- Subordinate units such as factories, departments, workshops of production and business units;

- Departments and equivalent units under provincial departments, agencies, mass organizations, and equivalents;

- Departments and equivalent units under district people's committees; commune people's committees;

- Units under the subordinate units of provincial departments, agencies, mass organizations, and equivalents.

3. Titles "Outstanding Commune, Ward, Town"; "Cultural Village"; "Cultural Family": Implemented according to Articles 29, 30, 31 of the Law on Encouragement and Reward 2022; Decree No. 86/2023/NĐ-CP dated February 7, 2023 of the Government on the framework of standards and procedures, files for awarding the titles "Cultural Family", "Cultural Village", "Outstanding Commune, Ward, Town" and guiding documents for implementation.

4. Letter of Commendation:

a) For individuals:

Letter of Commendation stipulated in Article 75 of the Law on Encouragement and Reward 2022 to be given to individuals meeting one of the following criteria:

- Achievements recognized in the encouragement movement;

- Outstanding achievements;

- Fulfilling duties well, being exemplary in abiding by the Party's guidelines, state policies, and laws, having good moral qualities, unity, and exemplary compliance with the Party's guidelines and state policies.

b) For collectives:

Letter of Commendation stipulated in Article 75 of the Law on Encouragement and Reward 2022 to be given to collectives meeting one of the following criteria:

- Achievements recognized in the encouragement movement;

- Outstanding achievements;

- Fulfilling duties well; internal unity, exemplary compliance with the Party's guidelines, state policies, and laws, implementing democratic regulations at the grassroots level, practicing thrift, and combating waste.

c) For households:

Letter of Commendation stipulated in Article 75 of the Law on Encouragement and Reward 2022 to be given to households meeting one of the following criteria:

- Exemplary in complying with the Party's guidelines, state policies, and laws, contributing labor or land, property to the locality and society, with influence recognized by the authority granting rewards;

- Having many achievements in participating in encouragement movements initiated by the locality.

Article 12. Commendation for individuals and groups belonging to Party agencies, mass organizations; associations at local levels; People's Councils at all levels; religious organizations shall be carried out in accordance with the provisions stipulated in Article 6 of Circular No. 01/2024/TT-BNV.

Article 13. Soliciting opinions for commendation

Implementation shall be in accordance with the provisions stipulated in Article 31 of Decree No. 98/2023/NĐ-CP and the specific regulations as follows:

1. The Department of Home Affairs (Competition and Commendation Board) shall advise the Chairman of the Provincial People's Committee:

- To solicit opinions from central ministries, sectors, and mass organizations with management functions in industries and fields regarding the commendation of units and individuals under the direct management of the Provincial People's Committee who hold leadership positions at the same level.

- To review and provide opinions on commendation when there is a written proposal from central ministries, sectors, and mass organizations.

2. Specifically for the Education and Training sector:

a) The Department of Education and Training shall provide opinions on the commendation of units proposing to be awarded the Flag of Excellence by the Provincial People's Committee and national-level commendations and awards managed by the district level according to the joint recommendation of the Competition and Commendation Board and the Department of Home Affairs.

b) The People's Committees of districts, towns, and cities shall provide opinions on the commendation of units proposing to be awarded the Flag of Excellence by the Provincial People's Committee and national-level commendations and awards managed by the Department of Education and Training located within their respective jurisdictions according to the joint recommendation of the Competition and Commendation Board and the Department of Home Affairs.

PROCEDURE FOR REVIEWING AND COMMENDING; PROCEDURES AND DOCUMENTATION FOR PROPOSAL OF COMMENDATION; AUTHORITY TO PROPOSE COMMENDATION

Chapter IV

Article 14. Procedure for reviewing and commending

1. The Provincial Competition and Commendation Council shall review and approve commendation titles and forms before reporting to the Provincial People's Committee and the Standing Committee of the Provincial Party Committee for approval. Specifically:

a) Advising and assisting the Provincial People's Committee to report to the Standing Committee of the Provincial Party Committee for consideration and provide written opinions before submitting to the Prime Minister:

- Commendation for individuals under its jurisdiction;

- Commendation titles and forms: "National Vanguard Soldier"; "Golden Star Order"; "Ho Chi Minh Order"; "Independence Order" (all categories); title "People's Armed Forces Hero", "Labor Hero".

b) Reporting to the Provincial People's Committee for approval:

- Title "Flag of Government Excellence"; "Flag of Provincial People's Committee Excellence"; "Provincial Vanguard Soldier";

- Commendation forms from the Prime Minister's Certificate of Merit upwards.

2. The Standing Body of the Competition and Commendation Council:

a) Reviewing achievements, compiling, and preparing contents to serve the Provincial Competition and Commendation Council's review of commendation titles and forms stipulated in Clause 1 of this Article before reporting to the Provincial People's Committee and the Standing Committee of the Provincial Party Committee.

b) Reviewing achievements and reporting to the Chairman of the Provincial People's Committee to decide on awarding:

- Title "Outstanding Labor Collective";

- Certificate of Merit from the Chairman of the Provincial People's Committee.

Article 15. Documentation for Proposing Commendation

Commendation titles and forms shall be implemented in accordance with the provisions stipulated in Articles 83, 84, and 85 of the Law on Competition and Commendation 2022 and Articles 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and 44 of Decree No. 98/2023/NĐ-CP.

Article 16. Authority to Propose Commendation

The authority to propose the granting of commendation titles and forms shall be implemented in accordance with the provisions stipulated in Article 83 of the Law on Competition and Commendation 2022 and Article 29 of Decree No. 98/2023/NĐ-CP.

The authority to propose the conferral of commendation titles and forms of reward shall be implemented in accordance with the provisions of Article 83 of the Law on Competition and Rewards 2022 and Article 29 of Decree No. 98/2023/NĐ-CP.

Article 17. Provisions on the time for submitting proposals

1. Agencies, units, and localities proposing commendations to the People's Committee of the province shall submit the proposal files to the Department of Home Affairs (through the Board of Competitions and Commendations) at least ten days before organizing the conference (except for sudden commendations).

2. For annual summary commendations: Agencies, units, and localities; competition clusters and groups of the province shall organize reviews and submit the proposal files to the Department of Home Affairs (through the Board of Competitions and Commendations) before December 15 each year.

3. For the Education and Training sector:

Based on the end date of the academic year, submit the proposal files to the Department of Home Affairs (through the Board of Competitions and Commendations) before July 10 each year.

Article 18. Bestowing and receiving competition titles and forms of commendation

Implement according to the provisions of Articles 24, 25, 26, and 27 of Decree No. 98/2023/NĐ-CP.

Chapter V

COMPETITION AND COMMENDATION BOARDS AT ALL LEVELS AND THE COMPETITION AND COMMENDATION FUNDS

Article 19. Competition and Commendation Boards at all levels

Implement according to the provisions of Article 49 of Decree No. 98/2023/NĐ-CP.

Article 20. Competition and Commendation Funds

1. Sources and amounts allocated to the competition and commendation funds; management and utilization of the competition and commendation funds shall be implemented according to the provisions of Article 11 of the Law on Competitions and Commendations 2022; Articles 50, 51, and 52 of Decree No. 98/2023/NĐ-CP.

2. The amount of monetary rewards shall be implemented according to the provisions of Articles 53, 54, 55, 56, 57, 58, and 59 of Decree No. 98/2023/NĐ-CP.

Chapter VI

IMPLEMENTING PROVISIONS

Article 21. Responsibilities of agencies, units, and localities

1. Based on this Regulation and the actual situation of the province, the Provincial Competition and Commendation Board shall issue guidelines for competition and commendation activities within the province of Bac Ninh.

2. Agencies, units, and localities; competition clusters and groups under the province shall strictly implement this Regulation. Based on the Law on Competitions and Commendations 2022, guiding documents, and this Regulation, they shall establish regulations (regulations) on competitions and commendations suitable for the characteristics of their agencies, units, and localities. They shall proactively identify and commend collectives and individuals with outstanding achievements or process procedures to request the People's Committee of the province to commend collectives and individuals with outstanding achievements.

3. Agencies, units, and localities shall monitor and compile cases of violations or inadequate performance in the year and send them to the Provincial Competition and Commendation Board before December 15 each year (through the Board of Competitions and Commendations, Department of Home Affairs):

a) Provincial Public Security: Compile lists of agencies, units, and localities where people involved in social evils have not decreased compared to the previous year; confirm compliance with fire prevention and firefighting regulations by economic organizations; lists of civil servants, public officials, and employees from agencies, units, and localities in the province who violated traffic safety regulations; lists of agencies, units, and localities that violated environmental protection work in the province of Bac Ninh;

b) Department of Home Affairs: Compile results of administrative reform; assess clean and strong governments; violations of laws or disciplinary actions against civil servants, public officials, and employees in agencies, units, and localities;

c) Department of Information and Communications: Compile results of information technology application and digital transformation by agencies, units, and localities in the province;

d) Department of Natural Resources and Environment: Compile lists of agencies, units, and localities that violated environmental protection work in the province of Bac Ninh;

đ) Provincial Tax Service, Social Insurance: Confirm compliance with state budget payment obligations; social insurance policies for workers and employees for commendation cases.

4. Request units to cooperate in providing information:

a) Provincial Party Organization Committee: Provide information on the results of evaluating and ranking party organizations of provincial-level party committees;

b) Provincial Party Inspection Committee: Provide information on disciplinary actions against party organizations and members of provincial-level party committees;

c) Party Committee of the Group of State Agencies and Enterprises: Compile results of evaluating party organizations of agencies, units, and enterprises under its jurisdiction.

5. The Board of Competitions and Commendations, Department of Home Affairs shall assist the Provincial Competition and Commendation Board in implementing tasks stipulated in Clause 3, Article 49 of Decree No. 98/2023/NĐ-CP.

6. Department of Science and Technology:

Assist the Chairman of the People's Committee of the province in establishing a provincial innovation award committee, a science and technology committee, and an innovation promotion committee to assist the Chairman of the People's Committee of the province in reviewing and recognizing the effectiveness of applying and the potential for widespread adoption of innovations; reviewing and recognizing the effectiveness of applying and the scope of influence of scientific research projects, scientific and technological works to serve as grounds for recommending awards of Model Worker titles and recommending commendation forms as prescribed.

7. Department of Culture, Sports, and Tourism:

Take the lead and coordinate with relevant agencies and units to advise the People's Committee of the province to detail standards and procedures for awarding exemplary commune, ward, and town titles; cultural village and community titles and "Model Family" titles based on the framework of standards prescribed in Government Decree No. 86/2023/NĐ-CP dated December 7, 2023, which stipulates the framework of standards and procedures, and documentation for awarding "Model Family", "Cultural Village and Community", and "Exemplary Commune, Ward, and Town" titles.

Article 22. Implementation organization

1. In case the legal normative documents referred to in this Regulation are amended, supplemented, or replaced, implementation shall be carried out according to the new provisions; for contents delegated to the province to specify and guide in detail, continue to implement this Regulation until it is amended, supplemented, or replaced.

2. During the implementation process, if there are difficulties, agencies, units, and localities shall report to the People's Committee of the province (through the Board of Competitions and Commendations, Department of Home Affairs) for timely reporting and appropriate amendments and supplements to ensure conformity./.
