Provisions on Implementation This Circular applies to individuals who have worked at the Ministry of Justice, Provincial Legal Departments, and relevant agencies and organizations that perform tasks within one of the fields listed in Article 3 of this Circular after ceasing to hold their positions. 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect. of Certain Articles of the Law on Competition and Reward in the Construction Industry
On the basis of Law on Competition, sector of Pursuant to the Law on Forces Participating in Ensuring National Security and Public Order at the Grassroots Level dated November 28, 2023;
Pursuant to Decree No. 98/2023/NĐ-CP dated December 31, 2023 of the Government detailing the implementation of certain articles of Law on Competition, sector of;
BASED ON THE GOVERNMENT DECREE NO. 52/2022/NĐ-CP OF AUGUST 8, 2022, PROVIDING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CONSTRUCTION;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular provides detailed provisions for certain articles of the Law on Competition and Reward, including:
1. Clause 4, Article 24 regarding the criteria for awarding the title of Advanced Laborer;
2. Clause 3, Article 26 regarding the subjects and criteria for awarding the Flag of Competition of the Ministry;
3. Clause 3, Article 27 regarding the subjects and criteria for awarding the Title of Excellent Labor Collective;
4. Clause 3, Article 28 regarding the subjects and criteria for awarding the Title of Advanced Labor Collective;
5. Clause 2, Article 71 regarding the name of the Commemorative Medal, the subjects and criteria for awarding the Commemorative Medal;
6. Clause 6, Article 74 regarding the criteria for awarding the Certificate of Merit of the Ministry;
7. Clause 2, Article 75 regarding the criteria for awarding the Certificate of Praise;
8. Clause 6, Article 84 regarding the number of files for proposing awards and commendation forms within the authority of the Minister of Construction.
Article 2. Applicability
1. Collectives, officials, civil servants, public employees, workers in agencies, organizations, units, enterprises under or directly under the Ministry of Construction;
2. Collectives, officials, civil servants, public employees working in Construction Departments, Planning and Architecture Departments of provinces and centrally governed cities;
3. Agencies, organizations, units, individuals operating in the Construction sector;
4. Collectives, individuals, households of Vietnamese citizens; collectives, individuals of Vietnamese citizens residing abroad; collectives, individuals of foreign citizens who have made achievements and contributions to the construction and development of the Construction industry.
Article 3. File request awarding competition titles and commendation forms within the authority of the Minister of Construction
1. The application for awarding competition titles and commendation forms within the authority of the Minister of Construction shall be implemented in accordance with Article 84 of the Law on Competition and Reward and Section 3, Chapter IV of Decree No. 98/2023/NĐ-CP dated December 31, 2023 of the Government detailing the implementation of certain articles of the Law on Competition and Reward.
2. The number of applications for awarding competition titles and commendation forms within the authority of the Minister of Construction includes 01 set (original) and electronic files (word file, pdf file, excel file) of the application, except for documents containing state secrets, to be sent to the Ministry of Construction.
PART II
SUBJECTS AND CRITERIA FOR AWARDING COMPETITION TITLES,
FORMS OF REWARD
Article 4. Title "Flag of Competition of the Ministry of Construction"
1. Subjects for awarding the title "Flag of Competition of the Ministry of Construction" annually:
The title "Flag of Competition of the Ministry of Construction" is awarded annually to collectives participating in competitions organized by the Ministry of Construction, including:
a) Agencies, organizations, units under or directly under the Ministry of Construction (for enterprises, including the parent company and subsidiaries);
b) Construction Departments, Planning and Architecture Departments of provinces and centrally governed cities;
c) Other agencies, organizations, units belonging to competition groups organized by the Ministry of Construction.
2. Subjects for awarding the title "Flag of Competition of the Ministry of Construction" for specific themes:
The title "Flag of Competition of the Ministry of Construction" is awarded to collectives participating in theme-based competitions organized and launched by the Ministry of Construction, lasting three years or more, including:
a) Agencies, units under or directly under the Ministry of Construction;
b) Construction Departments, Planning and Architecture Departments of provinces and centrally governed cities;
c) Agencies, organizations, units operating in the Construction sector.
3. Criteria for awarding the title "Flag of Competition of the Ministry of Construction" annually:
The title "Flag of Competition of the Ministry of Construction" is awarded annually to leading collectives in competitions organized by the Ministry of Construction and meeting the criteria specified in Clause 1, Article 26 of the Law on Competition and Reward; specifically, the criteria at Point a, Clause 1, Article 26 of the Law on Competition and Reward are defined as follows:
a) Exceeding the competition targets set by the competition groups;
b) Exceeding the assigned tasks and targets in programs and plans approved by competent authorities in the year;
c) Serving as exemplary models in implementing Party policies and State laws; fulfilling obligations to the State and employee benefits according to regulations.
4. Criteria for awarding the title "Flag of Competition of the Ministry of Construction" to collectives participating in theme-based competitions:
The title "Flag of Competition of the Ministry of Construction" is awarded to leading collectives in theme-based competitions organized and launched by the Ministry of Construction, lasting three years or more, when concluding the competition and meeting the following criteria:
a) Being outstanding collectives that complete the competition targets in various fields under the management of the Ministry of Construction;
b) Implementing Party policies and State laws well; fulfilling obligations to the State and employee benefits according to regulations.
Article 5. 2. The period during which individuals who were officials, civil servants, or employees directly researching, developing, or reviewing and approving programs, projects, and proposals as specified in Clause 7 of Article 3 of this Circular may not establish, hold titles, positions of management, or operate enterprises or cooperatives is the duration of completion of those programs, projects, and proposals. Title "Excellent Labor Collective"
1. Subjects for awarding the title "Excellent Labor Collective":
The title "Excellent Labor Collective" is awarded annually to collectives, including:
a) Administrative agencies, public service units under or directly under the Ministry of Construction (including departments, divisions, and equivalent units);
b) State-owned enterprises managed by the Ministry of Construction (including production teams, workshops, factories; departments, and equivalent units).
2. Criteria for awarding the title "Excellent Labor Collective":
The title "Excellent Labor Collective" is awarded annually to collectives meeting the criteria specified in Clause 1, Article 27 of the Law on Competition and Reward; specifically, the criteria for outstanding performance are defined as follows:
a) Exceeding the assigned tasks and targets in programs and plans approved by competent authorities in the year;
b) Fulfilling obligations to the State and employee benefits according to regulations.
Article 6. Domestic air passenger transport service on regular basic economy classTitle "Advanced Labor Collective"
1. Subjects for awarding the title "Advanced Labor Collective":
The title "Advanced Labor Collective" is awarded annually to collectives, including:
a) Administrative agencies, public service units under or directly under the Ministry of Construction (including departments, divisions, and equivalent units);
b) State-owned enterprises managed by the Ministry of Construction (including production teams, workshops, factories; departments, and equivalent units).
2. Criteria for awarding the title "Advanced Labor Collective":
The title "Advanced Labor Collective" is awarded annually to collectives meeting the standards set forth in Clause 1 of Article 28 of the Law on Encouragement of Competition and Merit; among which, the standard for successfully completing assigned tasks is specified as follows:
a) Completing all targets and tasks assigned in programs and plans approved by competent authorities within the year;
b) Fully implementing labor policies and benefits as prescribed.
Article 7. Title “LAdvanced Laborer"
The title "Advanced Laborer" is awarded annually to cadres, civil servants, public officials, and workers stipulated in Clause 1 of this Circular who meet the standards set forth in Clause 1 of Article 24 of the Law on Encouragement of Competition and Merit; among which, successfully completing assigned tasks throughout the year with quality and effectiveness is required.
Article 8. KCommemorative Medal, recipients and award criteria
1. Name of the Commemorative Medal: "Commemorative Medal for the Construction Industry".
2. Recipients of the "Commemorative Medal for the Construction Industry" include:
a) Leaders and former leaders of the Ministry of Construction;
b) Cadres, civil servants, public officials, and workers currently working or retired from organizations, institutions, and units under the Construction Industry;
c) Leaders of central ministries, departments, agencies, and mass organizations at provincial levels;
d) Individuals outside the Construction Industry who have made significant contributions to the development of the Construction Industry;
e) Vietnamese individuals residing abroad; foreign individuals who have made outstanding contributions to the development of the Construction Industry.
3. Award criteria for the "Commemorative Medal for the Construction Industry" for individuals working within the Construction Industry:
The "Commemorative Medal for the Construction Industry" is awarded once to individuals currently working or retired from the Construction Industry who meet one of the following criteria:
a) Leaders and former leaders of the Ministry of Construction;
b) Individuals honored with the title of Heroic Laborer;
c) Cadres, civil servants, public officials, and workers evaluated by competent authorities as having successfully completed assigned tasks and having a tenure of service:
- For males: Having continuously served for 20 years in the Construction Industry or a total service period of 25 years, including 15 continuous years in the Construction Industry;
- For females: Having continuously served for 15 years in the Construction Industry or a total service period of 20 years, including 10 continuous years in the Construction Industry.
4. Award criteria for the "Commemorative Medal for the Construction Industry" for individuals outside the Construction Industry:
The "Commemorative Medal for the Construction Industry" is awarded once to individuals outside the Construction Industry who meet one of the following criteria:
a) Leaders of central ministries, departments, agencies, and mass organizations at provincial levels who have made significant contributions to the development of the Construction Industry;
b) Individuals with national-level inventions, innovations, or scientific works recognized as valuable and applied in the Construction Industry;
c) Vietnamese individuals residing abroad and foreign individuals who have made outstanding contributions to building and consolidating international cooperation relationships between countries and international organizations with Vietnam's Construction Industry, actively contributing to its development;
d) Individuals who have made significant contributions and provided effective support to the development of the Construction Industry.
5. Other cases shall be decided by the Minister of Construction.
6. The awarding of the "Commemorative Medal for the Construction Industry" is conducted annually on the occasion of the Construction Industry's Traditional Day (April 29) and National Day (September 2), or may be awarded exceptionally according to the decision of the Minister of Construction.
Article 9. Certificate of Merit of the Minister of Construction
1. The Certificate of Merit of the Minister of Construction is awarded or posthumously awarded to collectives who exemplarily follow Party guidelines, state policies and laws, maintain internal unity, and meet one of the criteria specified in Clause 3 and Clause 4 of Article 74 of the Law on Encouragement of Competition and Merit; among which, the criterion for excellently completing assigned tasks is specifically defined as follows:
a) Exceeding the assigned tasks and targets in programs and plans approved by competent authorities in the year;
b) Implementing labor policies and benefits as prescribed.
2. The Certificate of Merit of the Minister of Construction is awarded or posthumously awarded to individuals who exemplarily follow Party guidelines, state policies and laws, and meet one of the criteria specified in Clause 1 and Clause 2 of Article 74 of the Law on Encouragement of Competition and Merit; among which, the criterion for excellently completing assigned tasks is assessed and classified as excellently completing annual tasks as prescribed by competent authorities.
Article 10. Letter of Commendation
1. The Certificate of Commendation of the Head of an organization or unit with legal personality under or subordinate to the Ministry of Construction is awarded annually to individuals under their management who exemplarily follow Party guidelines, state policies and laws, internal regulations, and meet one of the following criteria:
a) Achieving outstanding results recognized in competition campaigns organized and launched by the organization or unit;
b) Achieving many results or outstanding results with influence in one of the areas under the management of the organization or unit;
c) Successfully completing assigned tasks for the year; consistently studying and improving professional skills and expertise.
2. The Certificate of Commendation of the Head of an organization or unit with legal personality under or subordinate to the Ministry of Construction is awarded annually to collectives under their management who exemplarily follow Party guidelines, state policies and laws, internal regulations, and meet one of the following criteria:
a) Achieving outstanding results recognized in competition campaigns organized and launched by the organization or unit;
b) Achieving many results or outstanding results with influence in one of the areas under the management of the organization or unit;
c) Successfully completing assigned tasks for the year and competition and commendation work tasks; maintaining internal unity, practicing thrift, and combating waste; caring for the material and spiritual life of members of the collective; fully implementing labor policies and benefits for workers in the organization or unit.
3. The Certificate of Commendation of the Head of an organization or unit with legal personality under or subordinate to the Ministry of Construction is awarded to exemplary families who follow Party guidelines, state policies and laws, make significant contributions through effort and property, provide practical and effective support for the development of the Construction Industry, and are recognized by competent authorities.
Chapter III
IMPLEMENTING PROVISIONS
Article 11. Effective Date
This Circular takes effect from July 1, 2024, and replaces Circular No. 04/2020/TT-BXD dated December 30, 2020, issued by the Minister of Construction guiding the competition and commendation work in the Construction sector.
Article 12. Implementation Organization
1. Heads of agencies, organizations, units under the Ministry of Construction; Directors of Construction Departments, Urban Planning and Architecture Departments of provinces and centrally-administered cities; related organizations and individuals are responsible for implementing this Circular.
2. The Cadre and Civil Servant Department shall be responsible for guiding and implementing this Circular.
3. In case of difficulties during the implementation process, agencies, organizations, units, and individuals are requested to promptly reflect such issues to the Ministry of Construction (through the Cadre and Civil Servant Department) for consolidation, examination, and resolution./.
