Regulations on the reporting system for inspection work, citizen reception,

handling complaints and denunciations, and anti-corruption, anti-extortion

Pursuant to the Law on Complaints dated June 12, 2018;

Pursuant to the Law on Prevention and Control of Corruption dated November 20, 2018;

Pursuant to the Inspection Law on November 14, 2022;

Decree No. dated June 26, 2014 of the Government detailing the implementation of certain provisions of the Law on Citizen Reception; Pursuant to Decision No. 31/2019/NĐ-CP dated April 10, 2019 of the Government detailing certain provisions and measures for organizing the implementation of the Law on Denunciation;

Pursuant to Decree No.09/2019/NĐ-CPPursuant to Decision No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and measures for implementing the Inspection Law;

Pursuant to Decision No. 03/2024/NĐ-CP dated January 11, 2024 of the Government on specialized inspection agencies and activities of agencies assigned specialized inspection functions;

At the proposal of the Director of the Planning and General Affairs Department

Decree No. 81/2023/NĐ-CP dated 27 the 11 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;23 and the Director of the Legal Department;

The Inspector General issues this Circular regulating

the reporting system for inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption 1. This Circular regulates the reporting system for inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion.

2. This Circular applies to ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees, centrally governed cities (hereinafter referred to collectively as provincial People's Committees), organizations, entities with authority and responsibility in inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion. Article 2. Principles of Reporting, anti-extortion.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. Complete, accurate, objective, timely.

2. In accordance with the laws on inspection, citizen reception, complaints, denunciations, anti-corruption, anti-extortion, and the guidance provided in this Circular.

TYPES OF REPORTS, CONTENT, TIME PERIOD FOR DATA COLLECTION,

DEADLINE FOR SUBMITTING REPORTS

Article 3. Types of Reports

Chapter II

1. Periodic reports are reports on inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion conducted quarterly, every six months, every nine months, and annually.

2. Specialized reports are reports providing in-depth information on specific topics within the fields of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion, conducted one or more times during a specified period.

3. Ad hoc reports are reports providing information on unusual issues arising in the fields of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion, conducted upon request from higher authorities or the Inspectorate General.

1. Quarterly reports for the first quarter, six-monthly, nine-monthly, and annual reports:

a) On inspection work: situation, results, evaluation of the implementation of inspection tasks during the reporting period, directions, main tasks to be carried out in the next reporting period. The content of the report on inspection work is implemented according to Model No. 01 and the statistical tables 01/TTr, 02/TTr, 03/TTr, 04/TTr, 05/TTr, 06/TTr, 07/TTr, 01/QLNN, 02/QLNN issued together with this Circular.

b) On citizen reception and complaint resolution: situation, results, evaluation of the implementation of citizen reception and complaint resolution tasks during the reporting period, directions, main tasks to be carried out in the next reporting period. The content of the report on citizen reception and complaint resolution is implemented according to Model No. 02 and the statistical tables 01/TCD, 01/XLD, 02/XLD, 03/XLD, 04/XLD, 01/KQGQ, 02/KQGQ, 03/KQGQ, 04/KQGQ, 03/QLNN issued together with this Circular.

Article 4. Periodic Reports

c) On anti-corruption and anti-extortion work: situation, results of task implementation, evaluation of anti-corruption and anti-extortion work during the reporting period, directions, main tasks to be carried out in the next reporting period. The content of the report on anti-corruption and anti-extortion work is implemented according to Model No. 03 and the statistical tables 01/PCTN, 02/PCTN, 03/PCTN issued together with this Circular.

2. For the second, third, and fourth quarters, only the following statistical tables are required:

a) On inspection work: statistical tables 01/TTr, 02/TTr, 03/TTr, 04/TTr, 05/TTr, 06/TTr, 07/TTr, 01/QLNN, 02/QLNN issued together with this Circular.

b) On citizen reception and complaint resolution: statistical tables 01/TCD, 01/XLD, 02/XLD, 03/XLD, 04/XLD, 01/KQGQ, 02/KQGQ, 03/KQGQ, 04/KQGQ, 03/QLNN issued together with this Circular.

c) On anti-corruption and anti-extortion work: statistical tables 01/PCTN, 02/PCTN, 03/PCTN issued together with this Circular.

3. In addition to the contents stipulated in Clause 1 and Clause 2 of this Article, when necessary, ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees shall submit supplementary comprehensive reports on the results of inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-extortion within their scope of responsibility to the Inspectorate General.

b) Regarding citizen reception work, complaints, and accusations: the statistical forms 01/TCD, 01/XLD, 02/XLD, 03/XLD, 04/XLD, 01/KQGQ, 02/KQGQ, 03/KQGQ, 04/KQGQ, 03/QLNN issued together with this Circular.

c) Regarding anti-corruption and anti-neglect work: the statistical forms 01/PCTN, 02/PCTN, 03/PCTN issued together with this Circular.

3. In addition to the contents prescribed in Clause 1 and Clause 2 of this Article, when necessary, ministries, ministerial-level agencies, government agencies, provincial People's Committees shall supplement reports on comprehensive results of inspection work, citizen reception, complaint resolution, accusation handling, and anti-corruption and anti-neglect within their scope of responsibility to the Government Inspectorate.

Article 5. Special Reports

1. Annual special report on citizen reception work, complaint and denunciation resolution:

The annual special report on citizen reception work, complaint and denunciation resolution shall include the situation, results, evaluation of the implementation of citizen reception tasks and complaint and denunciation resolution during the reporting period, forecast of the situation and main directions, key tasks to be implemented in the next reporting period. The content of the report shall be carried out according to Model No. 02 and the statistical tables 01/TCD, 01/XLD, 02/XLD, 03/XLD, 04/XLD, 01/KQGQ, 02/KQGQ, 03/KQGQ, 04/KQGQ, 03/QLNN issued together with this Circular. In case additional content is necessary, the Government Inspectorate will issue specific guidance on the outline and statistical tables for the report.

2. Annual special report on anti-corruption and anti-vices work:

The situation, results of task implementation, evaluation of anti-corruption and anti-vices work during the reporting period, directions, key tasks to be implemented in the next reporting period. The content of the report shall be carried out according to Model No. 03 and the statistical tables 01/PCTN, 02/PCTN, 03/PCTN issued together with this Circular. In case additional content is necessary, the Government Inspectorate will issue specific guidance on the outline and statistical tables for the report.

3. Other special reports: The Government Inspectorate will issue specific guidance on the outline and statistical tables for the report.

Article 6. Emergency Reports

1. When the Government Inspectorate requests an emergency report in the field of inspection, citizen reception, complaint and denunciation resolution, and anti-corruption and anti-vices work, ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees, and relevant organizations, units shall report according to the guidance of the Government Inspectorate.

2. When organizations, units discover urgent issues with complex nature in the fields of inspection, citizen reception, complaint and denunciation resolution, and anti-corruption and anti-vices work directly related to their functions, tasks, and authorities, they shall promptly report to the higher-level inspection agency and the head of the competent state management agency for instructions and coordination in handling.

Article 7. Time for Data Closure, Reporting Subjects, Receiving Agencies, and Deadline for Submission of Reports

1. Time for Data Closure

a) For regular reports:

- Quarterly Report QI from December 15 of the previous year to March 14 of the reporting year;

- Quarterly Reports QII, QIII, QIV from the 15th day of the last month of the previous quarter to the 14th day of the last month of the reporting quarter.

- Semi-annual Report from December 15 of the previous year to June 14 of the reporting year.

- Nine-month Report from December 15 of the previous year to September 14 of the reporting year.

- Annual Report from January 15 of the previous year to December 14 of the reporting year.

b) For special and emergency reports: The time for data closure shall be according to the written request of the Government Inspectorate.

2. Reporting Subjects, Receiving Agencies, and Deadline for Submission of Reports

a) For regular reports:

- Commune People's Committees, specialized agencies under district People's Committees, and related organizations and individuals within the jurisdiction of the district shall submit reports to the district People's Committee no later than the 16th day of the last month of the reporting period;

District People's Committees, specialized agencies under provincial People's Committees, and related organizations and individuals within the jurisdiction of the province shall submit reports to the provincial People's Committee no later than the 18th day of the last month of the reporting period;

Provincial People's Committees shall consolidate, approve, and submit reports to the Government Inspectorate no later than the 20th day of the last month of the reporting period.

- Central agencies organized vertically at the district level shall submit reports to central agencies organized vertically at the provincial level no later than the 15th day of the last month of the reporting period;

Central agencies organized vertically at the provincial level shall consolidate, approve, and submit reports to central agencies no later than the 16th day of the last month of the reporting period;

Units directly under ministries, ministerial-level agencies, and agencies under the Government shall consolidate, approve, and submit reports to ministries, ministerial-level agencies, and agencies under the Government no later than the 18th day of the last month of the reporting quarter;

Ministries, ministerial-level agencies, and agencies under the Government shall consolidate, approve, and submit reports to the Government Inspectorate no later than the 20th day of the last month of the reporting period.

Central agencies organized vertically at the provincial and district levels shall simultaneously submit reports to the inspection agency and the state management agency at the same level for management purposes. The inspection agency and the state management agency at the same level shall not incorporate the content of the report from central agencies organized vertically into their own reports.

- In cases where necessary, ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees may stipulate deadlines for submitting reports to each level according to their management authority but must ensure that the deadline for submitting reports to the Government Inspectorate does not exceed the 20th day of the last month of the reporting period.

b) For special and emergency reports: the reporting subjects and submission deadlines shall be carried out according to the requirements of the Government Inspectorate.

Article 8. Forms of reports and methods for submitting reports

1. Reports shall be presented in paper form, electronic form, with the signature of the head of the agency, organization, or unit and stamped according to regulations.

In cases where the head of the state administrative agency delegates authority to the head of the inspection agency at the same level to sign the report, such delegation shall be carried out in accordance with the regulations on signing under delegated authority.

2. Reports shall be submitted to the receiving agency through the electronic document system within the state administrative agency and one of the following methods:

a) Submission through the reporting software system of the Inspection Agency;

b) Submission via the email of the state administrative agency;

c) Direct submission;

d) Submission through postal services;

e) Submission via fax.

3. Data for reports shall be entered into the reporting software system of the Inspection Agency in accordance with the guidelines of the Government Inspectorate.

Article 9. Application of information technology in implementing the reporting regime

1. The Government Inspectorate shall establish, manage, and operate the electronic reporting information system of the Inspection Agency; ensuring technical infrastructure, technology, security, and information safety to serve the establishment and operation of the reporting information system and data sharing in accordance with legal provisions.

2. Ministries, agencies equivalent to ministries, agencies under the Government, and provincial People's Committees shall organize the implementation and effective use of the electronic reporting system of the Inspection Agency. Where necessary, ministries, agencies equivalent to ministries, agencies under the Government, and provincial People's Committees may proactively establish an electronic reporting information system that meets their state management requirements and the reporting regime of the Government Inspectorate.

Chapter III

IMPLEMENTING PROVISIONS

Article 10. Responsibility for Implementation

1. The Government Inspectorate shall be responsible for guiding, monitoring, urging, and inspecting the implementation of the reporting regime as stipulated in this Circular.

2. The Minister, heads of agencies equivalent to ministries, heads of agencies under the Government, Chairpersons of provincial People's Committees, and heads of agencies, organizations, and units shall be responsible for organizing the implementation of the reporting regime as prescribed in this Circular.

Article 11. Effective Date

This Circular takes effect from March 5, 2024.

Circular No. 02/2021/TT-TTCP dated March 22, 2021 of the Government Inspectorate prescribing the reporting regime for inspection work, handling complaints and denunciations, and anti-corruption measures shall cease to be effective from the date this Circular takes effect.

During the implementation process, if there are difficulties or obstacles, they should be reported to the Government Inspectorate for guidance or appropriate amendments and supplements./.
