On Strengthening the Application of Information Technology in the Judicial Sector for the Period 2009-2010

In recent times, the Ministry of Justice has proposed and directed the implementation of many measures to promote the application of information technology in its operations and those of the sector; the benefits of information technology have gradually been realized, contributing positively to the completion of assigned political tasks, increasingopportunities for citizens, organizations, and businesses to access information. However, in light of new requirements and tasks that the administrative reform, judicial reform, and e-Government construction processes in Vietnam are imposing,the application of information technology in the operations of the Ministry and the sector is revealing some limitations and inconsistencies, not yet meeting the demands and tasks such as the application of information technology has not truly aligned with the request administrative reform; the efficiency of using hinternal network systems, email, search tools, and information exploitation has not matched the potential of technical infrastructure as well as work requirements; the use of electronic documents in management and operation has not been thorough; the development and deployment of application software have not been synchronized across the entire sector; thecoordination mechanism among units in applying information technology remains hesitant, lacking consistency and effectiveness specialized agency under the People's Committee of the province/city.not Supreme Court; computer skills, awareness of the important role of information technology, proactivity in applying the benefits of information technology to serve specialized activities of a portion of officials and civil servants is still limited; dedicated human resources in information technology are still insufficient; providing information to citizens and businesses is still untimely, incomplete, and online public services are mainly provided at level 1.

To address these shortcomings and limitations, while effectively implementing Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in the operations of state agencies, Directive No. 34/2008/CT-TTg on strengthening the use of email systems in the operations of state agencies, The Plan on the Application of Information Technology in the Operations of State Agencies for the period 2009-2010 approved by Decision No. 48/2009/QĐ-TTg dated March 31, 2009 of the Prime Minister, and the Plan on the Application of Information Technology in the Operations of State Agencies for the period 2009-2010 of the Ministry of Justice approved by Decision No. 1579/QĐ-BTTT dated October 24, 2008 of the Ministry of Information and Communications to further promote the application of information technology in the judicial sector for the period 2009-2010, thereby enhancing management, leadership, operational capacity, judicial work performance, and better serving the needs of citizens, organizations, and businesses, the Minister of Justice issues the following directive:

1. Before April 30, 2013, Provincial Departments of Justice, People's Court Enforcement Offices at provincial and centrally-administered city levels within their respective functions, tasks, and authorities shall be responsible for implementing the following contents:

a) Enhance awareness of the responsibility to apply information technology to serve management, leadership, operation, and judicial work in their agencies and units to form habits of using the benefits of information technology in performing assigned tasks, habits of working in a network environment to enhance the efficiency of work; practice thrift, prevent waste; innovate methods of providing information and public services to citizens, organizations, and businesses;

b) Tstrictly implement the provision of timely, complete, and accurate information on the network in accordance with the Law on Information Technology and other legal provisions on transparency and information disclosure Minutes of meetings of the Drafting Board, minutes of conferences, seminars related to the national technical standard proposal and other relevant documents. of individuals registered in accordance with the law continues to be updated into the information in the operations of state agencies Coordinate with the Information Technology Department to develop and deploy the application of information technology in various areas of work in the sector, especially enforcement of civil judgments; standardize, review, and systematize legal regulations; registration of secured transactions; notarization; certification; household registration; nationality; criminal records; forensic examination; personnel management; complaints and grievances handling, ensuring consistent application and facilitating information sharing for management and operational activities throughout the sector;;

c) Provide and update information on the Ministry of Justice's website according to the Ministry's requirements and guidance from the Information Technology Department, particularly pages on legal regulations, administrative procedures, business guidance, legal inquiries, investment projects, procurement bidding.

Strive to achieve by the end of 2010, 100% of management and operational directives will be posted on the Ministry's website, all online public services will be provided at levels 2 and 3; f) Increase the use of electronic documents to replace paper documents in management and operation

e) Adhere to regulations on security, safety, and confidentiality of information during the provision, updating, exploitation, and use of information in a network environment;

f) Dispatch officers and civil servants to fully attend training courses and capacity building sessions on information technology organized by the Ministry;

g) Report on the implementation of the Directive periodically every six months and at any time as instructed and required by the Department of Information Technology for consolidation and reporting to the Minister; evaluate the results of implementing the Directive when summarizing the work for six months and annually within the agency or unit.

2. The Department of Information Technology shall be responsible for:

a) Upgrade and improve the Email System, the Information Management System for Documents and Operations; build and perfect the Official Website to ensure that it can provide online administrative services;

b) Take the lead and coordinate with related units to establish regulations, propose solutions, and guide units in providing timely and complete information, ensuring the accuracy of the information. In the third quarter of 2009, review, amend, and supplement the Regulations to effectively operate and exploit the Official Website, Email System, and Information Management System for Documents and Operations of the Ministry. Timely adjust the Plan for Applying Information Technology in the Activities of State Agencies for the period 2009-2010 of the Ministry to meet new requirements and tasks;

c) Take the lead and coordinate with units under the Ministry to build and manage national databases, information systems, and shared software in fields under the Ministry's jurisdiction; organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.implement measures to ensure the security and confidentiality of the Ministry's information systems and databases;

d) Take the lead and coordinate with the Ministry's Office and related units to prepare necessary technical conditions to organize online conferences, meetings, and briefings through the multi-media briefing system; coordinate with units under the Ministry organize the procurement of information technology products in accordance with approved programs and plans for applying information technology;

e) Coordinate with units under the Ministry to develop a plan to implement this Directive; monitor, urge, inspect the implementation of the Directive, and report periodically every six months to the Ministry's leadership; by the end of 2010, organize a summary and evaluation of the implementation of the Directive and propose solutions to continue implementing information technology applications for subsequent years;

3. The Ministry's Office shall take the lead and coordinate with the Department of Information Technology to review and publish a list of documents and materials officially exchanged in electronic form, gradually reducing and eventually ceasing the use of paper-based documents within units under the Ministry; manage incoming and outgoing correspondence on a network environment.

4. The Cadre and Civil Servant Organization Department shall take the lead and coordinate with the Department of Information Technology to organize training and capacity building in information technology for cadres, civil servants, and employees under the Ministry and local civil execution agencies; develop and implement a plan for developing human resources in information technology within the legal sector.

5. The Civil Execution Department shall take the lead and coordinate with the Department of Information Technology to guide local civil execution agencies in collecting, processing, exchanging, and providing information, and managing and using information technology equipment for their work; guide and inspect the implementation of regulations on applying information technology in local civil execution agencies.

6. The Planning and Finance Department shall take the lead and coordinate with relevant units in preparing budgets, balancing funds, and submitting to the Minister for consideration and decision on allocating funds for the task of applying information technology..

7. The International Cooperation Department shall take the lead and coordinate with the Department of Information Technology to actively seek official development assistance and cooperate with foreign countries to implement large-scale projects and wide-ranging deployments.

8. Departments of Justice shall base on the Plan for Applying Information Technology in the Activities of State Agencies of the People's Committee of provinces and centrally-administered cities to determine objectives and tasks and develop the unit's Plan for Applying Information Technology; strengthen information exchange with the Ministry of Justice through the Email System, the Ministry's Official Website, and the Multi-Media Briefing System..

9. The Department of Commendation and Awards shall take the lead and coordinate with the Department of Information Technology to study and propose incorporating the results of applying information technology in work as criteria for annual commendation reviews for cadres, civil servants, and employees of the Ministry.

10. Heads of units under the Ministry, Directors of Departments of Justice, and Chiefs of Civil Execution Agencies of provinces and centrally-administered cities shall strictly organize the implementation of this Directive./.
