MINISTER OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM

Pursuant to Decree No. 63/2003/NĐ-CP dated June 11, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

Pursuant to the Law on Cultural Heritage and Decree No. 92/2002/NĐ-CP dated November 11, 2002 detailing certain provisions of the Law on Cultural Heritage;

On the basis of the dossier on relics and the proposal of the Chairpersons of the People's Committees of Cao Bang, Dong Nai, Tra Vinh, Ha Tinh, Thanh Hoa, Long An, and Dong Thap provinces;

Considering the proposal of the Director of the Department of Cultural Heritage.

Article 1: Rank 12 relics:

 Cao Bang province (02)

1. Historical relic: The Observation Post of the Border Campaign Command (1950) - Duc Long commune, Thach An district, Cao Bang province.

2. Historical relic: Ngom Boc Cave - where President Ho Chi Minh stayed during the Border Campaign (1950) - Hong Viet commune, Hoa An district, Cao Bang province.

 Dong Nai province (01)

3. Historical relic: Central Office Base of South Vietnam (1961-1962) - Phu Ly commune, Vinh Cuu district, Dong Nai province.

 Tra Vinh province (01)

4. Historical relic: Cau Tau Wharf (Ho Chi Minh Seaway) - Truong Long Hoa commune, Duyen Hai district, Tra Vinh province.

 Thanh Hoa province (02)

5. Architectural and artistic relic: Hoa Long Pagoda - Vinh Thinh commune, Vinh Loc district, Thanh Hoa province.

6. Historical relic: Dong Co Temple - Hoang Minh commune, Hoang Hoa district, Thanh Hoa province.

 Ha Tinh province (01)

7. Scenic spot: Tian Tu Pagoda and Lake area - Trung Luong commune, Bac Hong ward, Hong Linh town, Ha Tinh province.

 Adjustment of the name of the relic already ranked: Historical relic: Comrade Ha Huy Tap Memorial House (1936-1938) - Cam Hung commune, Cam Xuyen district, Ha Tinh province.

(This Decision replaces Decision No. 457/VH-QĐ dated March 25, 1991 of the Minister of Culture-Sports and Tourism ranking the Ha Huy Tap Memorial House, Cam Hung commune, Cam Xuyen district, Ha Tinh province).

8. Historical relic: Vo Cong Ton House and Brick Kiln - Long Hiep commune, Ben Luc district, Long An province.

9. Archaeological relic: O Chua Mound - Hung Dien A commune, Vinh Hung district, Long An province.

 Dong Thap province (03)

10. Historical relic: Giong Thi Dam Victory Site - Go Quan Cung, An Phu commune, Tan Hong district, Dong Thap province.

11. Historical relic: Binh Thanh Massacre Site - Thanh Binh town, Thanh Binh district, Dong Thap province.

12. Historical relic: Tran Van Nang Temple - Tan Thanh commune, Thanh Binh district, Dong Thap province.

* Adjustment of the name of the relic already ranked in Quang Binh province: Historical relic: Quan Hau Ferry Terminal - Quan Hau town and Vo Ninh commune, Quang Ninh district, Quang Binh province (This Decision replaces Decision No. 62/2003/QĐ-BVHTT dated November 27, 2003 of the Minister of Culture-Sports and Tourism ranking the Quan Hau Ferry Terminal, Quan Hau town and Vo Ninh commune, Quang Trach district, Quang Binh province).

Article 2. Strictly prohibit all construction and exploitation activities within the areas delineated for relic protection. In exceptional cases, the use of land in historical and cultural relics and scenic spots must be approved by the Minister of Culture-Sports and Tourism.

Article 3. People's Committees at all levels shall exercise state management over historical and cultural relics and scenic spots in accordance with the law.

Article 4. This Decision takes effect 15 days from the date of publication in the Official Gazette.

Article 5. The Heads of the Office, the Director of the Heritage Department, the Chairpersons of the People's Committees, and the Directors of the Culture-Sports and Tourism Departments of Cao Bang, Dong Nai, Tra Vinh, Ha Tinh, Thanh Hoa, Long An, and Dong Thap provinces are responsible for implementing this Decision./.
