THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, the eleventh session, first meeting, which stipulates the list of ministries and ministerial-level agencies of the Government;
Considering the proposal of the Head of the Cadre and Civil Service Department,
At the proposal of the Minister of Culture - Information and the Minister of Interior,
DECREE:
Article 1. Position and Functions
The Ministry of Culture - Information is an agency of the Government responsible for state management in the fields of culture and information including: cultural heritage, performing arts, cinema, fine arts, photography, exhibitions, press, publishing, copyright for literary and artistic works, libraries, advertising, mass culture, propaganda and information; state management of public services and representation of state ownership interests in enterprises with state capital in the fields of culture and information as prescribed by law.
Article 2. Tasks and Powers
The Ministry of Culture - Information is responsible for carrying out tasks and powers as prescribed in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submit draft laws, ordinances, and other regulatory legal documents concerning the areas of state management of the Ministry to the Government and the Prime Minister;
2. Submit strategies, plans for development, long-term plans, five-year plans, and annual plans within the areas of state management of the Ministry to the Government and the Prime Minister;
3. Issue decisions, directives, and circulars within the scope of state management of the Ministry;
4. Direct, guide, inspect, and be responsible for implementing regulatory legal documents, strategies, plans, and other legal documents within the scope of management of the Ministry after approval; promote, disseminate, educate about the law, and provide information on the areas of state management of the Ministry;
5. Regarding cultural heritage:
a) Propose the Prime Minister to decide:
Planning the network of museums; organizing and guiding implementation after approval;
Establishing national museums and specialized museums;
Ranking or revoking ranking decisions, protection zones for special national relics;
Recommending the United Nations Educational, Scientific and Cultural Organization (UNESCO) to recognize outstanding Vietnamese cultural heritages as World Cultural Heritage;
Permitting the export of national treasures abroad.
b) Decide within its authority:
Issuing regulations on the preservation, restoration, and repair of relics, archaeological exploration and excavation; organization and operation of private museums;
Specifying procedures for preparing scientific files on intangible cultural heritage, artifacts, antiques, and national treasures;
Ranking or revoking ranking decisions for national relics and museums of the first category; transferring artifacts, antiques, and national treasures to appropriate state museums;
Approving projects for the preservation, restoration, and repair of national relics and special national relics according to the law; approving or agreeing on construction projects in the second protected zone of national relics and special national relics;
Reviewing projects for the preservation, restoration, and repair of national relics and special national relics, renovation and construction projects outside the protected zones of national relics and special national relics that may have adverse effects on the relics according to the law;
Issuing permits for archaeological exploration and excavation; exporting artifacts, antiques; making copies of artifacts, antiques, and national treasures from national museums and specialized museums; managing permits for overseas Vietnamese residents, foreign organizations, and individuals to research and collect intangible cultural heritage in Vietnam;
c) Guide and inspect activities related to the protection and enhancement of the value of cultural heritage;
d) Take the lead and coordinate with relevant agencies and organizations to mobilize, manage, and utilize resources for the protection and enhancement of the value of cultural heritage.
6. Regarding performing arts:
a) Propose the Prime Minister to plan state-owned institutions for performing arts; organize and guide implementation after approval;
b) Issue regulations on professional performance activities; regulations on organizing festivals, contests, and performances on performing arts;
c) Guide and inspect the issuance of permits for professional performance activities;
d) Specify the review and issuance of permits for programs, acts, and plays by Vietnamese organizations and individuals performing abroad and by foreign organizations and individuals performing in Vietnam;
đ) Uniformly manage the production, distribution of music and stage recordings;
7. Regarding cinema:
a) Propose the Prime Minister to plan state-owned institutions for cinema; organize and guide implementation after approval;
b) Specify conditions for establishing film institutions; services and cooperation in film production with foreign countries;
c) Specify the issuance of permits for film export, import, and distribution;
d) Specify the organization of national and international film festivals, days of foreign films in Vietnam, and days of Vietnamese films abroad;
đ) Manage domestic film archives and store domestic and foreign moving image materials;
8. Regarding fine arts, photography, and exhibitions:
a) Issue regulations on fine arts, photography, and exhibition activities;
b) Plan national monumental sculptures and large-scale paintings;
c) Specify the organization and directly organize national and international exhibitions of fine art and photographic works;
9. Regarding press:
a) Propose the Prime Minister to plan the network of press outlets nationwide and representative offices of Vietnamese press agencies abroad;
b) State management over press activities nationwide including print, radio, television, online press, and news agencies;
c) Organize information for the press, manage press information according to the Press Law;
d) Issue regulations on organizing press contests;
đ) Inspect stored press publications, manage the national press archive;
e) Issue and revoke press activity licenses; special edition, supplement, and special program publication licenses; journalist cards; permit foreign press publications to distribute in Vietnam;
g) Manage the activities of the press and journalists throughout the country, coordinate with relevant agencies to manage the activities of Vietnamese press related to foreign countries and the press activities of foreigners and foreign organizations in Vietnam;
h) Agree on the appointment and removal of Chief Editors, Deputy Chief Editors, General Directors, Deputy General Directors, Directors, and Deputy Directors of press agencies.
10. On publishing:
a) Submit to the Prime Minister for approval the planning of the network of publishing, printing, and distribution of books; organize and guide its implementation after approval;
b) Specify conditions for establishing and operating in publishing, printing, and distributing books according to the provisions of the law;
c) Issue and revoke licenses for publishing activities and printing activities according to the provisions of the law;
d) Grant permission for non-commercial publication products for Vietnamese organizations and foreign organizations with offices in Vietnam according to the provisions of the law; manage the announcement and dissemination of works abroad within the scope of authority;
đ) Specify registration and inspection of the implementation of publication plans by publishers;
e) Manage sample publications and appraise publications when necessary;
g) Decide to suspend, revoke, confiscate, ban circulation, and destroy publications that violate the law;
h) Agree on the appointment and removal of Directors, Deputy Directors, Chief Editors, and Deputy Chief Editors of publishing houses.
11. On copyright for literary and artistic works:
ưa) Submit to the Government for approval the remuneration system for authors and owners of literary and artistic works and guide its implementation after approval;
b) Direct and organize the implementation of legal provisions on copyright for literary and artistic works;
c) Implement measures to protect the legitimate rights of the state, organizations, and individuals in the field of copyright for literary and artistic works;
d) Specify the provision, cooperation, ordering, use, and ensuring copyright for performing arts, film, and television, radio, and internet works;
đ) Guide the business of protecting copyright for literary and artistic works for sectors, localities, enterprises, social organizations, and citizens.
12. On libraries:
a) Submit to the Prime Minister for approval the planning of the library network; organize and guide its implementation after approval;
b) Specify the cooperation, exchange of books, newspapers, and materials with foreign countries and the interconnection of books, newspapers, and materials between libraries;
c) Specify conditions for establishing and guiding library operations.
13. On advertising:
a) Submit to the Government for approval the establishment and operation of foreign advertising branches in Vietnam;
b) Manage advertising activities according to the provisions of the law.
14. On mass culture and propaganda information:
a) Take the lead and coordinate with relevant ministries and sectors to submit to the Government for approval the national rituals according to the division of labor of the Government;
b) Submit to the Prime Minister for approval regulations on cultural and information facilities; organize and guide their implementation after approval;
c) Issue regulations on organizing mass cultural festivals, competitions, performances, propaganda information activities, and public cultural services;
d) Issue regulations, guide, and direct the movement of building a civilized lifestyle, information and propaganda activities, and the organization of festivals.
15. Lead and coordinate with the Ministry of Foreign Affairs and relevant ministries and sectors to implement state management over external information work;
16. Submit to the Government and the Prime Minister for approval state awards and honors in the fields of culture and information;
Submit to the Prime Minister for decision-making or establish according to authority National Councils in the fields of culture and information;
17. Specify conditions for establishing production and distribution bases for sound tapes, sound discs, video tapes, video discs; conditions for domestic organizations and individuals to engage in joint ventures, collaborations, and services with foreign countries regarding cultural heritage, performing arts, film, press, publishing; sponsorship and ordering using state budget funds for performing arts, film, fine arts, press, publishing, and advertising;
18. Grant permits to foreign organizations and individuals to organize cultural and information activities in Vietnam; grant export and import permits for cultural goods and printing equipment according to the provisions of the law;
19. Decide and implement preventive and blocking measures against superstition, outdated customs, pornographic cultural goods, and illegal cultural and information activities;
Directly organize some important national and international cultural and information activities;
20. Appraise and inspect the implementation of national programs and investment projects in the fields of culture and information according to the provisions of the law;
21. Implement international cooperation in the fields of culture and information according to the provisions of the law;
22. Organize and direct the implementation of scientific research plans, application of scientific and technological progress in the fields of culture and information;
23. Decide specific policies and measures and direct the implementation of operational mechanisms for service organizations under the Ministry's management according to the provisions of the law; manage and direct the activities of public institutions under the Ministry;
24. Perform specific tasks and powers belonging to the representative ownership of state capital in enterprises with state capital under the Ministry's management according to the provisions of the law;
25. State management over the activities of associations and non-governmental organizations in the fields of culture and information according to the provisions of the law;
26. Inspect, audit, resolve complaints, accusations, anti-corruption, and handle violations of laws on culture and information within the Ministry's jurisdiction;
27. Decide and direct the implementation of the Ministry's administrative reform program according to the goals and content of the government's approved administrative reform program.
28. Managing organizational structure and staffing; directing the implementation of salary systems and incentive policies, rewards, and disciplinary measures for state civil servants, public officials, and employees under the Ministry's jurisdiction; training and professional development for cultural, artistic talents, civil servants, public officials, employees, and technical workers in the field of culture and information; establishing professional standards for civil servants and public officials, technical levels, and professional standards in culture and information.
29. Managing financial resources and assets assigned, and organizing the implementation of allocated budgets in accordance with the provisions of the law.
Article 3. Organizational Structure of the Ministry

The Minister of Culture and Information shall take the lead and coordinate with the Minister of Home Affairs to develop a restructuring plan for other existing scientific and technological units under the Ministry, to be submitted to the Prime Minister for decision.
Article 4. Effectiveness
This Decree takes effect fifteen days after its publication in the Official Gazette, replacing Government Decree No. 81/CP dated November 8, 1993 on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information, and any previous regulations that conflict with this Decree.
Article 5. Responsibility for Implementation
The Minister of Culture and Information, Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
