On strengthening guidance and effectively implementing fire prevention and firefighting work

Since the Fire Prevention and Fighting Law was passed at the ninth session of the tenth National Assembly, ministries, sectors, provincial and municipal people's committees have made significant efforts to implement fire prevention and fighting measures, thereby curbing the increase in the number of fires and losses caused by them, contributing significantly to serving the country's economic and social development. However, in recent times, there have been several large fires across the country causing particularly serious losses, becoming a pressing issue for society. The main reasons are poor management and implementation of fire prevention and fighting work in many places, numerous shortcomings and oversights in fire prevention and fighting, insufficient attention and investment from many levels, sectors, units, and facilities, and inadequate awareness about fire prevention and fighting, as well as non-compliance with fire prevention and fighting laws by heads of agencies, organizations, civil servants, and a portion of the public...
To address these weaknesses and further enhance the effectiveness of fire prevention and fighting work, the Prime Minister instructs ministries, ministerial-level agencies, government-affiliated agencies, and provincial and municipal people's committees to implement the following actions:
1. In the immediate future, especially during the dry season at the beginning of 2006 and particularly during the Tet holiday of the Year of the Dog, it is necessary to continuously organize propaganda, dissemination, and guidance to raise awareness and knowledge about fire prevention and fighting among the public and officials, workers, and staff; conduct safety inspections for fire prevention and fighting at markets, shopping centers, residential areas, production and service facilities, and other key facilities with high fire risks; organize the construction, reinforcement of forces, provision of equipment, conditions for fire prevention and fighting, and rescue plans; organize signing commitments to ensure fire safety; organize shifts, strengthen patrols, and guard duty, especially at night and outside working hours, promptly rectify any oversights and deficiencies in fire prevention and fighting, and strictly handle violations of fire prevention and fighting regulations.
The Ministry of Public Security and the Ministry of Agriculture and Rural Development need to immediately implement the Government Decree No. 09/2006/NĐ-CP dated January 16, 2006, on fire prevention and fighting in forests according to their respective functions and responsibilities; pay special attention to identifying and warning early about forests with high fire risks; guide the public on measures to ensure fire safety when burning fields and operating in forests; develop forest fire prevention and fighting plans.
2. Prepare and conduct a five-year review of the implementation of the Fire Prevention and Fighting Law, organize activities to commemorate the 45th anniversary of the issuance of the Ordinance "Regulating State Management over Fire Prevention and Fighting" and the 5th anniversary of the issuance of the Fire Prevention and Fighting Law on October 4, 2006. The review must be conducted from the grassroots level upwards. During the review, each provision in the Fire Prevention and Fighting Law and other regulatory legal documents on fire prevention and fighting must be reviewed, clearly identifying achievements, shortcomings, lessons learned; responsibility must be assessed for each level, sector, facility, and individual in fire prevention and fighting work; combine the review with organizing exemplary meetings on fire prevention and fighting in industrial zones, export processing zones, high-tech parks, and economic zones; organize awards for collectives and individuals with outstanding achievements in implementing the Fire Prevention and Fighting Law. The Ministry of Public Security shall guide ministries, sectors, and localities on the content of the review.
3. Develop a plan for fire prevention and fighting planning for the period 2006-2010 that aligns with the economic and social development master plans of ministries, sectors, and localities, and formulate specific plans and measures for implementation.
4. The Ministry of Public Security needs to strengthen guidance to improve the effectiveness of state management over fire prevention and fighting, organize inspections and checks on fire prevention and fighting work at all levels and sectors; particularly in industrial zones, export processing zones, high-tech parks, economic zones, high-rise buildings, residential areas, markets, shopping centers, facilities producing, storing, and using industrial explosives, and other key facilities regarding fire and explosion risks; resolutely and strictly handle cases violating fire prevention and fighting regulations, select some typical cases to prosecute before the law for those who intentionally violate fire prevention and fighting regulations, arson, burning to cover up, and lack of responsibility in fire prevention and fighting causing particularly serious consequences; develop a proposal for investment to enhance the capacity of fire prevention and fighting police forces for the period 2006-2010 (focusing on investment in personnel and equipment for fire prevention and fighting and rescue operations).
5. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and chairpersons of provincial and municipal people's committees must strictly implement this Directive.
The Ministry of Public Security is tasked with inspecting and urging the implementation of this Directive./.
