Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

At the proposal of the Director of the Organization and Cadres Department and the Director of the Vietnam Internet Network Information Center,

DECISION:

Article 1. Position and Functions

The Vietnam Internet Network Information Center is a subordinate unit under the Ministry of Information and Communications responsible for performing management, allocation, supervision, and promotion of the use of Internet domain name, address, and network number resources (referred to collectively as resources) in Vietnam; providing guidance information and statistics on participating international Internet activities.

International trade name: Vietnam Internet Network Information Center (abbreviated as: VNNIC).

The Vietnam Internet Network Information Center is a self-financing public service entity with legal personality, its own seal and separate account for transactions in accordance with the law, with its main office located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Vietnam Internet Network Information Center has the following tasks and powers:

1. Planning, managing, and allocating Internet Protocol (IP) addresses and Autonomous System Numbers (ASN) at the national level.

2. Managing national-level Internet domain names including sub-levels under .vn.

3. Planning, investing in construction of technical infrastructure, technology, and human resources to develop the Vietnam Internet Network Information Center in line with practical requirements.

4. Establishing, operating, and maintaining the national-level Domain Name System (DNS) server .vn; national Internet transit station; registering and maintaining IP addresses and network numbers for Vietnam's Internet; participating in the exploitation of new technologies related to Internet resources, DNS technology, and IP protocols and Internet Certificate Authority systems.

5. Inspecting and supervising the issuance, registration, and use of IP addresses, network numbers, and domain names by organizations and individuals involved in Internet activities.

6. Researching and proposing, and participating with affiliated units under the Ministry to draft regulatory legal documents on state management of Internet resources, exploitation and use of Internet services, and Internet quality across the country.

7. Cooperating with functional units of the Ministry in state management of activities of associations and non-governmental organizations in the field of Internet.

8. Participating in representing Vietnam officially in Internet-related activities of international Internet organizations concerning Internet network resources and IP technology.

9. Having the right to request organizations and individuals operating on the Internet to provide relevant information and statistical data related to Internet activities. Implementing statistical reports on the development of the Internet domestically.

10. Being entitled to collect fees and charges for activities according to the functions, tasks, and powers of the Center and in accordance with the law.

11. Participating in training and professional development as prescribed by the Ministry of Information and Communications.

12. Being entitled to cooperate and collaborate with international organizations to exploit backup systems for the national .vn domain, register and maintain Vietnam's Internet resources, promote internationally about Vietnam's Internet, and develop the use of the .vn domain.

13. Being entitled to participate in providing services related to Internet resources, IP technology, information technology, and participating in related activities to generate additional revenue sources to expand the scope and scale of operations in line with the functions, tasks, and powers of the Center and in accordance with the law, ensuring the preservation and development of assigned resources.

14. Managing the organization, cadres, staff, and assets of the Center in accordance with the law and the delegation of the Minister.

15. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure and Staffing

1. Leadership of the Center:

The Vietnam Internet Center shall have a Director, Deputy Directors, and an assisting administrative apparatus.

The Director shall be responsible to the Minister and the law for organizing and implementing the assigned functions, tasks, and authorities.

The Deputy Directors shall assist the Director in directing and managing the Center's operations and shall be responsible to the Director for the assigned tasks.

2. Organizational Structure and Staffing of the Center:

- Organization and Administration Department.

- Accounting and Finance Department.

- Internet Resource Management Department.

- Technical and Informatics Department.

- Economics and Statistics Department.

- Community Relations Department.

- DNS Station.

- Branch Office in Ho Chi Minh City.

- Branch Office in Da Nang City.

The functions, tasks, and authorities of the Branch Offices in Ho Chi Minh City and Da Nang City shall be established by the Center Director and submitted to the Minister for decision.

The functions, tasks, and authorities of the Departments and the DNS Station shall be stipulated by the Center Director; the working relationships between units within the Center shall be regulated by the Center Director.

The staffing of officials and employees of the Center shall be established by the Center Director and submitted to the Minister for decision.

Article 4. Effective date

This Decision shall take effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 28/2003/QĐ-BBCVT dated March 12, 2003 of the Minister of Posts and Telecommunications on the functions, tasks, authorities, and organizational structure of the Vietnam Internet Center is hereby abolished.

Article 5. Responsibilities for Implementation

The Head of the Office, the Director of the Cadre and Civil Servant Department, the Director of the Vietnam Internet Center, the Heads of Ministries, Departments, and Units under the Ministry of Information and Communications, and related units shall be responsible for implementing this Decision./.
