Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 2, Article 4 of Decree No. 35/2012/NĐ-CP dated April 18, 2012 of the Government adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres;
The Minister of Home Affairs and the Minister of Finance issue this joint Circular guiding the implementation of the adjustment of monthly allowances from May 1, 2012 for retired village cadres pursuant to Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
Article 1. Scope of application
The subjects to which this joint Circular applies are village, ward, and town cadres who have retired and are receiving monthly allowances pursuant to Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired elderly village cadres).
Article 2. Adjustment of Monthly Allowance
From May 1, 2012, the adjustment of monthly allowances for retired elderly village cadres shall be implemented according to the provisions of Article 2 of Decree No. 35/2012/NĐ-CP dated April 18, 2012 of the Government adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres (hereinafter referred to as Decree No. 35/2012/NĐ-CP), increasing the monthly allowance by 26.5% over the amount of allowance received in April 2012, specifically as follows:
1. Formula for adjusting the monthly allowance from May 1, 2012:
Monthly allowance received from 01/05/2012 = Monthly allowance received in April 2012 x 1.265
In which: The monthly allowance received in April 2012 is the allowance prescribed in Clause 2, Article 2 of Joint Circular No. 05/2011/TTLT-BNV-BTC dated May 6, 2011 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from May 1, 2011 for retired village cadres pursuant to Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
2. The monthly allowance received from May 1, 2012 for retired elderly village cadres (rounded off according to the calculation formula in Clause 1 of Article 2 hereof) is as follows:
a) For former Secretaries of Village Party Committees, Chairmen of Village People's Committees: VND 1,325,000/month.
b) For former Deputy Secretaries, Deputy Chairmen, Permanent Members of Village Party Committees, Secretaries of Village People's Committees, Secretaries of Village People's Assemblies, Village Militia Commanders, Chiefs of Village Police Stations: VND 1,277,000/month.
c) For other positions: VND 1,172,000/month.
Article 3. Implementation Organization
1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from May 1, 2012 according to the guidelines set forth in this joint Circular for the subjects within their jurisdiction.
2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.
3. Retired elderly village cadres who move to a new legal place of residence within the same district must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs of the province; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation certificate from the competent authority at the same level). The place of transfer will continue to pay the allowance to the transferred cadre. If retired elderly village cadres moved to a new legal place of residence before the effective date of Decree No. 35/2012/NĐ-CP, the current place of payment will continue to pay the allowance to the subject.
Article 4. Effective date
1. This joint Circular takes effect from June 1, 2012.
2. The regulations stipulated in this joint Circular shall be implemented from May 1, 2012.
3. Abolish Joint Circular No. 05/2011/TTLT-BNV-BTC dated May 6, 2011 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from May 1, 2011 for retired village cadres pursuant to Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.
During the implementation process, if there are any difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs for coordination with the Ministry of Finance to study and resolve them./.
