Based on the Law on Organization of People's Councils and People's Committees 2003;

Pursuant to the Law on Legislative Documents of 2008;

Based on Decree No. 08/2005/NĐ-CP dated October 24, 2005 of the Government on Urban Planning;

Based on Decree No. 02/2006/NĐ-CP dated January 5, 2006 of the Government on Regulations for New Urban Areas;

Based on Decree No. 38/2010/NĐ-CP dated April 7, 2010 of the Government on Management of Urban Space, Architecture, and Landscape;

Based on Decree No. 42/2010/NĐ-CP dated April 15, 2010 and Decree No. 39/2012/NĐ-CP dated April 27, 2012 of the Government detailing implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Implement Decision No. 1610/QĐ-TTg dated September 16, 2011 of the Prime Minister approving the Program to implement the Movement "All People United to Build a Civilized Life" for the period 2011-2015 with orientation towards 2020;

At the proposal of the Director of the Department of Cultural Institutions;

The Minister of Culture, Sports and Tourism promulgates this Circular specifying detailed standards, procedures, and processes for reviewing and recognizing "Civilized Urban Ward" and "Civilized Urban Town".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular specifies detailed standards, procedures, and processes for reviewing and recognizing "Civilized Urban Ward" and "Civilized Urban Town" (hereinafter referred to collectively as "Civilized Urban Ward and Town").

a) Wards and towns under districts, counties, townships, cities directly under provinces (hereinafter referred to collectively as district level);

b) Agencies, units, organizations, and individuals related to the procedures for reviewing and recognizing "Civilized Urban Ward and Town".

Article 2. Implementation Principles

1. Recognizing "Civilized Urban Ward and Town" aims to encourage and motivate wards and towns to actively participate in the Movement "All People United to Build a Civilized Life".

2. Promote propaganda and mobilize the people to understand and voluntarily comply with the recognition standards for "Civilized Urban Ward and Town".

3. Link the construction and recognition of "Civilized Urban Ward and Town" with the construction and recognition of "Cultural Family" and "Cultural Resident Group".

4. The review and recognition of "Civilized Urban Ward and Town" must ensure accuracy, objectivity, democracy, and compliance with regulations.

Article 3. Authority, Time Limit, and Form of Recognition

1. "Civilized Urban Ward and Town" shall be recognized and re-recognized by the Chairman of the People's Committee at the district level.

2. Time limit for recognition:

a) First recognition, two years from the date of registration for construction;

b) Re-recognition, five years from the date of previous recognition decision.

3. Form of recognition: Recognition Decision accompanied by a Certificate of Recognition for "Civilized Urban Ward and Town" (Certificate according to the model specified in the Appendix of this Circular).

Chapter II

SPECIFIC PROVISIONS

Article 4. Standards for "Civilized Urban Ward and Town"

1. Urban architectural and construction management according to planning

a) General urban planning and detailed urban planning must be approved by competent authorities and publicly announced widely;

b) Construction, upgrading, and renovation of over 90% of public administrative, cultural-social, and urban infrastructure facilities;

c) Achieve 100% new public construction projects (since the approval of the planning) conforming to planning, harmonious architecture, and current construction standards;

d) Effectively perform state management responsibilities regarding construction; promote community self-management in implementing urban architectural planning and construction;

đ) Manage, exploit, and use public facilities effectively within the area for public benefit; do not misappropriate or use public land and facilities for commercial or residential purposes.

2. Enhance the quality of Cultural Families and Cultural Resident Groups

a) Over 80% of families recognized as "Cultural Family" for three consecutive years or more;

b) Over 60% of residents' houses newly constructed or renovated and beautified in terms of urban architecture;

c) Over 80% of resident groups (or equivalent) recognized as "Cultural Resident Group" for six consecutive years or more;

d) 100% of resident groups mobilize residents to maintain and upgrade urban infrastructure and ensure environmental sanitation;

đ) Over 80% of agencies, units, and enterprises operating in the ward or town meet cultural standards continuously for five years or more.

3. Building civilized lifestyles and urban cultural environment

a) Over 80% of households comply with current regulations on civilized wedding, funeral, festival practices, and urban lifestyle;

b) Do not encroach upon streets and sidewalks causing traffic obstruction, do not illegally extend buildings, install awnings, or place advertisements improperly, damaging urban aesthetics;

c) Meet the prescribed ratio of public greenery, static traffic land, water supply, drainage, and urban lighting standards;

d) Ensure environmental hygiene; collect waste as required; all production and business establishments meet environmental standards;

đ) Foster friendly community relations, mutual assistance in poverty alleviation; cooperate in economic development.

4. Building cultural and sports movements

a) Ward and town cultural-sports centers have adequate facilities and equipment, stable organization, and regular effective activities;

b) Over 80% of resident groups have regular cultural-sports activity points attracting broad participation from various social strata;

c) Maintain regular mass cultural activities, club activities, sports activities, preservation of historical-cultural relics and scenic spots, traditional folk cultural and sports activities in the locality;

d) Effectively implement the Movement "All People United to Build a Civilized Life"; ensure public security and social safety; ensure traffic safety; prevent social evils and serious criminal offenses.

5. Strictly abide by the Party's policies, State laws, and local regulations

a) At least 95% of households are informed about and strictly implement the Party's guidelines, policies, State laws, and local regulations;

b) 100% of residential wards build and effectively implement community conventions; have active self-management groups; conflicts and disputes are resolved within the community; grassroots democracy is well implemented without mass complaints, appeals beyond jurisdiction, or violations of the law;

c) Organize activities for citizens to participate in supervising the government, building the grassroots political system, combating corruption, and implementing social policies;

d) Timely and thoroughly address violations of urban planning, architecture, and construction laws; there are no construction projects with serious violations that require forced demolition;

đ) Cultural business establishments are built according to plans and strictly comply with legal provisions; there are no premises storing or circulating harmful cultural products;

Article 5. Procedures for Examination and Recognition

1. The Steering Committee of the "All People United to Build a Civilized Life" Movement at the ward/district level:

a) Registers to build a "Civilized Urban Ward/District" with the District People's Committee;

b) Organizes a Launch Ceremony for Building a "Civilized Urban Ward/District" (disseminating standards and approving the construction or maintenance plan for a "Civilized Urban Ward/District");

c) Inspects and evaluates implementation results;

d) Prepares a report on achievements to be submitted to the Ward/District People's Committee;

2. The Chairman of the Ward/District People's Committee issues a letter requesting recognition from the District People's Committee Chairman;

3. The Steering Committee of the "All People Building a Civilized Life" Movement at the district level organizes inspections and assessments of the implementation results of the recognition criteria for a "Civilized Urban Ward/District" (inspection reports included);

4. The Culture and Information Department at the district level collaborates with the Commendation and Reward Section at the same level to submit to the District People's Committee Chairman for consideration and decision on recognition, re-recognition, and issuance of the Certificate of Recognition for a "Civilized Urban Ward/District";

Article 6. Procedures for Examination and Recognition

1. Conditions for Recognition

a) A ward/district must meet the standards set forth in this Circular and other regulations of the provincial/municipal People's Committees (if applicable) to be recognized as a "Civilized Urban Ward/District";

b) Registration period:

- Two years for initial recognition;

- Five years for re-recognition;

2. Application documents

a) Achievement report confirmed by the Ward/District People's Committee Chairman:

- Two-year report for initial recognition;

- Five-year report for re-recognition;

b) Request letter from the Ward/District People's Committee Chairman;

One set of application files must be submitted directly to the District People's Committee;

Processing time is five working days from the date of receipt of complete and valid files;

3. Based on the application file and inspection records of the district-level Steering Committee of the "All People Building a Civilized Life" Movement, the District People's Committee Chairman issues a recognition decision accompanied by the Certificate of Recognition for a "Civilized Urban Ward/District";

4. In cases where recognition is not granted, the District People's Committee shall issue a document detailing the reasons for non-recognition and send it to the Ward/District People's Committee;

Chapter III

IMPLEMENTATION

Article 7. Responsibility for Implementation

1. Based on this Circular, provincial/municipal People's Committees may supplement specific criteria and achievement levels suitable to local conditions, but they must not conflict with the provisions of this Circular;

2. Provincial/Municipal Departments of Culture, Sports, and Tourism shall cooperate with district-level People's Committees to implement this Circular;

3. Based on the inspection and evaluation results of the district-level Steering Committee, wards/districts violating the provisions of this Circular will not be recognized or re-recognized. Serious violators will have their Certificates of Recognition revoked by the District People's Committee Chairman;

4. The Certificate of Recognition for a "Civilized Urban Ward/District" comes with a cash award; the award amount is determined by localities based on budget capacity and social resources;

5. "Civilized Urban Wards/Districts" achieving outstanding results will be commended by competent authorities and recommended for commendation according to current regulations;

Article 8. Implementation clause

1. This Circular takes effect from March 10, 2013;

2. During implementation, if any issues arise or difficulties occur, please report them to the Ministry of Culture, Sports, and Tourism for research, supplementation, and appropriate amendments./.
