CIRCULAR

REGULATING THE STANDARDS FOR EXPERTS IN ANTIQUE APPRAISAL

Pursuant to the Law on Cultural Heritage dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Law on Cultural Heritage dated June 18, 2009;

Pursuant to Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing implementation of certain provisions of the Law on Cultural Heritage and the Law Amending and Supplementing Certain Provisions of the Law on Cultural Heritage;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 61/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for antique appraisal business operations and practice in cultural heritage conservation, restoration, and repair;

At the proposal of the Director of the Heritage Department;

The Minister of Culture, Sports and Tourism issues this Circular regulating standards for experts in antique appraisal.

Article 1. Scope of Application

This Circular stipulates the standards for experts in antique appraisal.

Article 2. Applicability

This Circular applies to individuals participating in antique appraisal activities within the territory of Vietnam and other organizations or individuals related to such activities.

Article 3. Standards for Experts in Antique Appraisal

An expert in antique appraisal is a person who has full civil capacity as provided by the Civil Code, is not currently under criminal investigation, and must meet one of the following criteria:

1. Possessing an undergraduate degree or higher in one of the training fields related to cultural heritage, history (archaeology, cultural studies), fine arts, Han-Nom, ethnology, ancient anthropology, paleontology (zoology, botany), geology; having at least five years of direct involvement in archaeological activities, antique conservation and repair, evaluation of historical, cultural, and natural science documents or artifacts; publishing at least three scientific articles on antiques in specialized journals or participating in the compilation of published monographs on antiques;

2. Being a member of an occupational association related to the training fields specified in Clause 1 of this Article, with at least ten years of experience collecting antiques.

Article 4. Responsibility for Implementation

1. The Director of the Cultural Heritage Department shall be responsible for monitoring and inspecting the implementation of this Circular.

2. The Directors of Departments of Culture, Sports and Tourism, as well as Departments of Culture and Sports shall be responsible for organizing the implementation of this Circular.

Article 5. Provisions on Implementation

1. This Circular takes effect from August 25, 2017.

2. During the course of implementation, if any issues arise or difficulties are encountered, relevant agencies, organizations and individuals shall promptly report to the Ministry of Culture, Sports and Tourism (through the Cultural Heritage Department) for review, supplementation, and amendment./.
