DECREE

Regulations on functions, tasks, powers
and organizational structure of Vietnam Television

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government on agencies under the Government;

At the proposal of the Minister of Information and Communications;

The Government promulgates this Decree stipulating the functions, tasks, powers and organizational structure of Vietnam Television.

Article 1. Position and Function

1. Vietnam Television is an agency under the Government, a national television station performing the function of providing information and propaganda for the Party's guidelines and the State’s policies and laws; contributing to education, raising public awareness, and serving the spiritual life of the people through television programs and other multimedia journalism forms.

2. Vietnam Television has the abbreviated name in Vietnamese as THVN; the international trading name in English as Vietnam Television, abbreviated as VTV.

3. Vietnam Television is subject to state management by the Ministry of Information and Communications regarding press and television.

Article 2. Tasks and Authorities

1. To develop, submit to the Government and the Prime Minister strategic plans, long-term, medium-term, annual plans, and other important projects of Vietnam Television, and organize their implementation after approval.

2. To study and propose the establishment of national standards to be published by competent authorities; issue basic standards in accordance with the law.

3. To organize production, transmission, broadcasting, distribution, and storage of television programs, online newspapers, and printed newspapers in accordance with the law.

4. To participate in developing strategies and planning for the development of the Vietnamese television system.

5. Deciding and being responsible for the content, programs, and daily broadcast duration on the channels of Vietnam Television in accordance with the law.

6. To directly manage the specialized technical systems of Vietnam Television for program production, signal transmission, and broadcasting of domestic and international programs and channels in accordance with the law.

7. To take the lead and coordinate with local radio and television stations regarding plans for producing programs broadcast on Vietnam Television channels.

8. To manage and decide on investment and construction projects within its authority as prescribed by law; participate in reviewing important projects assigned by the Prime Minister.

9. To implement the mechanism of self-management and self-responsibility for tasks, organizational structures, and workforce numbers; to apply financial mechanisms and salaries as enterprises according to the law.

10. To take the lead and coordinate with relevant agencies to build a financial mechanism suitable to the functions, tasks, and authorities of Vietnam Television and the provisions of the law, and submit it to competent authorities for issuance.

11. To perform the function of representing the State's ownership rights over enterprises established by Vietnam Television and over shares held in enterprises according to the law.

12. To organize scientific research, application of advanced science and technology in television; international cooperation in the field of television and other multimedia communications according to the law.

13. To train and enhance professional skills in television according to the law.

14. To decide and direct the implementation of administrative reform programs of Vietnam Television according to the goals and contents of the State administrative reform programs approved by the Government and the Prime Minister.

15. To manage organizational structures, workforce numbers, appoint, reappoint, dismiss, award, and discipline employees; to direct the implementation of salary systems and incentive policies, training, and enhancement for staff under its management according to current laws.

16. To manage and use the state budget and assets allocated according to the law.

17. To handle complaints and denunciations within its authority; prevent corruption and waste according to the law.

18. To organize activities to provide services according to the law.

19. To implement reporting requirements to the Government, the Prime Minister, the Ministry of Information and Communications, and other competent authorities according to the law. 20. To perform other tasks and authorities as prescribed by law.

24. Foreign resident offices of Vietnam Television established in accordance with the law.

25. Program Production Technical Center.

26. Transmission and Broadcasting Technical Center.

27. Art Center.

28. Training and Enhancement Center for Television Journalism.

29. Advertising and Television Service Center.

30. Computer and Television Technology Center.

31. Television Magazine.

Units specified from Clause 1 to Clause 6 of this Article are assisting organizations to the General Director; units specified from Clause 7 to Clause 27 of this Article are production and broadcasting organizations; units specified from Clause 28 to Clause 31 of this Article are other non-profit organizations.

The General Director of Vietnam Television shall report to the Prime Minister for comments on the establishment, dissolution, and restructuring of other units within his authority as prescribed by law.

The Editorial Board Secretariat shall consist of 15 departments; the Office shall consist of 10 departments.

Article 4. Leadership

1. Vietnam Television has a General Director and not more than four Deputy General Directors.

2. The General Director and Deputy General Directors are appointed and relieved from their positions by the Prime Minister in accordance with the provisions of the law.

3. The General Director is responsible to the Government, the Prime Minister, and the law for all activities of Vietnam Television; Deputy General Directors assist the General Director and are responsible to the General Director and the law for the areas assigned to them.

4. The General Director appoints and relieves from their positions the heads and deputy heads of the heads, and defines the functions, tasks, authorities, organizational structures, and working relationships of subordinate units.

Article 5. Effective Date

1. This Decree takes effect from the date of issuance.

2. Abolish Decree No. 18/2008/NĐ-CP dated February 4, 2008, of the Government stipulating the functions, tasks, authorities, and organizational structure of Vietnam Television, and Decree No. 72/2014/NĐ-CP dated July 22, 2014, of the Government amending and supplementing Article 3 of Decree No. 18/2008/NĐ-CP dated February 4, 2008, of the Government stipulating the functions, tasks, authorities, and organizational structure of Vietnam Television.

Article 6. Responsibility for Implementation

The General Director of Vietnam Television, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decree./.
