Issuing Regulations on Management of Pilot Production Projects at the Ministry Level
of the Ministry of Education and Training
Pursuant to the Law on Science and Technology No. 29/2013/QH13 dated June 18, 2013;
Pursuant to the Government Decree No. 123/2016/NĐ-CP dated September 1, 2016 stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;;
Pursuant to Decree No.Decision No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to the Government Decree No. 08/2014/NĐ-CP dated January 27, 2014 detailing and guiding the implementation of certain provisions of the Law on Science and Technology;
Pursuant to the Joint Circular No. 22/2011/TTLT-BTC-BKHCN dated February 21, 2011 of the Ministry of Finance and the Ministry of Science and Technology guiding financial management for pilot production projects supported by state budget funds;
Considering the proposal of the Director of the Department of Science, Technology, and Environment,
The Minister of Education and Training issues this Circular on Regulations on Management of Pilot Production Projects at the Ministry Level of the Ministry of Education and Training.
These Regulations are promulgated together with this Circular.
Article 1. This Circular takes effect from March 14, 2018 and replaces Decision No. 59/2007/QĐ-BGDĐT dated October 16, 2007 of the Minister of Education and Training on Regulations on Management of Pilot Production Projects at the Ministry Level of the Ministry of Education and Training.
Article 2. Pilot production projects at the ministry level that are being implemented before the effective date of this Circular shall continue to be implemented according to the provisions of Decision No. 59/2007/QĐ-BGDĐT dated October 16, 2007 of the Minister of Education and Training on Regulations on Management of Pilot Production Projects at the Ministry Level of the Ministry of Education and Training.
Universities, academies, colleges, research institutes, and science research centers under the Ministry of Education and Training shall apply these Regulations to develop and issue regulations on management of pilot production projects at the institutional level within their jurisdiction.
Article 3. The Heads of the Office, Directors of the Department of Science, Technology, and Environment, heads of units under the Ministry of Education and Training, rectors of regional universities, academies, presidents of colleges, directors of teacher training colleges, rectors of research institutes, and directors of science research centers under the Ministry of Education and Training, and related individuals are responsible for implementing this Circular.

REGULATIONS
of the Ministry of Education and Training
(Issued together with Circular No. 02/2018/TT-BGDĐT
dated January 26, 2018 of the Minister of Education and Training)
Article 1. This document regulates the management of pilot production projects at the ministry level under the responsibility of the Ministry of Education and Training, including: determining, selecting, directly assigning, reviewing, and deciding to assign projects; organizing implementation and inspecting the progress of project execution; evaluating and accepting the results of project implementation.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 2. These Regulations apply to regional universities, academies, colleges, teacher training colleges, research institutes, and science research centers under the Ministry of Education and Training, organizations, and individuals selected and directly assigned to implement projects of the Ministry of Education and Training (hereinafter referred to as organizations and individuals).
In these Regulations, the following terms are understood as follows:
Article 2. Explanation of terms
Selection refers to the process of choosing organizations and individuals with the best capabilities and experience to undertake projects based on the orders of the Ministry of Education and Training through the examination and evaluation of registration files submitted in accordance with specified requirements and criteria.
1. Selecting Direct assignment refers to the designation of organizations and individuals with sufficient capabilities, conditions, and relevant expertise to undertake projects based on the orders of the Ministry of Education and Training.
2. Directly assigning Pilot production project
3. is a scientific and technological task aimed at applying research results to experimentally test solutions, methods, or economic and social management models at a small scale to perfect new technologies or products before they are put into production and use. Article 3. Objectives and Duration of Implementation of Pilot Production Projects at the Ministry Level of the Ministry of Education and Training
1. The objectives of pilot production projects at the ministry level of the Ministry of Education and Training (hereinafter referred to as projects) are as follows:a) To apply research results and advanced techniques to improve and innovate technology; to perfect and innovate high-quality and competitive production lines or new products meeting the requirements of the education sector and achieving socio-economic benefits; b) To quickly bring research results into practical production, enhancing the research and technology transfer capabilities of individuals and units under the Ministry of Education and Training.
2. The duration of project implementation shall not exceed 24 months from the date of approval and funding allocation. In special cases, the Minister of Education and Training may decide, but the maximum duration shall not exceed 36 months.
a) Apply research results and advanced techniques to improve and innovate technology; perfect and innovate production lines or new products with high quality and competitiveness, meeting the requirements of the Education sector and economic and social efficiency;
b) Contribute to quickly applying research results to practical production, enhancing the scientific research and technology transfer capabilities of individuals and units under the Ministry of Education and Training;
2. The project implementation period shall not exceed twenty-four months from the date of approval and allocation of funding. In special cases, the Minister of Education and Training may decide, but the maximum duration shall not exceed thirty-six months.
Article 4. Financial Provisions for the Project
1. Sources of financial support for implementing the project include:
a) State budget funds allocated in the annual state budget for science and technology activities of the Ministry of Education and Training (hereinafter referred to as state budget funds for science and technology);
b) Sources outside the state budget funds for science and technology of the Ministry of Education and Training:
- Legal income of the project's leading organization;
- Funds raised from enterprises and other individual and organizational sponsors.
2. The level of financial support from the state budget for projects using state budget funds for science and technology shall be implemented according to current financial regulations and in line with strategic directions and key tasks of the sector at each stage.
3. Financial management work
a) For projects using state budget funds for science and technology: shall be carried out in accordance with current state financial regulations;
b) For projects using sources outside state budget funds for science and technology: operating costs of the councils responsible for determining, selecting, reviewing projects, evaluating final acceptance at the ministry level, and inspecting project implementation shall be covered by the project's leading organization and regulated in the internal expenditure rules of the organization.
Article 5. Method of Assigning Projects
1. Projects using state budget funds for science and technology shall be implemented through methods of selection, direct assignment, and grant funding from state funds in the field of science and technology.
2. Projects using sources outside state budget funds for science and technology shall be implemented through the method prescribed in Clause 1 of this Article or another method chosen by organizations or individuals.

1. Projects using state budget funds for science and technology that are directly assigned are those falling within the cases stipulated in Clause 1 of Article 30 of the Science and Technology Law 2013.
2. The Minister of Education and Training selects organizations or individuals meeting the required conditions to directly assign the implementation of such projects.
Chapter II
DETERMINATION, SELECTION, DIRECT ASSIGNMENT,
REVIEW AND DECISION TO ASSIGN PROJECTS
Article 7. Determination of Projects Assigned Through Selection Method
1. Based on the plan for scientific and technological activities, the national economic and social development plan of the state, ministries, sectors, and localities; based on research results achieved, societal needs, and practical requirements, development plans, and needs of the education sector, the Ministry of Education and Training issues guidance letters to units and individuals to fill out project proposal forms (Model I-1 Appendix).
2. Units select projects proposed by individuals and include them in the list of proposed projects according to the form (Model I-2 Appendix), along with the project proposal form, and submit them to the Ministry of Education and Training as guided by the Ministry.
3. The Department of Science, Technology, and Environment compiles the list of proposed projects based on unit proposals; the list of projects directly proposed by ministry leadership (if any) according to each research field group and organizes the determination of projects.
Article 8. Determination of Projects Assigned Through Direct Assignment Method
1. The Ministry of Education and Training establishes an Advisory Council to determine directly assigned projects based on project proposals meeting the criteria set forth in Article 9 of these Regulations.
2. The Ministry of Education and Training notifies directly assigned projects to organizations and individuals.
3. Organizations and individuals assigned projects prepare documents in accordance with Article 14 of these Regulations and defend before the Advisory Council for directly assigned projects as stipulated in Article 16 of these Regulations.
Article 9. Criteria for determining projects
1. Meeting the conditions for proposing projects:
a) The project originates from the results of scientific and technological research topics or scientific research and technology development contracts at various levels that have been evaluated, accepted, and recommended for implementation and application by the science and technology council;
b) There is a market for product consumption (clearly explain the market potential for consumption, methods of transferring and commercializing products of the project);
c) Commitment and assurance to mobilize non-budgetary funds for science and technology affairs to implement the project.
2. The necessity to implement the project (urgency):
a) Alignment with priority technological directions and technological directions serving the development of important economic sectors;
b) Creating technologies (processes, equipment), new products of high quality and competitiveness that can be transferred to production;
c) Economic and social effectiveness (creating additional jobs, saving and utilizing resources and human resources, protecting the environment).
3. Feasibility:
a) Consistency in name, objectives, products, implementation time, financeable budget, and domestic scientific and technological capacity to resolve;
b) Reasonableness of setting economic and technical indicators for the project's products.
Article 10. Requirements for organizations and individuals primarily responsible for implementing projects 1. For organizations primarily responsible for implementing projects:
a) Possess sufficient scientific and technological capacity to primarily implement the project;
b) Have no pending scientific and technological tasks at the ministry level that need evaluation and acceptance at the time of submitting the application (for projects using science and technology affair budget funds).
2. For individuals primarily responsible for implementing projects (hereinafter referred to as the project leader):
a) Hold a bachelor's degree or higher, possess relevant expertise, and be actively working in the same field of science as the project;
b) Propose the implementation plan for the project and lead the preparation of the project description;
c) Possess the ability to directly implement or organize implementation and ensure sufficient time to lead the project's implementation;
d) Have completed financial settlement and acceptance of scientific and technological tasks that have reached their deadline (for projects using science and technology affair budget funds).
Article 11. Advisory Council for Determining Projects
1. The Advisory Council for Determining Projects (hereinafter referred to as the Determination Council) shall be established by the Minister of Education and Training according to the field of science and technology of the proposed project, with the task of advising the Minister on determining the project.
2. The Determination Council consists of 7, 9, or 11 members, including a chairman, secretary, review committee members, and other committee members, among which:
a) Two-thirds of the members are reputable scientists with appropriate expertise and deep understanding of the specialized fields of advisory services;
b) The remaining members belong to state management agencies, production and business organizations, enterprises, and other related organizations;
c) Each proposed project has two review committee members;
d) Individuals involved in implementing the project do not participate in the Council.
3. The Council only convenes when at least two-thirds of the members are present, including at least one review committee member, and there are complete written opinions from two review committee members.
4. Council members evaluate the proposed project based on the review form (Form I-3 Appendix) and assess it based on the project proposal evaluation form (Form I-4 Appendix).
4. Members of the Review Board shall comment on the project proposal according to the Comment Form (Form I-3 Appendix) and evaluate the project proposal according to the Evaluation Form for Project Proposals (Form I-4 Appendix).
Article 12. Evaluation Results of the Council shall be determined
1. A project proposal recommended for "implementation" by the Council must be agreed upon as "successful" by at least two-thirds of the members present at the Council meeting, with this number ensuring that it is not less than half of the total number of Council members.
a) For project proposals recommended for "implementation", the Council shall uniformly determine the name, orientation of objectives, products, and economic-technical indicators to be achieved, as well as the anticipated budget for the project;
b) For project proposals recommended for "non-implementation", the Council shall discuss and uniformly determine the reasons for not recommending implementation.
2. The evaluation results of the project proposal shall be recorded in the minutes of the Council meeting (Model I-5 Appendix). The Council shall approve the minutes of the Council meeting along with the list of projects put forward for selection and directly assigned to organizations or individuals to implement the project (Model I-6 Appendix).
Article 13. Selection of Organizations and Individuals to Lead Projects
1. Based on the advisory results of the Council, the Department of Science, Technology, and Environment shall compile the list of projects put forward for selection and directly assigned to organizations or individuals to lead the implementation of the project, and submit it to the Minister of Education and Training for consideration and decision.
2. The Ministry of Education and Training shall organize the selection of organizations and individuals to lead the implementation of projects.
3. At least thirty days before the selection date, the Ministry of Education and Training shall announce the list of projects put forward for selection on its website for organizations and individuals to register for participation in the selection process to implement the projects.
4. Not later than five days after the selection council meeting, the Ministry of Education and Training shall announce the selection results on its website and send the direct assignment results in writing to the organizations and individuals assigned directly.
Article 14. Application Documents for Participation in Selection and Direct Assignment of Projects
1. The application documents for participation in selection and direct assignment of projects (hereinafter referred to as project application documents) include the documents specified in Article 5 of Circular No. 08/2017/TT-BKHCN dated June 26, 2017, issued by the Minister of Science and Technology, which stipulates the selection and direct assignment of organizations and individuals to implement national science and technology tasks funded by the state budget, specifically:
a) Project description (Form B1-2c-TMDA);
b) Scientific curriculum vitae of the individual applying to be the principal investigator and other individuals applying to participate in the project (Form B1-4-LLCN);
c) Capability of implementing the project of the organization applying to lead the project (Form B1-3-LLTC);
d) Confirmation letter for cooperation in implementing the project (Form B1-5-PHNC) and legal documents proving the capability regarding human resources, experience, equipment, and financial capacity of the organization participating in cooperative implementation of the project.
2. The project application documents consist of one original set submitted directly or sent by post and one electronic copy of the documents (in PDF format). The deadline and address for submitting the project application documents shall be announced on the Ministry's website (for selection) and by written notice (for direct assignment).
Article 15. Criteria for Evaluating Project Application Documents
1. Project application documents shall be evaluated by scoring according to a scale of 100 points with the following groups of criteria:
a) Overview of technological and market issues of the project (maximum score 8);
b) Content and implementation plan (maximum score 24);
c) Novelty and feasibility of the technology (maximum score 12);
d) Development potential and expected socio-economic effectiveness of the project (maximum score 16);
đ) Financial plan (maximum score 24);
e) Implementation capability (maximum score 16).
2. For projects using sources outside the science and technology affairs budget, the leading organization or funding organization may apply and adjust the evaluation criteria and scale according to the specific characteristics and requirements of each project.
Article 16. Selection Board 16. Direct assignment project selection board
1. The advisory selection board for direct assignment projects (hereinafter referred to as the selection board for direct assignment) shall be established by the Minister of Education and Training, with the task of advising the Minister on selecting and directly assigning organizations and individuals to implement projects. Each board shall only select and directly assign one project.
2. The selection board for direct assignment consists of seven or nine members, including a chairman, a secretary, two opposing committee members, and other members, among which:
a) Two-thirds of the members are reputable experts with relevant expertise and deep understanding of the specialized field of the project;
b) The remaining members are representatives of state management agencies, policy planning agencies, and organizations or individuals funding the implementation of the project or expected to benefit from the results of the project;
c) At least one member has previously participated in the determination council.
3. The Council only convenes when at least two-thirds of the members are present, including at least one review committee member, and there are complete written opinions from two review committee members.
3. The board shall convene only when at least two-thirds of its members are present, including at least one opposing committee member, and there are complete written opinions of two opposing committee members.
4. Members of the board shall independently review and score project applications according to the criteria and evaluation scales set forth in Article 15 of this Regulation and in the forms specified in Articles 9 and 11 of Circular No. 08/2017/TT-BKHCN dated June 26, 2017 (Form B2-2c-NXDA and Form B2-3c-ĐGDA).
5. Individuals registering as the principal of the project shall attend the meeting and present a summary of the project's outline before the board, answering questions posed by board members (if any).
6. The board shall hold a closed session to evaluate project applications: discussing and scoring the applications independently (without the participation of individuals registered as the principal, project implementers, and representatives of organizations registered as the principal).
7. In necessary cases, the Ministry of Education and Training may invite external experts familiar with the project's field to review and re-evaluate the application.
8. For projects using non-budgetary science and technology funds, the Minister of Education and Training shall assign the head of the organization responsible for the project or the funding organization to establish and convene the selection board for direct assignment.
Article 17. Results of the Selection Board for Direct Assignment
1. The result of the project application evaluation is the average score of the board members present at the meeting.
2. A project application will be recommended for implementation if it achieves the highest score among participating applications and reaches a minimum of 70 out of 100 points, with no board member present giving zero points for the criteria listed in point a, b, c of Clause 1, Article 15 of this Regulation.
3. The evaluation result of the project application, conclusions, and recommendations for improvements to perfect the application shall be recorded in the minutes of the selection board for direct assignment meeting (Model I-7 Appendix).
Article 18. Review Content and budget of the project
1. Based on the results of the selection board for direct assignment meeting, the Minister of Education and Training shall establish a review team for the content and budget of the project implementation (hereinafter referred to as the review team).
2. The review team consists of five or seven members, including one team leader and at least two members who have participated in the selection board for direct assignment. Members of the review team are representatives of state management agencies on science and technology; planning and finance; organizations or individuals funding the project or expected to benefit from the results of the project.
3. Organizations or individuals registering to lead the implementation of the project are responsible for revising and perfecting the application according to the conclusions of the selection board for direct assignment and submitting it to the Ministry of Education and Training within the time frame and address published on the Ministry’s website and/or by sending it to relevant units in writing.
4. The reviewed project application submitted to the Ministry of Education and Training includes one original copy submitted directly or sent by post and one electronic copy of the application (in PDF format). The reviewed project application includes the following documents:
a) The project application as stipulated in Clause 1, Article 14 of this Regulation, supplemented and revised according to the conclusions and recommendations of the selection board for direct assignment, accompanied by the meeting minutes;
b) An explanatory document confirmed by the organization registering as the principal and the chairman of the board (or one opposing committee member of the selection board for direct assignment);
c) Quotation of raw materials, machinery, and equipment used (within thirty days from the date of submission of the reviewed application) to prepare the project budget.
5. The review result of the project, conclusions, and recommendations for improvements to perfect the application shall be recorded in the minutes of the review team meeting (Model I-8 Appendix).
6. For projects using non-budgetary science and technology funds, the Minister of Education and Training shall assign the head of the organization leading the project or the funding organization to establish and convene the review team.
Article 19. Decision on Project Assignment
1. Based on the results of the project review, the Minister of Education and Training decides to assign organizations or individuals to be in charge of implementing the project and notifies the organization in charge of the project, while also announcing it on the Ministry's electronic information website.
2. Organizations or individuals in charge of implementing the project are responsible for revising and completing the project dossier according to the conclusions of the Review Team and submitting it to the Ministry of Education and Training for approval within the time limit and address published on the Ministry's electronic information website. The project dossier submitted to the Ministry of Education and Training includes five original copies.
Chapter III
IMPLEMENTATION AND MONITORING OF PROJECT IMPLEMENTATION
AND MONITOR THE IMPLEMENTATION OF THE PROJECT
Article 20. Contract for Project Implementation
1. The Minister of Education and Training assigns the head of the organization in charge of the project to sign a project implementation contract (Model I-9 Appendix) with the project leader. The organization in charge sends one copy of the contract (original) back to the Ministry of Education and Training for monitoring and management.
2. In cases where the project is adjusted, the project adjustment document is part of the project implementation contract.
Article 21. Report on Project Implementation Status
1. The project leader reports the status of project implementation annually to the organization in charge.
2. The organization in charge reports to the Ministry of Education and Training on the status of project implementation before December 31 each year (Model II-1 Appendix).
3. In exceptional cases, the organization in charge and the project leader report the status of project implementation as required by the Ministry of Education and Training.
Article 22. Monitoring of Project Implementation Status
1. The Ministry of Education and Training organizes regular annual or ad hoc monitoring of the status of project implementation.
2. The head of the organization in charge monitors the status of project implementation regularly annually.
3. The content of the monitoring includes the progress of implementation, research content, products, and the use of project funds compared to the approved project description.
4. The results of the monitoring serve as the basis for considering the continuation of project implementation, project adjustments, and funding allocation.
5. The minutes of the monitoring of the status of project implementation (Model II-2 Appendix) are kept by the organization in charge, the Ministry of Education and Training, and the organization or individual providing project funding.
6. For projects using sources outside the science and technology public service budget, the Minister of Education and Training assigns the head of the organization in charge of the project or the organization providing funding to organize regular annual monitoring of the status of project implementation.
Article 23. Adjustment and Supplement to the Project, supplement the project
1. When an adjustment is needed, the organization in charge of the project submits a proposal letter along with the adjusted project document (Model II-3 Appendix) to the Ministry of Education and Training. The Ministry of Education and Training approves based on reviewing the project dossier or monitoring the status of project implementation.
2. Adjustments to the project implementation period must be made at least one month before the end of the contract term, can only be done once, and cannot exceed twelve months.
3. Changes to the project leader may be made in the following cases: the project leader goes for long-term study or work abroad for more than six months; suffers from illness (confirmed by a competent health authority) and is unable to manage research activities; violates financial management principles; fails to complete the project content schedule without a valid reason or violates the law requiring suspension of duties. The new project leader must meet the requirements set out in Clause 2 of Article 10 of this Regulation.
4. In cases where the project product needs to be adjusted, the opinion of the Selection Committee and the direct project assignment committee is required.
5. Project adjustments shall not change the project objectives.
6. For projects using sources outside the science and technology public service budget, the Minister of Education and Training assigns the head of the organization in charge of the project or the organization providing funding to approve project adjustments (if any) and report to the Ministry of Education and Training in the annual report.
Article 24. Liquidation of Projects, Termination of Project Implementation Contracts
1. The liquidation of a project shall be carried out if any of the following circumstances occur:
a) There is a request for liquidation from the leading organization of the project;
b) There is a conclusion from the inspection by the Ministry of Education and Training recommending liquidation;
c) The evaluation result of the project assessment council at the basic level is "unsatisfactory";
d) The implementation period has exceeded six months without any reason.
2. The project liquidation council shall be established by the Minister of Education and Training, consisting of seven or nine members, including a chairman, secretary, and other members. Members of the council are representatives of state management agencies on science and technology, planning and finance, the leading organization of the project, individuals or units providing funding for the project's implementation, and scientists in the research field of the project (Model II-4 and II-5 Appendix).
3. Based on the results of the project liquidation council meeting, the Minister of Education and Training shall instruct the head of the leading organization of the project to sign the Minutes of the project implementation contract liquidation with the project leader (Model III-8 Appendix).
4. For projects using sources outside the budget for scientific and technological affairs, the Minister of Education and Training shall instruct the head of the leading organization of the project or the funding organization to establish and convene the project liquidation council.
Chapter IV
EVALUATION AND ACCEPTANCE OF PROJECT IMPLEMENTATION RESULTS
Article 25. Organization of Evaluation and Acceptance of Project Results
1. At the end of the project, it must be evaluated and accepted at two levels: the basic level and the ministry level.
a) The evaluation and acceptance at the basic level shall be conducted through the Scientific Council for Evaluation and Acceptance at the Basic Level (hereinafter referred to as the Basic Level Acceptance Council) implemented by the leading organization of the project;
b) The evaluation and acceptance at the ministry level shall be conducted through the Scientific Council for Evaluation and Acceptance at the Ministry Level (hereinafter referred to as the Ministry Level Acceptance Council).
The evaluation and acceptance of project results at the ministry level shall only be conducted for projects ranked "satisfactory" by the Basic Level Acceptance Council.
2. Principles of Evaluation and Acceptance of Project Results:
a) Based on the signed contract and the evaluation criteria set forth in Clause 1 of Article 28 (for the basic level) and Article 33 (for the ministry level) of this Regulation;
b) Ensuring democracy, objectivity, honesty, and accuracy.
Article 26. Documentation for Evaluation and Acceptance at the Basic Level
1. Documentation for evaluation and acceptance at the basic level includes:
a) A comprehensive report on the project results (Model II-6 Appendix) and a summary of the project results (Model II-7 Appendix);
b) Scientific and technological products of the project in accordance with the quantity and quality stipulated in the contract;
c) The contract and project proposal;
d) Report on the final settlement of the project support funds (Model II-8 Appendix).
2. Deadline for submission of documentation and organization of evaluation and acceptance at the basic level
a) Not later than thirty days before the end date of the project as recorded in the contract or adjustment document extending the implementation time (if applicable), the project leader is responsible for submitting one set of basic level evaluation and acceptance documentation (original copy) and one electronic version of the documentation (PDF format) to the leading organization.
b) The organization of evaluation and acceptance at the basic level must be completed before the end date of the project as recorded in the contract or adjustment document extending the implementation time (if applicable).
Article 27. The Project Acceptance Committee at the Basic Level
1. The Project Acceptance Committee at the Basic Level shall have the duty to advise the head of the project's leading organization in assessing the project results against the contract and any agreed-upon or adjusted documents (if applicable).
2. The leading organization shall establish the Project Acceptance Committee at the Basic Level and organize the basic-level acceptance process.
3. The Project Acceptance Committee at the Basic Level shall consist of seven or nine members including the chairperson, secretary, two opposing members, and other members. The number of individuals from the project's leading organization participating in the Committee shall not exceed one-third of the total number of Committee members. The project leader and individuals directly implementing the project shall not participate in the Committee.
4. The project leader shall attend and explain issues related to the implementation results of the project during the Committee meeting.
5. The Committee shall convene in closed session (without the participation of the project leader and project implementers): discussing, commenting, and evaluating the project implementation results according to the evaluation criteria specified in Model III-1 of the Appendix.
6. The project evaluation results, conclusions, and recommendations shall be recorded in the minutes of the Project Acceptance Committee at the Basic Level meeting (Model III-2 of the Appendix), specifying in detail the contents that need to be revised and supplemented to complete the project.
Article 28. Criteria for Basic-Level Evaluation and Project Classification
1. Criteria for Basic-Level Evaluation on Project Results:
a) Organization of project implementation;
b) Completeness in quantity, volume, and type of main scientific and technological products of the project compared to the quantity, volume, and type of products registered in the Project Description and contract;
c) Degree of technological completion, quality, and scientific requirements achieved by the main products of the project compared to the contract (through technical documents, product quality, production scale...);
d) Quality of the comprehensive report on project results and related documents (design documents, technical documents, intermediate products, cited documents...).
2. Project Classification:
The Project Acceptance Committee at the Basic Level shall classify the project into one of two levels: "satisfactory" or "unsatisfactory".
a) The level "satisfactory" if the project receives at least two-thirds of the votes of the Committee members present who assess that it has basically completed the requirements set forth in Clause 1 of this Article;
b) The level "unsatisfactory" if the project does not receive two-thirds of the votes of the Committee members present who assess that it has basically completed the requirements set forth in Clause 1 of this Article. In cases where the Committee classifies the project as "unsatisfactory," it is necessary to clearly identify the contents and tasks that have been implemented in accordance with the contract for the Ministry of Education and Training to consider and handle in accordance with the provisions of the law.
Article 29. Handling and Reporting on Basic-Level Evaluation Results
1. For projects evaluated at the level "satisfactory" by the Committee, within thirty days from the date of the evaluation results, the project leader shall be responsible for completing the dossier in accordance with the Committee's conclusions.
2. The leading organization shall cooperate with the Committee chairperson to supervise and confirm the completion of the dossier to prepare for the ministry-level evaluation and acceptance.
3. For projects evaluated at the level "unsatisfactory" by the Committee, the leading organization shall report to the Ministry of Education and Training for handling in accordance with Article 24 of these Regulations.
Article 30. Dossier for Ministry-Level Evaluation and Acceptance
1. The dossier for ministry-level evaluation and acceptance includes:
a) A letter requesting evaluation and acceptance from the project's leading organization sent to the Ministry of Education and Training (Model III-4 of the Appendix);
b) The basic-level evaluation and acceptance dossier as stipulated in Clause 1 of Article 26 of these Regulations, which has been supplemented and completed according to the requirements of the Project Acceptance Committee at the Basic Level;
c) The decision establishing the Committee and the minutes of the Project Acceptance Committee at the Basic Level meeting;
d) An explanation of the completed evaluation and acceptance dossier, confirmed by the head of the project's leading organization and the chairperson of the Project Acceptance Committee at the Basic Level (Model III-3 of the Appendix).
2. Time limit for submitting the dossier and organizing the ministry-level evaluation and acceptance
a) Within forty-five days from the date of the conclusion of the Project Acceptance Committee at the Basic Level, the project's leading organization shall be responsible for submitting the dossier for ministry-level evaluation and acceptance to the Ministry of Education and Training;
b) Within ten days from the date of receipt of the dossier for ministry-level evaluation and acceptance, the Ministry of Education and Training shall check and confirm the completeness and validity of the dossier in accordance with the regulations or request the project leader and the project's leading organization to supplement and complete the dossier (if necessary). The maximum time for supplementing and completing the dossier (if any) is ten days;
c) Within sixty days from the date of receipt of a valid evaluation dossier, the Ministry of Education and Training shall complete the organization of the ministry-level evaluation.
Article 31. Ministry-level Acceptance Council
1. The Ministry-level Acceptance Council shall have the duty to advise the Minister of Education and Training on evaluating the project results in accordance with regulations. In cases where necessary, the Chairman of the Council may propose the establishment of a Specialized Expert Group to inspect and verify the reliability and authenticity of the project products as required by the Council.
2. The Ministry-level Acceptance Council and the Specialized Expert Group (if established) shall be decided upon by the Minister of Education and Training for establishment.
a) Members of the institutional-level Acceptance Council may participate in the Ministry-level Acceptance Council but not more than two members, including the Chairman and the Reviewer Member of the institutional-level Acceptance Council who shall not serve as the Chairman or Reviewer Member of the Ministry-level Acceptance Council.
b) The Project Leader and individuals involved in implementing the project shall not participate in the Council.
3. The Ministry-level Acceptance Council shall consist of seven or nine members, including the Chairman, Secretary, two Reviewer Members, and other Members, among which:
a) Two-thirds of the members shall be scientific and technological experts with relevant expertise in the research field of the project;
b) The remaining members shall be economic and management experts representing production and business organizations capable of applying the research outcomes of the project, administrative agencies, and other related organizations;
c) At least two-thirds of the Council members must be staff outside the leading organization of the project;
d) Experts, particularly Reviewer Members of the Council identified or selected directly by the Council, shall be prioritized for participation in the Council.
Article 32. Organizing Meetings of the Ministry-level Acceptance Council
1. The Ministry of Education and Training shall assign the leading organization of the project or the funding organization to organize meetings of the Ministry-level Acceptance Council.
2. The Ministry-level Acceptance Council must convene within forty-five days from the date of the decision establishing the Council.
3. The Council shall only convene if at least two-thirds of its members are present, including the Chairman, Secretary, and two Reviewer Members.
4. The project leader shall attend and explain issues related to the implementation results of the project during the Committee meeting.
5. The Council shall hold closed meetings (without the presence of the Project Leader and project implementation members): discussing, commenting, assessing, and independently scoring the project results (Model III-5 and III-6 Appendix).
6. The assessment results, conclusions, and recommendations shall be recorded in the minutes of the Ministry-level Acceptance Council meeting (Model III-7 Appendix).
Article 33. Criteria for Evaluating Project Results at the Ministry Level
1. Project results shall be evaluated by scoring according to a 100-point scale based on the following criteria groups (Model III-6 Appendix):
a) Organization of project implementation (maximum score 15);
b) Completeness of quantity, volume, and types of main scientific and technological products of the project compared to those registered in the Project Description and Contract (maximum score 25);
c) Degree of technological completion, quality, and scientific requirements achieved by the main products of the project compared to the Contract (through technical documents, product quality, production scale) (maximum score 30);
d) Quality of the comprehensive report on project results and accompanying documents (design documents, technical documents, intermediate products, cited documents...) (maximum score 10);
đ) Registration of industrial property rights, intellectual property rights for plant varieties (maximum score 5);
e) Quality of products, scientific level of products exceeding the registration level compared to the Contract or having significant scientific and technological significance (maximum score 5);
g) Impact on economy, society, and environment (maximum score 10).
2. For projects using sources outside the science and technology affairs budget, the leading organization or funding organization may apply and adjust the evaluation criteria and scale according to the specific characteristics and requirements of each project.
Article 34. Principles for Evaluating and Classifying Project Results
1. Principles for Evaluation and Scoring
a) The evaluation and scoring of project results shall be based on the criteria set forth in Clause 1 of Article 33 of this Regulation;
b) A valid evaluation form is one that scores equal to or lower than the maximum points stipulated for each evaluation criterion; in cases where the criterion regarding registration for protection of industrial property rights and intellectual property rights for plant varieties mentioned in Point d, Clause 1 of Article 33 of this Regulation does not have points, the project result will not be classified as "excellent";
c) The evaluation score of the project is the average of the total points recorded on valid evaluation forms of the members present at the Council meeting.
2. Classification of Project Results
Based on the project scoring results, the Ministry-level Acceptance Council classifies the project according to the following levels:
a) Level "Excellent": The project has an evaluation score from 90 to 100 points, with a total score of at least 70 points for the criteria mentioned in Points a, b, and c of Clause 1 of Article 33 of this Regulation;
b) Level "Pass": The project has an evaluation score from 70 to less than 90 points, with a total score of at least 60 points for the criteria mentioned in Points a, b, and c of Clause 1 of Article 33 of this Regulation;
c) Level "Fail": The project has an evaluation score below 70 points or a total score of less than 60 points for the criteria mentioned in Points a, b, and c of Clause 1 of Article 33 of this Regulation.
Article 35. Handling and Reporting of Ministry-level Evaluation Results
1. For projects classified at level "Pass" or higher, within thirty days from the date of the ministry-level evaluation results, the project leader completes the dossier according to the Council's conclusions and submits it to the Ministry of Education and Training.
a) The project leader and the main organizing entity submit one original set of the completed project confirmation dossier (original) and one electronic copy of the dossier (PDF format) to the Ministry of Education and Training.
b) The completed project confirmation dossier includes:
- Minutes of the Ministry-level Acceptance Council meeting;
- An explanation of the completion of the ministry-level acceptance and evaluation dossier, confirmed by the Chairman of the Ministry-level Acceptance Council and the main organizing entity (Model III-3 Appendix);
- A comprehensive report on the completed project results according to the Council's acceptance and evaluation opinions.
c) The main organizing entity and the project leader implement the registration and retention of project results according to current regulations and submit a confirmation of the registration and retention of project results to the Ministry of Education and Training.
2. In cases where the project is classified at level "Fail", the Ministry of Education and Training handles the matter based on the Council's conclusions, in accordance with relevant laws.
Article 36. Handling Assets and Liquidation of Project Implementation Contracts
1. The Minister of Education and Training instructs the head of the main organizing entity of the project to sign a liquidation agreement for the implementation contract with the project leader (Model III-8 Appendix).
2. The main organizing entity sends one copy of the liquidation agreement for the implementation contract to the Ministry of Education and Training for monitoring and management.
3. Assets formed from state budget funds when the project ends are managed and disposed of according to the laws governing the management and use of public assets./.
