Regulations on the classification of institutional sectors to be applied in Vietnam's statistics
Pursuant to the Law on Statistics No. 89/2015/QH13 dated November 23, 2015;
Pursuant to Decree No.Decision No. 94/2016/NĐ-CP July 1, 2016 Government Decree detailing and guiding the implementation of certain provisions of the Statistics Law;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." This Circular stipulates the classification of institutional sectors to be applied in Vietnam's statistics, including:of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsa) The list of classifications of institutional sectors to be applied in Vietnam's statistics as specified in Appendix I attached hereto;

b) The content of the classification of institutional sectors to be applied in Vietnam's statistics as specified in Appendix II attached hereto.
Article 1. Scope of Regulation and Applicability
2. This Circular applies to agencies, organizations, and individuals providing, producing, and using statistical information on institutional sectors to be applied in Vietnam's statistics.
1. An institutional sector entity (referred to as an institutional sector entity) is an economic entity with ownership rights over goods or assets, capable of incurring liabilities, and participating in economic activities and transactions with other economic entities. An institutional sector entity typically has the following main attributes: (i) ownership rights over goods or assets that can be exchanged through transactions with other institutional sector entities; (ii) the ability to make economic decisions, participate in economic activities, and bear legal responsibility for such activities; (iii) the capacity to incur liabilities, fulfill obligations, and enter into economic contracts; (iv) a complete accounting system or the ability to establish accounting records if required.
2. An institutional sector (institutional sector) is a collection of institutional sector entities with similar functions, business purposes, structural characteristics, economic roles, and operational methods.
3. Six institutional sectors of Vietnam:
Article 2. Interpretation of Terms
- Non-financial institutional sector;
- Financial institutional sector;
- General government institutional sector;
- Household institutional sector;
- Non-profit serving households institutional sector;
- Extra-territorial institutional sector.
Article 3. Principles for establishing institutional sectors in Vietnam
- Ensuring comprehensive coverage of all institutional sector entities in Vietnam;
- Ensuring feasibility in the process of collecting and calculating statistical indicators;
- Avoiding duplication: each institutional sector entity shall only be classified into one institutional sector; - Aligning with statistical practice and ensuring international comparability;
- Flexibility and consistency in classifying institutional sector entities.
1. The Ministry of Planning and Investment (General Statistics Office) shall take the lead and coordinate with relevant agencies:
a) Collecting and compiling statistical information related to institutional sectors in Vietnam to ensure the provision of statistical data in accordance with this Circular;
b) Guiding relevant units to implement the classification of institutional sectors in Vietnam as prescribed;
Article 4. Organization of Implementation
c) Applying information technology in statistical activities using the classification of institutional sectors to be applied in Vietnam's statistics.
2. Ministries, ministerial-level agencies, governmental agencies, Supreme People's Court, Supreme People's Procuracy, and relevant agencies shall produce, provide, and uniformly use statistical information on institutional sectors according to the provisions of this Circular.
1. This Circular takes effect from May 10, 2020.
2. During implementation, if there are any difficulties, agencies and units are requested to send their opinions to the Ministry of Planning and Investment (General Statistics Office) for research, amendment, and supplementation./.
2. The ministries, ministerial-level agencies, agencies under the Government, the Supreme People's Court, the Supreme People's Procuracy, and related agencies shall base their actions on the classification of the institutional sectors of Vietnam production, provide information, and uniformly apply the scope relevant to the statistical institutional sectors as prescribed in this Circular.
Article 5. Effective Date
1. This Circular takes effect from May 10, 2020.
2. During implementation, if there are any difficulties, the agencies and units are requested to send their comments to the Ministry of Planning and Investment (General Statistics Office) for research and amendment./.
