CIRCULAR

Regulations on job code, occupational standards, and appointment and classification of salary for teaching civil servants in public primary schools and appoint, set salary

civil servants teaching in public primary schools 

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage system for cadres, civil servants, public employees, and armed forces; and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage system for cadres, civil servants, public employees, and armed forces;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular regulating job codes, occupational standards, and appointment and classification of salary for teaching civil servants in public primary schools.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates job codes, occupational standards, and appointment and classification of salary for teaching civil servants in public primary schools.

Article 2. This Circular applies to teaching civil servants delivering the primary education program, including teachers, principals, deputy principals (hereinafter referred to collectively as primary school teachers) in primary schools, general education schools with multiple levels including primary level, specialized public schools, and other educational institutions delivering the primary education program (hereinafter referred to collectively as public primary schools), and other organizations and individuals related thereto.

Article 3. Private primary schools may apply the provisions of this Circular in recruiting, using, and managing teachers.

Article 2. Job Code and Rank of Primary School Teacher

The occupational title of primary school teacher includes:

1. Primary School Teacher Rank III - Job Code V.07.03.29.

2. Primary School Teacher Rank II - Job Code V.07.03.28.

3. Primary School Teacher Rank I - Job Code V.07.03.27.

Chapter II

OCCUPATIONAL STANDARDS

Article 3. Primary School Teacher Rank III - Job Code V.07.03.29

1. Tasks

a) Develop teaching and student education plans; participate in developing teaching and student education plans of subject departments according to the primary education program's objectives;

b) Implement the primary general education program and the school's education plan;

c) Apply teaching methods and education approaches aimed at developing students' qualities and abilities; participate in identifying and nurturing gifted students; participate in applied pedagogical research and making teaching aids and equipment for primary education;

d) Complete all required professional training courses as stipulated; engage in self-study and skill enhancement to improve political, professional, and vocational competence; participate in professional activities as required; participate in universal education, compulsory education, and literacy programs, and inclusive education;

đ) Coordinate with parents and social forces in educating students; implement counseling for primary school students;

e) Fulfill other tasks assigned by the principal.

2. Professional ethics standards

a) Adhere to the Party's policies, State laws, and regulations of the education sector and localities regarding primary education;

b) Continuously cultivate morality, demonstrate high sense of responsibility, maintain the quality, honor, and reputation of educators; set a good example for students;

c) Love, treat students fairly and respect their personalities; protect their legitimate rights and interests; unite and help colleagues;

d) Strictly comply with regulations on educator ethics; rules on behavior, conduct, and attire;

3. Educational and Training Standards

a) Hold a bachelor's degree or higher in teacher training for primary school teachers;

In cases where subjects lack primary school teachers with a bachelor's degree in teacher training, they must have a bachelor's degree in a relevant field and a certificate of professional training for primary school teachers according to the program issued by the Minister of Education and Training;

b) Hold a certificate of training according to the occupational standards of primary school teacher rank III (for newly recruited primary school teachers at rank III, they must obtain the certificate within 36 months from the date of recruitment);

Article 4. Professional Competence Standards

a) Understand the policies, laws, regulations, and requirements of the Party, State, sector, and locality regarding primary education and implement them in assigned tasks;

b) Ensure the quality of teaching and education according to the education program and school's education plan;

c) Apply knowledge of education and age-specific psychology to practical student education;

d) Possess the ability to apply teaching and education methods that develop students' qualities and abilities;

đ) Possess the ability to coordinate with colleagues, parents, and the community to enhance the effectiveness of student education;

e) Engage in continuous self-study and professional development to enhance personal professional capabilities; know how to apply the results of applied pedagogical research to actual teaching and education; guide students to make teaching aids themselves;

g) Possess the ability to apply information technology in performing the duties of primary school teacher rank III and possess the ability to use foreign languages or ethnic minority languages in specific tasks assigned.

Article 4. Primary School Teacher Grade II - Code: V.07.03.28

1. Tasks

In addition to the duties of a Primary School Teacher Grade III, a Primary School Teacher Grade II must perform the following tasks:

a) Serve as a reporter or demonstrate teaching at primary school teacher training classes or trial new models and methods from the school level upwards;

b) Lead content for teacher training and subject-specific professional activities at the department or faculty level; participate in evaluating and reviewing applied pedagogical research topics of colleagues from the school level upwards;

c) Participate in the judging panel for primary school teacher excellence competitions, class teacher excellence competitions, and Ho Chi Minh Youth Vanguard Team head teacher excellence competitions from the school level upwards; carry out the tasks of a core primary school teacher;

d) Engage in other professional activities such as educational quality assessment, professional inspection, and supervision from the school level upwards; participate in guiding and assessing student teaching internships (if applicable);

2. Professional ethics standards

Besides the professional ethics standards of a Primary School Teacher Grade III, a Primary School Teacher Grade II must always set a good example in implementing regulations on teacher ethics;

3. Educational and Training Standards

a) Hold a bachelor's degree or higher in teacher training for primary school teachers;

In cases where subjects lack primary school teachers with a bachelor's degree in teacher training, they must have a bachelor's degree in a relevant field and a certificate of professional training for primary school teachers according to the program issued by the Minister of Education and Training;

b) Hold a certificate for training according to the job title standards for a Primary School Teacher Grade II;

Article 4. Professional Competence Standards

a) Be thoroughly familiar with the Party's policies, State laws, regulations, and requirements of the education sector and locality regarding primary education and effectively implement them in assigned tasks;

b) Effectively implement educational plans and programs; proactively and flexibly adjust teaching and educational plans to suit the actual conditions of the school and locality;

c) Possess the ability to flexibly apply and guide colleagues to update and incorporate new educational knowledge and age-appropriate psychology into practical student education; take responsibility for the implementation of professional tasks (educational content, methods, student assessment) and the quality and effectiveness of education for each student in their class;

d) Actively collaborate with colleagues, parents, and the community to enhance student education effectiveness;

e) Apply research results in practical teaching and education; have the ability to evaluate or guide colleagues in producing applied pedagogical research products from the school level upwards;

f) Possess the ability to perform professional tasks: participate in judging panels, inspections, and assessments; develop and implement teaching topics;

g) Possess the ability to apply information technology in performing tasks of a Primary School Teacher Grade II and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

h) Be recognized as a grassroots labor model; or be awarded commendations or certificates of merit from the district level upwards; or be recognized as achieving one of the titles: excellent primary school teacher, excellent class teacher from the school level upwards, excellent Ho Chi Minh Youth Vanguard Team head teacher from the district level upwards;

i) A civil servant participating in the examination or evaluation for promotion to the job title of Primary School Teacher Grade II (code V.07.03.28) must have held the job title of Primary School Teacher Grade III (code V.07.03.29) or equivalent for at least nine years (excluding probationary period), calculated up to the deadline for submitting registration forms for the examination or evaluation for promotion.

Article 5. Primary School Teacher Grade I - Code: V.07.03.27

1. Tasks

In addition to the duties of a Primary School Teacher Grade II, a Primary School Teacher Grade I must perform the following duties:

a) Participate in editing, compiling, and developing programs and materials for teacher and student training at primary schools, or participate in the Textbook Selection Council when selected;

b) Lead activities for teacher training and specialized subject discussions at the school, or participate in evaluating and reviewing research topics in applied pedagogy from the district level upwards;

c) Participate in external evaluation teams or join inspection and supervision teams for primary school teachers' professional tasks from the district level upwards;

d) Participate in the judging panel for the Excellent Primary School Teacher Competition or the Excellent Primary School Class Teacher Competition or the Excellent Ho Chi Minh Youth Pioneer Team Leader Competition from the district level upwards.

2. Professional ethics standards

In addition to the ethical standards of a Primary School Teacher Grade II, a Primary School Teacher Grade I must be a model in terms of teacher ethics and encourage and support colleagues to comply with teacher ethical regulations.

3. Educational and Training Standards

a) Hold a master's degree or higher in teacher education for primary schools, or hold a master's degree or higher in a relevant field corresponding to the subject taught, or hold a master's degree or higher in educational management;

b) Hold a certificate in training according to the job title standards for Primary School Teacher Grade I.

Article 4. Professional Competence Standards

a) Actively and proactively implement and promote, guide colleagues to implement Party policies, State laws, and regulations and requirements of the industry and locality regarding primary education in assigned tasks;

b) Be proactive, flexible, and creative in implementing educational plans to suit students, schools, and localities; support colleagues in effectively carrying out teaching and educational plans;

c) Actively and proactively share experiences, guide, and support colleagues, parents of students, and the community to enhance the effectiveness of student education;

d) Have the ability to evaluate or guide colleagues in producing applied pedagogical research products from the district level upwards;

đ) Have the ability to apply information technology in performing the duties of a Primary School Teacher Grade I and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

e) Be recognized as a Model Worker at the ministry/bureau/sector/provincial level or higher; or receive commendation at the provincial level or higher; or be recognized as achieving one of the titles: Excellent Primary School Teacher, Excellent Primary School Class Teacher, Excellent Ho Chi Minh Youth Pioneer Team Leader from the district level upwards;

g) A staff member participating in the examination or assessment for promotion to the job title of Primary School Teacher Grade I (code V.07.03.27) must have held the job title of Primary School Teacher Grade II (code V.07.03.28) or equivalent for at least six years, calculated up to the deadline for submitting the application registration form for the examination or assessment for promotion.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES

Article 6. Principles for Appointment Based on Job Title for Primary School Teachers

1. The appointment of job titles for primary school teachers as stipulated in this Circular must be based on the current position being held and ensure compliance with the standards set forth in Article 3, Article 4, Article 5, and Article 7 of this Circular.

2. When appointing primary school teachers from the job title of primary school teacher as prescribed in Joint Circular No. 21/2015/TTLT-BGDĐT-BNV dated September 16, 2015, issued by the Ministry of Education and Training and the Ministry of Home Affairs, which stipulates the code, standards for the job title of public primary school teachers (hereinafter referred to as Joint Circular No. 21/2015/TTLT-BGDĐT-BNV), to the job title of primary school teacher as prescribed in this Circular, there shall be no combination of job title promotion.

3. The appointment to a higher job title category than the job title category already won through recruitment shall not be based on the level of education obtained for newly recruited primary school teachers.

Article 7. Cases for appointment to the position of primary school teacher

1. Civil servants who have been appointed to the ranks of primary school teacher positions according to Circular Joint Circular No. 21/2015/TTLT-BGDĐT-BNV if they meet the criteria for the rank of primary school teacher as stipulated in this Circular shall be appointed to the rank of primary school teacher as follows:

a) Primary school teachers of Rank IV (code V.07.03.09) shall be appointed to the position of primary school teacher of Rank III (code V.07.03.29);

b) Primary school teachers of Rank III (code V.07.03.08) shall be appointed to the position of primary school teacher of Rank III (code V.07.03.29);

c) Primary school teachers of Rank II (code V.07.03.07) shall be appointed to the position of primary school teacher of Rank II (code V.07.03.28).

2. Primary school teachers of Rank II (code V.07.03.28) shall be appointed to the position of primary school teacher of Rank I (code V.07.03.27) when determined to be successful candidates in the promotion examination for the rank of primary school teacher.

3. Primary school teachers of Rank II (code V.07.03.07) who have not met the corresponding criteria as stipulated in Clause 1, Article 4 of this Circular shall be appointed to the position of primary school teacher of Rank III (code V.07.03.29).

4. Newly recruited primary school teachers who have completed their probation period as prescribed and have been evaluated by the head of the public service unit as meeting the requirements shall be appointed to the appropriate rank of primary school teacher position they were successful in.

Article 8. Salary Classification

1. Civil servants appointed to the positions of primary school teachers as prescribed in this Circular shall apply the corresponding salary scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel, specifically as follows:

a) Primary school teachers of Rank III, code V.07.03.29, shall apply the salary coefficient of Category A1 public officials, from coefficient 2.34 to coefficient 4.98;

b) Primary school teachers of Rank II, code V.07.03.28, shall apply the salary coefficient of Category A2 public officials, Group A2.2, from coefficient 4.00 to coefficient 6.38;

c) Primary school teachers of Rank I, code V.07.03.27, shall apply the salary coefficient of Category A2 public officials, Group A2.1, from coefficient 4.40 to coefficient 6.78.

2. The classification of salaries upon appointment to the rank of occupational title shall be implemented in accordance with the guidelines set out in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the classification of salaries upon promotion, transfer of grade, and change of category of civil servants and public officials, and in accordance with current laws. When implementing new wage policies, the transition to new wages shall be carried out in accordance with the provisions of the Government.

Chapter IV

IMPLEMENTING PROVISIONS

Article 9. Transitional Provisions

1. Primary school teachers of Rank IV (code V.07.03.09) who have not met the training standards for primary school teachers as stipulated in Point b, Clause 1, Article 72 of the Education Law 2019 shall retain code V.07.03.09 and apply the salary coefficient of Category B public officials (coefficient from 1.86 to 4.06) until they meet the training standards, at which point they may be appointed to the position of primary school teacher of Rank III (code V.07.03.29) or until retirement if they are not required to upgrade their training standards in accordance with Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government on the implementation timeline for upgrading the training standards of kindergarten, primary, and junior high school teachers.

2. Primary school teachers of Rank III (code V.07.03.08) who have not met the training standards for primary school teachers as stipulated in Point b, Clause 1, Article 72 of the Education Law 2019 shall retain code V.07.03.08 and apply the salary coefficient of Category A0 public officials (coefficient from 2.10 to 4.89) until they meet the training standards, at which point they may be appointed to the position of primary school teacher of Rank III (code V.07.03.29) or until retirement if they are not required to upgrade their training standards in accordance with Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government on the implementation timeline for upgrading the training standards of kindergarten, primary, and junior high school teachers.

3. In cases where primary school teachers of Rank II (code V.07.03.07) are appointed to the position of primary school teacher of Rank III (code V.07.03.29) due to not meeting the criteria for Rank II (code V.07.03.28) as stipulated in Clause 3, Article 7 of this Circular, once they meet the criteria for Rank II (code V.07.03.28), they may be appointed to the position of primary school teacher of Rank II (code V.07.03.28) without having to go through an examination or evaluation for promotion.

Article 10. Provisions on Application

1. Primary school teachers with a bachelor's degree shall be recognized as equivalent to the bachelor's degree specified in Point a, Clause 3, Article 3 and Point a, Clause 3, Article 4 of this Circular.

2. Teachers of Music, Fine Arts, Art, Physical Education, Health Education, and Foreign Languages from other educational levels who switch to teaching the primary education program shall be eligible for transfer to the position of primary school teacher in accordance with regulations.

3. In cases where primary school teachers take the examination or evaluation for promotion to the position of primary school teacher of Rank II (code V.07.03.28) and already hold a master's degree before recruitment, meet the training standard for primary school teachers of Rank II, and have held the position of primary school teacher of Rank III (code V.07.03.29) or equivalent for at least six years (excluding probationary period), calculated up to the deadline for submitting application forms for the examination or evaluation for promotion, they shall be deemed to meet the requirement for time in rank as stipulated in Point i, Clause 4, Article 4 of this Circular.

4. The time primary school teachers hold Rank II (code V.07.03.07) and equivalent, Rank III (code V.07.03.08) and equivalent shall be considered equivalent to the time holding Rank II, III as stipulated in this Circular.

5. Certificates for professional development according to the criteria for Rank II, Rank III as stipulated in Joint Circular No. 21/2015/TTLT-BGDĐT-BNV shall be recognized as equivalent to certificates for professional development according to the criteria for Rank II, Rank III as stipulated in this Circular.

6. The programs for vocational training according to the standards of the primary school teacher positions of Class II and Class III (announced together with Decision No. 2516/QD-BGDĐT dated July 22, 2016; Decision No. 2515/QD-BGDĐT dated July 22, 2016 of the Minister of Education and Training) shall continue to be implemented until replacement programs are available.

7. The requirement for certification of vocational training according to the standards of the primary school teacher position of Class III as stipulated in Point b, Clause 3, Article 3 of this Circular applies to primary school teachers recruited after this Circular takes effect and primary school teachers of Class III (code V.07.03.08) when appointed to the primary school teacher position of Class III (code V.07.03.29) as stipulated in Point b, Clause 1, Article 7 of this Circular.

8. For tasks assigned according to the primary school teacher position grades that public primary schools are not authorized to undertake or do not have the conditions to implement, the head of the public primary school shall report to the competent authority directly to decide on converting such tasks to related tasks.

Article 11. Implementation Organization

1. This Circular serves as the basis for determining job positions, the structure of staff members according to the primary school teacher position titles, and implementing the recruitment, utilization, and management of primary school teachers in public primary schools within the national education system. The Department of Teachers and School Management Staff shall take the lead and provide detailed guidance on the implementation of this Circular.

2. The heads of public primary schools who directly manage and utilize staff members shall be responsible for:

a) Developing the Job Position Plan; specifically determining the structure of staff members according to the primary school teacher position titles in accordance with the school's conditions and ensuring the implementation of plans and strategies for developing the teaching staff; reviewing the Job Position Plan, establishing the appointment plan for the primary school teacher position titles and salary grading for primary school teachers under their management authority; submitting to the competent authority for consideration and decision-making or deciding according to the delegated authority;

b) Reporting to the managing authority as prescribed the results of the appointment of primary school teacher position titles and salary grading for primary school teachers;

c) Developing plans for training and professional development for primary school teachers; creating conditions for primary school teachers to receive training and professional development to meet the standards of the primary school teacher position titles as prescribed by law;

d) Arranging and assigning tasks to primary school teachers based on the duties of the primary school teacher position grades, reasonably utilizing their capabilities, and enhancing the effectiveness of their work.

3. The heads of the competent authorities managing public primary schools shall be responsible for:

a) Approving the appointment plans for primary school teacher position titles and salary grading for primary school teachers in public primary schools under their jurisdiction; resolving issues within their authority during the process of appointing primary school teacher position titles and salary grading for primary school teachers in public primary schools under their jurisdiction;

b) Deciding according to their authority or delegating the decision-making for the appointment to the primary school teacher position grades and salary grading for primary school teachers in public primary schools within their authority;

c) Reporting the results of the appointment of primary school teacher position titles and salary grading for staff members who are primary school teachers in public primary schools under their jurisdiction to the competent authority as prescribed.

Article 12. Effectiveness and responsibility for implementation

1. This Circular takes effect from March 20, 2021.

2. The Director of the Office, the Director of the Department of Teachers and School Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training, and the Directors of Departments of Education, Science, and Technology in Bac Lieu Province are responsible for enforcing this Circular.

3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the new documents.

4. This Circular replaces Joint Circular No. 21/2015/TTLT-BGDĐT-BNV dated September 16, 2015 of the Ministry of Education and Training and the Ministry of Home Affairs regarding the codes and standards of the public primary school teacher position titles.

5. In the course of implementation, if there are any difficulties, they should be reported to the Ministry of Education and Training for review and resolution./.
