Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Circular No. 02/2022/TT-BTTTT dated May 16, 2022 of the Minister of Information and Communications stipulating the List of Products and Goods with Potential to Cause Safety Risks under the Management Responsibility of the Ministry of Information and Communications;
Pursuant to Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance stipulating the List of Goods for Import and Export of Vietnam;
At the proposal of the Director of the Science and Technology Department.
DECISION:
Article 1.
Amend certain HS codes in the List of Products and Goods with Potential to Cause Safety Risks under the Management Responsibility of the Ministry of Information and Communications issued pursuant to Circular No. 02/2022/TT-BTTTT dated May 16, 2022 of the Minister of Information and Communications, specifically:
1. Amend certain HS codes in the List of Products and Goods in the Telecommunications and Information Technology sector that must be certified and declared compliant as set out in Appendix I attached hereto.
2. Amend certain HS codes in the List of Products and Goods in the Telecommunications and Information Technology sector that must be declared compliant as set out in Appendix II attached hereto.
Article 2.
This Decision shall take effect from December 1, 2022.
Article 3.
The Head of the Office, the Director of the Science and Technology Department, the Heads of agencies and units under the Ministry of Information and Communications, and relevant organizations and individuals are responsible for implementing this Decision./.

Note:
(1) Explanation of some terms:
- E-UTRA FDD: fourth generation (4G) mobile information technology.
- W-CDMA FDD: third generation (3G) mobile information technology.
- GSM: second generation (2G and 2.5G) mobile information technology.
- Equivalent isotropic radiated power: English term Effective Isotropic Radiated Power (EIRP), which is the equivalent effective isotropic radiated power related to the transmitter power, cable loss, and antenna gain. 60 mW is equivalent to 17.78 dBm.
- 2.4 GHz band: defined in QCVN 54:2020/BTTTT, the frequency band from 2400 MHz to 2483.5 MHz.
- The 5 GHz band: the band specified in QCVN 65:2013/BTTTT and QCVN 65:2021/BTTTT, which includes three sub-bands: from 5150 MHz to 5350 MHz, from 5470 MHz to 5725 MHz, and from 5725 MHz to 5850 MHz.
(2) The environmental parameters here are: water level (applicable to water level sensors for monitoring and warning purposes, Harmonized System code 9015.10.90); air temperature (applicable to temperature sensors - Harmonized System code 9025.19.19), air humidity (applicable to humidity sensors - Harmonized System code 9025.80.00), smoke in the air (applicable to smoke detectors - Harmonized System code 9027.10.00), dust in the air (applicable to air dust sensors - Harmonized System code 9027.89.90).
