Rules on fire-fighting and rescue operations training work
in the People's Public Security Force

The Minister of Public Security promulgates this Circular stipulating rules on/training fire-fighting and rescue operations in the People's Public Security Force. This Circular stipulates the subjects, forms, contents, locations, programs, timeframes for training, personnel conducting training, exemptions and postponements from training, organization of training, inspection, and evaluation of results of fire-fighting and rescue operations training. Pursuant to the Law Amending and Supplementing Certain Provisions of the Fire Prevention and Fighting Law dated November 22, 2013 This Circular applies to officers and non-commissioned officers specializing in operations, officers and non-commissioned officers specializing in technical professions, non-commissioned officers and conscript soldiers (hereinafter collectively referred to as officers and soldiers), units and training institutions under the Fire Prevention and Rescue Police Force directly under the Ministry of Public Security and local public security organs.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. Funding for organizing fire-fighting and rescue operations training of local public security organs is allocated within the annual security expenditure budget assigned by the Ministry of Public Security to local public security organs and other lawful sources (if any).

Article 2. Applicability

2. Annually, based on the fire-fighting and rescue operations training plan, current state budget regulations, local public security organs prepare the budget, consolidate it into the annual budget of local public security organs; manage, use, and settle accounts according to state regulations and the Ministry of Public Security.

SUBJECTS, FORMS, CONTENTS, LOCATIONS, PROGRAMS, TIMES, PERSONNEL CONDUCTING TRAINING, EXEMPTIONS AND POSTPONEMENTS FROM FIRE-FIGHTING AND RESCUE OPERATIONS TRAINING

ANNEXED TO THIS CIRCULAR IS THE ATTACHED FORMS AND MODELS TO BE USED IN THE WORK OF FIRE FIGHTING AND RESCUE BUSINESS TRAINING, INCLUDING:

Article 5. Subjects and Forms of Training

1. Subjects of Training:

a) Heads and Deputy Heads of Provincial Public Security Fire Prevention and Rescue Police Departments (hereinafter referred to as provincial-level public security organs).

b) Chiefs and Deputy Chiefs of District, County, City, and Town Public Security Organs (hereinafter referred to as county-level public security organs) responsible for fire prevention and fighting and rescue operations.

c) Heads and Deputy Heads of specialized teams tasked with fire-fighting and rescue operations under the Provincial Public Security Fire Prevention and Rescue Police Department; Heads and Deputy Heads of Fire Prevention and Rescue Police Teams under county-level public security organs.

d) Personnel conducting fire-fighting and rescue operations training.

đ) Firefighters and rescue personnel.

e) Fire truck drivers, rescue vehicle drivers; boat, canoe, and motorboat drivers for fire-fighting and rescue operations.

Chapter II

2. Forms of Training:
a) Regular training is conducted daily during regular duty shifts at fire prevention and rescue police units, applicable to the subjects specified in points c, đ, and e of Clause 1 of this Article.

b) Periodic training is conducted once a year, applicable to the subjects specified in points a and b of Clause 1 of this Article; twice a year, applicable to the subjects specified in points c, đ, and e of Clause 1 of this Article.

c) Advanced training is conducted once a year, applicable to the subject specified in point d of Clause 1 of this Article; once every two years, applicable to the subjects specified in points a, b, and c of Clause 1 of this Article.

b) HEAD OF POLICE, VICE HEAD OF POLICE OF DISTRICT, COUNTY, CITY, TOWN UNDER PROVINCE (HEREINAFTER REFERRED TO AS DISTRICT POLICE) RESPONSIBLE FOR FIRE PREVENTION AND FIGHTING, RESCUE WORK.

c) HEAD OF TEAM, VICE HEAD OF TEAM OF SPECIALIZED TEAMS ASSIGNED TO PERFORM FIRE FIGHTING AND RESCUE TASKS UNDER THE FIRE PREVENTION AND FIGHTING, RESCUE DEPARTMENT; HEAD OF TEAM, VICE HEAD OF TEAM OF FIRE PREVENTION AND FIGHTING, RESCUE TEAM UNDER DISTRICT POLICE.

d) STAFF ENGAGED IN FIRE FIGHTING AND RESCUE BUSINESS TRAINING WORK.

đ) STAFF, SOLDIERS ENGAGED IN FIRE FIGHTING AND RESCUE.

e) FIRE TRUCK DRIVER, RESCUE TRUCK DRIVER; BOAT, CANOE, RIB FIRE FIGHTING AND RESCUE DRIVER.

2. TRAINING FORMS:

a) REGULAR TRAINING IS CONDUCTED DAILY IN THE STANDING SHIFT AT THE FIRE PREVENTION AND FIGHTING, RESCUE POLICE DEPARTMENT, APPLICABLE TO THE OBJECTS AS PROVIDED IN POINT c, đ, e OF CLAUSE 1 OF THIS ARTICLE.

b) PERIODIC TRAINING IS CONDUCTED ONCE A YEAR, APPLICABLE TO THE OBJECTS AS PROVIDED IN POINT a, b OF CLAUSE 1 OF THIS ARTICLE; TWICE A YEAR, APPLICABLE TO THE OBJECTS AS PROVIDED IN POINT c, đ, e OF CLAUSE 1 OF THIS ARTICLE.

c) ADVANCED TRAINING IS CONDUCTED ONCE A YEAR, APPLICABLE TO THE OBJECT AS PROVIDED IN POINT d OF CLAUSE 1 OF THIS ARTICLE; ONCE EVERY TWO YEARS, APPLICABLE TO THE OBJECTS AS PROVIDED IN POINT a, b, c OF CLAUSE 1 OF THIS ARTICLE.

Article 6. Training Content

1. Legal regulations, directives, and guidelines on firefighting and rescue operations.

2. Theory on individual techniques; tactics, techniques; firefighting formations, rescue formations; firefighting plans, rescue plans; management, storage, maintenance of firefighting equipment and rescue equipment.

3. Theory on firefighting command and rescue operations.

4. Physical training exercises.

5. Practical exercises on individual firefighting and rescue techniques.

6. Practical exercises on firefighting formations and rescue formations.

7. Practical exercises on firefighting and rescue techniques and tactics.

8. Practical exercises on operating, maintaining, and servicing firefighting and rescue equipment.

9. Driver training for firefighting vehicles and rescue vehicles; repair work on firefighting and rescue equipment.

Article 7. Training Locations and Personnel Involved in Training

1. Training Locations

a) Regular training is conducted at the location or headquarters of the Fire Prevention, Firefighting, and Rescue Police Unit.

b) Periodic training is conducted centrally at the training center or at the location or headquarters of the Fire Prevention, Firefighting, and Rescue Police Department under the provincial police force.

c) Advanced training is conducted centrally at the training centers of units under the Ministry of Public Security.

2. Personnel conducting firefighting and rescue training must have a fire prevention, firefighting, and rescue associate degree or higher and meet one of the following criteria:

a) At least three years of experience in research, advisory, or guidance work on firefighting and rescue operations or leadership positions at the department level or equivalent within the Fire Prevention, Firefighting, and Rescue Police Bureau.

b) Instructor or head of a specialized firefighting and rescue department at the Fire Academy.

c) At least three years of experience in firefighting and rescue operations or leadership positions at the team level or equivalent within the provincial police force.

Article 8. Training Programs and Duration

1. Regular training as stipulated in point c, Clause 2, Article 5 of this Circular shall be carried out as follows:

a) The subjects specified in point c, Clause 1, Article 5 of this Circular shall implement regular training programs according to the contents prescribed in Clauses 1, 2, 3, 4, 5, and 8 of Article 6 of this Circular.

b) The subjects specified in point đ, Clause 1, Article 5 of this Circular shall implement regular training programs according to the contents prescribed in Clauses 1, 2, 4, 5, 6, 7, and 8 of Article 6 of this Circular.

c) The subjects specified in point e, Clause 1, Article 5 of this Circular shall implement regular training programs according to the contents prescribed in Clauses 1, 2, 4, 6, 8, and 9 of Article 6 of this Circular.

2. Periodic training as stipulated in point b, Clause 2, Article 5 of this Circular shall be carried out as follows:

a) The subjects specified in point a, Clause 1, Article 5 of this Circular shall implement periodic training programs according to the contents prescribed in Clauses 1, 3, and 7 of Article 6 of this Circular, with a minimum total duration of 40 hours (16 hours of theory, 24 hours of practice).

b) The subjects specified in point b, Clause 1, Article 5 of this Circular shall implement periodic training programs according to the contents prescribed in Clauses 1, 3, and 7 of Article 6 of this Circular, with a minimum total duration of 24 hours (8 hours of theory, 16 hours of practice).

c) The subjects specified in point c, Clause 1, Article 5 of this Circular shall implement periodic training programs according to the contents prescribed in Clauses 1, 2, 3, 4, 6, and 7 of Article 6 of this Circular, with a minimum total duration of 120 hours (24 hours of theory, 96 hours of practice).

d) The subjects specified in point đ, Clause 1, Article 5 of this Circular shall implement periodic training programs according to the contents prescribed in Clauses 2, 4, 5, 6, and 7 of Article 6 of this Circular, with a minimum total duration of 320 hours (32 hours of theory, 288 hours of practice).

đ) The subjects specified in point e, Clause 1, Article 5 of this Circular shall implement periodic training programs according to the contents prescribed in Clause 9 of Article 6 of this Circular, with a minimum total duration of 80 hours (16 hours of driver training, 64 hours of equipment maintenance, repair).

3. Advanced training as stipulated in point c, Clause 2, Article 5 of this Circular shall be carried out as follows:

a) The subjects specified in points a and b, Clause 1, Article 5 of this Circular shall implement advanced training programs according to the contents prescribed in Clauses 1, 3, and 7 of Article 6 of this Circular, with a minimum duration of 40 hours.

b) The subjects specified in point c, Clause 1, Article 5 of this Circular shall implement advanced training programs according to the contents prescribed in Clauses 1, 2, 3, 5, 6, and 7 of Article 6 of this Circular, with a minimum duration of 56 hours.

c) The subjects specified in point d, Clause 1, Article 5 of this Circular shall implement advanced training programs according to the contents prescribed in Clauses 1, 2, 4, 5, 6, 7, and 8 of Article 6 of this Circular, with a minimum duration of 120 hours.

Article 9. Cases for Exemption and Postponement of Training

1. Cases for Exemption from Training:

a) During the period of treatment for serious illness; diseases listed in the directory of diseases requiring long-term treatment as stipulated in Circular No. 46/2016/TT-BYT dated December 30, 2016 issued by the Minister of Health.

b) During the period of temporary assignment for work.

c) Having notice of leave pending retirement benefits.

d) Studying at academies or schools inside and outside the Public Security sector for 12 months or more.

đ) Pregnant women or nursing children under 12 months old.

2. Cases for Postponement of Training:

Officers and soldiers who are sick, injured, on sudden leave, or on official business with confirmation from their unit leaders, or granted leave by their unit leaders during training periods must participate in supplementary training in the following period to complete the unfulfilled contents.

Chapter III

ORGANIZATION OF TRAINING, INSPECTION AND EVALUATION OF RESULTS
TRAINING IN FIRE FIGHTING AND RESCUE OPERATIONS

Article 10. Issuance of Plans, Programs, Lesson Plans and Organization of Training

1. The Fire Prevention and Fighting Police Department shall be responsible for developing lesson plans for training according to Model No. 02 prescribed in the Appendix attached to this Circular, issuing plans and programs, and organizing advanced training in fire fighting and rescue operations for the subjects specified in points a, b, c, d of Clause 1, Article 5 of this Circular.

2. Provincial Public Security Departments shall be responsible for developing lesson plans for training according to Model No. 02 prescribed in the Appendix attached to this Circular, issuing plans and programs, and organizing regular training in fire fighting and rescue operations for the subjects specified in points a, b, c, đ, e of Clause 1, Article 5 of this Circular.

3. Fire Prevention and Fighting Police Departments under provincial and district-level Public Security Departments shall be responsible for developing lesson plans for training according to Model No. 02 prescribed in the Appendix attached to this Circular, developing programs and plans, and organizing regular training in fire fighting and rescue operations for the subjects specified in points c, đ, e of Clause 1, Article 5 of this Circular, in accordance with actual conditions at the units.

4. The organization of training must be recorded in the Training Work Monitoring Book according to Model No. 01 prescribed in the Appendix attached to this Circular.

Article 11. Content of Inspection and Criteria for Evaluation of Training Results

1. Content of Inspection and Evaluation of Training Results:

a) Inspection and evaluation according to the training program issued.

b) Inspection of plans, programs, lesson plans, monitoring books of training work, conditions ensuring service support for training work; inspection plans, inspection records, evaluation results of training, reports on training work.

c) Inspection and verification of training results based on the reports of training units.

2. Criteria for Evaluation of Training Results:

a) Individuals specified in Clause 1, Article 5 of this Circular must meet the requirement of participating fully in all training contents; the training time must be at least 80%; participating in inspections and achieving at least 50% of total marks.

b) Units meeting the requirements for Fire Prevention and Fighting Police Departments and district-level Public Security Departments must have at least 90% of officers and soldiers within the training subjects participating fully in the training contents and time as required, and at least 80% of officers and soldiers passing the inspection.

c) Units and individuals not meeting the requirements are cases where the criteria stipulated in points a and b of Clause 2 of this Article are not met.

d) Individuals whose inspection results do not meet the requirements must re-inspect the non-compliant contents.

3. The training results of units and individuals are one of the criteria for assessing and ranking quality and annual commendation review for units and individuals.

Article 12. Inspection and Evaluation of Training Results

1. Authority for inspection and evaluation of training results:

a) The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall establish an inspection and evaluation board for advanced training and regular and continuous training work inspections of provincial police forces (hereinafter referred to collectively as the inspection and evaluation board for training results).

The members of the inspection and evaluation board for training results include: leaders of the Fire Prevention, Firefighting, and Rescue Police Department; representatives of relevant functional units under the Fire Prevention, Firefighting, and Rescue Police Department appointed by the Director of the Fire Prevention, Firefighting, and Rescue Police Department.

b) The Director of the provincial police force shall establish an inspection and evaluation board for regular training and continuous training work inspections for units under their management.

The members of the inspection and evaluation board for training results include: leaders of the provincial police force; representatives of relevant functional units under the provincial police force appointed by the Director of the provincial police force.

2. The Director of the Fire Prevention, Firefighting, and Rescue Police Department and the Director of the provincial police force shall issue decisions to establish the inspection and evaluation board for firefighting and rescue training operations according to Model No. 04 stipulated in the Appendix attached to this Circular.

3. The inspection and evaluation board for training results shall be responsible for:

a) Preparing appropriate examination questions based on the training content; announcing the time and location of the examination; organizing the inspection and evaluation of training results according to the approved plan and program.

b) At the end of the inspection, convening a meeting to evaluate strengths and weaknesses, draw lessons from the organizational training work of the inspected unit; preparing an inspection and evaluation record of the firefighting and rescue training work results according to Model No. 05 stipulated in the Appendix attached to this Circular.

c) Notifying the inspection results to the inspected unit and individuals, related units to implement and report to the direct superior management authority.

4. Individuals and units subject to inspection shall be responsible for:

a) Fully complying with the regulations and requirements of the inspection board.

b) Preparing all required inspection content as requested by the inspection board.

c) Keeping the inspection record in accordance with the regulations at the inspected unit.

Chapter IV

IMPLEMENTATION

Article 13. Effective Date

1. This Circular takes effect from March 3, 2023.

2. Abolish Article 8 of Circular No. 08/2018/TT-BCA dated March 5, 2018, issued by the Minister of Public Security detailing certain provisions of Decree No. 83/2017/NĐ-CP dated July 18, 2017, on rescue operations of fire prevention and firefighting forces.

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

Clause 1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall be responsible for:

a) Guide, direct, and inspect the implementation of this Circular.

b) Guide the passing and failing criteria, evaluation of training work results, and inspection of firefighting and rescue operations.

2. Provincial police forces shall be responsible for:

a) Arrange locations, material resources, staff for training work, and other necessary conditions to organize regular training and inspection, and continuous training work inspections for units under their management as prescribed in this Circular and guided by the Fire Prevention, Firefighting, and Rescue Police Department.

b) Summarize the results of firefighting and rescue training work and report to the Ministry of Public Security (through the Fire Prevention, Firefighting, and Rescue Police Department) according to Model No. 03 stipulated in the Appendix attached to this Circular.

3. Heads of units under the Ministry of Public Security, Directors of provincial public security forces directly responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the Fire Prevention, Firefighting, and Rescue Police Department) for timely guidance./.
