Regulations on code numbers, professional standards, and salary grading for civil servants in the specialized field of Civil Enforcement Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Law dated November 25, 2014; the Competition Law dated June 12, 2018; the Law Amending and Supplementing Certain Provisions of the Administrative Violation Handling Law dated November 13, 2020; the Law Amending and Supplementing Certain Provisions of the Public Investment Law, the Public-Private Partnership Investment Law, the Investment Law, the Housing Law, the Bidding Law, the Electricity Law, the Enterprise Law, the Special Consumption Tax Law, and the Civil Enforcement Law dated January 11, 2022;

Pursuant to Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;

Pursuant to Decree No. 98/2022/ND-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Based on the unified opinion of the Ministry of Home Affairs in Circular No. 3431/BNV-CCVC dated July 5, 2023;

The Minister of Justice promulgates this Circular regulating code numbers, professional standards, and salary grading for civil servants in the specialized field of Civil Enforcement.

At the proposal of the Director of the Civil Enforcement General Department;

Article 1. This Circular regulates code numbers, professional standards, and salary grading for civil servant ranks in the specialized field of Civil Enforcement, including Enforcement Officers, Enforcement Case Reviewers, and Enforcement Secretaries.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. This Circular applies to civil servants engaged in civil enforcement work under the General Department of Civil Enforcement and related individuals, agencies, and organizations.

Article 3. In special cases where the rank of Junior Enforcement Officer, Intermediate Enforcement Officer, or Senior Enforcement Officer is appointed without passing an examination, it shall be implemented according to the provisions of Clause 6 and Clause 7, Article 18 of the Civil Enforcement Law.

1. The time spent working in legal affairs is the total time spent on the following activities:

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

a) Enforcement Officers, Enforcement Case Reviewers, Enforcement Secretaries, Intermediate Enforcement Secretaries; Judges, Court Case Reviewers, Court Secretaries; Prosecutors, Prosecution Reviewers; Investigators from Investigation Agencies within the People's Public Security Force, the People's Armed Forces, the Supreme People's Procuracy; Senior-level Detectives, Senior-level Police Officers of the People's Public Security Force, Senior-level Detectives of the People's Security Force; Investigative Officers, Security Officers in the People's Armed Forces; Inspectors;

b) Time with a bachelor’s degree in law or higher and holding the rank of Specialist or equivalent and above at positions requiring a bachelor’s degree in law or higher for civil servants and public officials working at the following agencies: Ministry of Justice, Departments of Justice, Justice Offices; the civil enforcement system; courts, prosecution offices, inspection offices, review offices, internal affairs offices, legal offices, research agencies, legal education institutions within political systems; time with a bachelor’s degree in law or higher counted as equivalent to the time held in rank according to Point d, Clause 3, Article 30 of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;

c) Time with a bachelor’s degree in law or higher and holding leadership positions at Party Committees, People's Councils, People's Committees at district level or higher;

d) Time practicing as a lawyer, notary, auctioneer, bankruptcy trustee, or commissioner.

2. Documents to determine the time spent working in legal affairs are:

a) Appointment decisions for ranks, titles, or documents changing ranks, titles (if applicable) for persons under Point a, Clause 1 of this Article;

b) Bachelor’s degree in law or higher; appointment decisions for civil servant ranks, public official titles, or documents changing ranks, titles (if applicable) or employment contracts for public officials accompanied by job descriptions and competency frameworks approved by competent authorities corresponding to the positions held, salary grading decisions according to Point d, Clause 3, Article 30 of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants, for persons under Point b, Clause 1 of this Article;

c) Bachelor’s degree in law or higher; approval decisions for positions, titles, or documents changing positions, titles (if applicable) for persons under Point c, Clause 1 of this Article;

d) Bachelor’s degree in law or higher; decisions granting Lawyer Cards, certificates for Auctioneer practice, Bankruptcy Trustee practice, decisions appointing Commissioners, accompanied by social insurance payment records consistent with the positions under Point d, Clause 1 of this Article;

3. A person with basic information technology skills is one who meets one of the following conditions:

a) Has been tested and evaluated as having basic information technology skills during recruitment, acceptance, appointment to civil servant ranks, public official titles, promotion to higher civil servant ranks, or advancement in public official grades;

b) Holds a diploma or certificate confirming possession of basic information technology skills as prescribed.

4. Documents to determine the main or participating role in drafting, reviewing normative legal documents, research topics, projects, scientific research programs, innovation proposals are:

a) Decisions by authorized persons establishing Drafting Committees, Editorial Teams, Drafting Groups for normative legal documents or documents assigning the main or participating roles in drafting by authorized persons in cases where the establishment of Drafting Committees, Editorial Teams, or Drafting Groups is not mandatory according to the Law on Enacting Normative Legal Documents.

a) Decision of the competent authority regarding the establishment of the Drafting Board, Editorial Group, or Drafting Team of regulatory legal documents, or a document assigning the main responsibility or participation in drafting by the competent authority in cases where it is not mandatory to establish a Drafting Board, Editorial Group, or Drafting Team as provided for in the Law on Enacting Regulatory Legal Documents;

b) The decision of the competent authority regarding the establishment of the Steering Committee, the Main Committee, the Drafting Board for topics, projects, programs of state-level, ministry-level, department-level, provincial-level, or grassroots-level scientific research, or the document assigning tasks by the competent authority regarding the main responsibility for reviewing legal regulatory documents;

c) The decision or document recognizing or approving an initiative of the competent authority as prescribed by law.

Article 3. Classification code for civil enforcement officials

1. Senior Enforcement Officer Code number: 03.299

2. Intermediate Enforcement Officer Code number: 03.300

3. Junior Enforcement Officer Code number: 03.301

Article 4. General Standards

1. Possess firm political will, firmly adhere to Marxism-Leninism, Ho Chi Minh Thought, thoroughly understand the Party's policies and guidelines; be loyal to the State of the Socialist Republic of Vietnam and its Constitution; protect the interests of the country and the people.

2. Fully perform the duties of a public official as prescribed by law; strictly comply with the assignment of tasks from superiors; abide by laws, maintain discipline, order, and administrative regulations; set a good example in following internal rules and regulations of the agency.

3. Devoted, responsible, honest, impartial, fair, and exemplary in performing public duties; courteous, cultured, and appropriate in communication and service to the people.

5. Continuously have a sense of learning and training to improve moral qualities, competence, and capabilities.

6. Have sufficient health to complete assigned tasks.

7. Public officials who register to take the examination for promotion or are considered for promotion must meet the criteria and conditions stipulated by the Government.

Chapter II

DUTIES, TASKS AND PROFESSIONAL QUALIFICATIONS OF ENFORCEMENT OFFICER CLASSIFICATIONS

Article 5. Senior Enforcement Officer Classification

1. Responsibilities

A Senior Enforcement Officer is the highest-ranking civil enforcement official, directly organizing and supervising the execution of complex civil and administrative enforcement cases involving various sectors, levels, localities, or foreign elements within the jurisdiction of the Civil Enforcement Office.

2. Tasks

a) Implement the duties and powers as stipulated in Article 20 of the Civil Enforcement Law;

b) Lead the study and propose work programs, issues related to organization and operation of civil enforcement, administrative enforcement measures, and methods of implementation;

c) Organize and direct the implementation of administrative enforcement work according to the law;

d) Guide, urge, or assist the head of the civil enforcement office to guide and urge subordinate civil enforcement offices under their jurisdiction to implement civil enforcement and civil enforcement laws, administrative enforcement laws; receive citizens as prescribed;

đ) Provide guidance on enforcement procedures for intermediate enforcement officers and junior enforcement officers;

e) Develop plans for civil enforcement and organize the implementation of decisions made by the head of the enforcement office regarding civil enforcement;

g) Assist the head of the civil enforcement office in understanding the situation of enforcement work and compliance with laws in enforcement work in the area; organize summaries of practical enforcement work and propose solutions to improve the effectiveness of civil enforcement and administrative enforcement;

h) Study and recommend amendments and supplements to enforcement-related documents, propose improvements to the legal system for civil enforcement and administrative enforcement;

i) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement office.

3. Professional Qualification Standards

a) Thoroughly understand the Party's policies and national laws, directives, and resolutions of higher authorities, and apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Thoroughly understand administrative management knowledge and in-depth knowledge of civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures of civil enforcement procedures;

c) Understand the development trends of domestic and international civil enforcement fields; organize research to serve management and information processing;

d) Have the ability to propose and advise on policy formulation, lead the drafting of projects, draft legal regulatory documents, proposals, and programs related to civil enforcement to submit for consideration and decision by competent authorities; have the ability to coordinate well with relevant agencies, units, and individuals in performing assigned tasks;

đ) Have the ability to educate and persuade parties to enforce court judgments, decisions of the Competition Dispute Resolution Council, and arbitration awards and decisions;

e) Be proficient in drafting, presenting, defending, and implementing skills to develop and implement projects, proposals, programs, work plans, and teaching materials related to civil enforcement and administrative enforcement work;

g) Possess research capabilities in scientific studies, comprehensive summaries within the assigned field, proposing strategic issues regarding enforcement of civil judgments and administrative enforcement work; capable of analyzing, generalizing, and synthesizing across multiple areas related to enforcement work;

h) Possess basic information technology skills.

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training in state management knowledge and skills for senior clerical staff positions or equivalent, or hold a master's degree in political theory and administration;

c) Hold a diploma in advanced political theory or advanced political theory and administration, or hold a certificate of equivalent advanced political theory level recognized by an authorized agency;

d) Hold a certificate for training in knowledge and skills according to job position requirements for Senior Enforcement Officers based on the program of the Ministry of Justice;

5. For civil servants participating in the promotion examination for Senior Enforcement Officer positions, in addition to the criteria stipulated in Clause 3 and Clause 4 of this Article, they must also meet the following conditions:

a) Have held the position of Intermediate Enforcement Officer for at least five years (sixty months);

b) During the period of holding the Intermediate Enforcement Officer position, have led the development of at least two of the following products: normative legal documents, topics, projects, research programs at the national, ministry, department, sector, or provincial level, which have been issued or accepted by competent authorities;

Article 6. Intermediate Enforcement Officer Position

1. Responsibilities

The Intermediate Enforcement Officer is a specialized civil servant responsible for enforcing civil judgments and administrative enforcement, directly organizing and supervising the execution of complex cases involving large sums of money or assets, where the enforcement involves multiple regions under the jurisdiction of the Civil Execution Office or the Civil Execution Branch;

2. Tasks

a) Implement the duties and powers as stipulated in Article 20 of the Civil Enforcement Law;

b) Participate in drafting directives for enforcement work, compiling materials and guiding the implementation of civil enforcement and administrative enforcement procedures;

c) Guide the procedural duties for Junior Enforcement Officers, Court Execution Secretaries, and Intermediate Court Execution Secretaries;

d) Implement administrative enforcement work according to legal provisions;

đ) Develop plans and organize the implementation of civil judgment enforcement decisions; propose measures and direct the enforcement of civil judgment enforcement decisions within their authority; perform citizen reception tasks as prescribed;

e) Report on the results of civil enforcement and administrative enforcement work, make recommendations and propose measures for organizing civil enforcement and administrative enforcement within their functional and assigned tasks;

g) Assist the head of the civil enforcement office in understanding the situation of enforcement work and compliance with laws in enforcement work within their jurisdiction as assigned;

h) Participate in researching and summarizing experiences and practical enforcement situations;

i) Study, recommend, and supplement enforcement-related documents; propose opinions to improve the enforcement legal system;

k) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement office;

3. Professional Qualification Standards

a) Proficiently understand the Party's policies and State laws, directives, and resolutions from superiors to apply them in civil enforcement and administrative enforcement work;

b) Deeply understand the content of laws on civil enforcement and administrative enforcement; skillfully apply principles, systems, and procedures for civil enforcement procedures;

c) Understand the current situation and trends in domestic and international civil enforcement work; organize research to serve management and information processing;

d) Possess good coordination skills with relevant agencies, units, and individuals in performing assigned tasks;

đ) Have the ability to educate and persuade parties to enforce court judgments, decisions of the Competition Dispute Resolution Council, and arbitration awards and decisions;

e) Possess analytical and synthesis skills, proficient in building documents and materials related to assigned responsibilities and presenting on assigned issues;

g) Possess basic information technology skills;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training in state management knowledge and skills for senior clerical staff positions or equivalent, or hold a master's degree in political theory and administration;

c) Hold a certificate for training in knowledge and skills according to job position requirements for Intermediate Enforcement Officers based on the program of the Ministry of Justice;

5. For civil servants participating in the promotion examination for Intermediate Enforcement Officer positions, in addition to the criteria stipulated in Clause 3 and Clause 4 of this Article, they must also meet the following conditions:

a) Have held the position of Junior Enforcement Officer for at least five years (sixty months);

b) During the period of holding the Junior Enforcement Officer position, have participated in developing at least one normative legal document, topic, project, research program at the grassroots level or higher, which has been issued or accepted by competent authorities, or have led the development and implemented at least one successful innovation within the civil enforcement system, Civil Execution Office, or Civil Execution Branch.

Article 7. Junior Enforcement Officer Rank

1. Responsibilities

A junior enforcement officer is a specialized civil servant responsible for organizing the execution of civil judgments and administrative decisions, directly supervising the execution of simple cases where the value of money or assets to be executed is not large within the jurisdiction of the Civil Enforcement Agency and the Branch Civil Enforcement Agency.

2. Tasks

a) Implement the duties and powers as stipulated in Article 20 of the Civil Enforcement Law;

b) Guide professional procedures for enforcement clerks and intermediate-level enforcement clerks;

c) Implement administrative enforcement work according to the law;

d) Develop plans and organize the implementation of civil enforcement decisions; perform citizen reception tasks as prescribed;

đ) Report on the results of civil judgment enforcement and administrative decision enforcement; propose measures to resolve issues;

e) Study and propose amendments to enforcement-related documents; contribute suggestions for improving the enforcement legal system;

g) Participate in drafting documents related to civil enforcement and administrative enforcement work within their assigned areas; propose organizational issues related to civil enforcement and administrative enforcement within their authority;

h) Perform other tasks assigned by the head of the enforcement agency.

3. Professional Qualification Standards

a) Proficiently understand the Party's policies and State laws, directives, and resolutions from superiors to apply them in civil enforcement and administrative enforcement work;

b) Master the content of laws on civil enforcement and administrative enforcement and skillfully apply principles, systems, and procedures regarding enforcement procedures in organizing the execution of assigned cases;

c) Understand the economic and social situation in the locality; be familiar with the area under their responsibility;

d) Possess good coordination skills with relevant agencies, units, and individuals in performing assigned tasks;

đ) Possess the ability to educate and persuade parties to comply with court judgments and decisions; decisions on handling competition disputes and arbitral awards and decisions;

e) Possess the ability to draft documents related to their responsibilities and tasks;

g) Possess basic information technology skills;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training knowledge and skills in state management for specialist-grade civil servants and equivalent positions;

c) Hold a certificate for training in civil enforcement procedures;

5. Candidates for the junior enforcement officer rank must have at least three years (36 months) of legal work experience.

Chapter III

DUTIES, TASKS AND PROFESSIONAL STANDARDS OF THE RANKS OF ENFORCEMENT AUDITORS

Article 8. Senior Enforcement Auditor Rank

1. Responsibilities

A senior enforcement auditor is the highest-ranking civil servant with expertise in the field of enforcement audit for civil judgments and administrative decisions; assists the head of the civil enforcement management agency in performing auditing and inspection tasks for important and complex civil enforcement cases involving multiple levels, sectors, fields, and localities; audits, inspects, and verifies complaints and petitions about civil enforcement and performs other tasks as assigned by the head of the civil enforcement management agency.

2. Tasks

Carry out duties and powers stipulated in Article 67 of Decree No. 62/2015/ND-CP dated July 18, 2015, of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Law and other tasks, including:

a) Lead or participate in drafting projects and drafts of legal normative documents related to the functions and tasks of the civil enforcement system;

b) Conduct audits and inspections of civil enforcement cases that have been and are being enforced; develop inspection plans, proactively implement or coordinate with relevant agencies and units to verify and inspect civil enforcement work according to plans approved by the head of the civil enforcement management agency. During the audit process, if errors are found, they must advise the competent authority to temporarily suspend the implementation of erroneous decisions to correct them and bear responsibility for their recommendations;

c) Develop plans, submit to the head of the civil enforcement management agency for approval, organize implementation or coordinate with relevant agencies and units to audit, inspect, verify, and propose solutions for complaints and petitions about civil enforcement and administrative enforcement management;

d) Develop plans, submit to the head of the civil enforcement management agency for approval, organize implementation, audit, verify, and report statistics and data on civil enforcement and administrative enforcement, as well as other files and documents related to civil enforcement work and administrative enforcement management of provinces and centrally-administered cities; counties, districts, towns, and provincial cities;

đ) Audit, inspect, and advise on resolving complex complaints and petitions related to personnel organization work in the civil enforcement system;

e) Audit, inspect, and compile reports related to civil enforcement work; report on accounting procedures for civil enforcement within the civil enforcement system;

g) Research scientific topics related to enforcement work;

h) Assist the head of the civil enforcement management agency in coordinating with relevant agencies to monitor, urge, and inspect compliance with administrative litigation laws;

i) Assist the head of the civil enforcement management agency in directing civil enforcement agencies to enforce complex cases;

k) Assist the head of the civil enforcement management agency in responding to objections and proposals from the People's Procuracy within their authority;

l) Participate in developing goals, contents, programs, and teaching materials for training and upgrading enforcement skills for enforcement auditors; direct or personally compile materials and guide procedures for enforcement officers, enforcement auditors, and enforcement clerks;

m) Assist the head of the civil enforcement management agency in guiding and directing enforcement audits nationwide and proposing measures to ensure the organization of civil enforcement and administrative enforcement management complies with the law and is effective;

n) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement management agency.

3. Professional Qualification Standards

a) Master the Party's policies and State laws, upper-level documents and directives to apply them to civil enforcement and administrative enforcement work; strategic development goals for the economy, culture, and society;

b) Master and thoroughly understand knowledge on administrative state management, deeply understand the contents of laws on civil enforcement, administrative enforcement, laws on handling complaints and denunciations; skillfully apply principles, systems, procedures for examination, inspection, handling complaints and denunciations in civil enforcement work, administrative enforcement work; deeply understand the contents of laws on civil enforcement, administrative enforcement; skillfully apply principles, systems, procedures related to civil enforcement business;

c) Understand the development trends of domestic and international civil enforcement fields; organize research to serve management and information processing;

d) Possess the ability to propose, advise on policy formulation, lead in drafting projects, draft regulatory legal documents, programs, plans related to the civil enforcement field to be submitted to competent authorities for consideration and decision;

Proficient in skills of drafting, presenting, defending, and organizing implementation to build and implement projects, programs, plans, work programs, teaching materials related to civil enforcement work, administrative enforcement work, examination, inspection, handling complaints and denunciations in civil enforcement;

e) Possess research capabilities, comprehensive summaries of wide-ranging topics within the assigned field, propose strategic issues regarding civil enforcement work, administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work;

g) Possess basic information technology skills;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training in state management knowledge and skills for senior clerical staff positions or equivalent, or hold a master's degree in political theory and administration;

c) Hold a diploma in advanced political theory or advanced political theory and administration, or hold a certificate of equivalent advanced political theory level recognized by an authorized agency;

d) Hold a certificate of training in knowledge and skills according to the job position requirements for Senior Enforcement Examiner in accordance with the program of the Ministry of Justice;

5. For civil servants participating in the promotion examination for Senior Enforcement Examiner in civil enforcement, in addition to the criteria stipulated in Clause 3, Clause 4 of this Article, they must also meet the following conditions:

a) Have held the rank of Chief Enforcement Examiner in civil enforcement or equivalent for at least 06 years (72 months), including at least 01 year (12 months) as a Chief Enforcement Examiner in civil enforcement up to the deadline for submitting registration documents for the promotion examination;

b) During the period holding the rank of Chief Enforcement Examiner in civil enforcement or equivalent, have led in building and reviewing at least 02 (two) of the following products: regulatory legal documents, research topics, programs, projects, national-level, ministry-level, department-level, or provincial-level scientific research programs that have been issued or accepted by competent authorities;

Article 9. Rank of Chief Enforcement Examiner in Civil Enforcement

1. Responsibilities

The Chief Enforcement Examiner in Civil Enforcement is a civil servant with high expertise in the field of civil enforcement examination, assisting the head of the enforcement agency directly or participating in performing tasks of examining cases that have been and are being enforced, examining, inspecting, verifying cases involving complaints and denunciations about civil enforcement, and performing other tasks as assigned by the head of the civil enforcement management agency or civil enforcement agency;

2. Tasks

Perform duties and powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP and other tasks, including:

a) Lead or participate in drafting projects, draft regulatory legal documents related to the functions and tasks of the civil enforcement system;

b) Develop inspection plans, proactively carry out or coordinate with relevant agencies and units to verify, inspect, and propose solutions for civil enforcement work, administrative enforcement management according to plans approved by the head of the civil enforcement management agency or civil enforcement agency;

c) Conduct examination of case files that have been and are being enforced according to approved plans or as assigned by the head of the civil enforcement management agency or civil enforcement agency; propose solutions and take responsibility for their recommendations. If errors are found during inspections, advise the competent authority to temporarily suspend the execution of erroneous decisions to correct them and take responsibility for their proposals;

d) Draft guidelines and instructions for the Junior Enforcement Officer rank, Enforcement Examiner rank, Enforcement Clerk rank;

đ) Examine, verify, inspect reports on statistics, data on civil enforcement from Intermediate Enforcement Officers, Junior Enforcement Officers, and subordinate civil enforcement agencies;

e) Examine, inspect, verify, advise on resolving complaints and denunciations related to personnel organization in the civil enforcement system;

g) Examine, inspect, compile reports related to civil enforcement work, accounting reports on civil enforcement business of subordinate units;

h) Assist the head of the civil enforcement management agency in coordinating with relevant agencies to monitor, urge, and inspect compliance with administrative litigation laws;

i) Advise the head of the civil enforcement management agency or civil enforcement agency: Respond to objections and suggestions from the People's Procuracy according to their authority; examine, inspect, verify, advise on resolving cases involving complaints and denunciations about civil enforcement, administrative enforcement management as directed by the head of the civil enforcement management agency or civil enforcement agency;

k) Perform other tasks as prescribed by law or assigned by the head of the agency;

3. Professional Qualification Standards

a) Proficiently understand the Party's policies and State laws, directives, and resolutions from superiors to apply them in civil enforcement and administrative enforcement work;

b) Understand the provisions of laws on civil enforcement, administrative enforcement, laws on handling complaints and denunciations; skillfully apply principles, systems, procedures for examination, inspection, handling complaints and denunciations in civil enforcement work, administrative enforcement work;

c) Possess the ability to lead or participate in proposing, advising on policy formulation, drafting projects, draft regulatory legal documents, programs related to the civil enforcement field to be submitted to competent authorities for consideration and decision;

d) Be aware of the situation and development trends of civil enforcement work both domestically and internationally; organize research to serve management and processing of management information.

đ) Possess the ability to analyze and synthesize, be proficient in skills for drafting relevant documents related to assigned responsibilities and duties, and present on assigned issues;

e) Possess basic information technology skills.

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training in state management knowledge and skills for senior clerical staff positions or equivalent, or hold a master's degree in political theory and administration;

c) Hold a certificate for training in knowledge and skills according to the requirements of the position for Chief Enforcement Inspector as per the program of the Ministry of Justice.

5. For civil servants participating in the examination to upgrade to the rank of Chief Enforcement Inspector, in addition to the criteria stipulated in Clauses 3 and 4 of this Article, they must also meet the following conditions:

a) Have held the rank of Enforcement Inspector or equivalent for at least nine years, including a minimum of one year (12 months) continuously holding the rank of Enforcement Inspector up to the deadline for submitting registration documents for the examination to upgrade to a higher rank;

b) During the period of holding the rank of Enforcement Inspector or equivalent, have participated in drafting and reviewing at least one legal normative document or research topic, project, program from the grassroots level upwards that has been issued or accepted by the competent authority or have successfully led the implementation of at least one initiative within the enforcement system, units under the Civil Enforcement General Department, Civil Enforcement Department, or Civil Enforcement Branch;

Article 10. Rank of Enforcement Inspector

1. Responsibilities

The Enforcement Inspector is a civil servant with specialized expertise in the field of enforcement inspection of civil and administrative enforcement, assisting the head of the agency in directly conducting inspections of cases being enforced, verifying complaints and reports according to the assignment of the head of the civil enforcement management agency or civil enforcement agency;

2. Tasks

Perform duties and powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP and other tasks, including:

a) Conduct inspections of case files handled by Enforcement Officers according to approved plans or assignments by the head of the civil enforcement management agency or civil enforcement agency, propose solutions and take responsibility for their recommendations;

b) Inspect, review, and advise on resolving complaints and reports related to organizational and personnel work within the civil enforcement system;

c) Inspect, review, and compile reports related to civil enforcement and administrative enforcement work;

d) Inspect statistics, reports, and data on civil enforcement, administrative enforcement management, and other relevant files and documents of Enforcement Officers and subordinate civil enforcement agencies;

đ) Participate in drafting projects and draft legal normative documents related to the functions and tasks of the civil enforcement system;

e) Advise the head of the civil enforcement management agency to coordinate with relevant agencies to monitor, urge, and inspect compliance with administrative litigation procedures;

g) Advise the head of the civil enforcement management agency or civil enforcement agency: Respond to objections and suggestions from the People's Procuratorate within their jurisdiction for simple cases; inspect, verify, and advise on resolving complaints and reports for simple cases within their jurisdiction for the head of the civil enforcement management agency or civil enforcement agency;

h) Plan and organize the implementation or cooperate with relevant agencies and units to verify, inspect, and propose measures to resolve according to the assignment of the head of the agency;

i) Perform other tasks assigned by the head of the agency;

3. Professional Qualification Standards

a) Be well-versed in the Party's guidelines and policies, state laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work;

b) Be well-versed in legal provisions on civil enforcement, administrative enforcement, laws on complaint and appeal resolution, and inspection and verification of civil enforcement and complaint and appeal resolution practices;

c) Understand the economic and social situation in the locality related to civil enforcement work;

d) Possess the ability to participate in formulating and guiding the implementation of state management systems and regulations on civil enforcement, administrative enforcement management, and possess the ability to participate in research to serve management and information processing;

đ) Possess the ability to coordinate with units and individuals during the performance of tasks;

e) Be familiar with the process of handling tasks, possess writing skills, and presentation skills for assigned research and advisory issues;

g) Possess basic information technology skills;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Hold a certificate for training knowledge and skills in state management for specialist-grade civil servants and equivalent positions;

c) Hold a certificate for training in knowledge and skills according to the requirements of the position for Enforcement Inspector as per the program of the Ministry of Justice;

5. For civil servants proposed for appointment to the rank of Enforcement Inspector must currently hold the rank of Specialist or equivalent, and have worked in legal affairs for at least three years (36 months);

Chapter IV

DUTIES, TASKS AND SPECIALIZED PROFESSIONAL STANDARDS OF THE RANKS OF ENFORCEMENT SECRETARY

Article 11. Clerk of Enforcement

1. Responsibilities

The Clerk of Enforcement is a civil servant with specialized knowledge and skills in civil enforcement and administrative enforcement, responsible for assisting the Enforcement Officer in implementing procedures and formalities in civil enforcement work, administrative enforcement work, or assisting the Enforcement Reviewer in conducting reviews as prescribed by law.

2. Tasks

a) Recording minutes of verification of enforcement; minutes of enforcement resolution; minutes of delivery of decisions and documents; minutes of handling evidence items, seized and temporarily detained assets; minutes of asset seizure; minutes of meetings; minutes of asset valuation; minutes of asset status inspection; minutes of destruction of evidence; minutes of compulsory execution; minutes of property handover; minutes of asset return, and other procedural minutes;

b) Implementing certain verification tasks and building files for civil enforcement cases as assigned by the Enforcement Officer or the Enforcement Reviewer;

c) Advising and assisting the Enforcement Officer in preparing files, procedures, and organizing enforcement within the jurisdiction of the provincial or district civil enforcement agency; assisting the Enforcement Officer in performing tasks related to administrative enforcement work as prescribed by law, or assisting the Enforcement Reviewer in conducting reviews on cases that have been and are being enforced, and cases involving complaints and reports about civil enforcement as prescribed by law;

d) Assisting the Enforcement Officer and the Enforcement Reviewer in notifying enforcement documents as prescribed;

đ) Coordinating with relevant agencies and units to assist the Enforcement Officer in organizing civil enforcement work and monitoring administrative enforcement work; assisting the Enforcement Reviewer in conducting reviews on enforcement as prescribed by law;

e) Performing other tasks assigned by the head of the enforcement agency;

3. Professional Qualification Standards

a) Proficient in the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Master basic knowledge about legal principles and civil enforcement procedures;

c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Clerk of Enforcement;

d) Possessing skills in drafting documents related to the assigned responsibilities and tasks;

đ) Possessing basic information technology usage skills;

4. Educational and Training Standards

a) Hold a bachelor's degree in law or higher;

b) Holding a certificate in training for management knowledge and skills for clerical civil servants or equivalent;

c) Holding a certificate in training for knowledge and skills required for the position of Clerk of Civil Enforcement according to the program of the Ministry of Justice;

5. For civil servants participating in the promotion examination to the Clerk of Enforcement grade, they must have held the Intermediate Clerk of Enforcement grade for at least three years (36 months).

Article 12. Intermediate Clerk of Enforcement

1. Responsibilities

The Intermediate Clerk of Enforcement is a civil servant with specialized knowledge and skills in civil enforcement and administrative enforcement, responsible for assisting the Enforcement Officer in implementing procedures and formalities in civil enforcement work and administrative enforcement work, or assisting the Enforcement Reviewer in conducting reviews on enforcement as prescribed by law.

2. Tasks

đ) Coordinating with relevant agencies and units to assist the Junior Enforcement Officer in organizing civil enforcement work; assisting the Enforcement Reviewer in conducting reviews on enforcement as prescribed by law;

e) Performing other tasks assigned by the head of the enforcement agency;

3. Professional Qualification Standards

a) Understand the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Proficient in basic knowledge of laws and enforcement practices in civil enforcement;

c) Having the ability to synthesize and propose solutions to issues related to the duties of the Intermediate Clerk of Enforcement;

d) Having the ability to draft documents related to the assigned responsibilities and tasks;

đ) Possessing basic information technology usage skills;

4. Educational and Training Standards

Having a college degree in law or higher.

Article 13. Salary Classification for Civil Enforcement Professional Civil Servants

Civil servants in the civil enforcement profession shall apply the Specialized and Vocational Pay Scale for Officials and Civil Servants in State Agencies (Table 2) issued together with Government Decree No. 204/2004/NĐ-CP dated December 14, 2004 on the salary system for officials, civil servants, public employees, and armed forces (amended and supplemented by Government Decree No. 17/2013/NĐ-CP dated February 19, 2013) as follows:

a) The Senior Enforcement Officer and Senior Review Officer positions shall apply the pay scale coefficient for Class A3, Group A3.1 civil servants;

b) The Intermediate Enforcement Officer and Chief Review Officer positions shall apply the pay scale coefficient for Class A2, Group A2.1 civil servants;

c) The Junior Enforcement Officer, Review Officer, and Clerk positions shall apply the pay scale coefficient for Class A1 civil servants;

d) The Intermediate Clerk position shall apply the pay scale coefficient for Class B civil servants.

Chapter V

IMPLEMENTING PROVISIONS

Article 14. Implementation Organization

1. The professional standards of the specialized civil servant ranks within the civil enforcement system serve as the basis for implementing recruitment, utilization, appointment, and management of civil servants engaged in civil enforcement work, as well as monitoring administrative enforcement.

2. The training and development standards for Enforcement Officers and Review Officers in the Ministry of Defense shall be implemented according to the regulations of the Minister of Defense.

Article 15. Transitional Provisions

1. In cases where civil servants have certificates confirming completion of training programs according to the professional standards of specialized civil enforcement civil servant ranks before June 30, 2022, they are not required to participate in state administration knowledge and skill management training programs; nor are they required to participate in job-specific knowledge and skill training programs for equivalent civil servant ranks as stipulated in this Circular.

2. In cases where civil servants were appointed to specialized civil enforcement civil servant ranks before the effective date of this Circular (including cases where due to job requirements, they were transferred to equivalent civil servant ranks and now return to their original ranks), the provisions of Clause 3, Article 2 of Government Decree No. 89/2021/NĐ-CP dated October 18, 2021 amending and supplementing certain articles of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and development of cadres, civil servants, and public employees shall apply.

3. In cases where the legal normative documents cited for application in this Circular are amended, supplemented, or replaced, implementation shall follow the amended, supplemented, or replacement documents.

Article 16. Effectiveness and Responsibility for Implementation

1. This Circular shall take effect 45 days from the date of signature.

Repeal Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on the titles, rank codes, and professional standards of specialized civil enforcement civil servant ranks; and Circular No. 08/2020/TT-BTP dated December 28, 2020 amending and supplementing certain articles of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on the titles, rank codes, and professional standards of specialized civil enforcement civil servant ranks.

2. Heads of units under the Ministry of Justice, Heads of local civil enforcement agencies, and Directors of the Civil Enforcement Department of the Ministry of Defense within the scope of their assigned tasks and authorities are responsible for organizing the implementation of the provisions of this Circular./.
