CIRCULAR

REGULATIONS ON THE AWARD OF THE COMMEMORATIVE MEDAL "FOR THE CAUSE OF INSPECTION"

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to the Inspection Law on November 14, 2022;

Pursuant to Decree No. 81/2023/NĐ-CP dated November 27, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 98/2023/NĐ-CP of the Government dated December 31, 2023 providing details on the implementation of certain provisions of the Law on Competition and Reward;

At the proposal of the Director of the Personnel Department and the Director of the Legal Department;

The Government Inspector General issues this Circular to regulate the award of the Commemorative Medal "For the Cause of Inspection".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, recipients, conditions, criteria, procedures, and formalities for awarding the Commemorative Medal, the organization of the presentation ceremony, and the rights and responsibilities of organizations and individuals in the process of awarding the Commemorative Medal "For the Cause of Inspection".

Article 2. Commemorative Medal "For the Cause of Inspection"

1. The Commemorative Medal "For the Cause of Inspection" (hereinafter referred to as the Commemorative Medal) is a form of award granted by the Government Inspector General to individuals who have made contributions to the cause of building and developing the Inspection sector.

2. The Government Inspectorate awards the Commemorative Medal on the occasion of the Traditional Day of Inspection of Vietnam (November 23) annually and may grant it exceptionally in special cases.

3. The Commemorative Medal has symbols, shapes, sizes, and colors that reflect the characteristics of the Inspection sector, in accordance with general regulations of the State; accompanying the Decision granting the Commemorative Medal are the Certificate, frame, Commemorative Medal, and Commemorative Medal box.

Article 3. Principles for awarding the Commemorative Medal

1. The awarding of the Commemorative Medal must be accurate, transparent, fair, and timely.

2. The Commemorative Medal is awarded only once to individuals meeting the conditions and criteria stipulated in this Circular.

Chapter II

RECIPIENTS, CONDITIONS, AND CRITERIA FOR AWARDS

Article 4. Recipients

1. Individuals currently working in inspection agencies and those assigned to perform specialized inspection tasks.

2. Individuals with achievements in leading and directing activities contributing to the cause of building and developing the Inspection sector of Vietnam, including:

a) Party and State leaders;

b) Leaders of the Vietnam Fatherland Front, central-level political and social organizations;

c) Leaders of Ministries, agencies at the level of ministries, and government agencies;

d) Secretaries and Deputy Secretaries of provincial party committees directly under the central government; Chairpersons and Vice-Chairpersons of provincial People's Councils and People's Committees directly under the central government;

e) Heads and Deputy Heads of Delegations of the National Assembly responsible for provinces and centrally-administered cities; leaders of the Vietnam Fatherland Front and political and social organizations at the provincial and centrally-administered city levels; Secretaries and Deputy Secretaries of district party committees, county party committees, town party committees, and district party committees within provincial and centrally-administered city party committees; Chairpersons and Vice-Chairpersons of district People's Councils, county People's Councils, town People's Councils, and district People's Councils within provincial and centrally-administered city People's Councils;

f) Heads and Deputy Heads of the Government Cryptographic Agency; Directors and Deputy Directors of General Directorates and equivalent positions under Ministries;

g) Directors and Deputy Directors of provincial departments and equivalent positions.

3. Individuals who are overseas Vietnamese or foreigners who have contributed to the cause of building and developing the Inspection sector of Vietnam.

4. Other cases decided by the Government Inspector General.

1. Recipients not eligible for the Commemorative Medal include:

1. Individuals under consideration for disciplinary action or involved in criminal cases without a conclusion from competent authorities shall not be considered for the award.

2. Individuals undergoing disciplinary sanctions shall not be considered for the award. The period during which disciplinary sanctions are imposed shall not be counted towards the service period for the award of the Commemorative Medal.

3. Individuals who have been dismissed, criminally prosecuted, or expelled from the Party shall not be considered for the award.

4. Individuals who have already received the Order of Merit "For the Cause of Inspection" shall not be considered for the award.

Article 6. Conditions and criteria for awarding Commendation Plaques

1. Individuals who are leaders of the Government Inspectorate holding the position for at least 04 years up to September 1 of the year under consideration for awarding.

2. Individuals working in inspection agencies with continuous service time of at least 10 years up to September 1 of the year under consideration for awarding.

Individuals assigned to perform specialized inspection tasks with continuous inspection work time of at least 20 years up to September 1 of the year under consideration for awarding.

3. Individuals falling within the categories specified in Clause 2, Article 4 of this Circular:

a) Party and State leaders who have contributed to the establishment and development of the Inspection sector;

b) Individuals falling within the categories specified in points b, c, and d must have held their positions for at least 05 years and have been responsible for or monitored inspection work for at least 04 years;

c) Individuals falling within the categories specified in points e, f, and g must have held their positions for at least 10 years and have been responsible for or monitored inspection work for at least 08 years.

4. Other cases decided by the Government Inspector General.

Article 7. Priority individuals for awarding Commendation Plaques

Individuals falling within the category specified in Clause 1, Article 4 of this Circular shall be given priority for awarding Commendation Plaques as follows:

1. Individuals awarded the title of "Heroic Forces Labor Medal", "Heroic Labor Medal", Gold Star Medal, Ho Chi Minh Medal, Independence Medal (all categories) shall be proposed for awarding after receiving the commendation decision.

2. Individuals awarded the Ho Chi Minh Prize, State Prize, National Model Worker title, Medals (excluding those specified in Clause 1 of this Article) shall be proposed for awarding two years earlier.

3. Individuals awarded the Prime Minister's Merit Certificate or the Model Worker title at the Ministry, Sector, or Provincial level shall be proposed for awarding one year earlier.

4. Individuals awarded the Merit Certificate from the Government Inspector General or the Model Worker title at the grassroots level shall be proposed for awarding six months earlier.

5. Individuals lacking up to 12 months of inspection work time or responsibility for or monitoring inspection work compared to the regulations until retirement time shall be prioritized for awarding Commendation Plaques before retirement.

6. Honors and commendations used to calculate priority time for awarding Commendation Plaques must be awarded and recognized during the individual's inspection work period; individuals receiving multiple honors and commendations shall be credited with the highest honor or commendation's priority time.

Chapter III

PROCEDURES FOR AWARDING COMMENDATION PLAQUES

Article 8. Responsibilities of individuals, agencies, organizations, and units in awarding Commendation Plaques

1. Heads of departments, bureaus, and units under the Government Inspectorate are responsible for preparing nomination files for awarding and ensuring the accuracy of the files for individuals directly under their management.

2. Chief Inspectors of Ministries, Chief Inspectors of agencies equivalent to Ministries, Chief Inspectors of agencies under the Government, and Chief Inspectors of the Government Cryptographic Service are responsible for preparing nomination files for awarding and ensuring the accuracy of the files for:

a) Individuals specified in points c and e of Clause 2, Article 4 of this Circular;

b) Individuals directly under their management, individuals working in inspection agencies, and individuals assigned to perform specialized inspection tasks in agencies tasked with specialized inspection functions under Ministries, agencies equivalent to Ministries, and agencies under the Government.

3. Chief Inspectors of provinces and centrally-administered cities are responsible for preparing nomination files for awarding and ensuring the accuracy of the files for:

a) Individuals specified in points d, e, and g of Clause 2, Article 4 of this Circular;

b) Individuals directly under their management, individuals working in inspection agencies, and individuals assigned to perform specialized inspection tasks in agencies tasked with specialized inspection functions in provinces and centrally-administered cities.

4. The Competition and Reward Council of the Inspection Sector is responsible for reviewing nomination files for awarding Commendation Plaques submitted by agencies, organizations, and units and preparing nomination files for awarding, ensuring the accuracy of the files for:

a) Party and State leaders; Central Committee of the Vietnam Fatherland Front and political-social organizations at the central level;

b) Leaders of the Government Inspectorate;

c) Other individuals not covered by Clauses 1, 2, and 3 of this Article.

Article 9. Documents and time for nominating to be awarded the Commendation Medal

1. The documents for nominating to be awarded include:

a) A proposal for nominating to be awarded the Commendation Medal;

b) A list of nominees for the Commendation Medal according to Model 01, Model 02, and Model 03 issued together with this Circular;

c) A statement of achievements and work history for nominating to be awarded the Commendation Medal according to Model 04 issued together with this Circular and applicable to the subjects specified in Clause 1, Article 4 of this Circular;

d) Copies of commendation decisions for cases that are prioritized for nomination.

2. The documents for nominating to be awarded the Commendation Medal shall be established in two sets, one set retained at the agency, organization, or unit submitting the nomination, and one set sent to the Council for Competition and Reward of the Inspection Sector (through the Department of Organization and Cadres of the Government Inspectorate) before September 10 each year.

Article 10. Procedure for awarding the Commendation Medal

1. The Department of Organization and Cadres of the Government Inspectorate is responsible for compiling the documents for nominating to be awarded the Commendation Medal and presenting them to the Council for Competition and Reward of the Inspection Sector before October 10 each year.

2. The Council for Competition and Reward of the Inspection Sector is responsible for compiling, reviewing, and examining the documents and presenting them to the Chief Inspector General for consideration and decision on awarding the Commendation Medal to individuals meeting the conditions and criteria stipulated in this Circular before November 10 each year.

3. For other cases, the Standing Committee of the Council for Competition and Reward of the Inspection Sector is responsible for receiving the documents and presenting them to the Chief Inspector General for consideration and decision.

Article 11. Organizing the Presentation of the Commendation Medal

1. The presentation ceremony will be organized on the occasion of the Anniversary Day of the Inspection Sector annually. The presentation must ensure solemnity, avoiding ostentation, formality, and waste.

2. The Department of Organization and Cadres of the Government Inspectorate is responsible for leading and coordinating with relevant agencies, organizations, and units to assist the Chief Inspector General in organizing the presentation for Party and State leaders; the Central Committee of the Vietnam Fatherland Front; political and social organizations at the central level; cadres, civil servants, public officials, and employees working at the Government Inspectorate; and individuals specified in Clause 3 and Clause 4, Article 4 of this Circular.

3. Provincial Inspectors, Inspectors of Ministries, agencies equivalent to ministries, and agencies under the Government, and Inspectors of Confidential Services are responsible for organizing the presentation for individuals specified in Clause 1 and point c, point e, Clause 2, Article 4 of this Circular.

4. Inspectors of provinces and centrally-administered cities are responsible for organizing the presentation for individuals specified in Clause 1 and point d, point d, point g, Clause 2, Article 4 of this Circular.

5. Other cases decided by the Government Inspector General.

Article 12. Rights and Responsibilities of Organizations and Individuals in the Process of Awarding the Commendation Medal

1. Individuals who are awarded the Commendation Medal shall receive the Certificate, frame, Commendation Medal, and storage box along with a monetary reward not exceeding 0.6 times the basic salary. In cases where salary reform policies are implemented, they shall be carried out according to the regulations of the Government.

2. Individuals who are awarded the Commendation Medal have the responsibility to maintain and serve as role models in implementing the Party's guidelines and the State's policies and laws; continue to promote the traditions of the Vietnamese Inspection Sector.

3. Organizations and individuals nominating to be awarded the Commendation Medal are responsible for the accuracy and honesty of the nomination documents.

Chapter IV

IMPLEMENTATION

Article 13. Effective Date

This Circular takes effect from May 15, 2024.

Circular No. 01/2017/TT-TTCP dated April 10, 2017 of the Government Inspectorate on awarding the Commendation Medal "For the Cause of Inspection" ceases to be effective when this Circular takes effect.

Article 14. Implementation Organization

1. The Competition and Reward Council of the Inspection Sector is responsible for guiding, urging, and inspecting the implementation of this Circular.

2. Heads of departments, bureaus, and units under the Government Inspectorate; Chiefs of Inspectors of Ministries, agencies equivalent to ministries, and agencies under the Government, and agencies of Confidential Services; Chiefs of Inspectors of provinces and centrally-administered cities and related agencies, organizations, units, and individuals are responsible for implementing this Circular.

3. During the implementation process, if there are difficulties or obstacles, heads of agencies, organizations, and units shall promptly report in writing to the Council for Competition and Reward of the Inspection Sector to report to the Chief Inspector General for consideration and amendment to suit the situation./.
