RESOLUTION

On applying special mechanisms in mineral exploitation

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to the Law on Legislative Regulatory Documents issued on February 19, 2025;

Pursuant to the Law on Minerals dated November 17, 2010;

Pursuant to Decree No. 146/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation in the field of industry and trade;

Pursuant to Decree No. 39/2022/NĐ-CP dated June 18, 2022 of the Government promulgating the Operational Regulations of the Government;

Pursuant to Decree No. 158/2016/NĐ-CP dated November 29, 2016 of the Government detailing the implementation of certain articles of the Law on Minerals;

Pursuant to Decree No. 10/2025/NĐ-CP dated January 11, 2025 of the Government amending and supplementing some articles of decrees in the field of minerals;

Based on the proposal of the Minister of Agriculture and Rural Development at Report No. 20/TTr-BNNMT dated April 3, 2025; Report No. 35/TTr-BNNMT dated May 9, 2025;

The Government issues this Resolution on applying special mechanisms in mineral exploitation.

Article 1. Content of special mechanisms in mineral exploitation

1. Mineral deposits for common construction materials that have been granted mining permits and still have remaining exploitation periods, serving as sources of common construction materials for the Long Thanh International Airport Project (hereinafter referred to as the Project), shall continue to apply special mechanisms under Resolution No. 60/NQ-CP dated June 16, 2021 of the Government on the application of special mechanisms in granting mining permits for common construction materials for the Project of constructing certain sections of expressways on the North-South Trunk Road, phase 2017-2020 (already commenced and about to commence), amended and supplemented by Resolution No. 133/NQ-CP dated October 19, 2021 of the Government.

2. For limestone deposits for common construction materials in Dong Nai Province that comply with land use planning for mineral activities, which have completed agreements on land transfer rights (land compensation and clearance) with households owning land but have not yet completed procedures for leasing land for mining purposes, they may continue operations to supply construction materials for national key projects and key transportation sector projects. The volume of stone extracted during the period before completing the land lease procedures shall only be supplied to national key projects and key transportation sector projects.

In cases where mineral exploitation projects are suspended according to the inspection conclusions of competent authorities, such cases shall be handled in accordance with the opinions of the authorities issuing the inspection conclusions.

Article 2. Implementation clause

1. This Resolution takes effect from the date of issuance.

2. The People's Committee of Dong Nai Province shall be responsible for:

a) Directing the increase of maximum capacity by 50% of the capacity stated in the mining permit, with the entire production volume being supplied to the Project as stipulated in Article 1 of this Resolution.

b) Directing contractors, organizations, and individuals holding mining permits to take measures to ensure safety and environmental protection during mining and capacity increase. The capacity increase process shall end after sufficient materials have been supplied to the Project.

c) Requiring organizations and individuals exploiting minerals as specified in Clause 2 of Article 1 to complete land lease procedures as soon as possible.

3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and the Chairman of the People's Committee of Dong Nai Province shall be responsible for implementing this Resolution.
