for use positions for legal affairs work in agencies,

administrative organizations, and public service units

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units;

Pursuant to Decree No. 55/2011/NĐ-CP dated July 4, 2011 of the Government stipulating functions, tasks, powers, organizational structure of legal affairs organizations; and Decree No. 56/2024/NĐ-CP dated May 18, 2024 of the Government amending and supplementing certain articles of Decree No. 55/2011/NĐ-CP; of Director of the Department of Legal Document Inspection and Administrative Violation Management;

Decree No. 39/2025/Decree-CP dated February 26 the 02 day5 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of The Minister of Justice issues this Circular guiding

positions for legal affairs work in agencies, administrative organizations, and public service units. This Circular guides on the list of positions, job descriptions, and level frameworks determining requirements for qualifications for legal affairs positions in agencies, administrative organizations, and public service units.

Article 1. Scope of Regulation

a) Senior Legal Officer, Principal Legal Officer, Legal Officer, and Legal Specialist at ministries, ministerial-level agencies, government agencies, specialized agencies under provincial People's Committees (hereinafter referred to collectively as provincial level); Principal Legal Specialist, Legal Specialist at public service units;

Article 2. Applicability

1. This Circular applies to:

b) Ministries, ministerial-level agencies, government agencies, provincial People's Committees, specialized agencies under provincial People's Committees, public service units, and related agencies, organizations, and individuals.

2. The list of positions, job descriptions, and level frameworks determining requirements for qualifications for legal affairs positions in the People's Army and the People's Public Security shall be implemented in accordance with the regulations of the Minister of National Defense, the Minister of Public Security, and relevant laws.

Article 3. Principles and bases for determining positions for legal affairs work

1. Principles and bases for determining positions for legal affairs work in agencies and administrative organizations are determined based on the principles stipulated in Article 3, Clause 1 of Article 4 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.

2. Principles and bases for determining positions for legal affairs work in public service units are determined based on the principles stipulated in Article 3, Clause 1 of Article 4 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on positions and number of staff in public service units.

Article 4. List of positions, job descriptions, and level frameworks determining requirements for qualifications for legal affairs positions

1. The list of positions for legal affairs work shall be implemented in accordance with the provisions of Appendix II and Appendix IV issued together with Circular No. 06/2024/TT-BNV dated June 28, 2024 of the Minister of Home Affairs amending and supplementing certain articles of Circular No. 12/2022/TT-BNV dated December 30, 2022 of the Minister of Home Affairs guiding positions for leading and managerial civil servants; common professional duties; support and service positions in agencies and administrative organizations; and common professional positions; support and service positions in public service units.

2. Job descriptions and level frameworks determining requirements for qualifications for legal affairs positions in agencies and administrative organizations are specified in Appendix I and Appendix II issued together with this Circular.

3. Job descriptions and level frameworks determining requirements for qualifications for legal affairs positions in public service units are specified in Appendix III and Appendix IV issued together with this Circular.

3. The job description and the competency level framework determining the capability requirements for the legal affairs position in public service units as prescribed in Appendix III and Appendix IV attached hereto.

Article 5. Procedures for approving job positions; documents submitted, contents, and time limits for reviewing the job position proposal; adjustment of job positions

1. The procedures for approving job positions; documents submitted, contents, and time limits for reviewing the job position proposal of administrative agencies and organizations shall be implemented in accordance with Articles 7 and 8 of Decree No. 62/2020/NĐ-CP.

2. The procedures for approving job positions; documents submitted, contents, and time limits for reviewing the job position proposal of public service units shall be implemented in accordance with Articles 6 and 7 of Decree No. 106/2020/NĐ-CP.

3. Adjustments to job positions shall be carried out in accordance with Article 9 of Decree No. 62/2020/NĐ-CP and Article 8 of Decree No. 106/2020/NĐ-CP.

4. Based on this Circular, administrative agencies and public service units mentioned in Clause 1 of Article 2 shall establish or adjust their own job position proposals and submit them to the agency or organization responsible for organizational and cadre management at the ministry, sector, or locality for review and submission to the competent authority for approval in accordance with the law.

Article 6. Effectiveness and Implementation

1. This Circular takes effect from May 15, 2025.

2. The Minister, Heads of ministries equivalent to ministerial level, Heads of government agencies, Chairpersons of provincial People's Committees, heads of public service units, and related agencies, organizations, and individuals are responsible for implementing the provisions of this Circular.

3. In case of difficulties during implementation, they should report to the Ministry of Justice for guidance and resolution.
