Pursuant to the Law on Construction dated June 18, 2014; the Law Amending and Supplementing Certain Provisions of the Law on Construction dated June 17, 2020;

Pursuant to the Law on Architecture dated June 13, 2019;

Pursuant to the Government Decree No. 06/2021/NĐ-CP dated January 26, 2021 detailing certain provisions on quality management, construction works, and maintenance of construction projects;

Decree No. 175/2024/NĐ-CP December 30, 2024, of the Government detailing certain provisions and measures for the implementation of the Construction Law concerning construction activity management;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the National Construction Quality Supervision Agency;

The Minister of Construction issues this Circular amending and supplementing some articles of Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction on classification of construction projects and guidance for application in management of investment construction activities.

Article 1. Amending and supplementing some articles of Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction on classification of construction projects and guidance for application in management of investment construction activities

1. Amending and supplementing Clause 1 of Article 1 as follows:

"1. Scope of Regulation This Circular provides detailed provisions on the classification of construction projects and guidance for applying project classification in managing investment construction activities as prescribed by the Construction Law; specifically, at Clause 4, Article 5 of the Construction Law 2014 amended and supplemented by Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Construction Law 2020 and Clause 2, Article 3 of Decree No. 06/2021/NĐ-CP."

2. Adding Clauses 5, 6, 7 following Clause 4, Article 2 as follows:

"5. The classification level of independent structure construction projects newly invested in and not part of phased investment projects of existing construction projects shall be determined according to the provisions of Clauses 1, 2, and 3 of this Article.

6. In cases where the project belongs to a phased investment project, the criteria specified in Clause 1 of this Article corresponding to the completion stage shall be used to determine the project classification level.

7. The determination of the classification level of certain types of projects is guided in Appendix III attached to this Circular."

3. Adding Clauses 4, 5 following Clause 3, Article 3 as follows:

"4. In cases of phased investment projects, the project classification level specified in Clause 6, Article 2 of this Circular shall be applied in managing investment construction activities as prescribed in Clauses 1, 2, and 3 of this Article.

5. The application of the classification level of certain types of projects is guided in Appendix III attached to this Circular."

4. Amending and supplementing some contents of Appendices I, II, III in the Appendices attached to this Circular.

Article 2. Implementation clause

1. This Circular takes effect from May 20, 2025.

2. The classification level of projects under investment construction projects decided on before the date this Circular takes effect shall be determined according to the legal provisions at the time of decision on investment.

3. In cases where projects or construction projects have been submitted to specialized construction management agencies for review or adjustment of feasibility study reports for investment construction, design documents implemented after basic design before the date this Circular takes effect and meet the conditions for review, the determination of the classification level and application of the classification level in managing investment construction activities shall be determined according to the legal provisions at the time of submission for review.

4. In cases where there is a change in the construction design from the date this Circular takes effect:

a) If the change in the construction design does not alter the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the legal provisions at the time of investment decision;

b) If the change in the construction design alters the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the provisions of Circular No. 06/2021/TT-BXD amended and supplemented by this Circular./.
